Commissioner Paine introduced the small business grant and Nicole Wilde from Love
Creamery, LLC. Nicole spoke about her business plans and answered questions from the
Commissioners. Director Serck explained the accelerated timeline for Love Creamery,
LLC grant application.

5.1 Planning, Economic Development & Port Director Report
Director Serck updated the Plan Commission survey that has been distributed regarding upper-
floor housing in the business districts. Director Serck introduced the symposium for commercial

property renovation hoping to reach the key people involved to help with barriers and educate for
building, zoning, and fire codes being held at Barker’s Island Inn on March 20th, 2025.
5.2 Housing Coordinator Update
No new updates.
5.3 Zoning Code Update
Mitch Brouse from SRF presented a Power Point with project updates, community
engagement efforts, existing code review summary and zoning code framework. Mitch
mentioned the Comprehensive Plan and aligning the zoning ordinance updates with the
Comprehensive Plan. Commissioners discussed the topics Mitch brought forward with the
Power Point presentation. Commissioners examined the different character areas and
districts throughout the city in the existing code and the potential moving forward and
fitting in with the environment in each community. Mitch will be putting together a
mapping exercise and future workshops.

4.2 Small Business Grant Program Discussion
Director Serck discussed the breakdown and rollover of the funds for the small business
grant program. Discussion was had about different possibilities with the small business
grant program and excess money available from rollover. Commissioner Moffat talked
about letting the money sit with the upcoming bridge closure to help the affected
businesses. Promotion opportunities and current promotion for the small business grant
program was discussed. Possible expansion of the small business grant program to
architectural services was spoke about. Jim Ceasar spoke about different possibles with
the small business grant program.

4.3 Lake Superior Apartments, LLC Rezone Request and Comprehensive Plan Future Land
Use Map Amendment Review and Plan Commission Recommendation
Director Serck introduced Rezone request and comprehensive plan future land use map
amendment to the Plan Commission. Ryan Nelson from Lake Superior Apartments LLC
was present. Commissioners discussed the project.

Commissioner Paine opened the Public Hearing for Resolution of the Plan Commission of
the City of Superior Approving the Project Plan and Establishing Boundaries for Tax
Incremental District No. 19 (Lake Superior Apartments Project) City of Superior,
Wisconsin and Recommendation for the Creation Thereof. Commissioner Paine asked if
anyone from the public wanted to discuss or speak at the public hearing. No public
comment was offered.
MOTION to close Public Hearing and Adopt the Resolution by Commissioner Porter,
seconded by Commissioner Fennessey. Carried.
4.5 City of Superior’s request to submit a Certified Survey Map for property located off
Winter Street, Superior, WI parcel numbers 048040101603 and 048040101602. CSM 24-

Commissioner Paine introduced the request to submit a Certified Survey Map.

4.6 Nye 24-03 Vacation request, review and recommendation
Director Serck introduced the alley and street vacation request for the alley located
between E 4th and E 5th Streets and 31st Ave E and 30th Ave E and a portion of the
unimproved 30th Ave E between E 4th and E 5th Street along with the homeowners plans
for the property with the alley and street vacation. The applicant attended in person.
Director Serck recommends approving.
MOTION to approve alley and street vacation request by Commissioner Fennessey,
seconded by Commissioner Moffat. Carried.
4.7 Discussion of Vacant Building Registry

Councilor Van Sickle introduced the possibility of creating a Vacant Building Registry.
Discussing what other cities are doing, the purpose of creating a Vacant Building Registry,
possible implementation. Councilor Elm and Fire Chief Vollbrecht were also present to discuss
the Vacant Building Registry. Plan Commission discussed the possibility of creating a Vacant
Building Registry.
5 RECURRING BUSINESS
5.1 Zoning Code Update
SRF created Power Point with a survey overview that was printed and shared with the
Plan Commissioners.
5.2 Housing Coordinator Update
Jeff Skrenes, Housing Coordinator and Planner presented on the Basics of Community Land
Trusts. Plan Commission had a discussion regarding Land Trusts in Superior.
5.3 Planning & Development Director Report
Director Serck updated the Plan Commission about the RACS and the Joint Review Board
meetings held earlier. Director Serck is the Flood Program Administrator for the City of Superior,
FEMA will be having an annual meeting will be held in January.

Project Description
Love Creamery LLC plans a complete rehabilitation and reuse of an underutilized building in the
Billings Park community of Superior, Wisconsin starting spring of2025. This former gas station
and convenience store, vacant since 2016, will be transformed into an ice cream production
facility, a retail destination offering ice cream, coffee, and healthy convenience foods, and Love
Creamery's headquarters, supporting regional product expansion while serving the Superior
community.
Located at 2704 N 21st Street, the building sits on a major arterial road connecting Billings Park
residents to downtown Superior and providing access to the city's Billings Park and Recreation
area. The 2020 census shows Billings Park comprises 1,833 households (15.7% of Superior) with
3,956 residents and a median age of 45.3.
Originally a 7-Eleven, the building became a locally-owned gas station and convenience store
owned by Inter City Oil (I CO). However increased competition and other factors let to its closure
in 2016. The subsequent removal of gas station tanks resulted in a brownfield site, requiring
environmental remediation and DNR oversight. Love Creamery conducted a Phase I
environmental assessment, and the DNR closed the site in July 2024.
In June 2023, Love Creamery entered into a lease agreement with the property owners, including
an option to purchase, anticipating DNR closure. This allowed for a feasibility study, zoning and
development compliance assessment, and navigation of the DNR closure process. Following a
12-month analysis and DNR closure, Love Creamery proceeded with planning and financing.
Love Creamery has secured two major construction loans and one grant, is applying for two
additional grants (including this application), and is proceeding with the building purchase. A
separate entity, Sunflower LLC, has been established for the purchase, with a closing date set for
December 20th. Sunflower LLC will lease the property to Love Creamery.
The project will involve a complete interior and exterior renovation, including a new outdoor
patio, landscaping, parking lot, roof, electrical system, plumbing, lighting, and exterior favade.
The goal is to create an aesthetically pleasing building that serves as a year-round gathering
place for the community and Love Creamery hradquarters.
Architectural plans are attached. Please note some favade adjustments will be made.
Project Information
Renovation is set to begin in Spring 2025, starting month is weather permitting. Some initial
work (demolition) may occur during winter. This grant application seeks $15 ,000 specifcally
towards a new roof bid at $81,000. That said the overall renovation and buildouts has a $1.4
million project budget.

WE HEREBY SUBMIT SPECIFICATIONS AND ESTIMATES FOR THE FOLLOWING:
Description: Provide the labor and materials to install a new fully adhered 60 mil EPDM membrane roof system to
include the following:
Inclusions:
• Removal and disposal of the existing roof system down to the building substrate. Inspect the substrate for
deficiencies and report to the owner prior to installing the new roof system.
• Mechanically fasten 6" of polyisocyanurate insulation to the structurally sloped substrate with crickets to
divert the water to the scuppers
• Fully adhere a 60 mil EPDM membrane and flashings to create a watertight finish.
• Fabricate and install perimeter edge metal flashing to match the existing metal from the old roof system out
of 24-gauge prefinished standard color metal.
• Provide a 15-year manufactures warranty
• Provide dumpsters to remove the debris.
Exclusions:
• Wood blocking
• Extending the mechanical equipment to accommodate the new insulation heights.
• Overtime
• Winter conditions/snow removal
• Work at the garage roof and lean-to area .
Proposal Amount:
We propose hereby to furnish material and labor, complete in accordance with the above specifications, for the sum of
Fifty six thousand eight hundred Dollars 00/100 ($56,800.00)
