City of Sunnyvale Meeting Minutes Zoning Administrator Hearing Wednesday, June 27, 2018 3:00 PM West Conference Room, City Hall, 456 W. Olive Ave., Sunnyvale, CA 94086 CALL TO ORDER Gerri Caruso, Zoning Administrator, called the meeting to order at 3:00 p.m. PUBLIC HEARINGS File #: 2017-7961 Location: 435 East McKinley Avenue (APN: 209-11-051) Applicant / Owner: Gary Holmes Architect (applicant) / Meena And William Tapsall (owner) Proposed Project: DESIGN REVIEW for a detached new residential unit on a 7,650-square foot lot with an existing single-family residence. The two-family dwelling is proposed to have 4,121 square foot gross floor area (2,760 square foot existing unit and 1,361 square foot proposed new unit) resulting in 53.8% Floor Area Ratio (FAR). VARIANCE permit is required to allow a 15 feet front yard setback where 20 feet is required for R-2 zoning district. Reason for Permit: A Design Review is required for construction of new residential unit to ensure compliance with the City’s development standards and Single- Family Home Design Techniques. Variance is from the required 20 feet front yard setback. Project Planner: Aastha Vashist, (408) 730-7458, avashist@sunnyvale.ca.gov Issues: Setbacks, neighborhood compatibility Recommendation: Approve with conditions Ms. Caruso inquired if Aastha Vashist, project planner, had any comments or changes to the staff report. Mrs. Vashist stated prior to the hearing, a neighbor had a question about the setback for the existing single family home. Since the setback has not changed, Mrs. Vashist explained that it was legally non-conforming. There were no other comments from the public. Ms. Caruso opened the hearing to the applicant. He had no comments other than to thank Aastha for her work on the project. Ms. Caruso opened the hearing to the public. As there were no members of the public who wanted to speak, Ms. Caruso closed the hearing. ACTION: Approved subject to the findings and conditions of approval located in the staff report. File #: 2017-8061 Location: 1296 Sunnyvale Saratoga Road (APN: 211-34-013) Applicant / Owner: FirstElement Fuel/ Deanza Family, LP Proposed Project: Special Development Permit: A request to add a hydrogen fueling dispenser and associated hydrogen equipment and enclosure to an existing gas service station with convenience store. Reason for Permit: The application is submitted pursuant to SMC: 19.20.030, (Permitted, Conditionally Permitted and Prohibited Uses in Commercial Zoning Districts), 19.26.030 (PD combining district), and 19.90 (Special Development Permit). The proposed hydrogen fueling station requires a Minor Special Development Permit and requires Zoning Administrator review and approval. Project Planner: Cindy Hom, 408-730-7411, chom@sunnyvale.ca.gov Issues: Proximity to sensitive receptors, Setbacks, Recommendation: Approve with conditions subject to the findings and conditions of approval. Ms. Caruso inquired if Cindy Hom, project planner, had any comments or changes to the staff report. Ms. Hom clarified the setback for the front landscaping is measured from the right of way line, adjusted in 2008, versus the property line that is shown in the electronically distributed site plan. There were no comments received from the public. Kristi Kandel, applicant, stated she has worked with city staff for some time and believes the project offers solutions for everyone. Ms. Caruso opened the hearing to the public. As there were no members of the public who wanted to speak, Ms. Caruso closed the hearing. ACTION: Approved subject to the findings and conditions of approval located in the staff report. Ms. Kandel inquired if the appeal period of 15 days were business days only or calendar days to which Ms. Caruso replied it was calendar days.
