COUNCIL MEETING Council Chambers @ 7:00 p.m. February 10, 22 1. CALL TO ORDER. President of Council Loughry called the Council meeting of Thursday, February 10, 2022, to order at 7:00 p.m. Just a note, we will have an Executive Session this evening to discuss pending court action prior to adjournment. 2. OPENING PRAYER AND PLEDGE OF ALLEGIANCE. Pres. of Council: At this time, I would like to call to lectern Pastor Deborah Wissner from St. Mark Lutheran Church to lead us in prayer. PLEDGE OF ALLEGIANCE: I would ask that Ethan Hall, a 5th grader at Tallmadge Elementary School to lead us in the pledge. 3. ROLL CALL: Mrs. Allman, Mr. Bollas, Mr. Bozic, Mrs. Gutman, Mrs. Kilway, Mr. Loughry, Mr. Sisak – present. 4. Correcting and Adopting the Previous Meeting Minutes 1-27-22 Council Meeting Minutes. Mr. Sisak moved to adopt the minutes as presented. Seconded Mrs. Kilway. Roll Call: Mr. Bollas, Mr. Bozic, Mrs. Gutman, Mrs. Kilway, Mr. Loughry, Mr. Sisak, Mrs. Allman – unanimous. The 1-27-22 Council Minutes are adopted by a vote of 7-0. 5. Financial Reports: • Fire & EMS Fund Transfer in the amount of $135,000, and Street Maintenance & Repair Transfer in the amount of $210,000 to Council on 2-1-22. • Appropriation Report, Fund Report and Revenue Report for the period ending 1-31-22 to Council on 2-4-22. • January Financial Reports to Council on 2-4-22. • Tallmadge Recreation Center Profit and Loss Report for the period ending 1-31- 22 to Council on 2-4-22. • Income Tax Comparisons for the period ending 1-31-22 to Council on 2-4-22. • Revenue Comparisons for the period ending 1-31-22 to Council on 2-4-22. • Consolidated Investment Portfolio for the period ending 1-31-22 to Council on 2-4-22. Mr. Sisak moved for the acceptance of the Financial Reports. Seconded Mrs. Kilway. Roll Call: Mr. Bozic, Mrs. Gutman, Mrs. Kilway, Mr. Loughry, Mr. Sisak, Mrs. Allman, Mr. Bollas – unanimous. The Financial Reports submitted by Finance Director Gilbride were accepted by a vote of 7- 0. 6. Public Hearings: The public hearing for Ord. 2022-29 will be moved to the Community Center and it will start at 6:01 p.m. Mrs. Raber, I spoke to Council, and they are available at 6:00 and so, do you want us to set the public hearing now or wait and do it on the agenda. Dir. of Law: If you would wait for that ordinance on the agenda that would be great. 7. Community Input: Letter received from Janice Rogers, 1316 Tansy Court regarding snow removal on Tansy Court cul-de-sac. Pres. of Council: Ms. Rogers has requested that the letter be read into the record, so Mrs. Burton. The Clerk of Council read Ms. Rogers letter into the record. Mrs. Kilway: Mrs. Rogers did call me first before she wrote the letter, and we had a long discussion about everything, and I asked her to put in writing what her issues were so that was the letter and then she said that she wanted to have it read into the record. We did have many discussions and I talked with Mr. Rorar about it too. Are you going to get into this a little bit later? Dir. of Pub. Service: Mrs. Rogers was able to supply some photos and I’m not sure how good everybody can see that. When the storms are going on on cul-de-sacs, we will not clean them out. We give a path in and a path out. Much like anybody who is in a cul-de-sac, you have to plow or snow blow from your driveway to our path. 1  COUNCIL MEETING Council Chambers @ 7:00 p.m. February 10, 22 Dir. of Pub. Service (Cont’d.) The next photo shows a similar picture. We were in there and we did plow. We have GPS units on all of our trucks now. There was further discussion regarding this issue. Pres. of Council: Is there anyone else who would like to speak before Council this evening? 8. Agenda Additions: • Becky Allman – Presenting Larry Bagnoli with Certificate of Appreciation. As the first of these presentations, I wanted to recognize someone who is not only been instrumental in our community, but someone who has utmost passion for our community and its members. The person I am giving this certificate to this evening is Larry Bagnoli. There were many accolades given to Larry and he spoke himself thanking everyone for this wonderful ceremony. • Jerry Feeman, Summit County Council Pres. of Council: Next, we were hoping to have Councilman Feeman, who is our Summit County Council person, but he was unable to attend, but we got lucky, and we have our State Representative here today; Mr. Bob Young. So, Bob, you can take a few minutes and update us. Mr. Bob Young: I am currently your State Representative. I have been a legislature for just over a year now. Previously before I was on the legislature, I served on Green City Council for 7 years and so this is my first Council meeting since my last meeting in Green. Mr. Young gave a short presentation about what is going on at the State Legislature. 9. Reports of Administrative Officers: a. Mayor/Director of Safety: Mayor Kline was out of town. b. Director of Administration: Good evening everyone. I have no report this evening, but I am happy to answer questions. c. Director of Public Service: Good evening. I brought this up at the last meeting and I want to visit it again; we are going out for bid for several of the capital items out there; paving, concrete and we are getting numbers back that did not . . . they exceeded what we budgeted for. I am just letting everybody know so I might be coming back and asking for maybe some additional funds. Moving on, the monthly report. For the month of January, we had 48 total permits issued; 28 which were street openings which shouldn’t be a surprise with Tallmadge Reserve going on. Code Violations we had 24; nine of which were property disrepair. Sadly, we had to cancel the P&Z meeting because of the weather. We rescheduled for February 22nd and that is at 6:00 p.m. at the Tallmadge Community Center. In the cemetery, we had 4 burials, 3 were full land one was cremains. The columbarium: we only have 20 spaces left until . . . we budgeted to add an additional columbarium this year. The columbarium has actually become a pretty good item out there. Parks & Rec: First of all, I would like to say that I hope everyone saw the Profit and Loss Report for the Parks and Rec. Kudos to Jessica Simons and her staff. She has done a great job. It is down less than $700. I don’t know when the last time that has happened, but great job. Membership at the Rec Center is up. Actually, we surpassed our 2019 number for January. Visits are up 68%. The Community All Stars are wrapping up. They had 48 teams this year. A couple complaints was that the season went long, and it is mostly because Christmas and New 2  COUNCIL MEETING Council Chambers @ 7:00 p.m. February 10, 22 Dir. of Pub. Service (Cont’d.) Years landed on the weekends and so we couldn’t do those weekend tournaments. We also did a Princess Tea Party on January 23rd. This was a reimagined event. There was a Princess Parade that we held at the Community Center, and it turned out pretty well. There is a new fitness class; Tone Every Zone. It is being offered and we actually took that from the Kent Parks and Rec. They actually cancelled that class and we picked up the instructor. So, a big following and well attended. We actually closed 3 days due to weather. Maca passes went on sale to residents on February 1st. They go on sale to non-residents on February 16th. We are up to 284 passes sold to date which is pretty good. The whale slide is being replaced this year with a dolphin slide. The whale slide has been in disrepair for a few years and needs to get done. Here is a picture of the 20 princesses at the Princess Tea Party held at the community center. It received some good press both in the Tallmadge Express and the Beacon. In the Street Department, the first part of the month was pretty good until Martin Luther King Day came and then we spent 1,295 hours on snow and ice control. We did 20 lineal feet of ditching and we installed 3 catch basins and there were 31 mailboxes that were repaired which isn’t bad, but . . . you know that is just part of snow and ice. Spot salting is what we do during the storm event and that is where we hit the intersections and curbs and grades and those should be in much better shape than some of the other roads. The objective for the City during snow and ice events is to maintain roadway safety while striving towards more passable roads. So, your pavement doesn’t always have to be running wet to be safe. Water Department – They had 7 water breaks. I would like to commend the guys. They had 4 water breaks over 3 days from January 12th to January 14th. They did a great job, and they didn’t have to bring in any contractors which is great. They did it all in-house and unfortunately our average right now for water breaks over the past 3 years is 17 and we might end up surpassing that this year in just 2 months because February we had just as many water breaks as we had in January. Sewer backups: we are at none. We are doing our own BOD which is biochemical oxygen demand as well as the SN sampling which is suspended solids at our master meters. We are doing our own sampling to make sure that it matches Akron’s. We did 1,000 new feet of sewer videoing. Lastly, we talked about the sewer increases on the sewer bills. It does start on May 1 st. d. Director of Economic Development: Good evening. I will be somewhat brief. For this evening’s report, just a snapshot of the available real estate in the community. We will start first with the Industrial side of things. There are currently 88 acres of vacant land. 41 of those acres are located in the Tallmadge portion of Portage County. Many years ago, when that land was annexed, it started with about 250 acres and so you can see that we still have about 41 acres available. I can tell you as of today, almost 30 of those acres . . . it is a very good likelihood that those will be taken off of this list. There are a couple of good perspective users for that land. On the Tallmadge/Summit County portion, there are 46 acres. Within the JEDD there is another 150 that is still available. It’s not to say that 150 couldn’t be increased, but as of right now, there are 150 that are available for development. It does not include the land where Hamrick is currently constructing or the 30 acres in which Kenda will be constructing and hopefully occupying by 2023. There is no change on the Commercial side. Development (Cont’d.) as well as the building, but you can still see the breakdown between the office and retail space. Nothing new to report on the 2021 New Jobs Program. You may have seen the progress at Petitti’s. I had the opportunity to meet with A.J. yesterday and tour the interior. I didn’t want to give it all away and so I am going to refrain. You can see the exterior. It is really good to see one of those reinvestment sites having reinvestment back into it. They do anticipate having a soft opening in early March and then obviously we will invite all of Council and we will do a big celebration. The available real estate in terms of the Industrial space is only 4,000 square feet remaining in the City of Tallmadge. 6,600 square feet was taken off of the market and it is because Dove Audio visual who is also doing this evening’s camera work. They made a good acquisition. This is the former Speelman facility at 358 Commerce Drive and as you know, Speelman had consolidated their operations into their Northeast Avenue headquarters freeing up this building which Dove Audio was able to acquire, so it is another really nice industrial building and it is great to see that Dove being able to be retained within the community and backfill a really nice building. So, with that, that concludes my report, but I would also be happy to entertain any questions. e. Director of Finance: Thank you. I have submitted my written financial report. In January we were looking pretty good with everything. January was a busy month getting the year wrapped up and starting to prepare for the audit and if anybody has any questions on the financials, I would be glad to entertain those. f. Director of Law: Thank you. I have no report this evening. 10. Reports of Standing Committees of Council of the Whole: a. Planning and Zoning Carol Kilway, Chair Rebecca Allman, Vice Chair The Planning & Zoning Committee deals with land use, zoning, conditional uses, planning, economic and community development, public property. i. Second Readings of Ordinances and Resolutions Ord. 2022-29 – P.H. on 3-10-22 @ 7:01 p.m. – Amended – Amending the zoning map by rezoning the property of Applicant, Pulte Homes of Ohio LLC and owner, Mindale Farms Co. from R-1 Residential District to R-6 Residential Open Space Planned Development District consisting of approximately 124.3 acres and approving the General Development Plan located at 1485 Northeast Avenue, Parcel 6008558. Sponsor: Councilperson Carol Kilway Mrs. Kilway: We do have at 2nd Reading Ord. 2022-29. Ord. 2022-29 was read into the record. We had a public hearing scheduled, but we are going to have to amend that based on the Planning & Zoning meeting being changed and so I would like to schedule the public hearing for March 10th at 6:00 p.m. instead of 7:00 p.m. Dir. of Law: Mrs. Kilway, if you could set the public hearing at 6:01 p.m. just because as the public hearing, it wouldn’t start immediately. Mrs. Kilway: The public hearing will be at 6:01 p.m. at the Tallmadge Community Center instead of here at Council Chambers. Is there anyone here today to speak to Ord. 2022- 29? Mick Belknap, 785 Bentley Place Blvd., Tallmadge. My wife wrote a letter . . . I don’t know, she was under the assumption that it was going to get read today. She submitted one. 4  COUNCIL MEETING Council Chambers @ 7:00 p.m. February 10, 22 Pres. of Council: Sir, we are in receipt of the letter, but the letter did not ask that it be read into the record and so that e-mail was forwarded to the rest of Council and so Council is in receipt of that letter. Nick Belknap: OK. Is there any way to get it read, or no? Dir. of Law: Sure, if you guys want to pull it up. Mrs. Kilway: I have it pulled up on my phone in case you want me to read it. Nick Belknap: I am a little nervous up here. She explains it a lot better than I do. Mrs. Kilway: This letter is from Michelle Belknap, 785 Bentley Place Blvd., Tallmadge. Mrs. Kilway read the letter into the record. Dir. of Law: Mrs. Kilway, we need to have amendments today because of the change in the time for the Planning & Zoning Commission meeting and your resetting of the public hearing. We have the amendment that reflects those changed dates and so if you want to go ahead and adopt that this evening that would be preferable. Again, I would note for the record that the meeting of Planning & Zoning will be at the Community Center at 6:00 p.m. on February 22nd and the public hearing for City Council has been set this evening for 6:01 p.m. on March 10th which will also be at the Community Center. Finance Craig Sisak, Chair Jonathon Bollas, Vice Chair The Finance Committee deals with budget, appropriations, and reappropriations, bonds, franchises, investments, and expenditures. i. Second Readings of Resolutions and Ordinances A. Ord. 2022-30 – Authorizing the Mayor to enter into a contract with the K Company through Ohio Buys State Purchasing Program without competitive bid for the HVAC system located at the Recreation Center and providing for immediate enactment. Sponsor: Mayor David G. Kline Mr. Sisak: I would like to call Finance to order. We currently have Ord. 2022-30 at 2nd Reading. The ordinance was read into the record. I would imagine this was budgeted for in the 2022 Budget. Dir. of Pub. Service: It was not budgeted. We talked about it, and we looked at possibly getting into the ARPA Funds to fund that. Does anyone have any questions about this? It looks like it is going to be about $150,000 they are going to borrow from the parking lot to pay for this HVAC and handling system. Any questions about this? Mrs. Kilway: Would we be able to use the ARPA Funds then for the parking lot? Dir. of Finance: Yes. Service: No. Mrs. Kilway: Are we making this revision because we are having more developments coming in and so we want to kind of give the developer a break on the tap-ins because they are going to be doing more at once, so they will have an economy of scale putting them in? Dir. of Pub. Service: Not to give them a break, it was more or less a learning curve the last year with Pulte. I have never seen a development go in with 5 phases in a year and we just didn’t budget or appropriate that type of money and so the Water Department was actually showing issues and it just didn’t make a lot of sense for us to go buy it and go drop it off . . . it was a learning curve. It would just be a lot easier for them to do it in-house. Dir. of Law: May I just add that I think the difference here is the purchase of the equipment and so when you look at the pricing, it is basically just allowing that when there is a development going in with more than 10 homes that they are allowed to purchase the equipment, but it has to meet our requirements and then they can install it and then all we do is inspect it and that money is just the tap-in fee part where the other two types of fees that you see there it is either all of it like if it is a single home, you purchase the equipment and we install the equipment and there is the tap-in fee part or the second option was . . . We provide the materials, and they install it and then pay the tap-in fee. That is the difference. They are providing the material and the reason for that is because it is a lot of time, energy, and expense from our department when there are that many being installed. The ordinance was read into the record. Dir. of Law: A civil case has been initiated by the City of Tallmadge in the County of Summit and the Summit County Court of Pleas is the next step in the enforcement of the partial condemnation order for remediation for various code violations of the Midway Plaza property. Brouse McDowell is representing the City of Tallmadge and the County of Summit. I am not going to make any further statement due to pending litigation on the floor. We do have an Executive Session should Council have in regard to this. Mr. Sisak: Would you like action taken on this after the Executive Session? Dir. of Law: That would be asked for please. I have my own comment, the Tallmadge Girl Scouts are working on a community service project to clear the fire hydrants and so you might see them out and about this weekend. Safety Adam Bozic, Chair Craig Sisak, Vice Chair The Safety Committee deals with Disaster services, communications, fire, and para- medics, police, and health Mr. Bozic: I would like to open the Safety Committee. We have nothing currently on the agenda. I do want to bring up a couple things here. We have the Summit County Regional Dispatch Center Ceremonial Contract Signing that will take place on February 17 th at 10:00 a.m. and that is going to take place on-site at the dispatch center. The other thing I would like to mention would be as Ms. Gutman had mentioned, the fire hydrants, I did have a conversation with Deputy Fire Chief Ben and Mr. Rorar about fire hydrants and the shoveling and everything like that and I do want to make you aware or make everyone aware that as I was made aware by Mr. Rorar, our fire hydrants are GPS locations and actually our IT guy actually informed me this evening too that that information is accessible to the Fire Department when they are on location. So, I think that is great information to have. I don’t think that should mean that we shouldn’t shovel around them. I still think we should, and I just wanted to share that information. Public Service Rebecca Allman, Chair Mary Gutman, Vice Chair The Public Service Committee deals with streets, highways, sidewalks, buildings, and improvements; water, sewer, electricity, gas, energy resources, recycle, waste, and trash. Mrs. Allman: I call the Public Service Committee to order. We have no legislation at this time. Does Council or the Administration have anything? Seeing none, I close committee. i. Additional Items: None. 11. Reports of Special Committees: a. Council Operations Committee: Pres. of Council: Mr. Bollas, would you like to give us an update on this project? Mr. Bollas: Yes, thank you Mr. President. I just wanted to take this opportunity to thank Dove Audio Video and Justin, Scott in the IT Department, and Mr. Cooper in the Administration. This has really been expedited; you know the original timeline for this we had estimated three to four weeks and all the supplies came in ahead of schedule and there were some faulty parts that got replaced rapidly and the staff from Dove is here now, so I just want to say to Mr. Davis thank you again. We are essentially just piloting this at this point and working out the kinks and there were some test runs done earlier. Again, I just want to say sincerely thank you to everyone involved in this. We did have a meeting with Mr. David Omni at Tallmadge High School, and this was just an exploratory discussion around potential volunteer hours or extra credit opportunities or a community service requirement for graduation. We need to look at 1) if it would even be an option working through our guidelines and we would primarily target next school year if that would be something to consider. Dove is going to put together some documentation for us to hopefully make it as easy 8  COUNCIL MEETING Council Chambers @ 7:00 p.m. February 10, 22 Jonathon Bollas (Cont’d.) as possible to operate. A lot of the equipment right now is automated and so there are options for voice activation and where the cameras will put it and there is also a control panel for camera views so the audience at home can see our presentations and PowerPoints to guest speakers. Again, they did a great job with the installation. No interruption to daily operations. We are still exploring that in terms of the staffing. We do have their services included for three additional meetings. We had initially, at this point we are still in a pilot phase and are working out several questions we have, but right now we are targeting the April 14 th meeting to go with our first live stream of that meeting. Dove will be here as we continue to work through the operation on that. I think it is a really great thing for our community. Mrs. Kilway: Just a quick question, I know that tonight is our big test night. Is there any way we could get the link sent to everyone on Council so we can take a look at it and see what it looks like? Mr. Bollas: Yes, I’m sure we can. i. Additional Items: None. Pres. of Council: I will add one more item, Mr. Bollas and I will be meeting with Mayor Adamson from New Franklin on February 25th. They have been live streaming for a long time just to get some input from them on lessons learned. That is one of the reasons we are waiting until April to kick this off. With us also this evening, I invited Mrs. Conti to come in. She made me aware of something that I didn’t even know existed. I am sure that most of our community does not, so the floor is yours. Deputy Clerk Conti: It is kind of an appropriate time now that we are having a lot of interest in some public meetings, so this is the ability to go on the website. Don is going to show you, that icon there takes you to the “Notify Me” category and from there you can put your email in and you can be notified of every public meeting that we have; you can choose an e-mail most times or a text message and so one of the things when I put the agenda out to the public, I send it to the press and some people who have actually asked for e-mail copies and then I send it to all of the Administration and inside and then I send it to the Council office and additionally when it is posted to the website, there is a place to put in a message that goes out to everyone who has subscribed to this “Notify Me” so right now I think we have about 26 people that have subscribed and it is probably the same that it has been for a long time. Any resident that wants to be proactively notified about a type of meeting can sign up and be notified to a message and link to the agenda that is on the website that has all of our legislation reports, etc. It is an easy way if somebody says, well I didn’t know, well we have this capability that is pretty simple to do. Pres. of Council: I would also like to add that Mrs. Kidder was also very helpful this week as well. As you know, she will post it on Facebook and now when our agenda is done, she will, this morning, the day of the meeting, she will send out another post and that will have the live agenda on it with the links. So, not only are we willing to send things out, e-mail, text notifications, etc. to anybody that is on Facebook will see and actually be able to click on the live link on our agenda and participate somewhat on our livestream and at least be able to follow along with what we are doing. 12.
