Parker Bob Jackson Matt Halter Town of Summerville COUNCIL MEETING MINUTES June 13, 2024 ATTENDANCE Present: Mayor Russ Touchberry, Councilmembers Kima Garten-Schmidt, Aaron Brown, Tiffany Johnson-Wilson, Matt Halter and Richard G. Waring, IV. Bob Jackson was absent. Also in attendance were Town Administrator Lisa Wallace, Town Attorney GW Parker, and Town Clerk Beth Messervy. A quorum was met. Public and press were duly notified. The meeting took place in Council Chambers at 200 South Main Street and was livestreamed from the Town’s website. CALL TO ORDER Mayor Touchberry called the meeting to order at 6:00pm on Thursday, June 13, 2024. Councilmember Matt Halter gave the invocation, followed by the Pledge of Allegiance. EMPLOYEE RECOGNITION Mayor Touchberry recognized Brandon Yeager, the Parks and Recreation Department’s Facilities Manager, for his hard work and dedication to the Parks and Recreation Department. PROCLAMATION PRESENTATIONS Mayor Touchberry presented proclamations honoring Dr. Adrian Fox, the Summerville High School Girls Softball Team State Champions, Juneteenth, and Bike/Walk Summerville Month. WEB SITE PRESENTATION Chris Makowski, the Town’s Public Information Officer, presented the newly revamped Town of Summerville Economic Development web site. PUBLIC HEARING Mayor Touchberry opened the public hearing for the municipal budget for fiscal year July 1, 2024 – June 30, 2025. There being no comments from the public, Mayor Touchberry closed this part of the meeting. Town Council Meeting Minutes – June 13, 2024 Page 2 APPROVAL OF MINUTES OF PREVIOUS MEETINGS Mr. Waring made a motion, seconded by Ms. Garten-Schmidt, to approve the minutes of the May 9, 2024 Council meeting, the June 3, 2024 Special Council Meeting, and the June 10, 2024 Standing Committee meetings. The motion carried unanimously, and the minutes were accepted into record. PUBLIC COMMENT – JUNE 13, 2024 AGENDA ITEMS Troy Long spoke in opposition of the proposed rezoning of two parcels on Wylie Street. He stated that it would change the character of the neighborhood. David and Jabria Boccabella spoke in opposition of the proposed rezoning of two parcels on Wylie Street. Mr. Boccabella stated that the plans show 6 visitor spaces for 7 townhomes, meaning that there would be visitors parking on their street. PETITIONS No petitions for June. PENDING BILLS AND RESOLUTIONS Mr. Brown made a motion, seconded by Mr. Halter, to give second and final reading to an ordinance to adopt an operating budget for the Town of Summerville for the fiscal year running July 1, 2024 – June 30, 2025. The motion carried unanimously. Mr. Waring made a motion, seconded by Ms. Johnson-Wilson, to give second and final reading to an ordinance to amend the Summerville Unified Development Ordinance, Chapter 2, Section 2.3.6.A - Encroachments; Chapter 4, Section 4.2.5 - Frontage Encroachments; Chapter 13, Section 13.7.1 – Zoning/Development Permit. The motion carried unanimously. Mr. Waring made a motion, seconded by Ms. Johnson-Wilson, to give second and final reading to an ordinance to amend the Summerville Unified Development Ordinance, Chapter 3, Section 3.3 – Table of Permitted Uses and Section 3.4.5.E – Tobacco/Tobacco Alternatives Sales Store; Chapter 15, Section 15.3 – Definition of Terms. The motion carried unanimously. Mr. Halter made a motion, seconded by Mr. Brown, to give second and final reading to an ordinance to amend the Summerville Unified Development Ordinance, Chapter 9-Lighting, Section 9.3 – Design Standards. The motion carried unanimously. Mr. Waring made a motion, seconded by Ms. Garten-Schmidt, to give second and final reading to an ordinance to amend the Summerville Unified Development Ordinance, Chapter 13, Section 13.7.2 – Building Permit and Section 13.7.3 – Certificate of Occupancy/Occupancy Permit. The motion carried unanimously. Ms. Garten-Schmidt made a motion, seconded by Mr. Waring, to give second and final reading to an ordinance to amend the Summerville Unified Development Ordinance, Chapter 14, Section 14.2.4 – Notice of Violation and 14.2.5 – Failure to Correct Violation. The motion carried 5-1 with Ms. Johnson- Wilson voting in opposition. Mr. Waring made a motion, seconded by Mr. Brown, to give second and final reading to an ordinance to amend Chapter 6 – Building and Building Regulations; Article II; Division 2 – Construction and Code Board of Adjustments and Appeals; Section 6-61, to allow, in addition to citizens, those individuals who own a business and/or real property or individuals with a unanimous vote of Council, to serve as a Town Council Meeting Minutes – June 13, 2024 Page 3 member of the Construction and Code Board of Adjustments and Appeals. The motion carried unanimously. INTRODUCTION OF BILLS AND RESOLUTIONS Mr. Waring made a motion, seconded by Mr. Brown, to give first reading to an ordinance to first reading of an ordinance to amend the Town of Summerville Code of Ordinances Chapter 2, Article II, Division 3, Section 2-98(b) – Addressing Council. The motion carried unanimously. Mr. Waring made a motion, seconded by Mr. Halter, to deny first reading of an ordinance to rezone TMS#s 130-14-13-001 and -002, located at 110 and 112 Wylie Street, totaling approximately one acre, and owned by Wendy G. Taylor, from GR-5, General Residential (5 units/acre), to N-MX, Neighborhood Mixed-Use (Council District 1). The motion carried unanimously. MISCELLANEOUS Mr. Waring made a motion, seconded by Ms. Garten-Schmidt, to approve the State Accommodations Tax Advisory Committee’s recommendations for 2024 funding to organizations. The motion carried unanimously. Town Engineer Bonnie Miley explained that the Arbor Walk HOA requested a three way stop sign on Goldfinch and Dolphin Drive, because residents are concerned with the speeding there. She reported that the Summerville Police Department did a speed study there, but that the findings did not warrant a stop sign for traffic calming purposes. Some discussion followed. Ms. Garten-Schmidt made a motion, seconded by Ms. Johnson-Wilson, to approve the requested stop signs and crosswalk at the intersection. The motion carried unanimously. Mr. Brown made a motion, seconded by Mr. Waring, to approve a Memorandum of Understanding with First Citizens Bank for the sponsorship and naming rights of the splash pad at Doty Park. The motion carried unanimously. Ms. Johnson-Wilson made a motion, seconded by Mr. Waring, to accept the agreement with Gilbert and Lee Construction for boring under the Town’s parking garage as related to the renovation of 118 West Richardson Avenue. Some discussion followed. Ms. Johnson-Wilson withdrew her motion. Mr. Halter made a motion, seconded by Ms. Garten-Schmidt, to accept the agreement with an indemnification clause protecting the Town against damage to the parking garage. The motion carried unanimously. Ms. Garten-Schmidt made a motion, seconded by Mr. Brown, to accept a quit claim deed from P.R. Properties of Summerville, LLC conveying a portion of Trolley Rd. Extension which will be repaved by Dorchester County and brought up to standards. Once that portion of Trolley Rd. Extension is accepted by the Town, the Town will be responsible for maintenance. The motion carried unanimously. Mr. Waring made a motion, seconded by Ms. Garten-Schmidt, to postpone the quit claim deed from the SCDOT for a portion of West 2nd South Street in between Main Street and Central Avenue until the July meeting. The motion carried unanimously. Town Council Meeting Minutes – June 13, 2024 Page 4 PUBLIC COMMENTS (open) Mayor Touchberry opened the floor for public comments on any topic. Andrew Price, Executive Director of the Summerville Orchestra, spoke on the different concerts and activities that the organization has had over the past year, as well as a look into the future. Dr. Showalter Johnson read a statement about Dr. Adrian Fox, recommending Dr. Fox for a proclamation. EXECUTIVE SESSION: Mr. Waring made a motion, seconded by Ms. Johnson-Wilson, to enter into Executive Session to discuss a. Personnel matter related to Town Administrator search b. Personnel matter related to appointments to Construction and Code Board of Appeals c. Personnel matter related to the position of Building Official The motion carried unanimously, and Council entered into Executive Session at 7:02pm. Council reconvened at 7:28pm. Town Attorney GW Parker stated no action was taken in Executive Session when Council met to discuss: a. Personnel matter related to Town Administrator search b. Personnel matter related to appointments to Construction and Code Board of Appeals c. Personnel matter related to the position of Building Official OTHER BUSINESS: Mr. Waring made a motion, seconded by Ms. Garten-Schmidt, to instruct the Town Administrator search committee to take the list of applicants down to 3 finalists. The motion carried unanimously. Mr. Halter made a motion, seconded by Mr. Brown, to appoint the following to the Construction and Code Board of Appeals: Chris Ackerman, Steve Hatton, Carlos Federico Martinez, Edward Tupper, Paul Lawton, Todd Wilson, and Mark Watson. The motion carried 5-0, with Ms. Johnson-Wilson recusing herself from the vote. Ms. Johnson-Wilson made a motion, seconded by Ms. Garten-Schmidt, to affirm the Town Administrator’s recommendation of Rebecca Brown to be the Building Official, moving Don Brown to the Deputy Building Official position, effective the first pay period of July 2024. Public and press were duly notified. The meeting took place in Council Chambers at 200 South Main Street, Summerville, SC. CALL TO ORDER Mayor Touchberry called the meeting to order at 11:00 am on Friday, June 14, 2024. EXECUTIVE SESSION: Mr. Brown made a motion, seconded by Mr. Halter to enter into Executive Session to interview a candidate for the Town Administrator position. The motion carried, and Council entered into Executive Session at 11:01am. Council reconvened at 12:04pm. Town Attorney GW Parker stated that Council met in Executive Session to interview a candidate for the Town Administrator position, and that no action was taken in Executive Session. EXECUTIVE SESSION: Mr. Waring made a motion, seconded by Ms. Garten-Schmidt, to enter into Executive Session to discuss a personnel matter related to the Town Administrator search and a contractual matter related to the proposed MOU with Dorchester County and the Oakbrook Sports Complex. The motion carried, and Council entered into Executive Session at 4:01pm. Council reconvened at 4:20pm. Town Attorney GW Parker stated that Council met in Executive Session to discuss a personnel matter related to the Town Administrator search and a contractual matter related to the proposed MOU with Dorchester County and the Oakbrook Sports Complex. He stated that no action was taken in Executive Session. OTHER BUSINESS: Mr. Waring made a motion, seconded by Ms. Garten-Schmidt, that Council appoint Scott Slatton to replace our current Town Administrator, and that the Town Attorney and Mayor negotiate a contract with Mr. Slatton, to be brought back to Council for approval. Special Town Council Meeting Minutes – June 18, 2024 Page 2 Ms. Garten-Schmidt made a motion, seconded by Mr. Halter, to approve the Memorandum of Understanding with Dorchester County for that portion of the Oakbrook Sports Complex located within the Municipal Limits of the Town, deferring development of the complex to the County, and authorize the Town Administrator to sign on behalf of the Town. The meeting took place in Council Chambers at 200 South Main Street, Summerville, SC. CALL TO ORDER Mayor Touchberry called the meeting to order at 3:00pm on Friday, June 21, 2024. EXECUTIVE SESSION: Mr. Halter made a motion, seconded by Mr. Brown, to enter into Executive Session to discuss contractual matters related to the new Town Administrator. The motion carried unanimously, and Council entered into Executive Session at 3:01pm. Ms. Garten-Schmidt and Mr. Waring voted via Zoom, and Mr. Jackson voted via conference call on the telephone. Council reconvened at 3:22pm. Town Attorney GW Parker stated that Council met in Executive Session to discuss contractual matters related to the new Town Administrator. He stated that no action was taken in Executive Session. OTHER BUSINESS: Mr. Halter made a motion, seconded by Ms. Johnson-Wilson, to authorize the Town Attorney and Mayor to finalize the contract, as presented to Council, with Scott Slatton for the Town Administrator position. The meeting was held in the Council Chambers of Town Hall, 200 S. Main Street, Summerville, SC. Committee members present included Richard Waring, Council District 4; Matt Halter, Council District 3; and Bob Jackson, Council District 6. Staff members present included Jessi Shuler, AICP, Director of Planning and other Town staff. The meeting was called to order at 5:30 PM by Mr. Waring, Chairman. Rezoning: Ms. Shuler introduced the petition by Michael C. Fox, Stefan Colucci, William Colucci, Alice Norton, Kim Colucci Lizzi, and Robert Colucci to annex TMS# 152-00-00-026, located at 400 Murray Blvd., totaling approximately 12.81 acres. Currently zoned TRM, Transitional Residential District, in Dorchester County and will be zoned N-R, Neighborhood Residential, upon annexation into the Town of Summerville’s municipal limits. (Council District 5). She stated that the Planning Commission held a public hearing and made a recommendation for denial at their meeting on June 17, 2024. Mr. Jackson expressed his belief that the Planning Commission did a good job analyzing the request, and he would not go against their recommendation, as he feels this is not appropriate for the neighborhood. Following his comments, Mr. Jackson made a motion to send the item to the full Council with a recommendation for denial, and Mr. Halter made the second. Mr. Waring asked how many units were proposed, and Ms. Shuler responded that the conceptual plan showed 58 units. Mr. Waring agreed with Mr. Jackson that that many units was not in character with the existing neighborhood, but he noted that he would support a more restrictive residential zoning district that was more in line with the rest of the street. Following the discussion, Mr. Waring called for the question, and the motion passed unanimously. Following no additional business or discussion, the meeting was adjourned at 5:33 PM on a motion by Mr. Jackson and a second by Mr. Halter. Present were Mayor Touchberry and Committee members Bob Jackson, Richard G. Waring, IV, Aaron Brown, Matt Halter, and Kima Garten-Schmidt. Tiffany Johnson-Wilson was absent. Also present were Town Administrator Lisa Wallace, Town Attorney G.W. Parker, and Town Clerk Beth Messervy. Other staff members, members of the press and members of the public were duly notified. The meeting was held in Council Chambers on the third floor of the Annex Building at 200 S. Main Street and livestreamed from the Town’s web site. Welcome Mayor Touchberry called the meeting to order at 5:35pm. Presentation Finance Director Rhonda Moore presented the June 2024 financial of Financial statements. Statements Financial Mr. Jackson made a motion, seconded by Mr. Brown, to correct a previous Requisitions authorization of a purchase order to Amick Equipment in the amount of $313,238 for a streetsweeper to reflect that funds will come from stormwater funds. The motion carried unanimously. Mr. Jackson made a motion, seconded by Ms. Garten-Schmidt, to issue a purchase order to Safe Industries in the amount of $1,100,000 dollars for the purchase of a KME Pumper with equipment for the Fire Department. Funds to come from Impact Fees. The motion carried unanimously. Ms. Garten-Schmidt made a motion, seconded by Mr. Waring, to issue a purchase order to Municipal Emergency Services in the amount of up to $65,000 for the purchase of 15 sets of Structural Protective Gear for the Fire Department. Funds to come from budgeted operating funds. The motion carried unanimously. Mr. Brown made a motion, seconded by Mr. Halter, to issue a purchase order to Stivers Ford, Waukee, Iowa, in the amount of $56,595 each, totaling $113,190, for two 2024 Ford F-150 Police Responder Pick-up Trucks. They are on state contract pricing. Funds to come from budgeted general funds. The motion carried unanimously. Surplus Mr. Jackson made a motion, seconded by Ms. Garten-Schmidt, to surplus the Vehicles following SPD vehicles: #311, #328, and #329. The motion carried unanimously. #311 will be sold. #328 and #329 will be transferred to Parks and Recreation. Executive Ms. Garten-Schmidt made a motion, seconded by Mr. Waring, to enter into Session Executive Session to discuss a personnel matter related to the Town Finance Committee Report July 8, 2024 Page 2 Prosecutor. The motion carried unanimously, and the committee entered Executive Session at 5:50pm. The committee reconvened at 5:58pm. Town Attorney GW Parker stated that the committee met in Executive Session to discuss a personnel matter related to the Town Prosecutor and that no action was taken. Other Mr. Waring made a motion, seconded by Mr. Jackson, to authorize the Town Business Attorney to offer the Town Prosecutor job to Jillian Frederick. The motion carried unanimously. Code Ann.§5-7-250 grants a Municipality the authority to determine its own rules and order of business, and WHEREAS, Town Council, other than Mutual Aid Agreements, has no authority to take actions beyond the municipal limits, and WHEREAS, Town Council Meetings are held to conduct the business of the Town in an orderly, efficient manner for the benefit of Town residents, businesses owners located within the Town municipal limits and those who own and pay taxes on real property located within the municipal limits, and WHEREAS, while there is no Constitutional or Statutory requirement for Town Council to allow public comments during a Council Meeting, Council is of the belief public comments should be restricted to Town Residents, Town Business Owners and those who own and pay taxes on real property located within the municipal limits, and WHEREAS, Town Council, through its observations and experiences with individuals who address Council during Public Comments at Council Meetings, is of the belief issues which need to be brought to the attention of Council can be delivered in three (3) minutes. NOW THEREFORE, be it Ordained by the Mayor and Members of Town Council duly assembled: 1. The above recitals are hereby incorporated into this Ordinance to the same extent as if set out verbatim. 2. Chapter 2, Article II, Division 3., Section 2-98(b) is hereby amended so that it will hereafter read: (b) Public Comments are limited to Town Residents, Town Business Owners and those who own and pay real property taxes located within the municipal limits. Those addressing the council during the "public comments" portions of the meeting must provide their name and address on the signup sheet located at the entrance to Council Chambers five (5) minutes prior to the beginning of the meeting. They shall speak only after being recognized by the presiding officer. Public comments are limited to three (3) minutes or less as recorded by a digital timer conspicuously placed in council chambers. Citizens' remarks shall be directed to the council as a whole, rather than the audience or specific individuals. Extended comments may be provided in writing. WHEREAS, the South Carolina Water Quality Revolving Fund Authority (the “State Authority”) provides low-interest loan financing for the construction of publicly owned water system facilities from the South Carolina Drinking Water Revolving Loan Fund (the “Fund”) pursuant to the Federal Clean Water Act and Title 48, Chapter 5, Code of Laws of South Carolina, 1976, as amended; and WHEREAS, the Town of Summerville is a legally constituted municipal corporation in the State of South Carolina and is authorized to incur revenue debt pursuant to Title 6, Chapter 21, Code of Laws of South Carolina, 1976, as amended; and WHEREAS, the Town of Summerville has determined that it is in the best interests of the Town to apply to the State Authority for a loan from the Fund. NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Summerville, South Carolina (the “Council”), in a meeting duly assembled: 1. That the Council hereby authorizes the General Manager of The Commissioners of Public Works of the Town of Summerville (the “SCPW”) to complete, execute and submit an application to the State Authority for a loan from the Fund in the amount of approximately eight million dollars ($8,000,000) to finance the costs of improvements to SCPW’s water system. The SCPW General Manager is authorized to take such actions as may be necessary or convenient to complete the application process. 2. That the Town of Summerville will grant to the State Authority a pledge of, and lien on, all revenues of SCPW’s combined water and sewer systems for repayment of the loan. 3. That the final terms and conditions of the loan and the loan documents shall be subject to the approval of this Council. ADOPTED, this ____ day of July, 2024.
