PROCEEDINGS OF THE LIABILITY CLAIMS COMMITTEE MEETING CITY OF SUPERIOR October 20, 2022 ROLL CALL Members present: Amanda Foster, Michael Hood, Thomas Kurtz, John Vaski Members excused: Chad Matushak Staff Present: City Attorney Frog Prell, Paralegal Starr Bowers Staff excused: There being a quorum present, the meeting was called to order at 4:00 p.m. and the following items were discussed: MOTION by Hood, seconded by Kurtz, to approve minutes of the June 20, 2022 meeting. Motion passes. No Claimants appeared to speak MOTION by Hood, seconded by Vaski, to move into closed session under Wis. Stat. 19.85(g) at 4:02 p.m. Motion passes. CVMIC rep Allison DeFranze was called to be present in the meeting. MOTION by Hood, seconded by Kurtz, to receive and file claim #22-11, Monica Knauf. Motion passes unanimously. MOTION by Hood, seconded by Vaski, to deny claim #22-12, Cole Matson. Motion passes unanimously. MOTION by Foster, seconded by Hood, to deny claim #22-13, Scott Hill. Motion passes unanimously. MOTION by Kurtz, seconded by Hood, to deny claim #22-14, Stephen Gee. Motion passes unanimously. MOTION by Hood, seconded by Vaski, to pay claim #22-15, Charles Harmon, upon receipt of a signed waiver from Charles Harmon. Motion passes unanimously. Wis. Stat. 19.85(g) Exemptions (1) Any meeting of a governmental body, upon motion duly made and carried, may be convened in closed session under one or more of the exemptions provided in this section. The motion shall be carried by a majority vote in such manner that the vote of each member is ascertained and recorded in the minutes. No motion to convene in may be adopted unless the chief presiding officer announces to those present at the meeting at which such motion is made, the nature of the business to be considered at such closed session, and the specific exemption or exemptions under this subsection by which such closed session is claimed to be authorized. Such announcement shall become part of the record of the meeting. No business may be taken up at any closed session except that which relates to matters contained in the chief presiding officer’s announcement of the closed session. A closed may held for any of the following purposes: (g) Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved. MOTION by Kurtz, seconded by Foster, to pay claim #22-16, Patricia Olson, upon receipt of a signed waiver from Patricia Olson. Motion passes unanimously. MOTION by Hood, seconded by Vaski, to pay claim #22-17, Bradley and Jennifer Massengill, upon receipt of a signed waiver from USAA General Indemnity Company, via Clerkin, Sinclair & Mahfouz, LLP as their attorney, on behalf of Bradley and Jennifer Massengill. Motion passes unanimously. MOTION by Hood, seconded by Vaski, to reconvene into open session at 4:18 p.m., at which time all committee decisions were announced. MOTION by Kurtz, seconded by Foster, to adjourn at 4:19 p.m. Wis.
