PROCEEDINGS OF THE LIABILITY CLAIMS COMMITTEE MEETING CITY OF SUPERIOR January 19, 2023 ROLL CALL Members present: Amanda Foster, Michael Hood, Chad Matushak Members excused: Thomas Kurtz, John Vaski Staff Present: City Attorney Frog Prell, Paralegal Starr Bowers, Chief Building Inspector Pete Kruit Staff excused: Human Resources Director Cammi Konecnzy and Finance Director Nicholas Rhinehart There being a quorum present, the meeting was called to order at 4:00 p.m. and the following items were discussed: MOTION by Hood, seconded by Matushak, to approve minutes of the October 20, 2023, meeting. Motion passes. Brad Turnboom and Char Kastern Turnboom spoke in person to the committee regarding their Claim #22-18 MOTION by Hood, seconded by Matushak to move into closed session under Wis. Stat. 19.85(g) at 4:06 p.m. Motion passes. CVMIC rep Allison DeFranze was called to be present in the meeting. CIC rep Mark Koch was called to be present in the meeting. MOTION by Hood, seconded by Matushak, to pay claim #22-18, Brad Turnboom and Char Kastern-Turnboom, in the amount of $31,473.00, upon receipt of a release of all claims. Motion passes unanimously. MOTION by Hood, seconded by Matushak, to pay claim #22-16, Patricia Olson, in the amount of $565.80, upon receipt of a release of all claims. Motion passes unanimously. MOTION by Matushak, seconded by Hood, to pay claim #22-19, Wisconsin Mutual Insurance, c/o Carrie Van Riper, upon receipt of a release of all claims. Motion passes unanimously. Wis. Stat. 19.85(g) Exemptions (1) Any meeting of a governmental body, upon motion duly made and carried, may be convened in closed session under one or more of the exemptions provided in this section. The motion shall be carried by a majority vote in such manner that the vote of each member is ascertained and recorded in the minutes. No motion to convene in may be adopted unless the chief presiding officer announces to those present at the meeting at which such motion is made, the nature of the business to be considered at such closed session, and the specific exemption or exemptions under this subsection by which such closed session is claimed to be authorized. Such announcement shall become part of the record of the meeting. No business may be taken up at any closed session except that which relates to matters contained in the chief presiding officer’s announcement of the closed session. A closed may held for any of the following purposes: (g) Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved. MOTION by Hood, seconded by Matushak, to pay claim #22-20, Ashley McGuire in the amount of $7,302.76, upon receipt of a release of all claims. Motion passes unanimously. MOTION by Matushak, seconded by Foster, to pay claim #22-21, Kevin Johnson, upon receipt of a release of all claims. Motion passes unanimously. MOTION by Hood, seconded by Matushak, to pay claim #23-02, GEICO a/s/o Kevin Johnson, upon receipt of a release of all claims. Motion passes unanimously. MOTION by Matushak, seconded by Foster, to deny claim #23-01, Linell Evans o/b/o the Estate of Michael Evans; c/o Dworkin & Maciariello. Motion passes unanimously. CVMIC rep Allison DeFranze ended phone call. CIC rep Mark Koch ended phone call. MOTION by Hood, seconded by Matushak to reconvene into open session at 4:26 p.m., at which time all committee decisions were announced.
