Town Council Agenda – April 8, 2021 9. Introduction of Bills and Resolutions a. First reading of an ordinance to amend Chapter 8 – Businesses, Section 8-33 – Purpose and duration to change the calendar end date from May 31 to April 30. b. First reading of an ordinance to amend Chapter 8 – Businesses, Appendix A, 8.7 NAICS 524127-Insurance Companies for Article I, Article II, and Article III so that license taxes for insurance companies shall now be due and payable on or before April 30 in each year. c. First reading of an ordinance to amend Chapter 16 – Offenses and Miscellaneous Provisions, Article I – In General, by adding a new Section 16-18 – Home Detention, to provide for a home detention program as an alternative to incarceration in certain cases in the Town of Summerville. 10. Miscellaneous a. Consideration of pay increase for civilian personnel in Summerville Police Department b. Consideration of contract with Charleston County for single-stream recycling c. Authorization to issue a purchase order in the amount of $124,206 to Southeast Pipe for supplies to repair three pipes in Corey Woods. Pricing is from a standing contract setup by Dorchester County. Request from Stormwater Department. Funds to come from budgeted Stormwater Control Projects Capital. d. Authorization for the Summerville Police Department to accept grant from Firehouse Subs Public Safety Foundation grant for the requested 16 Zoll AED Plus AEDs & Accessories valued at up to $21,333.28. e. Approval of Dorchester County’s Pine Trace Park Master Plan. Planning Commission affirmed compatibility with the Town’s Comprehensive Plan at their meeting on March 15, 2021, and County Council approved the plan at their meeting on March 15, 2021. f. Resolution regarding face coverings g. Naming of the Town’s park on the Ashley River 11. Public Comment - Open 12. Executive Session: Contractual matter a. Adjourn AN ORDINANCE TO AMEND TOWN ORDINANCE CHAPTER 8-BUSINESSES, APPENDIX A., 8.7 NAICS 524127-INSURANCE COMPANIES FOR ARTICLE I, ARTICLE II, AND ARTICLE III SO THAT LICENSES TAXES FOR INSURANCE COMPANIES SHALL NOW BE DUE AND PAYABLE ON OR BEFORE APRIL 30 IN EACH YEAR BE IT ORDAINED BY the Mayor and Council members of the Town of Summerville, in a meeting duly assembled, that the Code of Laws of the Town of Summerville be hereby amended by amending section Appendix A so that it will hereafter read as follows: APPENDIX A CLASS 8 RATES NAICS 524127 - Title Insurance .....2% of Gross Premiums Notwithstanding any other provisions of this ordinance, license taxes for insurance companies shall be payable on or before April 30 in each year without penalty. The penalty for delinquent payments shall be five percent of the tax due per month, or portion thereof, after the due date until paid. Any exemptions in the business license ordinance for income from business in interstate commerce are hereby repealed. Gross income from interstate commerce shall be included in the gross income for every business subject to a business license tax. Pursuant to S.C. Code 1976, §§ 38-45-10 and 38-45-60, the Municipal Association of South Carolina, by agreement with the municipality, is designated the municipal agent for purposes of administration of the municipal broker's premium tax. The agreement with the association for administration and collection of current and delinquent license taxes from insurance companies as authorized by S.C. Code 1976, § 5-7-300 and administration of the municipal broker's premium tax in the form attached hereto is approved, and the mayor is authorized to execute it. [The South Carolina General Assembly, in order to ensure consistency with the federal Non- admitted and Reinsurance Reform Act of 2010 ("NRRA"), ratified an Act (Rat# 283) on June 28, 2012, amending S.C. Code 1976, §§ 38-7-16 and 38-45-10 through 38-45-195. The Act establishes a blended broker's premium tax rate of six percent comprised of a four percent state broker's premium tax and a two percent municipal broker's premium tax. The Act states a municipality may not impose on brokers of non-admitted insurance in South Carolina an additional license fee or tax based upon a percentage of premiums.] .
