1. Call to Order:
Pres. of Council: Today is April 25, 2024, and this is our regularly scheduled 7:00 p.m. Council
meeting.
2. Opening Prayer: Rev. Daniel Doty, First Congregational Church, Tallmadge.
Pledge of Allegiance: Mayor Kilway lead the Pledge of Allegiance.
3. Roll Call: Mr. Bollas, Mr. Bozic, Mrs. Epstein, Mrs. Gutman, Mr. Pavlik, Mr. Roy, Mr. Rubino –
present.
4. Correcting and Adopting the 4-11-24 Council Minutes.
Mr. Pavlik moved to approve the 4-11-24 Council meeting minutes. Seconded Mrs. Gutman. Roll
Call: Mr. Bozic, Mrs. Epstein, Mrs. Gutman, Mr. Pavlik, Mr. Roy, Mr. Rubino, Mr. Bollas –
unanimous. The minutes from the 4-11-24 Council meeting were approved by a vote of 7-0.

7. Community Input:
Pres. of Council: This is the point in the meeting where anyone can address Council on any
item that is not on the agenda. Is there anyone who would like to address Council? Hearing
none, we will move onto Item 8.

9. Reports of Administrative Officers:
a. Mayor/Director of Economic Development:
o Thank you very much. These have been a busy couple of weeks. I did just finish up
my “After Hours with the Mayor.” I had several people come in. Some good
conversation and some good input from our community and that is what it is all about.
o I just want to remind everybody about the Tallmadge Little League Parade. It is this
Sunday at 5:00 p.m. Step-off is at 5:00 p.m. from Our Lady of Victory Church.
o Working on economic development in the City with inSITE. We met with several
businesses in the last 2 weeks. inSITE will be at the next CIC meeting which is going
to be next Tuesday.
o Per request from the last Council meeting, I did contact Dave O’Neil from the
Summit Emergency Communications Center to put together a tour for the Council
members and I realized we could only do 3 Council members at a time. He would
like to know what time of day works the best so he can shoot out some dates. So, if
you guys could all get to me and let me know what time of day works best so we can
get this schedule so you guys can have a look at it.
o I was invited to the wheelchair basketball banquet because they had just won the
State Championship and I did present them with a proclamation and some individual
achievement awards. They are working on getting them to Council for the next
Council meeting as well. So, we will get a resolution ready for that and we are looking
at May 9th at this point in time.
o We did host the 3rd Grade classes at City Hall this week. They were here on
Tuesday and Wednesday. 200 kids. We were letting them learn about what all goes
on at City Hall and City government. When we didn’t have them, the Historical Society
had them and so they had a couple of busy days as we did as well.
o We are actively working on the next Tallmadge Circular Newsletter. It will be out in
July.
o Working on planning the Memorial Day Parade. This is the 156 th consecutive
Memorial Day celebration and it is the longest running one in the State of Ohio. So,
again Council will customarily walk with the Administration in the parade so all of you
can be in attendance, that would be great.
o Also, we are working on the Circle Fest and Light Parade.

o Planning & Zoning meets on May 2nd and the State of the City address; we did have
it edited and it was put up on the City’s YouTube site and it went live tonight at 6:00
p.m. So, it is available for everyone to see. Any questions?
Mr. Pavlik: What is the date of the Circle Fest?
Mayor: The Circle Fest is August 10th.
Pres. of Council: I have a question regarding our Dir. of Administration. Do we have an
exact date of his arrival?
Mayor: Yes, we do.
Pres. of Council: What is that?
Mayor: May 13th. In just a couple of weeks.
Pres. of Council: Do we have a determination as to . . . I know we have kept the two
positions kind of lumped together on the agenda, I didn’t know what the intentions were of
the Administration for the Dir. of Safety and Dir. of Administration.
Mayor: He will be taking on some of the Dir. of Safety roles as I will. That will be kind of
split between the two of us.
Pres. of Council: Is that going to require any kind of changes to our grid because of that?
Mayor: No.
Mr. Bollas: I just wanted to say thank you to the Mayor and Justin and Mr. Rorar and
Jessica and Parks and Rec just for . . . I got word today that Wi-fi is available at Maca Pool
in the park and I know that that is something I have been asking about for a few years and
I understand with Covid and the backlog of hardware and whatnot and the installation, it
was just a huge achievement that I saw today and I have to say thank you and that is great
for the City.
Mayor: You are welcome. Great to everyone involved. I was not really involved; it was
99% Justin. He did all the work and Mr. Rorar; he is the one who made sure that it got
done.
b. Director of Administration/Director of Safety:

Good evening.
o I really don’t have any report this time. Next meeting I am going to be asking Council to
approve a change order for the Elton Avenue stormwater job. So, you guys know
anything over 10% over the contract amount, I have to come back to Council for. That job
was $47,000. There are 2 change orders. One was the catch basin it was sized for a 44”
pipe and it needed to be a 60” pipe so they had to change that and that cost me $4,298
and so I was under that threshold however the surprise was the gas line and making those
changes cost me an additional $13,122 and so I will be coming to Council to ask for
$17,943.54 on a change order for that project.
o Just to give you a ballpark figure, there are road plates out there that the contractor had
to rent because he doesn’t use that many and the barricades cost us an extra $2,500
because of the unknown gas line. That was a known gas line, but we didn’t know what it
was doing until we got to it. All the drawings and everybody assumed the gas line went
straight, well it did, but then it nose-dived, and it nose-dived right where we had to take the
pipe so that was the issue with that gas line. At the next meeting I will be bringing that.
o Also, I believe Councilman Rubino last meeting asked about membership discounts for
Summer Camp and we looked at that. We offer resident discounts. We are probably
going to stick with that because you can get a one-month membership and sign your kids
up for 9 weeks of summer camp and get the discount.
Mr. Rubino: I was talking more about priority registration for members; not discounts.
Dir. of Pub. Service: Not discounts; I apologize. So, you would like to see priority for
membership.
Mr. Rubino: Well, yeah, if you are a member of the Rec and you can do it how you

Mr. Rubino (Cont’d.) please, even if that means the recurring contracted members getting
first dibs at getting some of those perks of the Rec Center as loyal members.
Dir. of Pub. Service: Let me swing back to you on that at the next meeting. Let me see
if I can come up with a better answer. I misunderstood; I apologize.
Mr. Rubino: That’s OK.
Dir. of Pub. Service: Councilman Bozic, you asked for Summer Camp improvements. It
was a challenge I think to get more kids involved. We took a look at that and at the end of
the day it really comes down to staffing. Each staff member can only have 6 to 7 kids
because of a safety issue. To get more kids involved, you have to get more staff involved,
which goes back to the budget, and we would have to ask for more money. To get more
kids involved, you have to get more staff involved. So, the only way you can get more staff
is I have to get it at budget time.
Mrs. Gutman: Does the increased revenue from the extra children offset the cost of the
staff members though?
Dir. of Pub. Service: Not that . . . we are not making that much of it, so no.
Mrs. Gutman: Do we lose money on it?
Dir. of Pub. Service: No. We are breaking even. We probably need to look at raising the
rates to tell you the truth, but that still . . . I mean we are not going to raise it by much.
Mrs. Gutman: If we could put that on the agenda for the budget season to look at
budgeting that in and how that all balances out I am in definite agreement that if we could
get more kids it seems like a service that so many families need and want and it would be
good to provide it if we could.
Dir. of Pub. Service: Sure. Absolutely.
Mr. Rubino: I agree. There has been a lot of interest in that.
Mayor: Another key factor that Jessica Simons had said when you add more kinds, once
you get to a certain point you have to add another bus to transport them and they do go to
different places constantly so by adding another bus that really increases their cost and
then it could just price people out of it completely in order for us to recoup the cost on 2
busses as opposed to just 1 bus. So, there is a delicate balance there that we have to
figure out.
Dir. of Pub. Service: All doable, but we just need to talk about it at the budget meeting.
Again, field trips are important. I mean let’s keep in mind it is 2024 and the kids’ phones
are probably more exciting than playing kickball and dodge ball at the park and so you
have to keep the field trips relevant. You have got to get them out of there once in a while
and still keep them going and if you want to get more kids, it is going to cost more money.
Pres. of Council: So, I think in the last meeting when I asked the question about the
Summer Camp I had kind of challenged you guys to think outside the box and part of that
would be considering options for transportation and overcoming those obstacles whether
it be you know half day camps or something. There are a multitude of options out there.
Considering that we have a full-time staff member now, that that is their sole responsibility
during the summer, which should be something that they should easily be able to come up
with is a new format of our Summer Camp program. So, if that means you know Monday
is this age group and it is Group A out of that age group, and they go on this field trip and
Tuesday it is this group that goes on the field trip. There are so many options out there
and we are getting stuck in our silo of this is how we have always done it, and this is the
way that it has always been. When I brought that up at the last meeting was, break that
down. Think of something that is completely different and how do we provide that service
because it is a service to more kids and to say that it is a . . . more staff would be required.
Dir. of Pub. Service: That’s a fact.
Pres. of Council: That is a fact; yes but . . .
Dir. of Pub. Service: So, it comes down to money. Budget time, we . . .

Pres. of Council: When we get it, but for years even when I worked at the Rec Center it
was what is the percentage that we want to re-coop. What is the cost recovery? There is
no cost recovery model that we have within the Parks and Rec Department. We may say
that we want to break even, want to break even, but I don’t think that we really know. So,
I just challenge the Administration to . . .
Dir. of Pub. Service: When we look at that challenge and it comes back down to safety.
I mean we did look at that challenge over the last month since you asked us to do that, and
it came back down to needing more staff and you get more kids; you need more staff. I
mean it is a safety issue. So, it is pretty simple.
Mrs. Gutman: Mr. Rorar, with all due respect, and you know I respect you a great deal,
we had this conversation last year as well and I feel like the request and the concerns are,
and I think there is frustration here, that it is not being fully considered and so you know if
it does take more action on our part something that we can do for you, if it is budgetary
because we are saying that it is a valuable service that we are hearing from our residents
regularly that this is something that they request. I would like to see it happening with
Adam on this Mr. Bozic, that we can be creative whether that is bringing entertainment to
the Rec or rotating it or however that case may be, I know the kids want to be entertained
and the parents just want them to be safe and so I think we can make this happen and I
hope that we aren’t here again next summer having the same conversation.
Dir. of Pub. Service: I hope we’re not either. Like I said, we did look at it and we need
more than “x”. You know you guys give us “x” for the Summer Camp and that is what you
are getting. You want more out of that, then we need more money.
Mrs. Gutman: Give us the number.
Dir. of Pub. Service: We will get it for you; next budget.

Thank you.
o I just wanted to report that we did have a very nice Self Defense Class training that was
offered by Summit County Prosecutor Elliot Kolkovich and co-sponsored by myself and
Summit County Councilperson Christine Higham. It was very educational and great skills
were taught and if any of our residents missed that the Summit County Prosecutor’s Office
is moving throughout the whole of Summit County to different communities to host them
once a month so people can look for that. It is a free program. Again, great information
for people.
o We are also hosting our Drug Take Back Day. It is this Saturday, April 27th. It is at the
Tallmadge Police Department and all people have to do is pull in. They don’t even have
to get out of their car, and they can drop off any unused or unwanted over the counter or
prescription medications that they need to dispose of. That is running from 10:00 a.m. to
2:00 p.m. We do this semi-annually in conjunction with the DEA and we always collect
quite a lot of people’s unwanted medications. It helps keep it out of our storm water system
which is great and keeps it out of the hands of people that don’t need it and it gets disposed
of properly so we encourage everyone to take advantage of that and if they can’t come
during that time we do also offer a drop-box inside the Police Department but you do have
to get out and put that in the lobby of the Police Department. Thank you. End of report.

10. Reports of Standing Committees of Council of the Whole:
a. PLANNING AND ZONING
Mary Gutman, Chair
Jessica Epstein, Vice Chair
The Planning & Zoning Committee deals with land use, zoning, conditional uses,
planning, economic and community development, and public property.
Mrs. Gutman: I call the Planning & Zoning Committee to order. We have no legislation
before us this evening. Does anyone have anything for the Planning & Zoning Committee?
Pres. of Council: I have some questions for the Administration. I know that we will be
discussing this in the near future, but this has been something that has been talked about
on social media and I have taken a few phone calls as well. If the Administration can
discuss anything related to the planned development between Overdale and Smith
Drive?
Dir. of Law: That item is on the agenda for Planning & Zoning, and it is a subdivision that
is being proposed. I believe there are approximately 20 houses in the subdivision that is
being proposed. It is already zoned accordingly so actually the process is that it goes to a
preliminary plat approval and then a final plat approval and Council does not take action
on that because it already has the appropriate underlying zoning. Then what happens is
eventually Council does get an ordinance. If it were to be approved for preliminary and
then final plat when it comes to the dedication of the streets and the acceptance of the
bonds is when Council would see an ordinance on that matter, but the public is welcome
to attend the meeting for the Planning & Zoning Commission which is next Thursday at
7:00 p.m. here in Council chambers.
Pres. of Council: Alright. Thank you. Can you describe what studies or documentation
is submitted with a site plan like that?
Dir. of Law: So, it is a plat process. So, they have to submit the preliminary plat and that
shows where utilities are going to be, locations, lot size, setbacks, all the lots and where
the roadways will be and all those things and all those plans are available to the public as
well and they can take a look at that. I believe there is a link through our website on the
agenda item and then where they can come into Planning & Zoning Department, and they
can ask questions there and I know that they have assisted other people that have come
in and asked questions about that.
Pres. of Council: Are they required in our Planning & Zoning Code to provide soil sample
tests, traffic studies . . .
Dir. of Law: So, they have to comply with what is required in the Code that includes
typically concerns with utilities, soil and water, if there is any movement over an acre you
have to comply with all the Summit County Soil and Water gets involved and their water
engineering has to be reviewed by our engineer and the Fire Department looks at it for Fire
Code regulations, the Police Department, the Street Department and internally everybody
that has a role in it takes a look at it.
Pres. of Council: Thank you. That is good information to have. I think that a lot of the
questions that I know that I have been fielding have been related to the different types of
studies that are required for a development.
Dir. of Law: Well, again because this is already zoned this way, there is not like conditions
that are put upon it, it is just what the Code requires, and it has to meet all those
requirements.

The Finance Committee deals with budget, appropriations, reappropriations, bonds,
franchises, investments, and expenditures.
i. First Readings of Ordinances and Resolutions.
A. Ord. 2024-36–Exhibit A – Exhibit A. Tracked – Amending Ord. 109-
2021 rates, charges, and fees for the Zoning Department and providing
for immediate enactment.
Sponsor: Dir. of Pub. Service Rorar.
Mr. Pavlik: I call the Finance Committee to order. We have Ord. 2024-36 at 1st Reading.
The ordinance was read into the record. Mr. Rorar, do you have any comments?
Dir. of Pub. Service: Yes, so the sign permits; that is a cleanup from the last time. That
was changed and we just never updated the fees so those no longer exist; the temporary
and the limited duration; those are zero. There is no cost for them. The Natural Landscape
Permit . . . so we never set a fee for that permit and that is why we are coming in here for
tonight and then the last one on the second page is the Certificate of Design Compliance
and no such thing exists. That is actually the Certificate of Appropriateness. We are just
cleaning that up as well.
Mr. Pavlik: Does Council have any questions on this? Mr. Rorar, you are looking for 1 st
Reading adoption?
Dir. of Pub. Service: It doesn’t matter. I mean, no. It can go 3 readings, but thank you.
Mr. Pavlik: With that, we will go to the next Council meeting for 2 nd Reading on that
ordinance.
B. Ord. 2024-37 – Authorizing the Director of Public Service to advertise
For bids and the Mayor to enter into contract for miscellaneous repairs
And remodeling of Fire Station 1 at 85 W. Overdale Drive and providing
For immediate enactment.
Sponsor: Dir. of Pub. Service Rorar.
Mr. Pavlik: Next we have Ord. 2024-37. The ordinance was read into the record. Mr.
Rorar, do you have anything on this?
Dir. of Pub. Service: So, this is pretty much a facelift for Station 1. Remove and replace
is what it is. So, where the old tile is at, it is being ripped up and having new tile put down
and where the old carpet is at, it is being ripped up and putting new carpet down. The
walls are being painted and I think 5 of the windows are being replaced. So, there is no
addition. There is nothing new being added. I believe there is one hallway that is being
put back. I believe the hallway was removed at some point and now we are putting it back.
Mr. Pavlik: Thank you. Council, do you have any questions?
Mr. Bollas: Yes, just a question. I see here just in the first WHEREAS statement you are
talking about painting, replacing the flooring, the windows and doors and cabinets,
countertops. Is there . . . I toured the facility and I understand that it has been through a
lot of different repairs. Was there like a larger list or like was it evaluated as these are the
top priorities for like that budgeted number and now, I don’t have that number off the top of
my head, but . . .
Dir. of Pub. Service: $130,000 was budgeted.
Mr. Bollas: OK, $130,000 so out of the list for the year these were at the top.
Dir. of Pub. Service: Yes. So, pretty much 90% of that station will have that face lift.
Mr. Bollas: OK.
Mr. Pavlik: In the ordinance in Section 1. It states that Fire Station 1 of the City in
accordance with Plans and specifications now on file in the office of the Dir. of Pub. Service.

Mr. Pavlik (Cont’d.) When I asked to see those plans there was nothing.
Dir. of Pub. Service: So, this can go 3 readings and I should have that spec done by the
3rd Reading.
Mr. Pavlik: Are there any other questions from Council?
Pres. of Council: This is probably more so a comment than it is a question, but Mayor
Kilway, I know you and I have had some conversations about just kind of the future of the
City and the development and things of that nature and different areas of the City that could
be developed for City use and I am just curious if that is something that maybe we need to
take a look at. I know it is only $130,000 and obviously that is a lot cheaper than it would
be to build a new fire station and I an not suggesting that that is what we need to do, but I
believe that there is probably other repairs or remodeling that is going to need to happen
to Fire Station No. 1 beyond this? Is that a fair assessment?
Mayor: This is what it takes to make Fire Station 1 more livable because yes, the firemen
do live there 24 hours a day and this is to help get it up to acceptable standards. We are
evaluating all of the facilities but as you know, that takes a long time. It could be 5 or 10
years anything would change, so we need to make sure that this fire station is appropriate
for people to be living there for 24 hours a day and that is what this facelift will achieve.
Pres. of Council: So, when you say living there; does that . . . it has been some time . . .
Mayor: They are living there 24 hours a day, so they eat, sleep and . . .
Pres. of Council: Right, but is there within the living quarters, how many spaces are there
for the people that are currently on duty to go rest in a bunk or whatnot?
Mayor: There are like individual rooms for each firefighter that is on duty.
Pres. of Council: So, we have an adequate amount of living quarters for the total number
of firemen or firewoman that are on staff at any given time?
Mayor: Yes.
Pres. of Council: OK.

d. SAFETY

The Safety Committee deals with disaster services, communications, fire, and
paramedics, police and health.
Mr. Rubino: I call the Safety Committee to order. We have no legislation before us this
evening. Is there anything for the Safety Committee?
Pres. of Council: In light of the recent fires that we have had in the City, it got me thinking
about . . . I know we have Sandy who is our Fire Prevention Education person. Do we go

Pres. of Council (Cont’d.) into the schools and teach the students about fire safety and
fire escape plans and those sorts of things at a younger age and them maybe the Middle
School age or High School to say hey here is what you do if you have a grease fire and
those sorts of things.
Mayor: Firefighter Sandy does a great job with her fire education. She has several
programs that she goes and puts on throughout the City, within the schools, within senior
citizen communities, and I am going to be going with her next week I believe on some of
them as well. She does a great job getting that word out. So, she does have a lot of
different programs that she has for many different age groups.
Pres. of Council: OK, so she is physically going into the schools and teaching these
courses.
Mayor: Yes.
Pres. of Council: Because that is contradictory to what I have heard whether they have
been permitted into the schools due to lack of time based on . . . you know obviously they
have the curriculum they have to meet and things like that. So, maybe you could connect
with Steve Wood and just make sure that is being allotted or that they be given a 30-minute
training session or something like that. I think it is important to do. I think that it would . . .
it may not solve all of the safety problems, but if it can save one, I think that is worth it. So,
I just think that . . .
Mayor: These fires; they are accidents. They are not done on purpose. Nobody does
them on purpose.
Pres. of Council: No, I’m not saying they are done on purpose. I am just saying . . .
Mayor: And everybody did the appropriate thing. They all had training at some point in
time and everybody did get out of the house for both of the incidents.
Pres. of Council: Maybe you misunderstood what I was saying. I am not saying anybody
did anything wrong or . . .
Mayor: I’m not misunderstanding. I’m just saying that her training through the years
because she has been doing this for years . . . her training through the years has
obviously helped at some point in time because these people knew what to do.
Mrs. Epstein: I, as someone who has children in Tallmadge Public Schools, in Christian
schools, both of my children know Firefighter Sandy by first name. She has come into
both of their schools, and they adore her. She has done a great job. Thank you.
Pres. of Council: I am not saying firefighter Sandy is not doing a great job because I
know she is doing a great job. I am just saying in recent history, recent past, that
perhaps the schools have not permitted her in due to a lack of time based on the
importance of curriculum and things like that that they are being forced to do on a normal
basis.
Mayor: I will circle back around with Mr. Wood and make sure that she is you know
being allotted her time in order to go in.

The Community Issues Committee deals with Parks and Recreation, civic affairs,
and liaison between Council and the Recreation Board and intergovernmental
affairs.
Mr. Roy: I call the Community Issues Committee to order. We have no legislation before
us this evening. Are there any questions for Community Issues? Hearing none, I will close

f. PUBLIC SERVICE

The Public Service Committee deals with streets, highways, sidewalks, buildings,
and improvements: water, sewer, electricity, gas, energy resources, recycling,
waste, and trash.
Mrs. Epstein: I call the Public Service Committee to order. We have no legislation before
us this evening. Are there any questions or comments regarding Public Service?
Mr. Bollas: I have sent to Council . . . one, I just want to say thank you to Mr. Rorar and
the Service Department. They conducted an intersection study at East Avenue and
Community Road and the study unfortunately determined that a traffic signal was not
warranted at this time, but again just acknowledging that the study did take place at that
intersection. There was a discovery made in terms of speeding at that specific location

Mr. Pavlik: Mr. Rorar, on the East Avenue Corridor Expansion, what is the length of that?
Where does it start and where does it end?
Dir. of Pub. Service: So, it is two phases. Phase 1 goes from the Portage County line to
Munroe and then Phase 2 goes from Munroe to Community Road.
Mr. Bozic: I have a question related to that question that was just asked. I saw a few
people who had asked questions related to underground utilities and whether or not that
was feasible or possible to do it within our City. Is that something that we have looked at
down East Avenue?
Dir. of Pub. Service: Pretty much everything stays as is. It will be all overhead lines at
that location. Now, the rest of the utilities are underground. But the overhead lines will
stay the same.
Mr. Bozic: I know in our new developments everything is underground. Is that something
that was looked at when we planned this?
Dir. of Pub. Service: Yeah, so when we got the money through ODOT they looked at all
of that and you know you get all the players involved like First Energy and all of the utility
companies and can they do that and I don’t know why or what the reasoning is but they
kept it as is.
Mr. Bozic: OK. Is that something that we can circle back with them and just ask the
question and find out what that cost is?
Dir. of Pub. Service: That is always the case. So, we have already been awarded that
money and so I don’t think we are going to get any more.
Mrs. Epstein: Is there anything else? Hearing none, I will close committee.

Mr. Bollas: Thank you. Just two quick updates. I put a copy of the viewership stats in front of
everyone tonight and right now the only correction I want to make is the last meeting the views
were up to 120. The report on your desk says 70.
Lastly, the microphones are still on order for the upgrade here in Council chambers. That’s it.

Mr. Pavlik: I will note that I attended the Cost Containment Committee meeting and that was held
here two Monday’s ago at 9:00 a.m. and everything was up to par and Mr. Rine gave a good
presentation and so I thank the Mayor for running that.
Mr. Bollas: I have one question before we close. The CIC meeting that is next Tuesday, is there
typically, on average, is there always a set agenda or is that just a meeting for kind of brainstorming
and looking at overall community development, economic development or is the meeting brought
together with a specific agenda?
Mayor: There is a specific agenda. Most of it is to go over the Treasurer’s report and budget items
and then we are having Catey from inSITE doing a presentation to the CIC so yes, there is an
agenda on that.
Mr. Pavlik: I can confirm being on that board for the last 10+ years that there is always a set
agenda.
