COUNCIL MEETING MINUTES
April 13, 2017
ATTENDANCE
Present: Mayor Wiley Johnson, Mayor Pro-Tem Bob Jackson and Council members Walter
Bailey, Aaron Brown, Christine Czarnik, and Bill McIntosh. Kima Garten-Schmidt was absent.
Town Administrator Colin Martin, Interim Clerk/Treasurer and Finance Director, Belinda Harper
and Town Attorney G.W. Parker were also present. Members of the press and the public were
duly notified of the meeting and were also present.
CALL TO ORDER
The regular monthly meeting of Summerville Town Council was called to order at 6:00 p.m. on
Thursday, April 13, 2017. The meeting was opened with prayer by Rabbi Michael Davies
followed by the Pledge of Allegiance lead by Mayor Johnson.
PRESENTATION
Ms. Rebecca Engel read the Holocaust Commemoration Proclamation.
PUBLIC COMMENTS
Mayor Johnson called for any comments from the public. Mr. Patrick Ladney, founder of the
Summerville North Area Jewish Community, read a statement concerning the Holocaust
remembrance with a theme of “Never Again.” Mr. Louis Smith read a statement concerning
unity of community and solidarity. Mr. Peter Gorman, S. Magnolia, expressed concerns about
the use of CDBG funding. There being no further comments from the public, the Mayor
declared that portion of the meeting closed.
APPROVAL OF MINUTES OF PREVIOUS MEETINGS
Mr. McIntosh made a motion, seconded by Mr. Brown, to approve the minutes of the March 9,
2017 council meeting with one correction. The motion carried unanimously.
APPROVAL OF COUNCIL COMMITTEE REPORTS
Mr. Jackson made a motion, seconded by Mr. Brown, to approve the minutes of the April 10,
2017 Parks and Recreation Committee report. The motion carried unanimously.
Ms. Czarnik made a motion, seconded by Mr. Bailey, to approve the minutes of the April 10,
2017 Planning Committee report. The motion carried unanimously.

Mr. Brown made a motion, seconded by Mr. McIntosh, to approve the minutes of the April 10,
2017 Public Safety Committee report. The motion carried unanimously.
Mr. McIntosh made a motion, seconded by Mr. Bailey, to approve the minutes of the April 10,
2017 Public Works Committee report. The motion carried unanimously.
Mr. Jackson made a motion, seconded by Mr. Brown, to approve the minutes of the April 10,
2017 Finance Committee report. The motion carried unanimously.
PETITIONS
Mr. McIntosh made a motion, seconded by Ms. Czarnik, to accept the petition on first reading of
an ordinance to annex Dorchester County TMS#’s 144-04-06-001, 144-04-06-002 and 144-04-
06-003 (approximately 0.75 acres) located at the northwest corner of Mary Street and Boone Hill
Rd., owned by David O’Sullivan and Benjamin Bullock currently zoned R-2, Single-Family
Residential in Dorchester County and will be zoned R-2, Single Family Residential upon
annexation into the Town of Summerville’s municipal limits. The motion carried unanimously.
PENDING BILLS AND RESOLUTIONS
Mr. Jackson made a motion, seconded by Mr. Brown, to approve on second and final reading an
ordinance to annex Dorchester County TMS# 136-11-07-025, located at 218 White Boulevard,
owned by Richard and Lea Shoup, described as 1 lot (.4 acres), shall be zoned R2 “Single Family
Residential” and be classified as R2 “Single Family Residential” under the Zoning Ordinance of
the Town of Summerville. The motion carried unanimously.
Mr. Brown made a motion, seconded by Mr. Jackson, to approve on second and final reading an
ordinance to amend the Zoning Map of the Town of Summerville, Dorchester County TMS #
136-11-07-031, approximately .34 acres owned by Richard and Lea Shoup located at the rear of
218 White Blvd., be rezoned to the classification of R2, “Single Family Residential” from the
classification of PUD “Planned Unit Development”. The motion carried unanimously.
Mr. Brown made a motion, seconded by Mr. Jackson, to approve on second and final reading an
ordinance to amend the Zoning Map of the Town of Summerville, Dorchester County TMS #
130-15-03-009, approximately 1.07 acres owned by Mike Taylor, DB Properties, located at 603
W. 5th N. Street, be rezoned to the classification of B2, “Neighborhood Business Centers” from
the classification of R2 “Single Family Residential”. The motion carried unanimously.
INTRODUCTION OF BILLS AND RESOLUTIONS
Mr. Jackson made a motion, seconded by Mr. Bailey, to approve on first reading an ordinance to
rezone TMS#153-00-00-023, 1400 Old Trolley Rd., approximately 12.27 acres, and owned by
Fellowship of Oakbrook Church from R-2, Single Family Residential to B-2, Neighborhood
Business. The motion carried unanimously.
Mr. Jackson made a motion, seconded by Mr. McIntosh to approve a Resolution to split
Clerk/Treasurer position to Clerk to Council and Treasurer. The motion carried unanimously.

MISCELLANEOUS
Mayor Johnson gave an update on the annexation bill and the business license bill in the
legislature.
MAYOR’S REMARKS
Mayor Johnson said that he didn’t have any remarks.
EXECUTIVE SESSION
Mr. McIntosh made a motion, seconded by Mr. Brown, to enter into executive session at 6:32
p.m. concerning legal matters regarding motions to intervene by plaintiffs in Croft et. al. vs.
Town of Summerville into the Applegate & Co. demand for arbitration and Applegate & Co.
lawsuit filed in Court of Common Pleas, to discuss the Towing Ordinance, contractual matter
concerning the lease agreement with the Senior Citizens Center, and personnel matters
concerning the appointments of Planning Director and Clerk to council. The motion passed
unanimously. The meeting initially included GW Parker, Town Attorney, Belinda Harper, Clerk,
Colin Martin, Town Administrator, and Madelyn Robinson, Director of Administration and
Economic Development. These 4 additional personnel left the meeting at 7:50 p.m. Council
continued discussion of town employee personnel issues. .
Council returned to regular session at 8:18 p.m. and announced that no action was taken in
executive session.
Mr. Bailey made a motion, seconded by Mr. Jackson, to appoint Ms. Jessi Shuler to the position
of Planning Director. The motion carried unanimously.
ADJOURN
There being no further business, the meeting adjourned at 8:20 p.m. on motion of Mr. Jackson,
seconded by Mr. McIntosh.
