License and Fees Committee Meeting Proceedings City of Superior, Wisconsin The meeting was called to order by Clerk Ramos at 2:01 pm on October 20, 2021 in Government Center Room 204. 1. Roll Call COUNCILORS PRESENT: Brent Fennessey, Jack Sweeney, Craig Sutherland & Lindsey Graskey (Alternate) CITY STAFF PRESENT: City Clerk Ramos, Chief of Staff Raverty, City Attorney Prell 2. Selection of Committee President and Vice President. Motion by Councilor Sweeney, seconded by Fennessey and carried by unanimous voice vote, to elect Councilor Sutherland as Committee President. Motion by Councilor Sweeney, seconded by Sutherland and carried by unanimous voice vote, to elect Councilor Fennessey as Committee Vice President. 3. Review of committee mission statement and regular meeting schedule. No action taken by the committee members who agreed to convene each month, if necessary, as scheduled in the Boards, Commissions & Committees Directory. 4. City Clerk Ramos is recommending the approval of an Outdoor Alcohol Consumption License application for JamRock Cultural Restaurant, LLC (Agent: Antonio O’Neil), located at 1901 Tower Avenue, for the 2021-2022 license period, expiring June 30, 2022. City Attorney Prell reported that both the Police and Fire Departments are recommending the committee postpone making a decision on whether to issue the supplemental liquor licenses to JamRock due to ongoing investigations. Motion by Councilor Sweeney, seconded by Councilor Sutherland and carried, to allow Police Department & Fire Department a month to complete their investigations and report back to the committee. 5. City Clerk Ramos is recommending the implementation of late fee schedule for renewable licenses issued by the City Clerk’s Office. Motion by Councilor Sweeney, seconded by Councilor Fennessey and carried, to implement a late fee, which equals 50% of the total application fee, for all annual miscellaneous licenses maintained by the clerk’s office. Licenses & Fees Committee Meeting, 10/20/2021 Page 1 of 2 Motion by Councilor Fennessey, seconded by Councilor Sweeney and carried, to allow licensees a grace period of 5 business days to submit their renewal paperwork and avoid an additional late fee. Motion by Councilor Fennessey, seconded by Councilor Sweeney and carried, to set a minimum late fee of $25. Motion by Councilor Fennessey, seconded by Councilor Sweeney and carried, to establish an additional fee, equal to 50% of the total application fee, to reinstate a license after 15 business days. Councilor Fennessey left the meeting after this vote. 6. Review of Licenses issued by the City Clerk’s Office, and their applications. The City Clerk’s Office will be updating license applications to include all the city code and state statute requirements and supplying them to the committee for review at future committee meeting(s). No action taken. 7. Brainstorming for future meeting topics. Ccommittee members requested that the clerk check in with Assistant Finance Director Deb Kamunen, who has been reviewing fees for licenses maintained by the city. No action taken. 8. We already have a special assessment fees in place but not the rush fees. Camila is working on license renewals right now so we can get a handle on how many late ones we had this month. I am thinking the March L&F meeting would provide us with a little more time to check with the other municipalities regarding their late fee policy/ordinance. We will be tied up getting absentee ballots out early next week. We had discussed preparing some documentation for special assessment fees, special assessment rush fees, and late fees for licenses. When do you think would be a good time to start pulling this information together? When does License and Fees meet next? I would like to get this proposal in front of them in the next couple months for sure to begin the discussion, and am happy to help pull together the proposal/documentation. I am guessing we will need any ordinance or policy that currently exists relating to these fees, comparisons from other municipalities with WI (which I have a spread sheet of some for special assessments), and a memo proposing why now, comps, potential savings/revenue, and the policy outcome. Not sure if these are numbers we have, but how many special assessments are done and how many on a ‘rush’ as we wish to define it, and how many late license renewals your dept. has had to track down over the last 5ish years. I’ll never forget the shocked looks on everyone’s faces in my Clerks Institute budgeting class a couple years ago when I told them that we didn’t have either in place. They weren’t shocked to learn that I was spending an enormous amount of my time chasing down late renewals and processing multiple batches of these renewals simply because there was no real incentive for the licensees to submit their paperwork in a timely manner. And, although the City Clerk’s office charges a special assessment fee if the parcel in question has an outstanding alley assessment balance that they want to pay in full, I learned that most municipalities charge a special assessment fee regardless of whether or not there is an outstanding balance. Some even charge an additional $25-75 RUSH fee for special assessment inquiries which they require in less than 48 hours. Also, because the majority of these requests usually come from mortgage companies, some municipalities even have an special account set up so that their special assessment fees are automatically withdrawn when their requests are processed. Just a new possible revenue stream to consider. Thanks for listening. If they don’t renew on time, they have to submit a new application and pay a much higher rate. (And check out the “Cool Fee Schedule” which is also nice because of the precise rates are listed, but it also makes me glad I don’t work there.) I would also like to add an “Approval Required” column like the one in the Madison Fee Schedule. AND I would also like to break our list of licenses into 2 grids—one for those that expire in June and another for those that expire in December. Here’s some copy to get us started: All businesses are responsible for the timely filing of annual business license renewal applications and payments, which must be received or postmarked by their respective due dates. If you are filing after your due date, your renewal application cannot be accepted without an accompanying late fee. There is a grace period prior to penalties being applied.
