The December 10, 2013 meeting of the Board of Zoning Appeals was called to order at
7:00 p.m. by Chairman, Kevin Heilmeier.
The meeting was opened with the Pledge of Allegiance.
Roll called. All members present with the exception of Richard Schunk.
Mr. Heilmeier: I’ll entertain a motion to excuse Mr. Schunk.
Mrs. Kuzior: I’ll make a motion that we excuse Mr. Schunk from this meeting.
Mr. Cooper: seconded the motion.
Roll called. All members present voted in favor (4-0).
Mr. Heilmeier: The next item of business is the approval of the minutes of the
November 12, 2013 meeting of the Board of Zoning Appeals..

Mrs. Bushey: So moved.
Mr. Cooper: seconded the motion.
Roll called. All members present voted in favor (4-0).
Mr. Heilmeier: Is there any agenda additions for tonight’s meeting?
Mr. Lyons: No sir.
Mr. Heilmeier: Any correspondence or communications?
Mr. Lyons: No sir.
Mr. Heilmeier: It is now 7:01, Case No. 934.

Variance requested from Subsection 1155.07 (a) and (c); Minimum
Front yard setback 50 feet from the proposed right-of-way.
Request variance to 44 feet.

Mr. Heilmeier: Is the applicant present? Sir, come up, we’ll swear you in and we’ll get
started.
Mr. Michael Buehler was sworn in.
Mr. Heilmeier: State your name and address, please.
Mr. Buehler: Michael Buehler, 823 Laurann Avenue.
Mr. Heilmeier: At this time we’ll open the Public Hearing (7:02 p.m.). State the reason
for your request, please.
Mr. Buehler: I’m here for a 44’ variance from 50’ at my house. At the present time I
have a single garage which goes in on the side. As I get older, it’s getting harder and
harder to go in on the side like that because there’s not very much room and I would
like to extend the front of the garage out so I can be able to pull two cars in.
Mr. Heilmeier: I will close the Public Hearing (7:03 p.m.) and turn it over to the Board
since there’s nobody here. Is that okay?
Mrs. Raber: You might want to note for the record that there’s absolutely nobody else
in the audience.

Mr. Heilmeier: At this time we’ll note there is nobody else in the audience and we will
close the Public Hearing (7:03 p.m.) and turn it over to the committee. You’re moving
the driveway over and driving straight in?
Mr. Buehler: Right.
Mr. Heilmeier: What are you going to do with the old driveway?
Mr. Buehler: After construction, it will move over to the front.
Mr. Heilmeier: So you’re just going to plant grass over there again?
Mr. Buehler: Yes.
Mr. Heilmeier: Okay. I see what you’re saying. Roger, does this have to do with the
center of the street with the city?
Mr. Lyons: No, the 44’ will be to the existing right–of-way. In the variance language, on
your agenda it does say from the proposed right-of-way but Laurann is not a collector
or a thoroughfare on the Thoroughfare Plan. It was written correctly on the application
but got in there erroneously in the agenda.
Mr. Heilmeier: Okay. Any questions from the committee for the applicant? I will
entertain a motion please.
Mrs. Kuzior: I’ll make a motion that we approve the variance for the property
located at 823 Laurann Avenue; variance requested from Subsection 1155.07 (a);
minimum front yard setback 50’ from the right-of-way; requesting variance to 44’.
Mrs. Bushey: seconded the motion.
Roll called. All members present voted in favor (4-0).
Mr. Heilmeier: Your variance passed sir.
Mr. Buehler: Thank you very much.
Mr. Heilmeier: I’ll entertain a motion for adjournment, please.
Mr. Cooper: So moved.
Mrs. Kuzior: seconded the motion.
All members present voted in favor (4-0).
