CALL TO ORDER
PUBLIC HEARINGS

Location: 835 Dartshire Way (APN: 309-12-029)
Applicant / Owner: Ying Wang and Hongliang Yi
Proposed Project:
TENTATIVE PARCEL MAP to allow subdivision of an existing
14,863 square foot lot into two lots - 7,299 square feet (Lot 1)
and 7,564 square feet (Lot 2).
Reason for Permit: A Tentative Parcel Map is required for all
subdivisions that create less than five lots.
Environmental Review: Categorically Exempt from the California
Environmental Quality Act (CEQA) per CEQA Guidelines Section
15315 (Class 15, Minor Land Divisions)

Recommendation: Approve with conditions
Ms. Caruso asked George Schroeder, project planner, if there were any additional
comments.
Mr. Schroeder stated staff would like to request deletion of conditions of approval
BP-16, BP-17, AT-3 from the report. As the project is exempt from such
requirements, the conditions were added as an error. The conditions apply to
multi-family units and would not apply to the applicant. A home is proposed for lot 2
at a future time but is not included in this project application. This current
application is to add a new property line down the middle of the lot. The existing
house is in the process of being remodeled with an approved design review permit
in April. The intent of the remodel was to demolish portions of the existing house to
meet the required setbacks for this proposed property line.
Ms. Caruso inquired about whether the applicant can file the parcel map before
finalization of the construction.
Mr. Schroeder stated city Public Works and Building divisions prefer the

construction be completed to the satisfaction of the city. Staff can continue to work
with applicant to finalize the details of the parcel map, which will not stall any action
on the design review application. Construction permits are currently under review
and act independent on this permit.
Ms. Caruso opened the public hearing.
Richard So, applicant representative and project engineer, requested to modify
condition TM-2 to state the applicant can file a final map as long as all setbacks for
lot 1 have been met and the existing structure has been removed. The applicant is
concerned that waiting for the project to be finalized will hinder the financing for the
developer as well as incur other time delays.
Mr. So inquired on an additional condition of approval BP-10 to state the signed
agreement of the adjacent property owner is not required if the fence and/or
retaining wall is solely on Lot 2.
Joseph Xu, architect, stated the permit for remodel has been approved by the
Building division.
Ms. Caruso closed the public hearing.
Ms. Caruso took the item under advisement to confer with Public Works and
Building divisions regarding the parcel map approval. Ms. Caruso stated staff will
remove conditions BP-16, BP-17, AT-3. Condition BP-10 will be modified to reflect
the applicant's request.
ACTION: The Zoning Administrator approved the project with the below
modifications on May 26th:
1. Deleted three recommended conditions of approval since they were not relevant
to the project - BP-16, BP-17, and AT-3
2. Changed Condition # BP-10 to read: "If a fence and/or retaining wall is proposed
on the shared property line between Lot 2 and 1445 Kingfisher Way, then an
agreement on the final design, signed by the adjacent property owner, shall be
provided prior to issuance of grading permits. This agreement is not required if the
fence and/or retaining wall is solely on Lot 2"
3. Took Condition # TM-2 under advisement until May 26, when the Zoning
Administrator determined the condition as written would remain.

Ms. Caruso stated that the item would be continued indefinitely to further evaluate
revisions to the project.
Seeing no one in attendance, Ms. Caruso opened and closed the public hearing.
ACTION: This item has been continued indefinitely and will be re-noticed once a
date has been determined.
ADJOURNMENT
Ms. Caruso adjourned the meeting at 3:16 p.m.
