City of Sunnyvale Meeting Minutes - Final Housing and Human Services Commission Wednesday, November 19, 2014 7:00 PM West Conference Room, City Hall, 456 W. Olive Ave., Sunnyvale, CA 94086 Special Meeting CALL TO ORDER Chair Gilbert called the meeting to order at 7:07 p.m. SALUTE TO THE FLAG ROLL CALL Present: 6 - Chair Diana Gilbert Vice Chair Younil Jeong Commissioner Dennis Chiu Commissioner Patti Evans Commissioner Chrichelle McCloud Commissioner Barbara Schmidt Absent: 1 - Commissioner Navpreet (Ruby) Sidhu Council Liaison Tara Martin-Milius (absent) Commissioner Sidhu (unexcused absence) Commissioner Chiu arived at 8:20 p.m. PUBLIC ANNOUNCEMENTS None. CONSENT CALENDAR 1.A 14-1086 Draft Minutes of the Housing and Human Services Commission Meeting of October 22, 2014. Commissioner Schmidt moved and Commissioner Evans seconded the motion to approve the consent calendar which is comprised of the draft minutes of the Housing and Human Services Commission meeting of October 23, 2014. PUBLIC HEARINGS/GENERAL BUSINESS 2 14-0910 Recommend Adoption of 2015-2023 Housing Element (General Plan Amendment) Housing Officer Suzanne Isé gave a brief summary of the staff report and noted that the State Department of Housing and Community Development (HCD) had sent a letter approving the draft Housing Element with the minor changes as highlighted in the attachment they received. She also noted that the Housing Element will be going to the Planning Commission for another public hearing opportunity and finally to the City Council for adoption in early December to meet the January 2015 deadline to submit back to HCD for final approval. Chair Gilbert opened the public hearing at 7:19 p.m. Chair Gilbert closed the public hearing at 7:20 p.m. After a brieft discussion and some questions regarding the changes requested by HCD, Chair Gilbert asked for a motion. Commissioner Evans moved and Commissioner McCloud seconded the motion to approve Alternative 1: Recommend that Council adopt the 2015-2023 Housing Element as provided in Attachment 2. The motion carried by the following vote: City of Sunnyvale Page 2 Housing and Human Services Meeting Minutes - Final November 19, 2014 Commission Yes: 5 - Chair Gilbert Vice Chair Jeong Commissioner Evans Commissioner McCloud Commissioner Schmidt No: 0 Absent: 2 - Commissioner Chiu Commissioner Sidhu 3 14-1095 Review Draft Requests for Proposals for FY 2015-16 and FY 2016-17 CDBG Human Services Grants and FY 2015-16 CDBG/HOME Housing and Capital Projects Funding Housing Officer Suzanne Isé explained that the RFPs did not change significantly since the last funding cycle and that they are substantially the same as what was realeased last year for capital projects and the year before for human services. She noted that minor changes included clarification of some wording and the inclusion of the higher minimum grant amount for CDBG funding for human services. She noted that because the grant amounts will not be known before the RFPs are released, staff will use a conservative estimate to calculate the approximate amounts that will be available based on prior year's funding and anticipated program income. Officer Isé also noted that the final version will include the higher estimate of supplemental general funds ($115,000) as recommended by the commission during its Priority and Unmet Needs hearing in October, which was approved, for planning purposes, by Council in November. Chair Gilbert opened and closed the public hearing at 7:26 p.m. There were no members of the public present. After some questions from the commissioners, they all concurred that no action was needed on this item. 4 14-1087 Review and Rank Study Issues Officer Isé reviewed each of the study issues and answered commissioners' questions before the ranking process began. City of Sunnyvale Page 3 Housing and Human Services Meeting Minutes - Final November 19, 2014 Commission Chair Gilbert initiated the sudy issues ranking using the procedures provided by the City Clerk's office. First she asked if there were any study issues that the commission would recommend to be dropped or deferred. Commissioner McCloud moved and Commissioner Evans seconded to recommend dropping Study Issue CDD 15-01: Consider Imposing a Tax or Fee on Rental Property Owners to Provide Revenue Source to Pay for Tenant-Landlord Dispute Resolution Services, because they thought this method of generating funds for these services would not be cost-effective. The motion carried unanimouisly 6-0-1, with Commissioner Sidhu absent. Commissioner Evans moved and Commissioner McCloud seconded to recommend dropping Study Issue CDD 15-05: Review Below Market Rate (BMR) Unit and/or In-lieu Fee Requirements, because a similar effort was completed recently, this would not be good use of staff's time, and could potentially adversely affect smaller property owners. The motion passed unanimously 6-0-1, with Commissioner Sidhu absent. Commissioner McCloud moved and Commissioner Evans seconded to recommend deferring Study Issue CDD 15-10: Explore Introduction of Rent Stabilization Ordinance. After some discussion the motion was withdrawn. Each commissioner ranked each of the two remaining study issues, CDD 15-10: Explore Introduction of Rent Stabilization Ordinance and CDD 15-12: Regulating Short-term Residential Rental Units (i.e., AirBnB), by roll call. The results of the ranking was as follows: CDD 15-10 CDD 15-12 Chiu 1 2 Evans 2 1 Gilbert 1 2 Jeong 1 2 McCloud 2 1 Schmidt 1 2 ____________________________ Total Points 8 10 ______________________________________ Rank 1 2 Commissioner Chiu moved and Commissioner McCloud seconded to accept Study Issue CDD 15-10: Explore Introduction of Rent Stabilization Ordinance as #1 and City of Sunnyvale Page 4 Housing and Human Services Meeting Minutes - Final November 19, 2014 Commission Study Issue CDD 15-12: Regulating Short-term Residential Rental Units (i.e., AirBnB) as #2. Motion carried unanimously 6-0-1, with Commissioner Sidhu absent. 5 14-1088 Annual Review of the City Code of Ethics and Conduct Officer Isé explained that this item is a regular annual reminder to review the Code of Ethics and Conduct, and noted that no formal action is needed by the Commissioners unless they would like to ask for clarification or suggest any changes to the code. Chair Gilbert opened and closed the public hearing at 8:56 p.m. There were no members of the public present. The commissioners had no additional input or any discussion.
