PROCEEDINGS OF THE REGULAR COMMON COUNCIL MEETING SUPERIOR, WISCONSIN Wednesday, April 3, 2024 The Regular Meeting of the Common Council was called to order by Mayor Jim Paine at 6:31 p.m. in the Government Center, Board Room 201. 1. PLEDGE OF ALLEGIANCE 2. ROLL CALL Present: Nick Ledin, Jenny Van Sickle, Garner Moffat, Jack Sweeney (virtual), Brent Fennessey, Tylor Elm, Mike Herrick, Mark Johnson (virtual), Lindsey Graskey - 9 Absent: Ruth Ludwig Also Present: Mayor Paine, City Attorney Prell, City Clerk Blunt, Becky Scherf, Deputy City Clerk Bacon 3. PRESENTATIONS AND PUBLIC HEARINGS 4. APPROVAL OF MINUTES 4.1 March 19, 2024 - Regular Council Meeting There was no objection to Councilor Graskey’s request to amend the title of the minutes to read “PROCEEDINGS OF THE REGULAR COMMON COUNCIL MEETING” MOTION TO APPROVE, by Councilor Herrick, was seconded by Councilor Elm and carried. 5. CORRESPONDENCE TO BE FILED (No action) 5.1 CLAIMS referred to the Liability Claims Committee by City Clerk’s Office: 1. Claim No. 24-03, Shalynn Rask for Simko Acquisition, LLC. (Received 03/28/2024). 6. MAYOR’S REPORT 6.1 Report from Mayor Paine 7. STANDING COMMITTEE REPORTS 7.1 Human Resources Committee (Meeting held March 18,2024) No Report from the Chair. RECOMMENDATIONS: 7.1.1 Approve WPPA Police Union Contract for years 2024 through 2025. MOTION TO APPROVE, by Councilor Herrick, was seconded by Councilor Fennessey and carried. 1 Regular Council Meeting April 3, 2024 7.1.2 Approve job description and pay grade for Information Technology Director. MOTION TO APPROVE, by Councilor Graskey, was seconded by Councilor Moffat and carried. 7.1.3 Approve request to fill new Coordinated Response Specialist position in the Police Department. MOTION TO APPROVE, by Councilor Graskey, was seconded by Councilor Van Sickle and carried. 7.1.4 Approve job description and pay grade for the new Facilities and Construction Manager position. MOTION TO APPROVE, by Councilor Ledin, was seconded by Councilor Elm and carried. 7.2 Public Works Committee (No meeting to report) 7.3 Finance Committee (Meetings held March 14, 2024) Report from the Co-Chair Elm. RECOMMENDATIONS: 7.3.1 Approve the 2024 Grant Application for the Humane Society of Douglas County in the amount of $170,000. MOTION TO APPROVE, by Councilor Elm, was seconded by Councilor Herrick and carried. 7.3.2 Approve the Facility Agreement with the Humane Society of Douglas County. MOTION TO APPROVE, by Councilor Herrick, was seconded by Councilor Elm and carried. 7.4 Licenses and Fees Committee (No meeting to report) 7.5 Public Safety Committee (Meeting held 21, 2024) Report from Councilor Elm. RECOMMENDATIONS: 7.5.1 Approval of O24-4341, an ordinance amending City Code Chapter 112, Traffic Code, Schedule E, Section 2, No Parking Between Signs, Add at 19th Avenue E “South of East 5th” for a distance of 30 feet in front of the centralized mailbox. MOTION TO APPROVE, by Councilor Elm, was seconded by Councilor Herrick and carried. 7.5.2 Approval of the purchase of a Rosenbauer RTX EV Fire Engine in the amount of $1,853,702. 2 Regular Council Meeting April 3, 2024 MOTION TO APPROVE, by Councilor Moffat, was seconded by Councilor Van Sickle. MOTION TO REFER to the Public Safety Committee, by Councilor Johnson, was seconded by Councilor Fennessey and carried by roll call vote: Aye – 8 Ledin, Van Sickle, Sweeney, Fennessey, Elm, Herrick, Johnson, Graskey No – 1 Moffat 7.6 Committee of the Whole Meeting (No meeting to report) 8. SPECIAL COMMITTEE REPORTS 8.1 REPORTS WITH RECOMMENDATIONS 8.1.1 Plan Commission (Meeting held March 20, 2024) Report from Mayor Paine. ITEMS NOT RECOMMENDED: 8.1.1.1 Approve R24-13787, a resolution introduced by the Department of Planning and Development to set a public hearing to consider the vacation and discontinuance of certain streets and alleys referred to in the resolving clause of this resolution and providing for a public hearing thereon. 8.1.1.2 Approve R24-13786, a resolution introduced by the Department of Planning and Development to set a public hearing to consider an amendment to City of Superior’s 2040 Comprehensive Plan. 8.1.1.3 Approve R24-13788, a resolution introduced by the Department of Planning and Development to set a public hearing to consider an amendment to City Code Chapter 122, Zoning; and Zoning Map for the City of Superior. There was no objection to the Mayor’s request to allow Business by the Public comments before item discussion. Members of the public spoke both for and against the Nemadji Trail Energy Center (NTEC) development. MOTION TO APPROVE items 8.1.1.1, 8.1.1.2, and 8.1.1.3, by Councilor Fennessey, was seconded by Councilor Herrick and failed by roll call vote: Aye – 5 Sweeney, Fennessey, Elm, Herrick, Johnson No – 4 Ledin, Van Sickle, Moffat, Graskey 8.1.2 Parks & Recreation Commission (Meetings held March 14, 2024 and March 21, 2024) Report from the Councilor Ledin. RECOMMENDATIONS from March 21, 2024 meeting: 8.1.2.1 Approve the 2024 Recreational Grants. MOTION TO APPROVE, by Councilor Ledin, was seconded by Councilor Moffat, and carried. 8.2 REPORTS SANS RECOMMENDATIONS 8.2.1 Police & Fire Commission (Meeting held March 13, 2024) No Report from the Chair. 9. OLD BUSINESS 9.1 CITY CLERK BLUNT is recommending approval of an original “Class B” Beer and Liquor license application for Alyce’s Palace, LLC. located at 1108 Tower Avenue (Gary Nelson, 4 Regular Council Meeting April 3, 2024 Agent) for a period beginning January 1, 2024 through June 30, 2024. MOTION TO APPROVE, by Councilor Fennessey, was seconded by Councilor Johnson. MOTION TO POSTPONE, by Councilor Ledin, was seconded by Councilor Graskey, and carried. 10. NEW BUSINESS 10.1 CITY CLERK BLUNT is recommending approval of a Temporary Class “B” Beer License application for the Duluth Sail and Power Squadron located at 1 44th Avenue East (Agent: Amy Einbu) for the “Captain’s Platter Fishing Contest” event to be held on June 8, 2024. MOTION TO APPROVE, by Councilor Herrick, was seconded by Councilor Moffat, and carried. 10.2 CITY CLERK BLUNT is recommending approval of a Temporary Class “B” Beer License application for the Superior Area Jaycee’s Inc. located at 2701 Caitlin Avenue (Agent: Mackenzie Reykdal) for the “Gitchee Gumee Brewfest” event to be held on April 6, 2024. MOTION TO APPROVE, by Councilor Fennessey, was seconded by Councilor Herrick, and carried. 10.3 CITY CLERK BLUNT is recommending approval of a Temporary Class “B” Beer License application for the Acacia-Itasca Lodge #329 located at 3903 N. 18th Street (Agent: Laurel A. Humphrey) for the “Steppin Up for Dyslexia” event to be held on April 12, 2024. MOTION TO APPROVE, by Councilor Fennessey, was seconded by Councilor Moffat, and carried. 10.4 CITY CLERK BLUNT is recommending approval of a Temporary Class “B” Beer License application for the Western Lake Superior Trolling Assc. located at Barker’s Island Fisherman’s Parking Lot (Agent: James VanLaudschoot) for the “Jaw’s Derby” event to be held May 30th through June 2nd, 2024. MOTION TO APPROVE, by Councilor Fennessey, was seconded by Councilor Moffat, and carried. 10.5 PUBLIC WORKS DIRECTOR JANIGO recommends approval of O24-4340, an ordinance amending City Code Chapter 112, Traffic Code, Schedule J, Accessible Parking Zones, Remove Accessible Parking sign at 2324 Ogden Avenue (do not block sidewalk). MOTION TO APPROVE, by Councilor Moffat, was seconded by Councilor Elm, and carried. 10.6 PUBLIC WORKS DIRECTOR JANIGO recommends approval of O24-4342, an ordinance amending City Code Chapter 112, Traffic Code, Schedule J, Accessible Parking Zones, Add Accessible Parking sign at 3321 North 19th Street (both sides). MOTION TO APPROVE, by Councilor Herrick, was seconded by Councilor Moffat, and carried. 10.7 FINANCE DIRECTOR RHINEHART recommends approval of R24-13785, a resolution providing for Issuance and Sale of General Obligation Promissory Notes, Series 2024B, of the City of Superior, Wisconsin. MOTION TO APPROVE, by Councilor Moffat, was seconded by Councilor Herrick, and carried. 5 Regular Council Meeting April 3, 2024 10.8 CITY CLERK BLUNT is recommending approval of miscellaneous licenses. MOTION TO APPROVE, by Councilor Elm, was seconded by Councilor Moffat, and carried. 11. BUSINESS BY PUBLIC Councilor Graskey would like to wish Councilor Ludwig a Happy Birthday.
