COUNCIL MEETING Council Chambers @ 7:00 p.m. March 24, 22 1. CALL TO ORDER. President of Council Loughry called the Council meeting of Thursday, March 24, 2022, to order at 7:00 p.m. 2. Opening Prayer & Pledge of Allegiance: Prayer: Rev. Tod Sandler from Tallmadge Alliance Church. Pledge of Allegiance: Sydney Kaiser, 4th Grader at Cornerstone School. 3. Roll Call: Mrs. Allman, Mr. Bollas, Mr. Bozic, Mrs. Gutman, Mrs. Kilway, Mr. Loughry, Mr. Sisak – present. 4. Correcting and Adopting the Previous Meeting Minutes: 3-10-22 Council Meeting Minutes: To be provided. 5. Financial Reports: None. 6. Public Hearings: None. 7. Community Input: Pres. of Council: This is the time during our meeting when anyone who would like to speak for 2 minutes to Council on anything that is not on the agenda. So, is there anybody in the audience this evening that would like to speak? Seeing none, we will move onto Agenda Additions and we have three. 8. Agenda Additions: Pres. of Council: First we have Judge Lisa Coates, Stow Municipal Court Judge Coates talked about her duties being a judge at the court. She spoke about the court and who they serve. The jurisdiction serves 16 communities in the northeast section of Summit County. • Handle all the arraignments and set bond. We also handle civil issues. • All of the courts have been able to obtain new technology for virtual hearings and we can communicate with our Oriana House and some of our facilities and with the prisons now as well. • Criminal Justice Reform has been big in the last several years and what that essentially means is limiting incarceration and improving rehabilitation. • To be considered a Specialized Docket in the State of Ohio you must be certified by the Supreme Court, and we only have one in our court right now. A Specialized Docket has judicial in supervision and interaction. • I've been approached on multiple occasions about when are we getting a drug court in Stow and so I am making that a priority. Presentation of Certificate of Appreciation to Paul Kraszewski from Jonathon Bollas. Mr. Bollas: Thank you President Loughry, Administration and Council for having me here today to present this certificate. This is a fantastic sign of appreciation that we started this year, and this was literally the first person that came to mind when we introduced this certificate program. Paul, Krzyzewski is one of my neighbors off of Peter Path. These are a few items with regard to Paul: • He’s forever thankful to be married to his wife, Donna Thomas. • He's the middle child from a family of five. He has an older brother and sister, and two younger sisters. • He has one amazing daughter and her name is Lydia. • He was born and raised in Cuyahoga Falls. • Graduated from Falls High School in 1977. • He had 26 years of service with the Goodyear Tire and Rubber Company in the Mileage Sales Department. • Soon to have four years of service as a bus driver for the Tallmadge City Schools and he's resided in Tallmadge for nearly three years now. 1  COUNCIL MEETING Council Chambers @ 7:00 p.m. March 24, 22 • He’s truly thankful and grateful to be a bus driver in Tallmadge. His philosophy starting always with kids first, then teachers, administrators, parents and fellow bus drivers. He makes it a point to be kind, friendly, caring and overly happy. He's very blessed to be here and recognized this evening for those traits and be a wonderful fit for all kids that ride bus number 28. Mr. Krzyzewski thanked Council and the Administration for this honor and he stated that it’s awesome to recognize someone like himself who goes out and tries to, you know, do the best he can for the community. City Department Presentations: • Police Department Chief Williams: • We've been restructuring our command staff. I'm sure you know that we promoted a couple sergeants in December. Jim Orsine and Derek Heatwall are both doing very well. • This past Saturday we gave our Captain’s assessment and I have been told that they did very well; our 3 Senior Sergeants. Hopefully we will get the results from that here in the next few weeks. • We hired a young man from Tallmadge. We actually swore him in before the last Council meeting. Young man, Lou Carlson, who grew up on Atwood. We have been very lucky. It has been very competitive hiring good candidates in Police work. • Something that has really been talked about a lot is Police reform and one area that we really excelled at is CIT which is Crisis Intervention Training. The two most important areas are dealing with people in a mental health crisis and de-escalation. • Officer Ralph Stover approached me a couple of years ago and wanted to take the lead and has done very well actually to the point that on April 6th he is going to be the CIT Officer for the State of Ohio and he is going to be receiving that award down in Columbus. • I wanted to talk about my building. You guys approved our building improvement project last session, and they are just about done with the top level. We’ve got new flooring; new paint job and the next phase will be furniture. It is really starting to look better over there. Thank you. 9. Reports of Administrative Officers: a. Mayor/Director of Safety: Thank you for being here Chief Williams. So, let me start with the Fire Department. We also were considering the Battalion Officers. We had two that retired, and we just completed that test actually and sent out offer letters yesterday to two of them and so that process is done. They will start on April 5th. Last Friday we swore in 6 new firefighters here in Council Chambers. I know some of the Council folks were here, so thank you for that. We are starting the process for the new Lieutenants that were authorized through the union contract. As you can see, the fire station is really moving along. The roof structure on the high bay area, the back half of it, which is harder to see, all of the metal decking is up on that, and they started the metal deck on this side. The Treat Blvd. brick is completed and now they are working their way around the building. The inside, the business side with the sleeping quarters and the living quarters, that has all the duct work almost completed, the sprinkler, the inside electrical wiring is just about completed. I do offer anybody wishing to go through it, I will gladly take you through so you can see it. Dr. Cooper is out on training this week. Matt Springer is in Indiana. His brother is getting inducted into the Hall of Fame of Indiana. I think most of you have heard that Matt is moving on from the City of Tallmadge. Sad to say that, but I am happy for Matt. 2  COUNCIL MEETING Council Chambers @ 7:00 p.m. March 24, 22 Mayor: You can see on the wall up there the new zoning map has been updated and we have new colors and hats off to Helene and her department downstairs and Terry for getting that mounted. End of report. Mr. Sisak: How are we doing on the budget with the building of the fire station? Mayor: We are on budget right now. We have some change orders that have been going through the Board of Control. We have roughly about $200,000 that is extra for us right now. The only issue that I will probably have towards the end are the actual weights for the weight room. I should have enough to do that, I’m not sure. Still, we can open up the building and borrow some equipment from the Rec Center. b. Director of Administration: Dr. Cooper was out of town on training. c. Director of Public Service: Good evening. I would like to start with mentioning Memorial Day. The parade assembly starts at 9:30 a.m. at the Hole. It is a new route for the parade this year. The parade kicks off at 10:00 a.m. and it goes from the Hole to West Avenue, gets to the Circle and it will go clockwise around the Circle and then to Southwest and the cemetery. The service at the cemetery will immediately follow the end of the parade. The pancake breakfast is occurring as well as the Ritchie 5-K run. This is the PCR rating which is the paving condition report for the concrete and if you look, that is the City of Tallmadge, and everything colored in there is a rating scale for concrete roads. We got the concrete bid opening. The numbers came in pretty good. The base bid was $216,000 and you can see there all of the streets on the left are the ones that are going to have the slabs done and that is a variety of neighborhoods and then sidewalk repairs, you can tell by the square yardage that it is just not one block; those are many blocks on those streets. Also, this year, curb and gutter replacement. The alternate bid was for the promenade through the Tallmadge Circle. That is a walkway replacement and then Bid No. 2 was for sidewalks to be done at Baker’s Acres. Keep in mind per the ordinance, they had 3 years to put the sidewalks in there and they are actually going on year 5. So, we are going to take his bond by the middle of July. We extended it once for him and Mr. Baker is well aware of that. The promenade: some people ask why we are doing the promenade at the Circle. Well, this is exactly why we are doing the promenade. The walkways are swamped especially in the center there. That will be a 6” thick stamped concrete, 10 foot wide so you can drive a vehicle on it. It will look like the Veteran’s Memorial that was done. So, this is the VCR for the asphalt. You can see a lot of streets there in the City of Tallmadge there again, our streets are OK, but the bigger problem is that we need more of that blue and not so much of that green because that green is hard to judge because we are going to start slipping a lot of streets into fair and then poor off of that green faster than we can replace them. The bids came in this year. Again, they were great bid numbers. That is a decent paving job this year. Alternate Bid 1 is the Rec Center paving of both the north and south lots and we budgeted $150,000 and I think everybody can remember that we are going to use that money for the HVAC controls and upgrades that are being done up there, so I am asking for Council to consider re-appropriating and that is Ord. 2022-43, and I am asking for it to be done at 1st Reading and I will explain why. Alternate Bid No. 2 is the JetPack, the old Waltco parking lot in between JetPack and SPAN Ministries. This is part of the package deal. Waltco, before they left, signed over to the CIC, which uses the . . . they manage the parking lot for us for the City and they received about $103,000 and I am asking for that to be passed at 1st Reading and that is Ord. 2022- 42. This is part of the package. The Living Tree: those are the three trees this year for the Living Tree program. One of the things I was waiting for to put this out was for the promenade. A lot of those trees are 3  COUNCIL MEETING Council Chambers @ 7:00 p.m. March 24, 22 Dir. of Pub. Service (Cont’d.) going on the Circle and so there again, and it is a hot item. This year we are only doing 20 trees. You can only do so many. You can’t maintain more than 20 trees. Speaking of trees and I know a lot of people have talked about this; these are the City of Tallmadge street trees for the lawn strips or the devil strips or whatever you want to call them. We had a moratorium on them because of the damage done to the sidewalks over the years. They weren’t the right tree species. So, we hired a landscape architect and we asked him to come up with a better tree that can be used in these things that is disease free and salt tolerant and sucker free, litter free, drought tolerant and then the big thing was the dimensions of the devil’s strip as well as the topography. Lastly, what is not going to cause issues to the sidewalk. We don’t want to damage that infrastructure. So, you can see there they put this together and anything less than 8’ wide will not receive a tree. So, if your devil strip is 7’, 6’ or 4’ those will not be allowed because it is too narrow. The second thing is the grade of the sidewalk. So, what comes to mind is Amy Trail. Everybody is familiar with Amy Trail. That is too steep of a grade and the reason why doesn’t work is because it doesn’t hold water. Something else we are doing is we are putting on a root barrier and so as the roots come out, they hit that barrier and that will drive them down and will drive them underneath that sidewalk. There is a tree species on the left and I reached out to Petiti’s and so anybody in an old neighborhood that would like to get a tree, they can go to Petiti’s and get one of those trees. In the new allotments that is going in. They would have to abide by this, and they would have to plant the trees. I mean we all know about the Dutch Elm disease and the Emerald Ash. So, a polyculture is a different tree and so if something does hit, it won’t wipe them all out. Mrs. Kilway: Can you send me the slides for the concrete program and the asphalt program that shows the streets that are going to be done? Just in an e-mail anytime in the next couple of days would be great. Mr. Bozic: You had mentioned trees and they would be on the street side of the sidewalk and the branches that overhang. With the trees that you are recommending; they are how far from the street? Dir. of Pub. Service: They would be planted in the middle of the devil strip. d. Director of Economic Development: Matt Springer was out of town. e. Director of Finance: Good evening. Since I was not at the last meeting, I did send out the March financial reports and I know it was a while ago, but so far this year we are still looking good. The auditors just started in my office this week and so we are in the middle of that audit. Moving forward, I just sent out to the Mayor and Councilman Sisak a draft of some criteria to review for sending out to the Department Heads for them to start submitting projects for the ARPA funding and so we will start that process. I will just remind Council also that in terms of the ARPA funding, we have only received half of it, so we will not receive the second half until probably the third quarter of this year. So, if any Council people have questions about the financial reports or anything else, I would be glad to entertain them. Mayor: If I could add one thing on that. I was actually at a Summit County Mayor’s meeting that we have monthly, and we always have a speaker from Columbus speak to us about the legislative updates from down in Columbus. One thing that really bothered me was the comment that is coming out of Columbus is that the State Legislators are all saying that they are thinking about taking some of our local funding away because we are doing too good with ARPA funds. ARPA is a one-time expenditure and Tallmadge has $1.8 or $1.9 million and when that is gone; it’s gone. It is not a re-occurring fund. They are passing legislation down there saying that they have plenty of money because they have the ARPA funds and so that comment really bothered me. It is bothering a lot of the local mayors. We deserve that local fund. They already took it away once and so there will be more to 4  COUNCIL MEETING Council Chambers @ 7:00 p.m. March 24, 22 Mayor (Cont’d.) come on that. We will meet with our local legislators as a collective group, the Summit Mayor’s Association soon. f. Director of Law: Thank you. I have no report this evening. 10. Planning and Zoning Carol Kilway, Chair Rebecca Allman, Vice Chair The Planning & Zoning Committee deals with land use, zoning, conditional uses, planning, economic and community development, public property. i. First Readings of Ordinances and Resolutions A. Ord. 2022-45 – P.H. on 5-12-22 @ 7:03 p.m. – Repealing Tallmadge Codified Ordinance Section 1103.06 R-6 Residential Open Space Planned Development Districts and amending the Table of Contents, Code Index, Section 1101.04 and Section 1102.14 to eliminate references thereto. Third Readings of Resolutions and Ordinances A. Ord. 2022-38 – Amended – Authorizing a one-time special payment to certain non-collective bargaining employees and providing for immediate enactment. Sponsor: Mayor David G. Kline, Dir. of Finance Gilbride, Dir. of Law Raber Mr. Sisak: I would like to call Finance to order. We currently have Ord. 2022-38 at 3rd Reading. The ordinance was read into the record. So, we did amend this ordinance for the part-timers to go from $500 to $750. Dir. of Finance: There would be 90 part-time employees that would be impacted by that and so that would be . . . Pres. of Council: I believe the number was $22,500 and so it just impacts actually the percental of the increase that those in comparison to their wages is getting over the full-time employees. Mayor: There is one more bargaining unit that has not been part of any of these and that is the part-time firefighters. I do have a meeting set up. Mr. Bozic: At some point in time there was some discussion about the Police Department doing a study like the Fire Department I believe for personnel. I didn’t know if we have an update on that. Community Issues Mary Gutman, Chair Carol Kilway, Vice Chair The Community Issues Committee deals with Parks and Recreation, civic affairs, and liaison between Council and the Recreation Board and intergovernmental affairs Mrs. Gutman: I call the Community Issues Committee to order. We have nothing before us tonight. Is there anything else to come before Community Issues this evening? Mrs. Kilway: I did have one quick question for Council since it does come under Community Issues with the Circle Fest and there is going to be a Light Parade; I would assume. Is that correct? Mayor: That is correct. Mrs. Kilway: Council, in the past we have always done a float, or I think the last time we lit up golf carts. Mr. Loughry, are we going to do anything like that this year? Pres. of Council: I don’t know. Mrs. Kilway: It is only 4 or 5 months away, so this is something that we need to start planning now and that is why I am asking. Pres. of Council: You are going to need to do that. I think I do some things pretty well, but I am also very aware of some of my weaknesses and so I need to be more cognizant of what we are going to do at events like that. So, I will try to think more about that. Yeah, I would like to do that. Mrs. Kilway: I think it shows unity as a Council and Administration to put a float together or something. It is just a matter of what are we going to do this year. Pres. of Council: For those of you that are new to Council, the Memorial Day Parade is very special as well and I hope you are all available to walk and participate in that. Safety Adam Bozic, Chair Craig Sisak, Vice Chair The Safety Committee deals with Disaster services, communications, fire, and para- medics, police, and health Mr. Bozic: I call the Safety Committee to order. We are all present. We have no legislation in front of us this evening. I will open it up to any additional comments or questions. So, I do have one of my own. I did have a question regarding cell service seeing that that is kind of relevant to our safety. I didn’t know if we had any kind of update with that cell tower. Mayor: There are no applications in Planning & Zoning as of yet. Pres. of Council: I can give a brief update though. The vendor does a lot of work with Speelman Electric and their typical backlog, Christine told me, is 18 months and so we should not expect to see anything probably this year. But it is a priority project for them. They are just booked out. There was additional discussion between the Mayor and Mr. Bozic. Mr. Bozic: I will close committee. i. Additional Items: None. f. Public Service Rebecca Allman, Chair Mary Gutman, Vice Chair The Public Service Committee deals with streets, highways, sidewalks, buildings, and improvements: water, sewer, electricity, gas, energy resources, recycle, waste, and trash. i. First Readings of Resolutions and Ordinances A. Ord. 2022-44 – Recognizing the outcome of the 2020 Census reaffirming the Ward boundaries as provided in Tallmadge Codified Ordinances Chapter 105.01. Sponsor: Mayor Kline Mrs. Allman: I call the Public Service Committee to order. We have at 1st Reading Ord. 2022-44. The ordinance was read into the record. Mayor: We just wanted to ratify with Council so we have some records and Megan can probably talk better on that issue, but the map is on the table as I have shown Council in the past. The blocks of the City of Tallmadge and to balance out the wards. We are within 6.7% from the highest ward to the least and I anticipate that at the next census we will definitely have to tweak the boundaries of the wards as we did in 2011 from the 2010 census. We had to change some of the ward boundaries. Sunset View used to be all 3rd Ward and now a portion of Sunset View is in the 4th Ward. That is when it gets pretty challenging. What streets do you move from one ward to another? Mr. Bozic: How is that process starting? Is that from the Administration, is that from Council . . . Mayor: It is from the census and so as soon as the census is finished, they put out the track map and then we are required by the Board of Elections to balance out as close as we can. Typically, if you are within 10%, you are doing good. We are under that and that is why we are not changing it at this time. When there are changes, the Administration will do the map and then Council has to ratify it. Mrs. Allman: We will just give this a 1st Reading. Is there anything else? Hearing none, I will close committee. ii. Additional Items: None. 8  COUNCIL MEETING Council Chambers @ 7:00 p.m. March 24, 22 11. Reports of Special Committees: a. Council Operations Committee: Pres. of Council: I think we are about ready to live stream. I had a conversation today with Max in IT regarding some signage that we were going to put in Council Chambers so that everyone would know that we are videoing and recording just in case I would ever forget to say it. We do have the ability at the lectern . . . so for instance, we have students doing the pledge and there may be from time to time a parent that may not want their child being videoed while we are doing that, and we have the ability of knowing not to video them. Then the last thing regarding Council operations. Forever, we have been doing verbatim minutes and going forward we are going to do legal minutes as briefly as are allowed based on what Mrs. Raber feels we can do those. Dir. of Law: Council Rules provides for summary minutes, and they will be summary minutes. Pres. of Council: So, the audio will always be available and obviously you can go back and listen to the meeting, but the minutes that we will adopt in the future will be summary minutes and not verbatim minutes. Mr. Bollas: I want to just add that from the last report there were really no updates. I did also talk to the Mayor, Andrea and Justin and everything seems good. I spoke to Dove again and everything seems fine there. I think we are good to go, and I just want to say thank you again to everyone. Pres. of Council: Then we do have two sections on our Council part of the website that need updating and we will do that just as soon as possible, but it will be done before that first live stream meeting. Mr. Bozic: What type of promotion are we doing to let the public know that we are going to be live streaming. Mr. Bollas: Again, this was a conversation, and the plan was that the link would be provided on the post whether it is social media and the webpage for awareness purposes and so it will be clearly marked, but there will be no other promotions. Pres. of Council: So, Mrs. Kidder has been very good and so on Monday of a Council week, she sends out a Facebook post about the meeting. As soon as that agenda is done, she sends out a post with the agenda attached with the links and so going forward, the community will have an opportunity to see it there or go to our website page and click on some sort of tab; hopefully very easily and then regarding the communication to us, we are going to treat it the same way as we have been recently and that is, if we receive an e-mail or a letter by 3:00 p.m. the day of Council then Mrs. Burton will forward that to us, and we will all have access to it. Someone may in the future ask a question if they looked at that agenda and clicked on a link, but we are not going to read them into the record.
