Subjects 1: Staff Report for Annexation of TMS#s 145-03-01-005, -006, and 009, three tracts
totaling 3.2 acres

ISSUE
The property owner, Rolina Investments, LLC, is requesting for the above referenced tracts to be
annexed into the Town from Dorchester County. The existing zoning in Dorchester County is R-
1(M)(A), R-1, and TRM, respectively.
BACKGROUND/DISCUSSION
This property is included in the Town’s ‘Single-Family Detached’ area as identified within the
Summerville: Our Town, Our Future Comprehensive Plan as well as on the accompanying Future
Land Use Map. This property is also included as a priority annexation area in the Community
Facilities & Infrastructure Element of the Comprehensive Plan, which includes the recommendation of
prioritizing areas directly adjacent to the municipal boundary to prevent the overextension of
infrastructure and reduce costs. The adjacent properties in the County are all zoned either R-1
(Single-Family Residential, minimum lot size 14,500 sf) or TRM (Transitional Residential District,
minimum lot size 1 acre), although the properties across Gahagan Road in the County are zoned R-2
(Single-Family Residential, minimum lot size 7,500 sf), and across Garbon Road in the Town are
zoned PUD and most of the lots are about 8,000 sf. The owner is proposing to develop the properties
into nine (9) single-family detached lots and must request annexation as these properties are located in
the Summerville CPW sewer service area. Details on the proposed development will be resolved in
the development review process. No public comment was received at the required public hearing.
RECOMMENDATION
Based on these findings, the requested annexation and zoning of GR-5, General Residential (5
units/acre) is interpreted by staff to be in conformance with the Town’s Comprehensive Plan and is
recommended for approval. Planning Commission made a recommendation for approval of the
annexation and proposed zoning of GR-5 on a 4-0 vote.

Subject 2: Staff Report for Rezoning of TMS# 130-10-00-033, 823 W. 5th North St., one parcel
totaling 1.69 acres

ISSUE
The property owner, Dorchester County, is requesting for the above referenced parcel to be rezoned
from UC-MX, Urban Corridor Mixed-Use, to PL, Public Lands.
BACKGROUND/DISCUSSION
This property is included in the Town’s ‘Neighborhood Mixed-Use’ area as identified within the
Summerville: Our Town, Our Future Comprehensive Plan as well as on the accompanying Future Land
Use Map. Dorchester County purchased the property in 2017, as this property is adjacent to the EMS
station at 821 W. 5th North Street, which is already zoned PL, Public Lands. Dorchester County plans
to build a new Coroner’s Office on this site with the potential for an additional county building in the
future. No public comment was received at the required public hearing.
RECOMMENDATION
Based on these findings the requested PL, Public Lands, zoning district is recommended for approval.
Planning Commission made a recommendation for approval of the rezoning on a 4-0 vote.
Subject 3: Staff Report for Rezoning of TMS# 130-10-00-051, 603 N. Maple St., one parcel
totaling 0.77 acres

ISSUE
The property owner is requesting for the above referenced parcel to be rezoned from N-R, Neighborhood
Residential, to N-B, Neighborhood Business.
BACKGROUNG/DISCUSSION
This property is included in the Town’s ‘Neighborhood Mixed-Use’ area as identified within the
Summerville: Our Town, Our Future Comprehensive Plan as well as on the accompanying Future Land
Use Map, which “is intended to encourage the integration of commercial and a variety of residential
land uses within easy walking distance of each other. Commercial uses should include residentially
scaled businesses, such as sales of consumer goods, health and personal care, professional services,
offices, restaurants, and religious institutions.” The Economic Development element of the Comp Plan
also identifies this area as a “Downtown Transition Commercial Area” with commercial businesses and
mixed-uses where “pedestrian mobility is still a priority.” The property owner stated that they wanted
to sell the property as commercial, not residential. The properties between this property and
Wassamassaw Road are already zoned N-B. The properties to the west (rear) and north (side) are zoned
for residential use, so a 30-foot vegetated buffer will be required along those property lines if this
property is redeveloped as a commercial use. No public comment was received at the required public
hearing.
RECOMMENDATION
Based on this information, the proposed rezoning to N-B is determined to be in conformance with the
Town’s Comprehensive Plan and is recommended for approval. Planning Commission made a
recommendation for approval of the rezoning on a 4-0 vote.

Subject 4: Staff Report for Amendments to Chapter 10 – Signs, Section 10.5 – Changeable Copy
Signs

ISSUE
The requested amendments are proposed by the applicant, Tiffany Johnson of Johnson & Wilson Real
Estate, to change the ordinance to allow digital signs to be used as window signs approved at staff
level.
BACKGROUND/DISCUSSION
The applicant’s business at 100 W. Richardson Ave., Suite D, would like to be able to utilize a digital
sign to advertise. While staff does realize that the sign ordinance needs to be amended to provide
clarification on the intent of certain sections, staff does not support allowing digital signs,
freestanding, wall, or window, to be approved at staff level for commercial businesses. Staff does
have proposed amendments to Chapter 10 for consideration (see Subject 6). No public comment was
received at the required public hearing, and the applicant did not attend the meeting.
RECOMMENDATION
Staff does not recommend approval of these changes as proposed but has suggested changes that are
proposed in a separate ordinance. Planning Commission sent the item to Council with no
recommendation.
Subject 5: Staff Report for Proposed amendments to the Summerville Unified Development
Ordinance (UDO) Chapter 7 – Parking and Driveways, Section 7.3 – Vehicle Parking Location

ISSUE
These amendments are proposed by staff to correct a discrepancy in the parking locations noted
in this Chapter versus what is shown in the District Standards in Chapter 2 for the N-MX zoning
district, and to clarify that parking on the side for corner lots cannot be closer to either street than
the building.
RECOMMENDATION
Planning Commission did not receive any public comment at the required public hearing and
recommended approval of the changes on a 4-0 vote. Staff also recommends approval.

Subject 6: Staff Report for Proposed amendments to the Summerville Unified Development

ISSUE
These amendments are proposed by staff to provide clarification and remove some confusing
and/or outdated language.
RECOMMENDATION
Planning Commission did not receive any public comment at the required public hearing but
recommended denial of the changes on a 4-0 vote. Denial was recommended because the
Commission felt that the standards in Section 10.5 needed to be clearer and should not require
DRB/BAR approval if met. The Commission had no concerns with the other Sections of Chapter
10. Staff disagrees with the Commission’s assessment. The proposed changes to Section 10.5
add clarification and remove confusion. The proposed amendments to that section do not change
the current approval process for changeable copy signs, which Council previously approved, only
provide clearer language. Staff recommends approval of all proposed changes to Chapter 10.
Subject 7: Staff Report for Proposed amendments to the Summerville Unified Development
Ordinance (UDO) Chapter 13 – Administration & Procedures, Section 13.3.3 – Board of Zoning
Appeals and Section 13.4.2 – Public Notice Requirements

ISSUE
These amendments are proposed by staff to provide an appointment to BZA for each
Councilmember and to help with efficiency and costs. The BZA is one of the few Boards that
only has five (5) members. This change would increase the membership to seven (7), which
would then allow each Councilmember to have an appointment. The BAR is the only Board that
requires a public notification be mailed to adjacent property owners. The current language
requires a notice be mailed to all property owners within 500 feet, which in some areas of the
Historic District can require over 50 notices for a single project, and for larger agendas, end up
requiring staff to print and mail 100s of notices. Each month, a number of the notices are
returned by the USPS as well, and staff has had property owners in the Historic District complain
about the number of notices they receive. Changing the language to only includes properties that
are actually adjacent would still reach the property owners that would be most affected by
changes, and greatly reduce the amount of staff time and expenses paid to send out mailings to
those within 500 feet from a property.
RECOMMENDATION
Planning Commission did not receive any public comment at the required public hearing and
recommended approval of the changes on a 4-0 vote. Staff also recommends approval.

These amendments are proposed by staff to move the definition for Dwelling, Single Family,
which was accidentally included in the Signs, Window definition; change the definition of Signs,
Changeable Copy to differentiate between manual and electronic; add a definition for Signs,
Digital; and change the definition of Signs, Window to clarify what is considered a window sign.
RECOMMENDATION
Planning Commission did not receive any public comment at the required public hearing and
recommended approval of the changes on a 4-0 vote. Staff also recommends approval.

WHEREAS, the owner of the real estate designated as Dorchester County TMS #s 145-03-01-005, 145-03-
01-006, and 145-03-01-009, located at 207 and 209 Garbon Drive and totaling approximately 3.2 acres,
has petitioned the Town Council of the Town of Summerville to annex into the Town of Summerville.
NOW, THEREFORE BE IT ORDAINED by the Mayor and Members of Town Council duly assembled;
SECTION I. That the described land on the attached deeds and recorded plats, contiguous to the boundary
of the Town of Summerville is hereby annexed to, taken into and made a part of the Town of Summerville
and including the public roadway(s) immediately adjacent to the property lines of the parcel for the purposes
of providing public service to the parcel.
SECTION II. That the properties above described and hereby annexed shall be Zoned GR-5 “General
Residential” and be classified as “GR-5 General Residential” under the Zoning Ordinance of the Town of
Summerville.

10.5 CHANGEABLE COPY/DIGITAL SIGNS Agenda Items 2d and 2f
10.5.1 DEFINITIONS
Changeable Copy Sign is defined as a sign or portion of a sign with characters, letters, or
illustrations that can be changed or rearranged without altering the face or the surface of the sign.
A sign on which the message changes more than once per day shall be considered a digital sign
and not a changeable copy sign for purposes of this chapter.
Digital Sign is defined as any sign that is remotely changed on or off site and has a message
duration time established. Digital Sign copy is altered by electric or electronic means.
10.5.2 APPLICABILTY
Changeable copy signs are allowed only at indoor entertainment, gas/fueling stations, churches,
schools, theaters, civic uses and parks.
10.5.3 APPROVAL REQUIRED
Changeable copy and Digital signs with changeable letters or images are not allowed by-right as
freestanding or wall signs. Such signs may be allowed for the following uses and must be
approved by Town Staff unless otherwise noted:
A. Educational establishments: kindergarten, elementary, junior, senior or degree educational
programs
B. Churches or spiritual institutions
C. Window signage
D. Commercial establishments:
1. Fuel Sales: For fuel sales establishments the changeable copy shall not be more than 40% of
the sign face area.
2. Other establishments: For other establishments, the changeable copy shall not be more than
25% of the maximum freestanding signage area subject to approval by the DRB. Churches,
schools and theaters are exempt from this requirement.
10.5.4 WALL/FREESTANDING STANDARDS
A. Sign Area: Changeable copy signs count as part of the computation for freestanding or
marquee signs only and shall not exceed 50% of the total allocated sign area.
B. Digital Signs: Digital signs with changeable copy shall be subject to the same size and
placement limitations as non-digital signage subject to approval by the DRB.
C. Single Color: Changeable copy shall be expressed in one color only.
D. Time for Message Rotation: Signs containing automatic changeable copy messages must
remain fixed, static, motionless, and non-flashing for a period of at least eight (8) seconds.
10.5.5 Window Sign Standards
A. Sign Area: Changeable copy/digital signs shall not exceed 5% of the total window area.
B. Digital Signs: Digital signs with changeable copy shall be subject to the same size and
placement limitations as non-digital window signage.
C. Multi Color: Changeable copy signs shall be expressed in three colors only.
D. Time for Message Rotation: Signs containing automatic changeable copy messages must
remain fixed, static, motionless, and non-flashing for a period of at least ten (10) seconds.
E. There shall be no video feed or flashing lights.

10.2.1 APPLICABILITY

replacement, maintenance, use, type, quantity, location, material, and size of all exterior signs
(including window signs, see definition in Chapter 15) within the planning jurisdiction of the
Town of Summerville. No sign shall be erected, altered or maintained unless it is in compliance
with the regulations of this section.
Section 10.4.3.B & E – Wall Signs & Window Signs

Section 10.5 –Changeable Copy Signs
10.5.1 APPLICABILITY
Changeable copy signs are allowed only at indoor entertainment, gas/fueling stations, churches,
schools, theaters, civic uses and parks.
10.5.2 APPROVAL REQUIRED 10.5.1 STAFF APPROVAL REQUIRED
Reader Boards Changeable copy, digital, or other signs with changeable letters or images (manual
or digital) are not allowed by-right as freestanding, window, or wall signs. Such signs may be
allowed for the following uses and must be approved by Town Staff and meet the standards
detailed in 10.5.2 unless otherwise noted below:
A. Educational establishments: kindergarten, elementary, junior, senior or degree educational
programs
B. Churches or spiritual institutions
C. Commercial establishments:
1. Fuel Sales: For fuel sales establishments the changeable copy or digital sign shall not
be more than 40% of the sign face area and shall only display the price per gallon.
2. Other establishments: For other establishments, the changeable copy shall not be more
than 25% of the maximum freestanding signage area subject to approval by the DRB.
Churches, schools and theaters are exempt from this requirement.
10.5.3 STANDARDS 10.5.2 DRB/BAR APPROVAL REQUIRED
For those uses not detailed above, changeable copy, digital, or other signs with changeable letters
or images (manual or digital) are only allowed with DRB or BAR approval and must meet the
applicable standards detailed below:
A. Freestanding and wall sign standards
A.1. Sign Area: Changeable copy and digital signs count as part of the computation for
freestanding and wall or marquee signs only and shall not exceed 50% of the total allocated
sign area for the specific type of sign.
B. Digital Signs: Digital signs with changeable copy shall be subject to the same size and
placement limitations as non-digital signage subject to approval by the DRB.
C. 2. Single Color: Changeable copy and digital signs shall be expressed in one color only.
Digital images may be exempt from this requirement if approved by the DRB or BAR.
D. 3. Time for Message Rotation: Signs containing automatic changeable copy messages
must remain fixed, static, motionless, and non-flashing for a period of at least eight (8)
seconds.
4. There shall be no video feed or flashing lights.
B. Window sign standards
1. Sign area: Changeable copy and digital signs, mounted or displayed on the inside or
outside face of the window, count as part of the computation for total allowable window
signage. Digital signs are considered illuminated and shall meet all requirements of
Section 10.4.3.E.
2. Single Color: Changeable copy shall be expressed in one color only. Digital images
may be exempt from this requirement if approved by the DRB or BAR.
3. Time for Message Rotation: Signs containing automatic changeable copy messages
must remain fixed, static, motionless, and non-flashing for a period of at least eight (8)
seconds.
4. There shall be no video feed or flashing lights.
Section 10.8.1 – Incidental Signs
10.8.1 INCIDENTAL SIGNS
A. Building Addressing: Building addressing and other signs required for the provision of
emergency services and the delivery of mail/packages.
B. Multi-Tenant Building Sign: On multi-tenant building an additional sign is permitted that may
be up to 4 square feet in area.
C. Wall or Directional/Informational Signs (e.g., tenant identification, open/closed signs,
directional signs):
1. Residential Structure: All signs under 1 square feet in area
2. All Other Structures: All signs under 4 square feet in area are permitted and do not
require a sign permit.
D. Decorations: Temporary holiday decorations.
Section 10.9.E – Moving, Flashing, or Audible Signs
E. Moving, Flashing or Audible Signs: Signs that can potentially distract drivers with the following
features are prohibited:
1. Signs which display intermittent or flashing lights or moving parts are not permitted, except
barber’s poles, time/temperature signs and temporary signs erected by a public agency.
2. Portable or mobile signs utilizing any type of illumination or electrical connections except
temporary signs erected by a public agency.
3. Devices consisting of banners, streamers, pennants, feather/flutter flags, wind-blown
propellers, balloons, inflatable devices, strung light bulbs and similar installations, unless
approved by Town Staff for temporary events only.
4. Permanent moving signs or devices designed to attract attention with any of the following
features:
a. All or part of which move by any means regardless of whether they contain written
messages.
b. Set in motion by movement of the atmosphere or by mechanical, electrical or other
means, including but not limited to: pennants, posters, propellers, discs, ribbons,
streamers, forced air tubes, strings of light bulbs and spinners
c. Flashing signs or devices displaying flashing or intermittent lights or lights of changing
degrees of intensity, except for signs displaying time and temperature and temporary
signs erected by a public agency.
d. Signs which emit audible sound, odor or visible matter.
5. Signs placed on vehicles or trailers which are parked or located for the primary purpose of
displaying such sign. (This does not apply to lettering on trucks, automobiles, buses, taxis or
service vehicles operating during the normal course of business.)

Terms, is amended to change the definitions of Single Family Dwelling; Sign, Changeable Copy; Sign,
Window; and add the definition of Sign, Digital, as follows:
15.3 DEFINITION OF TERMS
Dwelling, Single Family: Single Family Dwelling: A free standing building designed for and/or occupied
by one household. These residences may be individually owned as residences or residences owned by
rental or management companies. Also includes factory-built, modular housing units that comply with SC
State Building Code.
Sign, Changeable Copy: A sign on which message copy is changed manually in the field, through the
utilization of attachable letters, numbers, symbols and other similar characters or changeable pictorial
panels. or portion of a sign with characters, letters, or illustrations that can be changed or rearranged
without altering the face or surface of the sign. A sign on which the message is altered by electric or
electronic means shall be considered a digital sign and not a changeable copy sign.
Sign, Digital: A sign or portion of a sign that is remotely changed on or off site and has a message
duration time established. Digital sign copy is altered by electric or electronic means. Digital signs may
include but are not limited to television screens, holographic displays, programmable ink, LCD, LED, or
plasma displays.
Sign, Window: Any sign which is painted on, applied to, attached to or projected upon or within the
exterior or interior of a building glass area, including doors, or located within 15 feet of the identification,
message, symbol, insignia, visual representation, logotype, or any other form which communicates
information, displayed within two feet of a window or door and can be read from off-premises contiguous
property or public right-of-way.
