Comments for all public hearing items will be heard during the Board of Zoning Appeals consideration of each case.
Please wait until you are recognized by the Chair, state your name and address so that your comments may be properly
recorded and limit your remarks to a period of five minutes or less. Participants must register with the Zoning
Department by 2 pm on the day of the meeting. Staff will monitor those attending digitally to determine if there is a
speaker waiting.
Any written comments and/or evidence participants (including applicants) want to be considered may be submitted
to the Board and must be received by 2 pm on the day of the meeting. All comments and/or evidence will be read into

BACKGROUND:
Approval of the R6 Final Development Plan was granted by the Planning & Zoning Commission on February 6,
2020. The Final Plat application is being submitted for approval by the Planning & Zoning Commission and
acceptance by City Council. This Final Plat is for Phase I and involves 37 lots, 2 Open Spaces and Blocks A & B,
future acreage for the rest of the phases as approved in the Final Development Plan.
Following the recording of the Plat at the Recorder’s Office at Summit County, sale or transfer of lots may be
made.
1160.10 R-6 RESIDENTIAL DISTRICT - PHASED DEVELOPMENT.
If the development is to be implemented in phases, each phase shall have adequate provision for access, parking,
storm water management, and other public improvements to serve the development.
As detailed below, each phase has adequate provision for access, storm water management and other public
improvements to serve the development. Additional Parking is not planned for and not deemed necessary.
Each phase shall be provided with temporary or permanent transitional features, buffers, or protective areas in
order to prevent any adverse impact on completed phases, future phases, and adjoining property.
The phasing schedule is an overlapping schedule. As all homes will be built by the same builder, they control the
developing of plans for each phase. As Phase I is currently in the Final Plat stage, Phases 2 & 3 are being prepared
for Improvement and Engineering approval. Each phase meets the city standards for a major subdivision.
The Final Plat includes the whole development, where phases 2 & 3 are Block A and Phases 4 & 5 are Block B. Pulte
Homes LLC has requested to submit the Final Plat for recording in this matter. The County Auditor has no objection
to this. When future phases are submitted for final approval, they will still follow the Final Plat application process.
1109.09 FINAL PLAT PROCESSING.
(c) Effect of Approval. Upon approval or approval with conditions the Commission shall communicate to Council
its action. The approval or approval with condition has the following effect.
(1) It authorizes the subdivider to prepare bonding for Council consideration.
(2) It authorizes the developer to begin the grading of streets.
(3) It authorizes the transfer of lots and the recording of the final plat in the office of the Recorder of Summit
County, Ohio, upon acceptance of bonds and public dedications by Council.
(4) If the final plat is not recorded with the County Recorder's office within twelve months of the date of
approval by the Planning Commission it shall be null and void.

1109.10 STANDARDS FOR REVIEW OF FINAL PLATS.
The Planning Commission shall either approve or disapprove the plat based upon the following:
(a) Compliance with thoroughfare plan.
(b) Compliance with zoning.
(c) Compliance with the design requirements of these regulations and the construction standards of the City.
(d) Compliance with the procedural requirements of these regulations.
ANALYSIS:
Other areas of review considered in the compilation of this report include the following:
Thoroughfare Plan
The Thoroughfare Plan is met with the installation of Reserve Dr, Woodhull Cir, Washburn Cir and North Washburn
Rd being 60’ in R-O-W width. These roads are intended for public dedication to City Council.
Improvement Plans/Detailed Engineering Drawings
Improvement Plans were submitted to the Planning & Zoning Department on July 30, 2020. The plans were
reviewed and approved by the Public Service Director, the City Engineer and Summit Soil & Water Conservation
District. Approvals were also received by Summit County Department of Sanity Sewer Services. The plans met the
Final Development Plan as approved by the Commission on February 6, 2020.

Utilities
Utilities were reviewed and approved by the City of Tallmadge and Department of Sanitary Sewer
Services. Water installation is in progress and at the time of the Staff Report completed around 50%.
Stormwater
The City Engineer has reviewed and approved the stormwater management plan on June 5, 2020
Lighting/Landscaping/Dumpster
Lighting: The developer’s proposal of street lighting has been vetted by Ohio Edison and meets the Final
Development Plan as approved by the Commission on February 6, 2020.
Landscaping: Landscaping installation will be per the Final Development Plan as approved by the
Commission on February 5, 2020.
Dumpster: n/a
Access/Parking
Access is from East Ave.
No additional parking is provided. Each lot will have a driveway upon construction of each house.
Variances/Modifications
None
Police Department
No comment.
Fire Department
1. Address to be placed on the structure facing the street. Numbers to be minimum 1” wide by 4” tall. They
must be in contrast to the color of the background.
2. All phases must include a location for fire truck turn around.

3. All roadways shall be hard surfaced prior to combustible construction.
4. Fire hydrants shall have a 5” Storz connection on the largest outlet. Fire hydrants shall meet all other city
requirements.
5. During construction, fire lanes must be maintained at all times. Dumpsters shall not be placed in the
roadway.
Economic Development

Law Department
HOA and deed restriction were reviewed and approved by the City of Tallmadge Director of Law.

RECOMMENDED MOTION:
I move to Approve (or Reject) the Final Plat for Item #PZ 20-12-01, applicant/owner Pulte Homes of Ohio LLC at
1223 East Ave (PN 6004338), 1241 East Ave (PN 6006401) & Southern portion of 1229 East Ave (PN 6006400) for
the development of Tallmadge Reserve Phase One, consisting of 37 lots, 2 open spaces and 2 Blocks, based upon
the application & plans submitted November 17, 2020 to the Planning & Zoning Department and based on the
following standards:
1. Compliance (or lack of compliance) with the thoroughfare plan,
2. Compliance (or lack of compliance) with zoning,
3. Compliance (or lack of compliance) with the design requirements of the City’s regulations and the
construction standards of the City, and
4. Compliance (or lack of compliance) with the procedural requirements of the City’s regulations,
And subject to the following conditions not included in the plat as submitted:

1. Approval by the City Engineer;

On June 6, 2019, the Planning & Zoning Commission approved the construction of the new Leppo site
with outdoor display. After being open for business, Leppo Inc has found the need to install fencing to
keep their outdoor equipment secure.

The fencing size, height and location meet the zoning code. The fence will be installed behind the
approved landscape buffer and will be attached to the existing gate at the Nottingham Dr entrance.
Utility Department:
Lock access required at access off Maryann Rd and Nottingham St to allow for two access points.
Police Department:

Fire Department:
Knox box to be installed per Fire Department requirements
