REGULAR MEETING in Council Chambers @ 7:00 p.m. August 28, 14 1. CALL TO ORDER: President of Council Donovan called the Regular Council meeting of Thursday, August 28, 2014 to order at 7:00 p.m. 2. PRAYER: Fr. Matusz, Our Lady of Victory Church. PLEDGE OF ALLEGIANCE. 3. ROLL CALL: Mr. Donovan, Mrs. Kilway, Mrs. Ray, Mr. Rensel, Mr. Sisak, Mr. Stalnaker, Ms. Tricaso – present. Also present were Mayor Kline, Dir. of Pub. Service Esler, Dir. of Finance Shanafelt, Dir. of Law Raber and Clerk of Council Burton. Economic Developer Loughry was absent. 4. MINUTES: 7-10-14 Regular Council meeting minutes. Mrs. Ray moved to adopt the 7-10-14 Regular Council meeting minutes. Seconded Mr. Sisak. Voice vote 7-0. The 7-10-14 Regular Council meeting minutes were adopted by a vote of 7-0. FINANCIAL REPORTS:  Bond Retirement Transfer in the amount of $250,000 to Council on 7-31-14.  Fire/EMS Capital Transfer in the amount of $35,000 to Council on 7-31-14.  Appropriation Report, Fund Report, Revenue Report, and Encumber Report for the period ending 7-31-14 to Council on 8-4-14.  Tallmadge Recreation Center Profit and Loss Report for the period ending 7-31-14 to Council on 8-26-14.  Income Tax Comparisons for the period ending 7-31-14 to Council on 8-26-14.  July Financial Reports to Council on 8-26-14.  Revenue Comparisons for the period ending 7-31-14 to Council on 8-26-14.  Maca Park Summary for July, 2014 to Council on 8-26-14. Mrs. Ray moved for the approval of the Financial Reports submitted by Dir. of Finance Shanafelt. Seconded Mr. Rensel. Voice vote 7-0. The Financial Reports were approved by a vote of 7-0. 5. PUBLIC HEARINGS: None. 6. COMMUNITY INPUT: President of Council: The Regular Council meetings are held on the second and fourth Thursday’s of the month. Those are our business meetings. The Monday’s prior are our Committee meetings where we allow almost unlimited community input. We do have a brief time during the business meeting if anybody would like to address Council; you are welcome to at this point. I have no takers. OK. 6.A. ANNOUNCEMENTS: I have none. 7. REPORTS OF SPECIAL COMMITTEES: None. 8. AGENDA ADDITIONS: None. 9. REPORTS OF ADMINISTRATIVE OFFICERS: MAYOR, DIR. OF PUBLIC SERVICE, DIRECTOR OF FINANCE, DIRECTOR OF LAW AND ECONOMIC DEVELOPER Mayor: First of all, I would like to thank the folks in the audience. We have some special guests here tonight and we do have the Resolutions 20, 21 and 22-2014 and I would ask Council if they would move that up on the agenda when we are done with the Administrative reports. I will talk more about them when we get to that area. This summer has been fabulous for the youth of this community and we have a couple of those here today with us. To recap a little bit about Circle Fest; it went off extremely well and I would just personally would like to thank and congratulate all of the City work forces that had worked on that from the Street Department to the Police Department to the Fire Department and also the Chamber of Commerce who did . . . was the co-sponsor and did a lot of work and when you have 15,000 people in the Circle and dangerous fireworks going off and the light parade and floats driving around the Circle with that many people with very few glitches; I felt it went extremely well. So mark your calendar, it will be next August 15, 2015 at the same time and the same “bat channel” and so it was a lot of fun and a lot of work, but I am not sorry it is over! It was a lot of fun. Just a little bit on West Avenue. As you drive up and down West Avenue you can see a lot of things going on there. Serpentini; their brand new front looks phenomenal and Park Ford is getting very close to being wrapped up there. Doctor Schmeiser’s office there in front of the old “Y” that building looks tremendous and we are very close to putting our lot into the CIC with a couple of potential buyers for that. So, I think you will see a brand new building hopefully starting by the end of this year or first of spring. So we are real happy about that. Gas Aggregation; it is that time of year again. I have been talking to our person every day. We thought we had a situation where I could sign a two-year agreement and Constellation has sort of backed off of that and so we have to fix this by September 15 th and today’s rate was $4.89. If you go to Apples to Apples, it is up in the $5’s so I am trying to get it locked in with what we currently have or below. If I would go to a two-year; I could do that, but Constellation sort of backed out of that. The ordinances that I would like consideration of tonight are Ord. 67, Ord. 68, Ord. 73, Ord. 74 and Ord. 75-2014 and all of the resolutions and we will talk about those as they come up. End of report. REGULAR MEETING in Council Chambers @ 7:00 p.m. August 28, 14 Dir. of Pub. Service: Very soon we will be replacing the flooring up in the weight area of the Recreation Center. The carpet is looking pretty shabby. We are going to put the same type of material that we have on the aerobics side with a little thicker material going down where the free weights are because of the people dropping the weights. So that should happen soon. We are also looking for someone to come in and replace the grading that is carpeted in the front entryway because it is worn and looking pretty bad too and so we are also looking at that. The Street Department has been already getting ready for winter. They are going to try a new de-icing product now. They have purchased a large tank that is going to hold the salt brine and then they have got some tanks that actually go on the salt trucks and they also created another truck that just has a tank on it so they can pre-wet the roads with the salt brine and that will help keep the snow from sticking and also they can wet the salt as it is coming out and it is supposed to make that more effective and so they are working on that. The waterline on South Avenue . . . I don’t know if any of you have seen where it is leaking by Planet Fitness. That line is full of pin holes and we keep making spot repairs and we are going to try out a new process where we can cut into a line without shutting down the waterline and then we can isolate a smaller section that is about 30 feet where we can go in there and replace that section without affecting too many businesses. On Thomas Road; we got a preliminary report back from GPD about what we can do to help with the storm water up there. Unfortunately there is no one quick fix up there and a lot of things that they are suggesting that we do, we would have to get approval from the EPA and the Army Corps of Engineers and we would also have to obtain some properties up there. I will let you know as that proceeds along. End of report. Mr. Rensel: Mr. Esler, when you talk about salt; are you talking about the chloride solution or I mean sodium chloride salt, but are you talking about potassium chloride? Dir. of Pub. Service: No, it is . . . well it is called Aqua Salina and it is similar to salt brine and it is cheaper for us to get that than it is to buy our own equipment and make the salt brine and I know that Stow has their own equipment where they make it, but right now we are going to try this year with the Aqua Salina and see how it works and then if we decide in the future to buy the equipment to make our own salt brine then we will do that. Mr. Rensel: Is that similar to what they are putting down on the Interstates? Dir. of Pub. Service: Yes. Pres. of Council: I think the Falls does that also. I have seen a few communities do that. Dir. of Pub. Service: Yes, there are a few municipalities that do it; Akron does it . . . Dir. of Finance: I will keep this brief. As of the end of July we were 58% of the way through the year. The General Fund Revenues are at 61% of estimate and the Income Tax is 4% ahead of last year and the General Fund Balance is just a bit over $5.4 million. The Rec Center is still adjusting to having competition in town. Maca closed the month with $71,868 profit. All of the other departments are operating within budget both revenue and expense-wise and that basically ends my report unless you have questions. Dir. of Law: I will be very brief. I just wanted to mention that when I was drafting the legislation for this time period it was wonderful to do so many congratulatory resolutions that we will be going through here shortly and it is wonderful to note that they are all the youth of our community which is a fabulous thing. I would just encourage any Council people to just remember that if there is news information or persons among our community that deserve a resolution to please make sure you pass that information on to me. No further report. Pres. of Council: Dennis isn’t here; would anybody like to speak on economic development? Mayor: No, but I will take his time. I forgot to tell you that next week we are having a Regional Storm Water meeting here. Service Directors meet every quarter, but we elected and we offered to hold a meeting here in City Council Chambers strictly to talk about storm water. We have invited the Army Corps of Engineers, the EPA, the Governor’s office will be here and a lot of the different communities just to talk about how you handle off road ditching and just different things and so it is going to be a round table discussion and that is September 4th in the morning. About the youth, and I will just take a little bit of time; the Tallmadge Middle School is actually creating a new program that they are going to try to make annual and it is called, “TMS Summer Success” and it is about all of the youth throughout the community from . . . you know we think of these folks that are here, but there are a lot of other youth in different events from education successes to karate and a whole bunch of different things and so they are having a program on September 3rd at 1:45 p.m. in the Rossiaky Stadium, in the football stadium, to introduce all of the Tallmadge Middle School youth that have had successes over the summer. It is a new program that they are starting. That is economic development for you. Mr. Sisak: I would like to make a motion to move Items 20, 21 and 22 between Item No. 9 and Item 10 please. Seconded Mrs. Ray. Pres. of Council: We have a motion and second to move Items 20, 21, and 22. Voice vote 7-0. The motion carries. 2 REGULAR MEETING in Council Chambers @ 7:00 p.m. August 28, 14 20. Resolution 17-2014 At 1st Reading. Congratulating the Tallmadge Little League 11-12 year old All-Star Softball Team and providing for immediate enactment. Mr. Rensel moved for the adoption of Res. 17-2014 at 1st Reading. Seconded Mr. Sisak. Pres. of Council: Is there anyone who would like to speak on that? Mayor: Yes, Mr. Chairman, what a great job that these 12-year old girls performed representing not only the City of Tallmadge and not only the State of Ohio and not only our central region, but making it all the way out to the World Series. The thirteen girls and the coaches did a phenomenal job. There are 1,500 Little League sanctioned teams that qualified to be out there or could have qualified to be out there, but Tallmadge was one of the ones that made it out there and they represented Tallmadge very good. The team that actually won the World Series that beat Tallmadge was a phenomenal team from New Jersey. Eight of those girls played in the World Series last year and the pitcher pitched last year and so it was a great accomplishment to be where they are at. They are having a banquet on September 9th at the Community Center and we will present all of these resolutions to the girls at that time. Mrs. Ray: Would the girls like to stand up? Mayor: The softball team is not here. Mrs. Ray: I thought I saw someone come in; sorry. Pres. of Council: We have a motion and second on Res. 17-2014. Voice vote 7-0. Res. 17-2014 is adopted by a vote of 7-0. 21. Resolution 18-2014 At 1st Reading. Congratulating Dylan Theisen on his All- American Soap Box Derby victory and pro- viding for immediate enactment. Mrs. Kilway moved for the adoption of Res. 18-2014. Seconded Mr. Sisak. Pres. of Council: Is there any discussion? Mayor: Mr. Chairman, we are very honored to have Dylan here in the audience today with his family and what a great job representing the youth of this community and to win the Stock Division and I don’t know how many teams or folks were out there, but if you would like to maybe say a couple of words? Maybe just explain a little bit about it. Say hi. Dylan: Hi!! Mayor: Could you say a little bit about how you did that day? Ms. Tricaso: How long did it take you to build your car? Dylan: A couple of days. Ms. Tricaso: Just a couple of days? Dylan: Yeah. Mr. Sisak: How long have you been in Soap Box Derby racing? Dylan: No more than a year and a half; not even. Mrs. Ray: So, how fast were you going as you went down the hill? What was the fastest speed you obtained? Dylan: I think it is about 33 miles per hour. Mrs. Ray: How many times did you actually go down the hill? How many heats did you have in order to get to the final? Dylan: I think five. Ms. Tricaso: What did you think the first time you rode down that hill? Dylan: I did not think I was going to win, but when I did it was a surprise enough and just to keep winning was amazing. Mr. Sisak: What else have you gotten to do since you won Dylan? Dylan: Nothing really. Mr. Sisak: How did you get in the press box at Progressive Field? Dylan: My dad works with someone who knows Matt Underwood and so . . . that’s what I want to do when I grow up. It was a very cool experience. Mayor: Weren’t there other Tallmadge folks; could you name their names? Dylan: Cailey Bozic and Makayla; they both did an amazing job. It was Makayla’s first year. She started racing in October of last year. She has been racing not even as long as I have and for her to do as well as she did was great. Mayor: These are all Tallmadge students. Congratulations! Res. 18-2014 is adopted by a vote of 7-0. 3 REGULAR MEETING in Council Chambers @ 7:00 p.m. August 28, 14 22. Resolution 19-2014 At 1st Reading. Congratulating Rachel Prior and Ethan Fairhurst on their participation and com- pletion of the Youth Division of the Cleve- land Triathlon. Mrs. Ray moved for the adoption of Res. 19-2014 at 1st Reading. Seconded Mr. Rensel. Pres. of Council: I have a motion and second for the adoption of Res. 19-2014. Mr. Mayor? Mayor: Yes, thank you Mr. Chairman. Again, part of the youth of this community . . . and Rachel is here. Rachel, come on up if you want to. We won’t make you talk too much! Here is such a special girl to take on her friend Ethan, a classmate, and to go into the Cleveland Marathon and to do all of that I think is just . . . nobody made her do this; she wanted to do it on her own and it is just a phenomenal feat for you to take on such a great cause and we thank you so much for doing that and maybe you just want to say a couple of words. How was the race? They will ask you a couple of questions. Mr. Sisak: How many kids participated with you? Rachel: I think 26 kids did it in Tallmadge. Mrs. Ray: So what was the hardest part of the race; the swimming or the running? Rachel: I think the biking. Mayor: How many different events did you have? Rachel: We did three. We did swimming and biking and running. Mayor: How long was the swim? Rachel: It was 200 meters. Mayor: You pulled him in a boat? Rachel: Yeah. Ms. Tricaso: Did you train for this? Rachel: Yeah. Ms. Tricaso: How long? Rachel: We swam at Bierce’s pond. We trained for the bike and the run at Lion’s Park. Mayor: How long was the biking part of the Marathon? Rachel: It was six miles and then the run was two kilometers. Ms. Tricaso: When did you decide that you wanted to do this? Rachel: When I was in school. When I went up to use CP after we did the race last year then they talked to me about doing it. Ms. Tricaso: That’s great! Mayor: Again, thank you for your dedication to help Ethan out and the cause and it is just great that you are willing to do this and I am sure that tradition will carry on throughout the community and throughout your life and thank you. Pres. of Council: Thank you all very much. I am glad you could come out tonight. Thank you and congratulations. Tallmadge Resident: I just want to say something. I am so impressed with the youth of Tallmadge. I have been in the community all my life and to see these kids train and some of these kids couldn’t swim at all and when Kelly asked me about this back in February she said, “What do you think about it?” I was like sure. You can do this and then the first day that they showed up I thought, wow, we have some work to do and luckily we worked all summer long. But, just the dedication and the look on their faces when they finished; it was the most moving experience I think I have ever had. I challenge all of you guys to watch the video. It is out there on the Summit DD blog and it is the story of Rachel and Ethan and it talks about from the very beginning and through the training and through the Triathlon and if you don’t cry after that then I’m sorry! But it is . . . I have so many people come up and say that they want to do it next year and they want to build onto the tradition and make awareness and show that she created history. This is historic for her that she is the only youth that pushed . . . or push, push, pull . . . but the only one that has done it so far, but she has created history here and the kids that did it; Eric and Zachary and they all did a great job and everybody cheered for each other and they all ran in together at the end and I don’t think there was a dry eye in the whole Cleveland area. So, I am very proud to be a part of it and I encourage . . . and like I said, watch the video and next year just watch for it to happen again. Oh, my name is Carol Bender. Mayor: Thank you. FINANCE Accepting a donation to the City of Tall- madge Upson/Rasp Historical Preservation Fund and providing for immediate enact- ment. 4 REGULAR MEETING in Council Chambers @ 7:00 p.m. August 28, 14 Mrs. Ray moved for the adoption of Ord. 67-2014 at 1st Reading and expressed her thanks to the Historical Preservation Society for their donation. Seconded Mr. Stalnaker. Mayor: Just for the record; and it think it states it there that when we did the budget back in November we anticipated getting $30,000 and they actually gave us $35,000 and so we just wanted to re- appropriate the money that was to go into that building and the work is being done at 29 Southwest Avenue and if you haven’t been by there; it is really looking extremely nice. They are doing a great job on it. Pres. of Council: There are a lot of volunteer hours there. Mayor: It looks brand new. Mayor: Mr. Chairman, just so you know, the banquet, and we didn’t know the date when we had Megan draft this up and put it out, but it is September 9th starting at 5:30 p.m. at the Community Center. Pres. of Council: Ord. 70-2014 is at 1st Reading and is assigned to the Planning & Zoning Committee. 14. Ordinance 71-2014 At 1st Reading. FINANCE Declaring certain City-owned personal property to be excess/obsolete and authorizing the Chief of Police to sell such equipment at public sale or trade-in and providing for immediate enactment. Pres. of Council: Ord. 71-2014 is at 1st Reading and is assigned to the Finance Committee. 15. Ordinance 72-2014 At 1st Reading. PLANNING & ZONING Granting a conditional zoning certificate for special nonresidential development to applicant Cynthia A. Mason, owner, Donald W. Hamilton to operate an elder law office at 1347 Southeast Avenue. Pres. of Council: Ord. 72-2014 is at 1st Reading and is assigned to the Planning & Zoning Committee. 5 REGULAR MEETING in Council Chambers @ 7:00 p.m. August 28, 14 16. Ordinance 73-2014 At 1st Reading. PUBLIC SERVICE Authorizing and entering into a final resolu- tion with the Ohio Director of Transportation to resurface State Route 261, lying within the City of Tallmadge and providing for immediate enactment. Mr. Stalnaker moved for the adoption of Ord. 73-2014 at 1st Reading. Seconded Mrs. Kilway. Dir. of Pub. Service: This will allow us to have that property down on West Avenue. The State mandates that we have this adopted and we need to have it adopted tonight. The total cost of the project now is $600,000 and our portion would be $134,000. Mayor: That money was actually appropriated for 2014, but if you recall when we said earlier that ODOT chose, with their schedule, they weren’t able to get it out this year and so they are doing all of the bidding this year and getting a contractor ready to go for spring and so the money that was really in this year’s budget will just be re-appropriated for next year for all of West Avenue. Mr. Rensel: Is it still the intention to put the new composition of asphalt down on that pavement? Dir. of Pub. Service: Yes, it is; it is modified. Mr. Rensel: They promise not to take a shortcut and go backwards? Dir. of Pub. Service: No. Mr. Rensel: Who will inspect that to be sure? Dir. of Pub. Service: There will be State inspectors there and also we will have an inspector there. Mr. Rensel: And you don’t set the specs; they are setting the specs? Dir. of Pub. Service: That is correct. Mr. Rensel: But, you have a chance to review them; right? Dir. of Pub. Service: That’s right. Mr. Rensel: OK. Thank you. FINANCE Authorizing the Director of Public Service to certify delinquent utility fees to Portage County Auditor for collection with real estate taxes and providing for immediate enactment. Mr. Stalnaker moved for the adoption of Ord. 74-2014. Seconded Mr. Sisak. Dir. of Pub. Service: Each year Portage County requires that we have an ordinance that permits them to certify to the taxes any utility bills that haven’t been paid and we would like to get it adopted tonight so that we can get that process completed. Roll Call: Mr. Sisak, Mr. Stalnaker, Ms. Tricaso, Mr. Donovan, Mrs. Kilway, Mrs. Ray, Mr. Rensel – unanimous. Ord. 74-2014 is adopted by a vote of 7-0. 18. Ordinance 75-2014 At 1st Reading. COMMUNITY ISSUES/SAFETY Authorizing the Mayor to enter into a Memorandum of Understanding with the City of Mogadore and other political sub- divisions and appropriating necessary funds for the 2013 AFG Regional SCBA Grant EMW-2013-FR-00173 and pro- viding for immediate enactment. Ms. Tricaso moved for the adoption of Ord. 75-2014. Seconded Mr. Stalnaker. Mayor: Yes, Mr. Chairman. I would like to thank Council for their consideration on this. This is something, since we are appropriating money and I don’t like doing it on 1 st Reading, but with the break, we have to get this memorandum back to Mogadore. Mogadore is the lead agent who is applying for these SCBA’s; those are the breathing apparatuses and of the $666,000, Tallmadge’s portion is more than any of the other communities. It is $214,414 and so we are spending $34,000 to get that $214,000 and it replaces all of our SCBA’s which if we didn’t get the grant, we still have to replace them and so we are happy to get this grant and half of Mogadore’s Department is Tallmadge anyways and so that is how it is all working out. COMMUNITY ISSUES/SAFETY Authorizing the Mayor to enter into a Memorandum of Understanding with the Summit County Sheriff’s Office and other political subdivisions and providing for immediate enactment. Pres. of Council: Ord. 76-2014 is at 1st Reading and is assigned to the Community Issues/Safety Committee. Mr. Sisak: I would like to make a motion to adopt Ord. 76-2014 at 1st Reading. Seconded Mrs. Ray. Mr. Rensel: Can someone explain what is going on? Mayor: John, this is part of our Officers that are going to combine with Summit County for the task force and we asked about the other . . . Mr. Rensel: I just think that we need a brief discussion anytime you adopt at 1st Reading. Mayor: We are just helping out on the special task force throughout Summit County. Mr. Rensel: Great. ADDITIONAL ITEMS: Mrs. Ray: Thank you and I apologize that I did not bring this up during announcements, but I would like to invite my fellow Council members and members of the Administration to participate in “Operation Orange” which is the Akron/Canton Regional Food Bank’s 24-hour volunteer event. It is being held on Friday, September 5 th and Saturday, September 6th and actually on Friday from 12:00 to 2:00 p.m. is a time that they have set aside for elected officials to come down and volunteer to sort and inspect the donated food. So, I will be there on September 5th from 12:00 until 2:00 p.m. and I would invite anyone who would like to come down and help. It is a great event; it is 24 hours and there is music, donated food and just a lot of really fun activities and it is goes for a great cause. They are kicking off the 2nd Annual Hunger Awareness Month which runs the entire month of September. If you would like to join just shoot me an e-mail or a telephone call and I will get you registered. Pres. of Council: What is the name of it? Mrs. Ray: It is called “Operation Orange.” It is September 5th and 6th and as I said, on Friday, September 5th from 12:00 to 2:00 p.m. has been set aside for elected officials. Mayor: Mrs. Ray, did you get my face-book acceptance? Mrs. Ray: Yes I did; thank you. Mayor: So it worked? Mrs. Ray: It did work. I am figuring out this face-book thing. Mayor: Yeah, me too! Mrs. Ray: It is a great event and I helped out last year and it does run literally 24 hours. There are volunteers around the clock for those two days and then there is something going on every minute. It helps out a lot of people. Mr. Rensel: Kim, I don’t think I heard you say where? Mrs. Ray: It is at the Akron/Canton Regional Food Bank which is on Opportunity Parkway in downtown Akron. Mayor: Real briefly, I didn’t bring it up earlier, but we had the Heritage Commission this week and Taco Bell was there and they were approved to redo the entire face of their building. So look forward to that coming. Mr. Rensel: This is going quickly, but you ought to wish everybody a happy Labor Day on the record. Mayor: It is the end of summer.
