City of Sunnyvale (U.S. District Court Case No. 5:20-CV-00824-EJD) Approve Budget Modification No. 13 since the payment has been ordered by the District Court. 1.H 25-0312 Approve Budget Modification No. 15 of $76,642 for November 5, 2024, Elections Costs Approve Budget Modification No. 15 in the amount of $76,742. 1.I 25-0257 Award of Contract in the Amount of $2,561,259.29 to Casey Construction, Inc. for Replacement/Repair/Rehabilitation of Sanitary Sewer System and Finding of California Environmental Quality Act (CEQA) Categorical Exemption Pursuant to CEQA Guidelines Sections 15301(b), 15302(c), and 15303(d) (PW25-05) Take the following actions: - Award a contract in substantially the same form as Attachment 2 to the report in the amount of $2,561,259.29 to Casey Construction, Inc of Emerald Hills; - Make a finding of a categorical exemption from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Sections 15301(b),15302(c), and City of Sunnyvale Page 4 City Council Meeting Minutes February 25, 2025 15303 (d); - Authorize the City Manager to execute the contract when all necessary conditions have been met; and - Approve a 10% contingency in the amount of $256,126. 1.J 25-0197 Authorize Reinstating and Amending two On-Call Contracts for Pavement Rehabilitation Services (F25-203 and F25-209) Take the following actions: - Authorize the City Manager to execute the Second Amendments to the contracts with Michael Baker International, Inc. and Wood Rodgers, Inc. for Pavement Management in substantially the same form as Attachment 1 and 2 to the report to extend the term of the agreements to May 10, 2025; and - Authorize the City Manager to execute the Contracts when all necessary conditions have been met. 1.K 25-0064 Amend an Existing Purchase Agreement with Dell Marketing L.P. for Computer Equipment in the Amount of $2,500,000 and Extend the Term Through June 30, 2028 (F25-186) Take the following actions: - Authorize the City Manager to modify an existing purchase agreement with Dell Marketing L.P., increasing the PA amount from $800,000 to $2,500,000, for ongoing, scheduled replacements of computers, monitors, servers, and associated equipment; and - Authorize the City Manager to renew the contract for up to three (3) additional one-year periods and to further modify the PA amount, both subject to available budget and if pricing and service remain acceptable to the City. 1.L 25-0096 Review and Approve 2025 Board and Commission Annual Work Plans Approve the 2025 Work Plans as submitted. 1.M 25-0094 Annual Review of City’s Code of Ethics and Conduct for Elected and Appointed Officials Public Hearing opened at 7:33 p.m. Esther Rosenfeld spoke in support of adding new language to the 2025 Code of Ethics and Conduct and provided language examples. Maia Elder Kadar shared their support of Human Relations Commission recommended changes to the 2025 Code of Ethics and Conduct. Public Hearing closed at 7:40 p.m. MOTION: Vice Mayor Sell moved and Councilmember Cisneros seconded the motion to direct staff to develop additional language options for the Code of Ethics and Conduct for Elected and Appointed Officials for Council to consider and return to Council at a date to be determined by the City Manager. MOTION TO SUBSTITUTE: Councilmember Mehlinger moved and Councilmember Le seconded the motion to substitute the motion to approve the staff recommendation to approve the 2025 Code of Ethics and Conduct for Elected and Appointed Officials with non-substantive changes from the 2024 Code as set forth in Attachment 1 to the report.
