PROCEEDINGS OF THE LIABILITY CLAIMS COMMITTEE MEETING CITY OF SUPERIOR June 20, 2022 ROLL CALL Members present: Chad Matushak, Amanda Foster and Tom Kurtz Members excused: Mike Hood and John Vaski Staff Present: City Attorney Frog Prell, Paralegal Heather Peterson, Russ Behlings, Darienne McNamara and Erin Abrahamson Staff excused: Human Resources Director Cammi Koneczny and Finance Director Ashley Puetz There being a quorum present, the meeting was called to order at 3:30 p.m. and the following items were discussed: MOTION by Matushak, seconded by Kurtz, to approve minutes of the May 4, 2022 meeting. Motion passes. Scott Carlson spoke to his claim, #22-07. Jessica Tapani spoke to claim #22-08, Mahkahta Consulting & Development. Felicia Swenson & Diane Brook spoke to claim #22-09. MOTION by Matushak, seconded by Kurtz to move into closed session under Wis. Stat. 19.85(g) at 3:54 p.m. Motion passes. MOTION by Kurtz, seconded by Matushak to reconvene in open session at 4:00 p.m. Motion passes. MOTION by Kurtz, seconded by Foster to pay claim #22-07, Scott Carlson, in exchange for Release of All Claims & W-9. Motion passes unanimously. MOTION by Matushak, seconded by Kurtz to receive and file claim #22-08, Mahkahta Consulting & Development Corp. Motion passes unanimously. MOTION by Foster, seconded by Matushak to deny claim #22-09, Michael & Felicia Swenson. Motion passes unanimously. Wis. Stat. 19.85(g) Exemptions (1) Any meeting of a governmental body, upon motion duly made and carried, may be convened in closed session under one or more of the exemptions provided in this section. The motion shall be carried by a majority vote in such manner that the vote of each member is ascertained and recorded in the minutes. No motion to convene in may be adopted unless the chief presiding officer announces to those present at the meeting at which such motion is made, the nature of the business to be considered at such closed session, and the specific exemption or exemptions under this subsection by which such closed session is claimed to be authorized. Such announcement shall become part of the record of the meeting. No business may be taken up at any closed session except that which relates to matters contained in the chief presiding officer’s announcement of the closed session. A closed may held for any of the following purposes: (g) Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved. MOTION by Matushak, seconded by Foster to receive and file claim #22-10, Notice of Injury of Damian Cole. Motion passes unanimously. MOTION Matushak, seconded by Kurtz to pay claim #22-11, Monica Knauf, in exchange for Release of All Claims & W-9. Motion passes unanimously. MOTION by Matushak, seconded by Foster to pay claim #21-14, American Family on behalf of Eric Altman in exchange for Release of All Claims & W-9. MOTION by Kurtz, seconded by Matushak to adjourn at 4:10 p.m. Wis.
