Parker William McIntosh Town of Summerville SPECIAL CALLED COUNCIL MEETING MINUTES September 11, 2019 ATTENDANCE Present: Councilmembers Christine Czarnik, Aaron Brown, Kima Garten-Schmidt, Walter Bailey, Bob Jackson and Bill McIntosh. Mayor Johnson was absent. A quorum was present. Staff was also present. Public and press were duly notified. CALL TO ORDER Mayor Pro-Tem Bob Jackson called the Special Council Meeting to order at 2:07pm on Wednesday, September 11, 2019. TREE PROTECTION ORDINANCE Councilman McIntosh presented the resolution to rescind the Executive Order of September 6, 2019 and to implement emergency conditions subsection of the Summerville Tree Protection Ordinance, Code SEC 32-324 (o). Some discussion followed regarding the intent of the subsection of the Tree Protection Ordinance and how the ordinance is worded. More discussion followed regarding the legality of the Mayor’s issuance of an Executive Order as well as the legality of rescinding the order. Town Attorney GW Parker stated that in drafting the Executive Order of September 6, 2019, he should have worded it differently. Mr. Parker further stated that he agrees with the rescinding of the Executive Order. Mr. Bailey made a motion, seconded by Mr. McIntosh to rescind the Executive Order of September 6, 2019 in regards to the Tree Protection Ordinance. The motion carried unanimously. September 11, 2019 Page 2 Mr. Bailey made a motion, seconded by Ms. Garten-Schmidt, to pass the resolution to implement the Emergency Conditions subsection of the Summerville Tree Protection Ordinance, Code Sec. 32-324 (o). The motion carried unanimously. ADJOURN Ms. Garten-Schmidt made a motion, seconded by Mr. Bailey, to adjourn. The motion carried unanimously, and the meeting adjourned at 2:19pm.
