The Commissioners then discussed each Study Issue. Chair Mehlinger asked if previously dropped Study Issues from City Council can come back as a consideration after a year or two. Ms. Tsang stated that previously dropped Study Issues cannot be brought back until after 1 year. 1. CDD 19-07 - Develop Citywide Guidelines or Criteria for Allowing Reduced Parking for Development Projects and for Future Conversions of Parking to Other Uses • Staff recommendation: Defer 2. Public Hearing closed at 6:51 p.m. Commissioner Oey asked about the following: - DPW 21-05 - Staff's recommendation to drop this study issue because it is being funded through other means and the improvements will be implemented anyway? Ms. Tsang stated that is correct and the Safe & Seamless Mobility Quick-Strike program grant will provide the funding to build a pathway along that segment for pedestrians to travel on. - DPW 22-02 - Why staff focused on motorized scooters in their recommendation to drop this study issue when the proposal didn't have anything to do with motorized scooters. Ms. Tsang stated that the proposed study issue focuses on bicycle and personal mobility devices and there are state laws and Sunnyvale Municipal Code City of Sunnyvale Page 3 Bicycle and Pedestrian Advisory Meeting Minutes - Final January 20, 2022 Commission that regulate usage on certain types of facilities. - DPW 22-02 - Purpose of this study issue is for the grey zone where motorized devices are not covered by state law. Ms. Tsang stated that the California Motor Vehicle Code has sections that explain what motorized scooters are and they cover what type of motorized scooters the study issue is referring too. Vice Chair Mehlman asked about the following: - DPW 21-01 - Prioritization of vehicle parking should not be a reason to deny a study issue. Ms. Tsang stated there were a few factors in determining locations on-street parking is proposed to be removed to implement bicycle improvements identified in the ATP. Hollenbeck was not one of the streets that was identified in the ATP with a recommendation to remove on-street parking. Commissioner Davé asked about the following: - Explanation about the existing law that covers electric scooters. Ms. Tsang stated that the study issue includes bicycle and other mobility devices. - Why staff is recommending to drop study issue DPW 22-02. Mr. Ng, Transportation and Traffic Manager, stated that staff recommended to drop the study issue because there is existing state law that governs the usage of electic devices such as scooter and hoverboards, which limits their use on certain streets. Commissioner Hafeman asked about the following: - DPW 21-01 - Just because there might be a parking impact and the recommendation is not currently in the ATP are not strong enough reasons to drop the study issue. Mr. Ng stated the ATP identifies corridors and roadways that need further study to determine whether on-street parking can be removed; or if a travel lane can be removed. These items are for future study and consideration by City Council. Another reason not to study Hollenbeck is because the ATP had just been approved and staff has limited resources, so their efforts are to focus on implementing the improvements identified in the ATP. Commissioner Bonne commented on the following: - DPW 21-01 - Disappointed with Staff's recommendation to drop due to availability of parallel routes. Urge to move forward with study issue DPW 21-01. The City of Sunnyvale needs to move away from car centric instead towards a bicycle and pedestrian centric mentality. Availability of alternate bike routes instead of considering availability of alternate car routes should change. City of Sunnyvale Page 4 Bicycle and Pedestrian Advisory Meeting Minutes - Final January 20, 2022 Commission Councilmember Hendricks suggested for the BPAC to rank the study issues and state the positive reasons for the rankings. Chair Mehlinger asked about the following: - DPW 22-02 - Could the BPAC recommend narrowing the scope of this study issue to focus specifically on the bicycle portions. Ms. Tsang stated when ranking the study issue to state in your reasoning why it is supported and recommendations on what to include. - The BPAC authorizing the Chair to send a letter that could be included in the packet explaining the BPAC's choices when it goes to City Council. Ms. Tsang stated the Chair of the BPAC can speak on behalf of the BPAC on the day of the Study Issue Workshop. Ms. Tsang also stated that the meeting minutes will be attached to the packet. - FIN 22-01 - Council Fiscal Policy 7.1 - There is a need for additional resources for implementing the ATP and there is limited staff and budget resources available. These are the reasons to keep Study Issue FIN 22-01. Ms. Tsang stated that Council Fiscal Policy 7.1 refers to a one time project that needs additional funding strategy. Ms. Tsang stated the reason for Staff's recommendation was due to upcoming Capital Improvement Projects that are bond funded so they can't add anymore bond funding. Commissioner Oey asked and commented about the following: - Would like to add a short synopsis that would be attached to the study issues for City Council. Councilmember Hendricks stated that the City Council reads the meeting minutes that state the rankings and reasons for the study issues and there would be no need to attached a synopsis. Councilmember Hendricks stated to rank the study issue and then follow with very specific bullet points on why the study issue was ranked a certain way. - CDD 19-07 - Planning Commission's recommendation for this study issue. Chair Mehlinger stated the Planning Commission has not ranked study issues yet. - CDD 22-04 - Staff recommended to drop this study issue because they are waiting on VTA to update their Bicycle Technical Guidelines which has standards for bike and electric bike parking. Mr. Ng stated that VTA is hoping to finalize the Bicycle Technical Guidelines in 2022. MOTION: Commissioner Oey moved and Commissioner Bonne seconded the motion to drop DPW 21-05, Pedestrian Improvements on Marion Way between City of Sunnyvale Page 5 Bicycle and Pedestrian Advisory Meeting Minutes - Final January 20, 2022 Commission Norman Drive and Oriole Avenue. The motion carried with the following vote: Yes 7 - Chair Mehlinger Vice Chair Mehlman Commissioner Bonne Commissioner Davé Commissioner Hafeman Commissioner Oey Commissioner Paradkar No 0 Commissioner Oey stated DPW 21-05 is not needed because funding is on its way to implement pedestrian facilities at that location. Chair Mehlinger stated he supports the motion because we don't need to study items that are already being worked on. Vice Chair Mehlman asked about the following: - VTA standards only cover facilities on VTA properties. Mr. Ng stated VTA Bicycle Technical Guidelines were created so all the local agencies could use them for design standards for bicycle facilities on public streets and for bicycle parking ratios on private developments. - Is it ok to do a friendly amendment on a study issue after the fact? Ms. Tsang stated if other commissions are ranking the study issue then they would only see the study issue that was proposed without any amendment. Ms. Tsang stated she has not seen any guidance to allow commissions to make any additional revision during the ranking process. Councilmember Hendricks stated that a study issue cannot be changed by a Board or Commission during the ranking process. Chair Mehlinger ruled as Chair that it is out of order to modify the language of study issues at this time. However, the motion to rank the study issues may include advisory language recommending modifications. Commissioner Oey asked if a study issue could be deferred or dropped and then revised. Chair Mehlinger stated if a study issue is dropped then it can be rewritten. City of Sunnyvale Page 6 Bicycle and Pedestrian Advisory Meeting Minutes - Final January 20, 2022 Commission Commissioner Bonne asked if Study Issue CDD 19-07 was only for VTA sites or all residential and multi-family dwellings units in Sunnyvale. Ms. Tsang stated the study issue will look at the guidelines for the City of Sunnyvale. MOTION: Chair Mehlinger moved and Commissioner Oey seconded to drop DPW 21-02, Community Driven Active Transportation Plan Amendment Process. The motion carried with the following vote: Yes 5 - Chair Mehlinger Vice Chair Mehlman Commissioner Bonne Commissioner Oey Commissioner Paradkar No 1 - Commissioner Hafeman Abstain 1 - Commissioner Davé Chair Mehlinger stated he proposed this study issue over 1 1/2 years ago as a way to provide a structure for modification to the ATP. Since then the ATP has had a number of successful projects come forward. Engaging with the Council Sub-committee on Board and Commissions on possible improvements to the study issue process. Commissioner Oey agrees with Chair Mehlinger Commissioner Hafeman thinks this study issue should be ranked high and not dropped due to the changes the City of Sunnyvale has and will be facing. Commissioner Hafeman moved and Commissioner Bonne seconded the motion to drop CDD 22-04, Adopt Personal Electric Vehicle (PEV) Parking Standards. Commissioner Hafeman stated he feels it is overly complex and doesn't understand how it could move forward because there are so many different devices that are changing so fast. Vice Chair Mehlman commented on the following: - Standards for each device - Proposed methods for charging devices City of Sunnyvale Page 7 Bicycle and Pedestrian Advisory Meeting Minutes - Final January 20, 2022 Commission Commissioner Oey commented on the following: - VTA's recommendations and their new standards - Supports dropping or deferring Chair Mehlinger commented on the following: - Supports deferring but will not support dropping - Devices are expensive need to be securely stored to prevent theft, require electricity from 110 outlet, Lithium Ion batteries are potential fire hazards - Should have specific standards - Fire safe room MOTION: Commissioner Hafeman moved and Commissioner Bonne seconded the motion to drop CDD 22-04, Adopt Personal Electric Vehicle (PEV) Parking Standards. Commissioner Oey stated he would like to see the study issue cleaned up and better articulated to easily understand what everyone wants to achieve and improving the sidewalk riding ordinance. Vice Chair Mehlman stated the study issue needs to have the scope narrowed and to clarify exactly what needs to be looked at since certain items are already covered by state law. Commissioner Hafeman stated there will be several months of further insight and VTA will be coming out with new standards. So it is a good idea to defer and redefine it as necessary. Chair Mehlinger stated he is waiting for the VTA guidelines and then there will be a clearer picture on what to do with the study issue. Commissioner Davé asked about why the study issue is being deferred based on information outside of the BPAC. Commissioner Paradkar supports deferring based on waiting for VTA guidelines. Commissioner Oey supports this motion because he feels the study issue needs to be clearer and more precise of what the BPAC wants. Would like to present study City of Sunnyvale Page 9 Bicycle and Pedestrian Advisory Meeting Minutes - Final January 20, 2022 Commission issues to City Council that are of top priority and articulated correctly. MOTION: Commissioner Hafeman moved and Chair Mehlinger seconded to defer CDD 22-04, Adopt Personal Electric Vehicle (PEV) Parking Standards. The motion carried with the following vote: Yes 5 - Chair Mehlinger Commissioner Bonne Commissioner Hafeman Commissioner Oey Commissioner Paradkar No 1 - Commissioner Davé Abstain 1 - Vice Chair Mehlman Chair Mehlinger called for a recess at 8:10 p.m. Chair Mehlinger reconvened the meeting at 8:16 p.m. Commissioner Hafeman commented on the following: - CDD 19-07 - should be deferred due to parking standards not specifying what to do with extra cars resulting from those parking standards - Hard to disagree with staff recommendation when not on Planning Commission for context Commissioner Hafeman moved and Commissioner Paradkar seconded to defer CDD 19-07. Commissioner Paradkar agrees with Commissioner Hafeman and feels it is better to wait and see the affects on the tighter parking standards Commissioner Oey stated he will not be supporting a motion to defer because he feels it should be ranked number 2 in the study issue rankings due to the parking issues. Need fewer places to park to allow for parking spaces for other uses. Vice Chair Mehlman stated she will not be supporting a motion to defer because there needs to be a reduction in vehicle dependencies. Chair Mehlinger stated he will support the motion to defer because this study issue needs to be revised and made clearer. Commissioner Bonne stated he will not be supporting a motion to defer because he feels there are 3 critical links between the topics which are parking, availability of bike lanes and funding for bicycle and pedestrian improvements. Commissioner Bonne stated the study issue should be ranked and then add asterisks to highlight the BPAC's additional comments to it. Commissioner Bonne moved to rank the Study Issues as follows: 1. DPW 21-01 - Bike Lanes on Hollenbeck Avenue between El Camino Real and Homestead Road 2. CDD 19-07 - Develop Citywide Guidelines or Criteria for Allowing Reduced Parking for Development Projects and for Future Conversions of Parking to Other Uses 3. FIN 22-01 - Explore a General Election Ballot Measure to Fund Bicycle and Pedestrian Infrastructure Projects With appropriate comments to follow. Commissioner Hafeman stated Study Issue CDD 19-07 doesn't address street parking at all. Commissioner Paradkar agrees with Commissioner Hafeman about the street parking. Chair Mehlinger commented on the following: - Strongly supports this study issue - Defer based on staff's limited resources - Waiting another year - Bring this study issue to City Council when the District 1 seat is filled Commissioner Bonne commented on the following: - Urgent topic, shouldn't defer - Should be brought to City Council immediately without waiting a year - Supports this study issue and adding dedicated bike lanes to a very crowded street - Will not support deferral Commissioner Oey commented on the following: - Against deferring because it is an important bicycle corridor that is heavily used and stresses bicyclists out - Main route to get to the central part of Sunnyvale Commissioner Hafeman commented on the following: - Bike lanes on Hollenbeck Avenue provide a bike access to the Washington Community Swim Center and to the Sunnyvale Public Library from the south part of the city Vice Chair Mehlman commented on the following: - Against deferral because it is a very important bicycle route that needs to be City of Sunnyvale Page 12 Bicycle and Pedestrian Advisory Meeting Minutes - Final January 20, 2022 Commission utilized and deferring will just delay the process Commissioner Davé commented on the following: - Hollenbeck is a back door to Fremont High School which students could utilize rather than busier roads that are more dangerous Commissioner Pradakhar asked how much of an impact the District 1 Councilmember would have if the study issue was ranked. Chair Mehlinger stated if the seat was represented by a District 1 Councilmember it would have a better chance to pass. Chair Mehlinger agrees with the BPAC for all the reasons why it is a good idea to build bike lanes on Hollenbeck Avenue. Commissioner Bonne stated the BPAC should not be swayed by burdening or under burdening staff when making a decision on study issues. MOTION: Chair Mehlinger moved and Commissioner Bonne seconded to defer DPW 21-01, Bike Lanes on Hollenbeck Avenue between El Camino Real and Homestead Road. The motion failed with the following vote: Yes 1 - Chair Mehlinger No 6 - Vice Chair Mehlman Commissioner Bonne Commissioner Davé Commissioner Hafeman Commissioner Oey Commissioner Paradkar Chair Mehlinger recommended to the BPAC to rank FIN 22-01 as number 1. If not ranked number 1 then to defer it and spend the next year to build support for this study issue as it is a very substantial lift. Commissioner Oey agrees that the study issue is substantial and will support deferring. Vice Chair Mehlman agrees to defer. City of Sunnyvale Page 13 Bicycle and Pedestrian Advisory Meeting Minutes - Final January 20, 2022 Commission Vice Chair Mehlman commented on the following: - City Budget being greatly impacted by Covid - Need to examine this study issue outside of the Pandemic - Need more time to explore what exactly the BPAC wants to accomplish - Giving residents a clearer picture of what the study issue could do Commissioner Paradkar commented on the following: - Agreed with topics Vice Chair Mehlman mentioned - Agreed with Chair Mehlinger if not ranked 1 then it shouldn't be ranked and deferred Commissioner Hafeman commented on the following: - Supports having this issue ranked as #1 - Consultants getting a feel if the bond measure will pass before putting it for the voters - Doesn't see a good reason to delay Commissioner Oey asked if there are any other options for funding for bicycle and pedestrians. City of Sunnyvale Page 14 Bicycle and Pedestrian Advisory Meeting Minutes - Final January 20, 2022 Commission Commissioner Oey commented on the following: * DPW 21-01 - #1 choice because it is a critical bike route for school kids, for multiple schools, biking central core for Sunnyvale East/West and a great regional corridor Chair Mehlinger commented on the following: * DPW 21-01 - #1 choice because it is a clean win, infrastructure win and uniquely valuable * Closely aligned to the charter as a commission than the parking issue Commissioner Bonne commented on the following: * DPW 21-01 - #1 choice because Hollenbeck is a very critical bike route, visible addition and improvement in safety for all bike riders * CDD 19-07 - Supports this study issue because this is out of balance if advocating for a more bike and pedestrian centric transportation system rather than car centric Commissioner Davé commented on the following: * DPW 21-01 - # 1 choice because this study issue will improve the safety of bicyclists already traveling on Hollenbeck * CDD 19-07 - Strong second ranking Vice Chair Mehlman agrees with everyone for the rankings and for the same reasons Commissioner Davé ranked the Study Issues as follows: 1. Commissioner Oey commented on the following: * Strongly supports having DPW 21-01 ranked as #1 as it is a clear win for kids and for older people for the whole city * CDD 19-07 - Parking needs to be reduced in the future so that it would be less expensive to live in Sunnyvale as well MOTION: Commissioner Oey moved and Commissioner Pradakhar seconded the motion to accept the overall Study Issue Rankings with DPW 21-01 ranked as #1 and CDD 19-07 ranked as #2. To defer CDD 22-04, DPW 22-02, FIN 22-01 and to drop DPW 21-02 and DPW 21-05. Commissioner Oey asked why the trim. Chair Mehlinger stated because that is the only thing that affects existing buildings, and everything else in this study issue would affect new buildings. Taking it out would keep it future oriented. Commissioner Oey is ok with trimming existing parking. Vice Chair Mehlman stated the BPAC can make recommendations on it but can't change it. City of Sunnyvale Page 18 Bicycle and Pedestrian Advisory Meeting Minutes - Final January 20, 2022 Commission - Presentation on the implementation of Senate Bill 743 and the transition from Level of Service (LOS) to Vehicle Miles Traveled (VMT) in transportation impact analysis, including highlights of countywide implementation resources prepared by VTA. - SB 743 (passed 2013, effective as of 2020) changed the California Environmental Quality Act (CEQA): - New CEQA Transportation metric is VMT – aligns with climate goals - VTA is helping cities switch from LOS to VMT analysis for projects. VTA created an online evaluation tool to help with VMT analysis. Version 1 was released May 2020, Version 2 of the tool was released Sept 2021.
