PROCEEDINGS OF THE REGULAR COMMON COUNCIL MEETING SUPERIOR, WISCONSIN Tuesday, June 4, 2024 The Regular Meeting of the Common Council was called to order by Mayor Jim Paine at 6:30 p.m. in the Government Center, Board Room 201. 1. PLEDGE OF ALLEGIANCE 2. ROLL CALL Present: Nick Ledin, Jenny Van Sickle, Garner Moffat, Jack Sweeney, Brent Fennessey, Tylor Elm, Ruth Ludwig, Mike Herrick, Mark Johnson, Lindsey Graskey - 10 Absent: Also Present: Mayor Paine, City Clerk Blunt, Chief of Staff Scherf, Deputy City Clerk Bacon 3. PRESENTATIONS AND PUBLIC HEARINGS 4. APPROVAL OF MINUTES 4.1 May 21, 2024 - Regular Council Meeting MOTION TO APPROVE, by Councilor Herrick, was seconded by Councilor Elm and carried. 5. CORRESPONDENCE TO BE FILED (No action) 6. MAYOR’S REPORT 6.1 Report from Mayor Paine 7. STANDING COMMITTEE REPORTS 7.1 Human Resources Committee (Meeting held May 20, 2024) Report from Councilor Van Sickle. 7.2 Public Works Committee (No meeting to report) 7.3 Finance Committee (No meeting to report) 7.4 Licenses and Fees Committee (No meeting to report) 7.5 Public Safety Committee (No meeting to report) 7.6 Committee of the Whole Meeting (Meeting held May 30, 2024) No report from the Chair. 1 Regular Council Meeting June 4, 2024 8. SPECIAL COMMITTEE REPORTS 8.1 REPORTS WITH RECOMMENDATIONS 8.1.1 Parks & Recreation Commission (Meeting held May 23, 2024) Report from Councilor Ledin. RECOMMENDATIONS: 1. Approve the Lighting Upgrades contract to Electro Mechanical Contracting, Inc. in the amount of $287,059.36. MOTION TO APPROVE, by Councilor Ledin, was seconded by Councilor Ludwig and carried. 2. Approve the trails plan agreement with Cyclists of Gitchee Gumee Shores, Incorporated. MOTION TO APPROVE, by Councilor Ledin, was seconded by Councilor Graskey. MOTION TO REFER to Urban Forestry Tree Board Committee, by Councilor Ludwig, was seconded by Councilor Graskey, and carried. 8.1.2 Wisconsin Point Committee (Meeting held May 29, 2024) Report from the Chair. RECOMMENDATIONS: 1. Approve the Visitor Use-Assessment Agreement with Legacy Works Group in the amount of $40,000.00. MOTION TO APPROVE, by Councilor Ludwig, was seconded by Councilor Ledin and carried. 8.2 REPORTS SANS RECOMMENDATIONS 8.2.1 Historic Preservation Committee (Meeting held May 22, 2024) No report from the Chair. 8.2.2 Assessment Board of Review (Meeting held May 29, 2024) No report from the Chair. 9. OLD BUSINESS 9.1 Intent to Terminate Superior Public Museums Memorandum of Understanding. MOTION TO APPROVE with intent to terminate in ninety days, by Councilor Sweeney, was seconded by Councilor Graskey. 2 Regular Council Meeting June 4, 2024 MOTION TO AMEND with intent to terminate on October 1, 2024, by Councilor Johnson, was seconded by Councilor Herrick and carried by roll call vote with Mayor Paine voting in favor of the motion by breaking a tie vote: Aye – 5, Ledin, Fennessey, Ludwig, Herrick, Johnson, Paine No – 5, Van Sickle, Moffat, Sweeney, Elm, Graskey There was no objection to pause discussions and allow public comment. Katelyn Bauman spoke in favor of keeping the current MOU until a contract is in place. Discussion resumed regarding the MOTION TO AMEND. MOTION TO APPROVE as AMENDED carried via voice vote. 10. NEW BUSINESS 10.1 CITY CLERK BLUNT is recommending approval of miscellaneous licenses. MOTION TO APPROVE, by Councilor Johnson, was seconded by Councilor Herrick and carried. 10.2 CITY CLERK BLUNT is recommending approval of an Amend the Premise and One- Day Cabaret license application for Dodgies East End Tavern, LLC, located at 2114 E 5th Street (Agent: Michael C. Dodge), for a retirement party on June 8, 2024. MOTION TO APPROVE, by Councilor Fennessey, was seconded by Councilor Sweeney and carried. 10.3 CITY CLERK BLUNT is recommending approval of an Amend the Premise license application for Hudy’s Bar, located at 2126 E 5th Street (Agent: James Ronning), for the event “Kick Off Summer Bash” on June 22, 2024. MOTION TO APPROVE, by Councilor Sweeney, was seconded by Councilor Fennessey and carried. 10.4 CITY CLERK BLUNT is recommending approval of a Request for Unlimited Transfer of Full-Service Retail Outlet by Producer Earth Rider Brewing for the event “Superior Choice Credit Union Lot Party’ located at 2817 Tower Avenue, on June 22, 2024 from 4:00 p.m. to 9:00 p.m. for the on-premise consumption of beer. MOTION TO APPROVE with corrected date of June 20, 2024, by Councilor Fennessey, was seconded by Councilor Herrick and carried. 10.5 CITY CLERK BLUNT recommending approval of the Preliminary 2024-2025 Alcohol Report. MOTION TO APPROVE, by Councilor Ledin, was seconded by Councilor Moffat and carried. 3 Regular Council Meeting June 4, 2024 11.
