The meeting was called to order by Councilor Fennessey at 1:05 pm on June 13, 2022 in Government Center
Room 204.

MOTION by Vice-Chair Graskey to approve, seconded by Chair Fennessey and carried.

3.1 Review of Former License Type Assignments:
3.1.1 Sales & Business Licenses – Chair Fennessey
There was no objection to Chair Fennessey’s recommendation to focus on the Sales and Business
set of city licenses, and leave the other three sets of licenses for future meetings.
Discussion regarding the health inspection approval required by our city code led to various
questions that would be better answered by health department staff.
At present, the city clerk’s office charges applicants of multiple city licenses
(hotel/motel/rooming house, mobile/manufactured home court, massage therapy business, tattoo
establishment) a $15 health inspection fee, which the county later obtains by invoicing the city
a $15 fee for each inspection.
Councilors requested that Clerk Ramos extend an invitation to a representative of the Douglas
County Health Department for the July meeting, to determine whether there is any way that the
county obtain that $15 health inspections fee directly from the applicant in going forward, when
applicable.
MOTION by Vice-Chair Graskey to postpone action until meeting with the health inspector,
seconded by Chair Fennessey and carried.

4 NEW BUSINESS
4.1 Review of Short-Term Rental (STR) Proposed Ordinance and License Application
Mayor Paine explained that licensing short-term rentals with a nominal fee ensures that property
owners are collecting the appropriate taxes. He also advised that online vacation rental
marketplaces like VRBO and AirBnB confirm property owners license their rentals before they
are listed, if the local code requires a city license.
Chair Fennessey asked that the cap be removed until the city, with input from the Housing Task
force if possible, verifies that limiting the number of short-term rentals in the city would be
beneficial to the city in some manner.
MOTION by Chair Fennessey to eliminate section 74-308(b), seconded by Vice-Chair Graskey
and carried.
MOTION by Chair Fennessey to strike “(for 3 months of less)” from section 74-305(a),
seconded by Vice-Chair Graskey and carried.
MOTION by Chair Fennessey, seconded by Vice-Chair Graskey and carried, to change the first
line in section 74-305(a) as follows: “All applications must be filed with applicable filing fee;
applications filed after May 1 of each year will be subject to a $25 late fee.”
MOTION by Chair Fennessey to replace “individual and $1,000,000.00 aggregate” with
“occurrence” in section 74-304(c), seconded by Vice-Chair Graskey and carried.
MOTION by Chair Fennessey to have the annual license term to begin on January 1 and expire
on December 31—replace “July 1” with “January 1” in section 74-305(b), and “May 1” with
“November 1” in section 74-305(c)—seconded by Vice-Chair Graskey and carried.
MOTION by Chair Fennessey to replace “June 30” with “December 31” in section 74-304(1),
seconded by Vice-Chair Graskey and carried.
MOTION by Chair Fennessey to approve the ordinance as amended, seconded by Vice-Chair
Graskey and carried.
4.2 City Clerk Ramos is recommending the approval of Outdoor Alcohol Consumption
license renewals for the 2022-2023 license period.
Mayor Paine advised that Vice-Chair Graskey might need to abstain from action on this item.
There was no objection to Chair Fennessey’s request to suspend the rules and consider Item 4.3
while the mayor consulted Attorney Prell.

Mayor Paine promptly informed the committee that Attorney Prell agreed. When Vice-Chair
Graskey abstained, the committee lost quorum and was unable to make a recommendation.

4.3 City Clerk Ramos is recommending the approval of an [Outdoor] Alcohol
Consumption License application (due to updated site plan) for Dodgie’s East End
Tavern, located at 2114 E 5th Street, for the 2022-2023 license period, expiring
June 30, 2022.
MOTION by Vice-Chair Graskey to approve, seconded by Chair Fennessey and carried.
4.4 City Clerk Ramos is recommending the approval of Sidewalk Café and Outdoor
Alcohol Consumption License applications for Ride or Die Pizzeria, LLC, located at
1623 Broadway Street, for the 2022-2023 license period, expiring June 30, 2022.
MOTION by Chair Fennessey to approve, seconded by Vice-Chair Graskey and carried.
4.5 Clarify 1-Day Cabaret License Requirements
Chair Fennessey and Vice-Chair Graskey agreed that 1-day Cabaret licenses should be issued at
the discretion of the city clerk—when there isn’t enough time for Council approval—as long as
the Police Department and Fire Department are notified of the event.
Clerk Ramos will be supplying the committee with a proposed ordinance update at their July
meeting.

4.6 Propose Future Meeting Topics
1. Recap sales and business licenses after discussion with health department representative.
2. Initial run through on second set of licenses—Transportation and Mobile Businesses.
3. Review code update for cabaret licenses.

4.1 Licensing Mobile Food Vendors
Director Serck advised why the city didn’t currently license mobile food truck vendors. The
committee agreed that there was no need to begin licensing them now, since they were licensed
by the Douglas County Health Department.

ARTICLE XII ‐ SHORT‐TERM RENTALS
Sec. 74‐301. ‐ Definitions.
The following words, terms and phrases, when used in this article, shall have the meanings
ascribed to them in this section, except where the context clearly indicates a different meaning:
Short‐term rental means a residential dwelling that is rented for a fee for fewer than 30
consecutive days, as defined in Wis. Stats. § 66.0615(1)(dk).
Dwelling unit means one or more rooms with separate entrances and provisions for living,
cooking, sanitary, and sleeping facilities and a bathroom arranged for lodging by one person or
one family.
Homeowner means any property owner offering lodging for rent out of his/her own primary
single‐family dwelling.
Property Manager means any person appointed to act on behalf of the property owner.
Property Owner means any business entity offering short‐term lodging out of all other types of
residential dwellings, and shall include any corporation, partnership, limited liability company,
or sole proprietorship licensed to conduct business in this state.
Sec. 74‐302. – Purpose and Operation of Short‐Term Rentals.
a) The purpose of licensing short‐term rentals within the city ensures that property owners
are aware of their responsibilities; and that the lodging meets the minimum standards
necessary for the health and safety of persons occupying or using buildings, structures
or premises as well as the surrounding community; and provisions for the
administration and enforcement thereof.
b) Each short‐term rental shall be operated by a homeowner or property manager.
c) The building inspector, fire inspector and health officer shall inspect and approve all
short‐term licenses under this section prior to issuance/renewal of the annual license.
d) Short‐term rentals must comply with the City of Superior Hotel‐Motel Room Tax
Ordinance; license renewals will not be granted to parties in arrears of hotel‐motel
room tax by more than six months.
Sec. 74‐303. ‐ Supervisory duties of licensee.
It is made the duty of the property owner, together with the license under this article, to:
a) Maintain a current register of all guests, which shall be available at all times to
inspection by federal, state or city officers, and shall include the following:
a. The names and addresses of all guests.
b. The date of the guest's arrival and departure.

c. The license number of all guest vehicles and the state issuing the license.
b) Maintain the rental in a clean, orderly and sanitary condition at all times.
c) Provide garbage and recycling removal on a weekly basis.
d) See that the provisions of this article are complied with and enforced and report
promptly to the proper authorities any violations of this article or any other violations of
law which may arise.
e) Report to the county health department all cases of persons or animals infected or
suspected of being infected with any communicable disease.
f) Maintain functional smoke detectors, fire extinguishers and carbon monoxide detectors
in accordance with the requirements of Wis. Admin. Code, ch. SPS 362;
g) Prohibit the use of any unit by a greater number of occupants than that which it is
designed to accommodate.
h) Prohibit excessive noise, fumes, glare, vibrations generated during the use.
i) Prohibit recreational vehicles (RVs), camper, tent, or other temporary lodging
arrangements on site as a means of providing additional accommodations for paying
guests or other invitees.
j) The designated caretaker must be located within 25 miles of the short‐term rental
property and must be available 24 hours a day.
a. The property owner must notify the city clerk within 24 hours of a change in
management contact information for the short‐term rental.
b. The property manager must be authorized to allow city employees, officers and
their designees, to enter the property for purposes of inspection and
enforcement of this article and the Code of Ordinances for the City of Superior,
Wisconsin.
Sec. 74‐304. – License Term and Requirements.
1) A license issued pursuant to this article shall expire on June 30 after its issuance, but may be
renewed under the provisions of this article for additional periods of one year.
2) No person shall establish, operate or maintain a short‐term rental more than ten nights
each year within the city without having secured a license therefor from the city clerk, the
application for which requires the following:
a) A State of Wisconsin tourist rooming house license;
b) A seller's permit issued by the Wisconsin Department of Revenue;
c) A certificate of liability insurance statement with liability limits not less than
$300,000.00 per individual and $1,000,000.00 aggregate.

a) License application and fees. The application for a license required by this article shall be
filed with the city clerk on forms furnished by the city clerk. The fee for a license
required by this article, or the renewal thereof, shall be $10.00 per month for a seasonal
license (for 3 months or less) or $50.00 for an annual license. Fees for new annual
licenses to be issued prior to July 1 of any year shall be a pro rata share of the annual
license fee.
b) Health department fee. In addition to the license fee set forth above, at the time of
application the applicant shall pay a $15.00 fee for inspection services provided by the
county health department. No portion of the health inspection fee shall be refunded.
c) Filing date. All applications must be filed on or before May 1 of each year with the
applicable filing fee. Any application which does not include all of the required
information and documentation shall not be considered complete. The clerk may
conditionally accept incomplete applications, which may be subject to payment of an
additional $25.00 late fee.
Sec. 74‐306. ‐ License Contents; Posting Requirements.
a) The clerk shall issue a short‐term rental license to all applicants following the approval
of an application and the filing of all documents and records required under this article.
The license shall contain the following information:
a. Name and contact information of the property owner (and the property
manager, if applicable);
b. The maximum occupants for the premises;
c. The license term; and
d. The Wisconsin seller's permit number.
b) A copy of this article and the city license issued for the short‐term rental shall be
displayed on the inside of the main entrance of each short‐term rental.
Sec. 74‐307. ‐ False statements.
It shall be unlawful for any person to make any false statement in any application for the
purpose of obtaining a license for a short‐term rental; and it shall also be unlawful for any
person to make any false statement to the licensee under this article, the manager or person in
charge of any short‐term rental for the purpose of obtaining accommodations therein.
Sec. 74‐308. ‐ Transferability and cap.
a) Each short‐term rental license shall be non‐transferable to any other person or location.
No short‐term rental license shall be assignable and shall not be transferred upon sale
or other transfer of ownership of the property.

b) Short‐term rental licenses shall be capped at forty (40). If at any time, the number of
valid short‐term rental licenses issued in the City of Superior exceeds forty (40), the
issuance of licenses will cease and additional applicants will be placed on a first‐come,
first‐served waiting list.

Local alcohol licensee was requesting a 1‐day outdoor cabaret license for a celebration of life event, which didn’t allow time for council appoval. Current

ARTICLE VII. - CABARET LICENSE
Sec. 14-165. - Required.
No dancing, whether private or public, or exhibitions or entertainment of whatever nature, commonly classed under the term
"cabaret," "nightclub" or "floor show" performance shall be permitted on any premises licensed under this chapter unless a cabaret
license has been also issued for such premises. A one-day license or a one-day outdoor license may be issued for a license fee of $50.00.
Outdoor music is limited to the following hours: Sunday—Thursday from 12:00 p.m.—10:00 p.m.; and Friday and Saturday 12:00 p.m.—
12:00 a.m.

Sec. 14-166. - Scope.
A cabaret license when issued by the city shall entitle the holder thereof to give, permit, produce, present, conduct and offer
entertainment or exhibitions consisting of music, dancing, singing, floor shows and cabaret performances only upon the licensed
premises.

A cabaret license may be issued to any premises which has a designated area of 100 square feet or more for use as a stage or dance
floor. Prior to the issuance of a cabaret license, such area must be approved by the building inspector and fire inspector. Music, dancing,
singing, floor shows and cabaret performances shall be performed or occur only on the dance floor or separated stage.

Sec. 14-168. - Suspension or revocation of license; grounds; procedures.
A cabaret license may be suspended or revoked by the common council for violation of any of the rules, regulations or laws
governing or applying to cabaret premises or premises licensed to sell alcohol beverages as a tavern. The procedures set forth in Wis.
Stats. § 125.12(2) and (3) shall apply in any revocation, suspension, or nonrenewal of a cabaret license.

Sec. 14-169. - Exemptions.
A cabaret license issued under this chapter is not required under the following circumstances and conditions:
(1) Musical entertainment, provided by non-profit organizations, at events for a period of not more than seven days, such as
events being held at city's parks.
(2) Those entities that meeting the qualifications to hold a temporary beer and/or wine license under Wis. Stats. ch. 125.
