City of Sunnyvale Meeting Minutes Zoning Administrator Hearing Wednesday, June 25, 2014 2:00 PM West Conference Room, City Hall, 456 W. Olive Ave., Sunnyvale, CA 94086 CALL TO ORDER PUBLIC HEARINGS 14-0585 File #: 2014-7415 Location: 295 East Washington Avenue (APN: 209-05-011 ) Applicant / Owner: Island 295, Inc. (applicant) / Greg Smith (owner) Proposed Project: SPECIAL DEVELOPMENT PERMIT to allow general alcohol sales at an existing restaurant with previously approved live entertainment (karaoke). Reason for Permit: A Special Development Permit is required for a restaurant with on sale general alcohol beverage service in the DSP - 3 (Downtown Specific Plan, Block 3) Project Planner: Momoko Ishijima, (408) 730-7532, mishijima@sunnyvale.ca.gov Issues: Compatibility with surrounding uses. Recommendation: Approve with Conditions In attendance: Eddy Shen, Applicant; Andy Kasik, Owner Representative; Maria Pan, Neighbor; Andrew Miner, Zoning Administrator; Momoko Ishijima, Project Planner; Luis Uribe, Staff Office Assistant. Mr. Andrew Miner, Zoning Administrator, on behalf of the Director of Community Development, explained the format that would be observed during the public hearing. Mr. Miner announced the subject application. Momoko Ishijima, Project Planner, presented the item. Ms. Ishijima mentioned that the other tenants consist of a Chinese restaurant, beauty salon and tattoo parlor. Previous approvals have included a SDP for a bar with live entertainment in 2010 and a modification to the SDP for a restaurant with beer and alcohol sales and live entertainment in 2012. With receipt of the application, staff inquired with DPS regarding compliance with the current beer and wine license and if there has been any reports of incidents or nuisance. The current business is in compliance and there have been no reports of incidents or nuisance. Mr. Miner asked if condition GC-6 is a new condition. Staff stated that the applicant will be required to a new six-month review starting from the day they get the liquor license. Mr. Miner opened the public hearing. Eddy Shen, Applicant, received and reviewed a copy of the staff report. Mr. Shen had no questions or comments regarding the conditions of approval. Maria Pan, Neighbor, stated that since the opening of this business there has been a lot of litter on the sidewalk. Andy Kasik, Owner Representative, stated that he does not believe that the trash is a direct result of this business as there are other businesses at this location that has a lot of loitering. He also mentioned that they have never received any complaints regarding this business. Mr. Kasik stated that they are always trying to maintain the property as a whole and is in support of this application. Mr. Miner stated that, in the past, there was in issue regarding the trash enclosure. Mr. Kasik stated that there are two different lots at this location and currently there are no issues with access to the garbage bins. Mr. Miner closed the public hearing. Approved subject to the findings and conditions of approval located in the staff report. The Zoning Administrator noted that the garbage bins be checked during the six-month review. Mr. Miner stated that the decision is final unless appealed to the Planning Commission with payment of the appeal fee within the 15-day appeal period. ADJOURNMENT 2:18 p.m. City of Sunnyvale Page 2
