CALL TO ORDER
George Schroeder, Zoning Administrator, called the meeting to order at 3:00 p.m.
PUBLIC HEARINGS
1. Proposed Project: Related applications on a 0.75-acre site:
USE PERMIT to allow multiple ownership in an industrial zoning district,
and;
TENTATIVE PARCEL MAP to subdivide an existing one-story meeting
facility/place of assembly for a fraternal organization (Moose Lodge) into
two condominium units. The project does not include a change of use nor
would it alter the site layout or building size.

Environmental Review: Class 1 Categorical Exemption relieves this
project from the California Environmental Quality Act (CEQA) provisions.

Mr. Schroeder inquired with Robby Miller, Project Planner, if there were any
additions to the staff report or comments.
Mr. Miller stated the project was noticed and no comments were received. Mr. Miller
noted an owner-representative provided comments on the recommended conditions
of approval.
Julia Klein, Principal Planner, explained the following modifications to conditions
GC-3, GC-6, GC-11, and TM-1:

GC-3. ENTITLEMENTS—DISCONTINUANCE AND EXPIRATION:
The Use Permit shall expire if discontinued for a period of one year or more. [SDR]

GC-6. CONFORMANCE WITH PREVIOUS PLANNING PERMIT:
This approval is only for the Tentative Parcel Map and associated Use Permit and
shall not be construed as an approval for any modifications of landscaping, parking,
floor plan layout, or architecture. The previously approved planning applications
(i.e., 2022-7500, PLNG-2023-0167, and PLNG-2023-0821) remain in effect for this
site including all conditions of approval, unless modified through this planning
application. [PLANNING] [COA]
GC-11. RECORDATION OF PARCEL MAP:
This project is subject to, and contingent upon recordation of a parcel map. The
submittal, approval and recordation of the parcel map shall be in accordance with
the provisions of the California Subdivision Map Act and Sunnyvale Municipal Code
Title 18 Subdivision requirements. Parcel map shall be recorded prior to any
grading or building permit issuance related to the subdivision associated with File
#PLNG-2023-0353. [COA] [PUBLIC WORKS]
TM-1.
c) The developer shall maintain all private utilities and landscaping
following installation of such improvements until the improvements are transferred to
an owners association, at which time the owners association will assume
maintenance obligations.
Mr. Schroeder inquired if the subdivision would occur on the black line where Unit 1
was listed on the plans.
Mr. Miller confirmed that was the location of the subdivision and that it was an
airspace and not a physical lot, but a condo.
Mr. Schroeder inquired with the applicant if they had any updates or comments. He
asked the applicants to provide context on why the condo was requested.
Beatriz Esquivel, applicant, stated the location was acquired to replace an existing
location and the intention was like for like within square footage. This location had
surplus space, so the decision to subdivide was made. There was no intended use
for the space.

Mr. Schroder inquired if there would be any changes to the site or parking
otherwise.
Ms. Esquivel confirmed there would be no other changes to the site or parking.
Mr. Schroeder opened the hearing to public comments

ACTION: Approve the Use Permit and Tentative Parcel Map with modifications to
Conditions: GC-3, GC-6, GC-11, and TM-1.
ADJOURNMENT
Mr. Schroeder adjourned the hearing at 3:11 p.m.
