The meeting was called to order by Chair Fennessey at 3:34 pm on October 10, 2022 in Government Center
Room 217.

2.1 Licenses & Fees Committee (Special Meeting held September 26, 2022)
MOTION by Vice Chair Herrick to approve, seconded by Councilor Sweeney, carried.
There was no objection to allow Nicole Loukes, local business owner, to address the committee.
Loukes is recommending the City to amend our massage therapy business license code to allow
for massage therapy services could be in provided in people’s homes. She has volunteered to
research if and how other Wisconsin municipalities do this at present and provide her findings to
the clerk’s office to be reviewed at the future November meeting.
Nicole Loukes and Andrew Watson left the meeting at 3:48 pm.
3 OLD BUSINESS
3.1 Health Department Recommendations for Short Term Rental Licenses
Clerk Ramos reported that neither the city attorney nor anyone at the Health Department could
recall how the $15 inspection fee was established, and that the Health Department wasn’t
interested in changing their process for obtaining the fee from the City.
3.1.1 Review of Updated Short‐Term Rental City Code & corresponding License
Application
Clerk Ramos shared that the license period and license renewal due date was updated as the
committee has requested. She also proposed removing the Health Department inspection from
the code because applicants are required to supply the city with a copy of the Health
Department’s Tourist Rooming House permit with their application.
As for the STR application, she removed the $15 health inspection fee and added a certification
section at the bottom of the application so that the applicant was aware of their tax collection &
reporting responsibilities.

Acting Director Kamunen shared monthly sales report maintained by the City and a quarterly
sales report that is maintained by the DOR. The former report is submitted to the city by STR
lodging providers, and the latter is submitted by the marketplace providers to the Finance
department with the hotel-motel taxes they collect on behalf of their STR lodging providers. The
DOR form does not presently require the marketplace providers to provide any details—not even
the STR addresses—for the sales from which the taxes were collected. (handouts attached)
Because marketplace providers collect taxes from STRs which the city does not have on file, the
city often receives more taxes than the monthly reports are predicting.
Kamunen informed the committee that she and Ashley Puetz, former finance director, had
attended a demo for software that could help municipalities pinpoint all the STRs that were
operating within the city, but that Puetz had decided it wasn’t cost-effective. Kamunen asked if
the committee would like to watch another demo for the software.
Chair Fennessey mentioned that it wouldn’t be necessary once the marketplace providers started
requiring STRs to be licensed by the City, as required by the STR code adopted earlier this year.
Chair Fennessey left the meeting at 4:25 pm; Vice Chair Herrick chaired the meeting thereafter.
Chief Inspector Kruit recommended updating the definitions in the Hotel-Motel code to
incorporate/eliminate the code set forth in the STR code recently adopted; he also supplied the
committee with state statutes prohibiting the Building Inspection Department to inspect STR
rentals in the City. (handout attached)
Kruit also recommended removing Rooming House license code (shared lodging for renters who
don’t have permanent residences elsewhere) from the Room Tax code,
MOTION to update dates in the STR code, by Councilor Graskey, was seconded by Councilor
Sweeney and carried.
MOTION to strike the health inspection required in the STR code, by Councilor Graskey, was
seconded by Councilor Sweeney and carried.
3.1.2 Review of Additional Code Referencing $15 inspection Fee

4 NEW BUSINESS
4.1 Review of STR Frequently-Asked Questions
Kamunen and Ramos will work on creating a Hotel-Motel Room Tax FAQ for all lodging
providers in the city.
4.1.1 Propose Future Meeting Topics
Councilor Sweeney asked Ramos to see if the Health Department could share a couple of
completed (good and bad) Tourist Rooming House inspection reports.

Ramos will be report how the City of Fitchburg Building Inspection handles their STR
inspections at the next meeting.
Councilor Graskey reported that constituents have been losing housing to higher paying renters
and was wondering what if there was anything we could do to help and the councilors discussed
alternative housing options and local organizations who could help residents who found
themselves in need of new place to live.

4.1 Health Department & Police Department Recommendations for Short Term Rental
Licenses
Assistant Chief Kiel advised that the background check be removed from the application since
the PD could not legally recommend denial of a license unless the applicant had previously been
convicted of a crime which involved the business and/or the location of the business on the
application.
MOTION, to remove the background check requirement from the STR application by Councilor
Sweeney, was seconded by Chair Fennessey and carried.
There was no objection for Chair Fennessey to chair the meeting upon his arrival.
While there were no representatives from the Health Department in attendance, everyone agreed
that they were clearly interested in having us continue collecting the $15 inspection fee from the
applicant, which we would later pass on to them. Clerk Ramos is waiting to hear back from the
county on how and when the $15/inspection rate was established.
MOTION, to hold in committee until we get more information from the Health Department, by
Councilor Fennessey, was seconded by Councilor Sweeney and carried.

4.1.1 Total City Licenses Requiring HD Approval
NO ACTION.
4.1.2 Inspection Lists
MOTION, to accept the Fire Department list by Vice Chair Herrick was seconded by Chair
Fennessey, then there was no objection to having it withdrawn.
The committee discussed pros and cons of self-inspections and courtesy inspections.
Chief Inspector Kruit felt that an initial inspection should be done for new applicants.
Clerk Ramos was asked to look into how the Fire Departments of other Wisconsin
municipalities.
She was also asked to consolidate inspection lists from the health dept, the Superior Fire
Department, and Building Inspection into a one and/or create an FAQ that could be supplied to
property owners with the license application.
MOTION, to hold in committee until next regular meeting, by Councilor Sweeney was seconded
by Vice Chair Herrick and carried.
4.1.3 Current City of Superior Short Term Rental Properties
NO ACTION.
4.1.4 Review of Short‐Term Rental Application
Clerk Ramos will be updating the application, to remove the background check and update the
term so that it coincides with all other license applications that require approval from the
Douglas County Health Department (annual period beginning July 1 and ending on June 30 of
the following calendar year), and so renewal applications are due by March 1st.

I apologize, I am not aware of a current agreement. However, since these are required to be licensed and the
inspection is being done so we can complete the record review for the city. Then the health inspector goes over
the city list provided and confirms which are done and if there are any issues. The unlicensed ones just need a
process in place, and a checklist, for consistency.

Hello,
Celeste shared information about the meeting she attended with
representatives from the city regarding license fees. She and I met with our
director and corp counsel to determine how we should proceed with
businesses within the city limits that are licensed by the Health Department
and businesses that are not required to be licensed.
1. Environmental Health/Health Department cannot collect fees required
by the city.
2. Environmental Health will continue to provide the city with a list of
businesses currently licensed and inspected by the Health Department.
a. The HHS bookkeeping department will generate an invoice annually for
the currently agreed upon $15 per facility.
3. We will begin developing a process for inspecting businesses not
required to be licensed by the Health Department (such as bars that

serve liquor only), creating an agreement, inspection checklist, and fee
schedule.
We appreciate our partnership and will continue to work hard for the health
and safety of the residents of
Superior and Douglas County.
I understand there was a question about the credentials of the health
inspectors/registered sanitarians. Below I have included a summary of the
duties and responsibilities required for this position. Feel free to share with
those who are interested.

DESCRIPTION:
Under the direction of the Health Officer, the Environment Health Specialist,
as a Registered Sanitarian, has the authority and responsibility for
conducting inspections for food service, lodging, vending, swimming,
camping, recreational-educational camp, tattoo, and body piercing facilities
using applicable health and safety statutes and administrative codes.
ESSENTIAL DUTIES:
Investigates (including sample procurement), documents, and initiates
corrective action regarding public health nuisances, consumer complaints,
housing complaints, lead risk assessments, and rabies control; Performs
inspection and investigation related to complaints of suspect foodborne,
waterborne, vectorborne illnesses or potential human health hazards in
accordance with WI State Statutes, partnering with Public Health, Human
Services, and Law Enforcement when necessary; Performs sanitary surveys,
water sampling and inspections of county establishments which theHealth
Department has regulatory authority over to determine compliance with the
applicable laws, regulations, and ordinances.
Conducts plan reviews, issues permits, and assists license/permit applicants
in the interpretation of local and state codes; Implements outreach and
educational campaigns designed to cultivate a better understanding of the
principles of Environmental Health; Maintains records and reports of official
activities and performs other related work as assigned by the Health Officer;
Participates in public health preparedness planning and response to
emergency events including acts of terrorism, hazardous material
spills/releases, extreme weather events, and communicable disease
outbreaks; Performs other duties of similar nature or level.
MINIMUM QUALIFICATIONS:
Bachelor's degree in Environmental Health, or Physical or Biological Sciences
or related degree and six months of employment in the field of
environmental health sanitation preferred, or an equivalent combination of
education and experience sufficient to successfully perform the essential
duties of the job such as those listed above. Current certification as a
Registered Sanitarian preferred. If not currently certified, must be eligible to

upon hire.

Listed below is a check list that inspectors will consider during the annual inspection (but not
limited to):
Up-to-date license (license or a copy) must be posted in public view
Appliances and furnishing shall be in good working order and installed to facilitate cleaning
WATER & SEWAGE:
Approved public water supply. Private wells shall be constructed and pump installed in
accordance with Ch.NR 812. Drinking Water from private well must be tested, per the DNR
testing requirements, within the last 12 months and a copy of the results provided. Douglas
County Health & Human Services can assist you in your annual water testing needs.
Approved public or private sewage must be in accordance of SPS 382 and 383

KITCHEN
Appliances and surfaces must be maintained in a sanitary condition.
Utensils must be constructed with material that is easily cleanable and durable (example:
wooden cutting knife blocks are NOT allowed because it is not easily cleanable)
All food must be disposed of after each guest stay (single use, sealed from the manufacturer
items are acceptable. i.e. sugar packets, single serve coffee pods, single serving creamers)

Fire Safety
1. Smoke detectors: Does the residence have working smoke detectors
that are within expiration date? (An operable smoke alarm shall be provided and
maintained in accordance with the manufacturer’s instructions in each sleeping room, in the area
providing access to the sleeping areas, on each story and in the basement. The preferred location is the
ceiling. Alarm placement must not be farther than twelve inches (12”) from the ceiling if placed on the
wall. Specific smoke alarm installation instructions and approved alarm types are found in Municode

2. Carbon Monoxide Detectors: Does the residence have working Carbon
Monoxide alarms within the expiration date? (State Statute requires an operable carbon

AMENDING CHAPTER 74, LICENSES, PERMITS AND BUSINESS REGULATIONS
OF THE CITY OF SUPERIOR CODE OF ORDINANCES, TO AMEND ARTICLE XII,
SHORT-TERM RENTALS
The Common Council of the City of Superior, Wisconsin, does ordain as follows:
SECTION 1. Code of Ordinances Chapter 74, Licenses, Permits And Business Regulations,
Article XII Short-Term Rentals is hereby created to read as follows:
Secs. 74-277—74-300. - Reserved.
ARTICLE XII - SHORT-TERM RENTALS
Sec. 74-301. - Definitions.
The following words, terms and phrases, when used in this article, shall have the meanings
ascribed to them in this section, except where the context clearly indicates a different
meaning:
Short-term rental means a residential dwelling that is rented for a fee for fewer than 30
consecutive days, as defined in Wis. Stats. § 66.0615(1)(dk).
Dwelling unit means one or more rooms with separate entrances and provisions for living,
cooking, sanitary, and sleeping facilities and a bathroom arranged for lodging by one person
or one family.
Homeowner means any property owner offering lodging for rent out of their own primary
single-family dwelling.
Property Manager means any person appointed to act on behalf of the property owner.
Property Owner means any business entity offering short-term lodging out of all other types
of residential dwellings, and shall include any corporation, partnership, limited liability
company, or sole proprietorship licensed to conduct business in this state.
Sec. 74-302. – Purpose and Operation of Short-Term Rentals.
1. The purpose of licensing short-term rentals within the city ensures that property owners
are aware of their responsibilities; and that the lodging meets the minimum standards
necessary for the health and safety of persons occupying or using buildings, structures or
premises as well as the surrounding community; and provisions for the administration
and enforcement thereof.
2. Each short-term rental shall be operated by a homeowner or property manager.

3. The building inspector, fire inspector and health officer shall inspect and approve all
short-term licenses under this section prior to issuance/renewal of the annual license.
4. Short-term rentals must comply with the City of Superior Hotel-Motel Room Tax
Ordinance; license renewals will not be granted to parties in arrears of hotel-motel room
tax by more than six months.
Sec. 74-303. - Supervisory duties of licensee.
It is made the duty of the property owner, together with the license under this article, to:
1. Maintain a current register of all guests, which shall be available at all times to inspection
by federal, state or city officers, and shall include the following:
a) The names and addresses of all guests.
b) The date of the guest's arrival and departure.
c) The license number of all guest vehicles and the state issuing the license.
2. Maintain the rental in a clean, orderly and sanitary condition at all times.
3. Provide garbage and recycling removal on a weekly basis.
4. See that the provisions of this article are complied with and enforced and report promptly
to the proper authorities any violations of this article or any other violations of law which
may arise.
5. Report to the county health department all cases of persons or animals infected or
suspected of being infected with any communicable disease.
6. Maintain functional smoke detectors, fire extinguishers and carbon monoxide detectors in
accordance with the requirements of Wis. Admin. Code, ch. SPS 362;
7. Prohibit the use of any unit by a greater number of occupants than that which it is
designed to accommodate.
8. Prohibit excessive noise, fumes, glare, vibrations generated during the use.
9. Prohibit recreational vehicles (RVs), camper, tent, or other temporary lodging
arrangements on site as a means of providing additional accommodations for paying
guests or other invitees.
10. The designated property caretaker must be located within 25 miles of the short-term
rental property and must be available 24 hours a day.
a) The property owner must notify the city clerk within 24 hours of a change in
management contact information for the short-term rental.
b) The property manager must be authorized to allow city employees, officers and their
designees, to enter the property for purposes of inspection and enforcement of this
article and the Code of Ordinances for the City of Superior, Wisconsin.

Sec. 74-304. – License Term and Requirements.
1. A license issued pursuant to this article shall expire on June 30 after its issuance, but may
be renewed under the provisions of this article for additional periods of one year.
2. No person shall establish, operate or maintain a short-term rental more than ten nights
each year within the city without having secured a license therefor from the city clerk, the
application for which requires the following:
a) A State of Wisconsin tourist rooming house license;
b) A seller's permit issued by the Wisconsin Department of Revenue;
c) A certificate of liability insurance statement with liability limits not less than
$300,000.00 per occurrence.
Sec. 74-305. - Application for license; Fees and Filing Date.
1. License application and fees. The application for a license required by this article shall be
filed with the city clerk on forms furnished by the city clerk. The fee for a license
required by this article, or the renewal thereof, shall be $10.00 per month for a seasonal
license or $50.00 for an annual license. Fees for new annual licenses to be issued prior to
July 1 of any year shall be a pro rata share of the annual license fee.
2. Health department fee. In addition to the license fee set forth above, at the time of
application the applicant shall pay a $15.00 fee for inspection services provided by the
county health department. No portion of the health inspection fee shall be refunded.
3. Filing date. All applications must be filed with applicable filing fee; applications filed
after March 1 of each year will be subject to a $25 late fee. Any application which does
not include all of the required information and documentation shall not be considered
complete. The clerk may conditionally accept incomplete applications, which may be
subject to payment of an additional $25.00 late fee.
Sec. 74-306. - License Contents; Posting Requirements.
1. The clerk shall issue a short-term rental license to all applicants following the approval of
an application and the filing of all documents and records required under this article. The
license shall contain the following information:
a) Name and contact information of the property owner (and the property manager, if
applicable);
b) The maximum occupants for the premises;
c) The license term; and
d) The Wisconsin seller's permit number.
2. A copy of this article and the city license issued for the short-term rental shall be
displayed on the inside of the main entrance of each short-term rental.

Sec. 74-307. - False statements.
It shall be unlawful for any person to make any false statement in any application for the
purpose of obtaining a license for a short-term rental; and it shall also be unlawful for any
person to make any false statement to the licensee under this article, the manager or person in
charge of any short-term rental for the purpose of obtaining accommodations therein.
Sec. 74-308. - Transferability.
Each short-term rental license shall be non-transferable to any other person or location. No
short-term rental license shall be assignable and shall not be transferred upon sale or other
transfer of ownership of the property.
Secs. 74-309—74-330. - Reserved.
SECTION 2. All ordinances and parts of ordinances in conflict herewith are hereby repealed.
SECTION 3. If any section, subsection, sentence, clause or phrase of this ordinance is for any
reason held to be invalid, unconstitutional by reason of any decision of any court of competent
jurisdiction, such decision shall not affect the validity of any other section, subsection, sentence
or clause or phrase or portion thereof.
SECTION 4. This ordinance shall take effect and be in force from January 1, 2023.

Sec. 78-16. - License fees for manufactured home parks.
(a) No person shall establish, operate or maintain a manufactured home park
within the city without having secured a license therefor from the city clerk.
The building inspector, fire inspector, police chief and health officer shall
inspect and approve all manufactured home parks licensed under this
section at least annually and/or prior to issuance of the license and/or
license renewal.
(b) The license fee for any manufactured home park within the limits of the city
shall be $50.00 plus $2.00 for each manufactured home space within the
court. Provided that said fee shall not exceed the limitation of Wis. Stats. §
66.0435(3). In addition to the license fee set forth in this section, at the time
of application the applicant shall pay a $15.00-fee to the county health
department for its inspection services.
(c) Upon filing a proper written application with the city clerk, a license shall be
issued on July 1 of each year or when applied for and continue in force until
the following June 30 unless sooner revoked. The license fee may be
prorated if purchased after July 1 of the current year, however, no portion of
the health department inspection fee shall be refunded.

Sec. 74-194. - City procedures after receiving application for license.
After receiving a complete application for a youth entertainment center license, as
specified in sections 74-192 and 74-193, the city shall follow the following procedures:
(1) The city clerk shall forward copies of the application to fire, building,
police and health officials for their inspections and approvals regarding
compliance with regulations under their jurisdiction. The city clerk shall
submit the materials and comments submitted to the common council
which shall issue or deny the license.
(2) A youth entertainment center license shall be denied by the common
council for any one or more of the following grounds:
a. If the business premises do not comply with all applicable
ordinances and laws;
b. If the application is incomplete or if it contains any material
misrepresentation;
c. If the application does not show adequate measures for the
protection of the public health, safety and welfare in terms of traffic
control, crowd protection and security, both inside and outside the
premises, and the monitoring of the ages of patrons admitted to the
youth entertainment center; and/or
d. Such other reasons as the council deems appropriate, including
location.
(3) If the common council denies a license, written notice of the denial
stating the reasons why shall be sent to the applicant within ten working
days after the denial.

specified, the city shall follow the following procedures:

building, police and health officials for their inspections and approvals
regarding compliance with regulations under their jurisdiction. The city
clerk shall submit the materials and comments submitted to the
common council which shall issue or deny the license.
(2) Grounds for denial. An adult dance hall license shall be denied by the
common council for any one or more of the following grounds:
a. If the business premises do not comply with all applicable
ordinances and laws;
b. If the application is incomplete or if it contains any material
misrepresentation;
c. If the application does not show adequate measures for the
protection of the public health, safety and welfare in terms of traffic
control, crowd protection and security, both inside and outside the
premises and the monitoring of the ages of patrons admitted to the
adult dance hall.
d. Such other reasons as the council deems appropriate.
(3) Written notice of denial. If the common council denies a license, written
notice of the denial stating the reasons why shall be sent to the
applicant within ten working days after the denial.

business; display of license.
The annual license fee is $50.00. No license authorized under this article shall be
issued or renewed until the license fee has been paid to the city. In addition to the
license fee set forth above, at the time of application the applicant shall pay a $15.00
fee to the county health department for its inspection services. No part of any fee paid
under this section shall be refunded. A separate license shall be obtained for each
place of business. The licensee shall display the license in a prominent place on the

SHORT TERM RENTALS FAQ
What do I need from the City of Superior to rent my home to transient guests?
In order to obtain a short-term rental license so you can rent your property to any person(s) for
more than 10 days within a calendar year, you will need to obtain a Wisconsin Seller’s permit
number and a Tourist Rooming House (TRH) permit from Douglas County Health Department.
TRHs are vacation homes, cabins and cottages that are rented out to tourists and transients for a
short period of time. The state of Wisconsin requires these properties be licensed. Under a TRH
license, an operator may rent as many as 4 units (examples: rooms, cottages or cabins).
What is Room Tax?
Room tax is paid on gross lodging sales. If you collect additional money for services or other items,
those charges would not be subject to room tax. These items may include:
Exempt room sales - those persons staying for over 30 consecutive days or sales exempt
from room tax such as those for governmental purposes. For those exempt from room tax,
you must obtain and keep for at least three (3) years a tax exempt letter or other certificate
of exemption from the guest.
Room and Sales tax. If you have included the tax in your advertised total room rate as in the
example above, you will need to back the room and sales tax out so that you are only paying
room tax on the actual rental portion of the total nightly rate.

If you are deducting costs for any of the above, you will need to keep clear records of those costs to
support their deduction. If an audit is conducted, you will be asked to provide those records for

furnishing, at retail, of rooms or lodging to transients by hotelkeepers, motel operators, lodging
marketplaces, owners of short-term rentals and other persons furnishing accommodations that are
available to the public. All funds collected are used to support and grow tourism in the City of
Superior.
How do I collect a room tax from guests who are renting my short-term rental?
Room tax is a pass through tax. That means that you will collect this tax from your guest as part of
the rental fee for your home and then report and submit the tax to the City of Superior. There are
different options to collect room tax. It is up to you to decide what works best for your rental. You
may include the amount in your nightly advertised rate.
For example, if you want to receive $100 for a rental, you would advertise the total nightly rate as
$106.50 to include the 6.5% room tax. You will also need to consider sales tax in your rates.
If you go through an online lodging marketplace (such as AirBNB or VRBO) there may be an
opportunity for that provider to collect the room tax for you. However, you are responsible to make
sure that the room tax is collected and paid. Even if you use an online application and have
arranged for them to collect and remit the room tax, you must file a Monthly Room Tax Report. (is

That report should include the rentals through the online platform and you should note that the tax
was collected by the online provider. If the tax is not paid by the online provider to the City, you
remain responsible for the tax and may be subject to late fees and penalties, so it is important to
make certain that the online provider is collecting and timely paying the amounts due.
Whichever method you use to collect room tax, you should clearly communicate how it is done in
your listing and communications with potential guests.
