City of Sunnyvale Meeting Minutes Zoning Administrator Hearing Wednesday, March 28, 2018 3:00 PM West Conference Room, City Hall, 456 W. Olive Ave., Sunnyvale, CA 94086 CALL TO ORDER Gerri Caruso, Zoning Administrator, called the meeting to order at 3:00 p.m. PUBLIC HEARINGS CONTINUED FROM FEBRUARY 28, 2018 PUBLIC HEARING File #: 2017-7137 Location: 150 Lawrence Station Road (APN: 216-27-052) Applicant / Owner: Costco Wholesale (applicant) / Price Company (owner) Proposed Project: USE PERMIT to allow expansion of the existing Costco Gasoline facility by addition of 10 fueling position to the existing 20 fueling position and expand the existing fuel canopy by 5,652 square feet, resulting in a total of 10,676 square feet area. Reason for Permit: A Use Permit is required to allow modification to the existing Use Permit (2013-7013) for the site. Existing uses are continued to be allowed by the Lawrence Station Area Plan (LSAP). Project Planner: Aastha Vashist, (408) 730-7458, avashist@sunnyvale.ca.gov Issues: Parking and circulation Recommendation: Approve with conditions Ms. Caruso inquired if Aastha Vashist, project planner, had any comments or changes. Mrs. Vashist stated there was one member of the public who commented by email in support of the project and staff's recommendation of designating employee only parking along driving aisles feeding into the gas station. He was concerned about the overall parking, which could be a challenge on site. Ray crump Conflict prevents my attendance today Sent from my iPhone Ms. Caruso opened the hearing to the applicants. Sean Anderson, applicant, stated that he has read and agreed with the conditions but needed further clarification on condition AT-7. He wanted to make sure it referenced to the project plan as opposed to the entire parking lot. John Ellingsen, applicant, requested clarification and changes to condition PS-3. He suggested the last sentence should be moved up to condition PS-1 to reflect the intent to possibly change the employee parking only designation to regular parking should potential queue spillback not happen with the improved operation of the facility. While he will not be pursuing that, the condition should be clear in relation to condition PS-1. Ms. Caruso reiterated the second part of condition PS-3 to be moved to condition PS-1, part b). Ms. Caruso informed the applicant that the way the application was set up as a miscellaneous plan permit is discretionary and is not an automatic approval. Ms. Caruso stated condition PS-2 should state either Planning Commission or Director of Community Development but not both. Since the project will not be going to Planning Commission for approval, it should be deleted from the condition. Ms. Caruso inquired about condition AT-1 with the hours of operation of every day between the hours of 5 a.m. to 10 p.m. City of Sunnyvale Page 2 Zoning Administrator Hearing Meeting Minutes March 28, 2018 Ms. Vashist stated the hours applied to the original use permit for the gas station, to which Mr. Ellingsen stated he would like to maintain those hours. ACTION: Approved subject to the findings and conditions of approval located in the staff report with the following changes: 1) Deletion of “Planning Commission” in PS- 2 2) The point where the statement “6 months after expansion begins” in PS- 3 will be moved to PS-1 and become PS-1 b) 3) The opening sentence will state “The parking lot shall be maintained in accordance with the approved project plans as follows:” in AT-7 ADJOURNMENT Ms. Caruso adjourned the meeting at 3:08 p.m. City of Sunnyvale Page 3
