PUBLIC WORKS COMMITTEE MINUTES November 28, 2023 Special Meeting The meeting was called to order by Councilor Van Sickle at 5:02 p.m. on November 28, 2023, in Government Center Room 270. NEW BUSINESS 2.1. Recommendation to approve a contract with REM Inspecting to provide Commercial Electrical Permitting and Inspections within the City of Superior. REM Inspecting is a Certified Inspection Agency based in Amery, Wisconsin. REM provides commercial electrical inspection for 16 counties in Northern Wisconsin under contract from the State of Wisconsin. Director Janigo stated that the City of Superior has been facing difficulties in filling the Commercial Electrical Inspector position for the past two years after a retirement. The Chief Building Inspector, Pete Kruit, who possesses the necessary credentials, is also retiring in January 2024. The city will no longer have staff qualified to permit and inspect commercial electrical work. The city is a delegated authority by the state tasked with performing commercial electrical inspections. The city has two options as a delegated authority starting in January. The city can send a letter to the State of Wisconsin relinquishing our delegated authority. Responsibility would transfer to the state. Alternatively, the city can choose to retain its delegated authority and contract with REM for electrical inspections and permitting. In this alternative, contractors would contact REM for permitting and inspections. REM and the city would communicate on all projects with REM providing the city with all permit and inspection documentation. REM would collaborate with the city on final inspections and the city would continue to issue Certificate of Occupancy Permits upon project completion. The contract with REM would be valid for one year. There is an option to terminate it 60 days before its expiration if renewal is not desired. Requesting approval of a resolution to modify Commercial Electrical Permitting and Inspection Fees within the City of Superior. Director Janigo provided an explanation stating that the city's fees are determined by resolution. The current commercial electrical fees require adjustment to align with the schedule outlined in REM Inspecting's contract. Bill Slattengren, the Project Manager at Benson Electric, inquired regarding the continuity of permit fees during the transition to REM. Dawn Kegley, the Vice-President of REM, clarified that the fee structure differs from the city's current fee schedule and is similar to the State of Wisconsin's mandated fee schedule. The city will share the new fee schedule with all licensed electrical contractors. The revised fees will take effect on January 1, 2024. However, they will only apply to new permits, not those already issued by the city. The city has issued approximately 142 commercial electrical permits this year. Request approval of a Landfill Gas Purchase Agreement and Land Lease Agreement with Vespene Energy – Referred by City Council meeting on November 21, 2023. Director Janigo has stated that more information is being collected for this project due to additional inquiries raised at the previous City Council meeting. As a result, the matter has been referred back to the Public Works Committee and will be presented to the committee during the next scheduled meeting on December 7, 2023. Discussion The State of Wisconsin Department of Safety and Professional Services (DSPS) is the authority for commercial electrical plan review, permitting and inspections throughout the State. Municipalities that meet certain requirements (SPS 316.001) may request and receive the authority to permit and inspect commercial electrical installations locally. The City of Superior is one of these delegated authorities. The ability to permit and inspect projects locally provides benefits to the community. Builders, developers, and contractors can expect quicker service with more flexibility while ensuring that projects within the city are built in a manner to protect public safety. As the delegated authority, the city is responsible for having qualified staff to provide these permitting and inspection services. Qualification is measured by having the appropriate state‐issued inspection credentials. After the retirement of Chief Building Inspector, Peter Kruit, on January 1st, the city will no longer employ staff with the required commercial electrical credential. The city previously employed a part‐time commercial electrical inspector. However, that position became vacant in July of 2021 due to retirement. Since that retirement, the city has been unable to fill the position despite continuous advertisements and significant effort. The city has staff working towards getting additional credentials. However, none will achieve commercial electrical in a timeline to satisfy our immediate need. If the city doesn’t have qualified staff to perform commercial electrical inspection, it has two options. Option 1 is to relinquish our delegated authority designation. The responsibility to provide commercial electrical permitting and inspection would revert to DSPS. DSPS contracts with regional companies to perform its state‐led inspections. For the northwest region, their contract is with REM Inspections. REM performs commercial electrical permitting and inspection for fifteen counties including Douglas. Any commercial electrical installation within the fifteen counties, except for a municipality with delegated authority, must be permitted and inspected by REM. REM was selected by the state through a competitive solicitation in January of 2023. REM was the lowest cost proposal. Three consultants provided bids for the northwestern region. However, only REM bid for Douglas County. If the city relinquishes its delegated authority, REM becomes the authority for commercial electrical permitting and inspections in the city. Cost for the permitting and inspections would be at the rate set by the DSPS contract (Exhibit 1). Option 2 is for the city to maintain its delegated authority and contract directly with REM. The city would direct permit applicants to REM for permitting and inspections. REM would prepare and issue the permits as well as invoice the applicant for the cost of the permit. REM would also provide the city with notifications and copies of all permits and inspections for our records. The cost for the permitting and inspections would be at the rate negotiated by the city. The negotiated rate (Exhibit 2) is less than the rate set by the DSPS contract. Contracting for the Commercial Electrical Permitting and inspection will represent a cost increase to projects. While the negotiated rate for the City of Superior represents about a 30% decrease in cost from the State inspection rate, the percentage increase from the existing city fees varies widely between types of projects with multi‐unit residential incurring the largest increase. While commercial electrical permit fees will increase, the fee represents the true cost of providing the service. It also represents the best and lowest cost option available for commercial electrical permitting in the city. A rate comparison for a few typical projects is attached. It is my recommendation to pursue option 2. Option 1 results in a higher average permitting cost to applicants. Option 1 also removes city control over managing permitting and inspections on the local level. If contractors or developers are struggling with commercial electrical permitting and inspections, the city would have no authority to effect a change. 2. Budget Source Permitting and inspection costs will be the responsibility of the permit applicant. Hourly consulting costs for projects with city staff will be charged to the Building Inspection General Fund Budget. 3. Recommendation It is my recommendation to approve a contract with REM Inspecting to provide Commercial Electrical Inspection services within the City of Superior. Electrical scope of work fees is the sum of the fees listed in Table A2 with a minimum fee of $125. 2. A Re-inspection, additional inspection fee is up to $125. Rough-in and Final is included in Table A2. 3. An administration fee of $60 per project or permit. This includes, but is not limited to, application processing, permitting issuance, inspection scheduling, inspection reporting, tracking, logging, etc. 4. Starting a project without a permit is double the normal fees or as specified in electrical ordinance. 5. Any additional services or duties will be in addition to the above rates and shall be charged out at the hourly rate. Duties such as, but not limited to, consultations, plan review, code administration, code enforcement, investigation of complaints, attendance of meetings when requested, etc. No cost to attend an annual meeting each year. 6. Regular hourly rate is $125 per hour, M‐F, 7am to 5pm 6.1. Before or after‐hours; Holiday hourly rate is 1.5 times the regular rate. 6.2. Hourly rates are calculated to the quarter hour. Minimum of ½ hour. 7. Mileage Rate is $1 per mile, round trip. 8. Any Municipal fees will be added to the REMI fees. Pertinent building classifications shall be based upon the International Building Code, Chapter Three (3), Use and Occupancy Classifications. Note: When an application is submitted for a property when only the shell of the building is to be completed, the fee will be calculated at 50% of the total fee for that particular fee group. When an application is submitted for construction of the interior of a building where the shell of the building has been previously granted a permit, the fees shall be based on the square footage of that space and the fee shall be calculated at 50% of the total fee for that particular fee group. (Minimum $25.00) B. Appeals (filing fee) $100.00 Industrial Electrical Inspections (Not new construction) Quarterly inspections are required and shall be invoiced at $100.00 per hour. Additional inspections shall be required before any installations are covered or concealed. No permits or permit fees are required. A record of electrical work performed and supporting calculations and design data shall be required and a copy provided to the electrical inspector for all electrical work performed at the site.
