At the Committee meeting legislation is discussed thoroughly with Council deciding to adopt, amend, reject, hold or table the legislation. REPORTS OF SPECIAL COMMITTEES: None. 8. AGENDA ADDITIONS: None. 9. REPORTS OF ADMINISTRATIVE OFFICERS: MAYOR, DIR. OF PUBLIC SERVICE, DIRECTOR OF FINANCE, DIRECTOR OF LAW, DIRECTOR OF ADMINISTRATION AND ECONOMIC DEVELOPMENT DIRECTOR Mayor: Thank you. I will start off with the Tallmadge Expo this year at the Tallmadge Rec Center is April 8th just as an FYI. I am sure you will see more information, but as always, the City will have a booth out front and Council is welcome to go to that. Today we were able to start our QRT Program, which is Quick Response Team, to go out on opiate heroin overdoses to visit the folks out there and that program actually started today with the Police Department with the help of other organizations and they said they had a couple of visits today and it was very positive. So thank you to Chief Williams for starting that program. We are in the process of redoing our City Handbook for the City employees with a team working internally and I am just giving you that heads up and we are going to look at the other personnel ordinances; the benefit ordinance and that grid ordinance. That legislation is sometime down the road and that will come your way. On the Stow Dispatch; we have our bi-monthly meeting here tomorrow morning; the Executive Team which is the three Mayors and the County Executive will meet at 8:00 a.m. and then the whole team and the Department Heads of the different groups will meet then immediately after that. So there will be around 50 people here representing the different communities and we are making some headway, but there is still a lot to go forward before we come back to the City Council on that. Today Mollie and I attended the Northeast Ohio Mayor’s Association Meeting that we are members of to get a legislative update out of Columbus. The House Bill 49 with changing the Biennium Budget and a couple of things that could affect us down the road. We are trying to stay on top of that. We will schedule meetings with our House Rep and our Senate Rep in the very near future as soon as we get more information, but Squires, Patton, Briggs; attorneys out of Columbus who help us . . . they are our go-to people down in Columbus and they gave us the update today and there are some concerns going on and Mollie might speak of that. As I said, we are also going to have the Captain’s and the Deputy Fire Chief’s legislation to you within a month just like we did with the Police Chief. I also, last night, attended the Portage County Regional Development Board on the Maplecrest Golf Course. If you recall last month Brimfield had the Maplecrest Golf Course at their Zoning meeting and so they just had a public hearing and then they refer it to Portage County Regional who approved unanimously to go forward with the re-zoning, not the site plans, but just the re-zoning of Maplecrest and that is where Rita is at right now. It started at 7:00 p.m. and since I had the sewer contract, I thought this was more important to be here, but Rita is there representing Tallmadge and there is also a public hearing and so I am waiting for a text from Rita with what is going on there and once they make a decision then it goes to the Trustees for their vote and we will see where it goes. End of report. Dir. of Pub. Service: Yes, thank you. We met with our City Engineer, B&N, this week to discuss the restarting of our GIS collection for all of our waterlines and storm sewers. We hire interns in the spring as they get out of school to do that collection and so we will be starting that up again. They are also reviewing some storm water because Baker’s Acres is considering starting construction again so they are going to be reviewing the storm water for that. We do have an advertisement out to hire a Zoning Inspector. Hopefully we will be getting some applications in for that and we will be reviewing those and we will keep you updated on that. End of report. Dir. of Finance: As Mayor Kline mentioned, we are busy following the State Budget that was just put out. I think I did forward to Council some information that we received from R.I.T.A. regarding the State; the Governor proposing that the State would begin collecting our net profit returns for the businesses within the City of Tallmadge and so that language just came out today or actually yesterday; the actual budget language was released and so we want to review that. R.I.T.A. is reviewing that to determine what they are actually proposing. It looks like they would propose that all businesses would file with the State of Ohio and then they would pass the money onto us. I personally am opposed to that. I don’t think we want the State in the business of taking our tax dollars before we get to have them. So, we will be reviewing that like the Mayor said and we will be reaching out to our State Representatives and I will keep everybody informed as to what that entails. End of report. 2  REGULAR MEETING in Council Chambers @ 7:30 p.m. February 9, 17 Vice Pres. of Council: I do have a questions Mrs. Gilbride in reference to that. Is it only the net profit taxes and not the withholding at this point in time? Dir. of Finance: Right now it is only the net profit taxes. I don’t know if you remember a couple of years ago there was a House Bill 5 that dealt with the State kind of revamping City Income Tax and part of a big debate of that was centralized collection, which at that time was taken out of the bill, but the fear would be that they are going to start with this net profit return and then say, oh well, we are also going to collect your withholdings now and you know, so we would lose control of those tax dollars which we don’t want to do. Vice Pres. of Council: And that could potentially then put companies like R.I.T.A. out of business. Dir. of Finance: Correct and so . . . technically businesses already have an opportunity to actually file their net profit with the State through a mechanism that the State put out called the Ohio Business Gateway. The Ohio Business Gateway kind of was a flop and businesses actually don’t like to use it. Just to kind of give you an idea, R.I.T.A. had sent us a statistic based on what the Governor had said and they processed last year 71,000 business returns of which under 1,000 were actually filed through the Ohio Business Gateway by businesses. So, I am not quite sure what the intent is, but I think this is being pushed by the Tax Commissioner through the Governor that they for some reason feel that the municipal income tax is a burden on businesses and that they want to centralize that and so we are watching that. Mayor: Mollie, do you want to just clarify what was quoted in the newspaper about the collection rate; Tallmadge was at 3% and the State could do it for like 1.5%. Dir. of Finance: So, what the State is proposing is that they would collect that net profit tax and then charge us 1% of the revenues that they collect and the Governor had stated that cities are paying between 2.5 and 3% right now for collections. Personally, I can speak to Tallmadge and actually R.I.T.A. also sent out some information, but the last few years our overall collection cost with R.I.T.A. was around 1.5% but that also means that R.I.T.A. does advanced collections for us and they will do civil litigation to collect unpaid taxes and we have control over auditing and I have direct communication with them at all times and that is an additional fear with the State collecting is that we don’t know what kind of input we will have in that process. To give you an example, currently the State does collect on all utilities that owe taxes in municipalities and so a utility like Dominion or First Energy; they all file their taxes at the local level through the State and we don’t ever get to see what that return is and we don’t get to audit it and if they tell us we owe them money back; they send us a certified letter and we have to write a check. So that is kind of the framework that we have been under with them collecting the utility taxes that are owed to the City and so it kind of leads me to believe that would be a similar process with businesses with our net profit returns. Vice Pres. of Council: I have another question too. With R.I.T.A. you know the companies pay their net profit and their withholding taxes to R.I.T.A.; what type of a turnaround does the City have as to like how soon they get the money from R.I.T.A.? Dir. of Finance: We actually get the money from R.I.T.A. the month after they collect it. So they will collect a whole month’s worth of returns and we get two distributions from R.I.T.A. a month and so they distribute to us everything they have collected and processed up to the first day of the month so we can . . . and they call it an advance so we know on the first day of the month that we get the majority of the income tax that they have collected the previous month and then there is a small window and on the tenth business day of every month, we get what is called a reconciliation where they give us any additional money on returns they may have received but were not able to process for that previous month. So it is basically when we converted to R.I.T.A. we are basically one month behind what we used to be when we collected it ourselves. Now I mean, through the transition it really didn’t cause any cash flow issues, but we always have a consistent; it is once a month and like I said, I have not seen the language and so I do not know how often the State is proposing to make distributions to us. I know for the utility tax we get those quarterly. Vice Pres. of Council: OK. What about . . . I know with the Ohio Business Gateway I believe you could use or submit your city or your municipality through that; do we have any businesses that use the Ohio Business Gateway to submit their net profit taxes? Dir. of Finance: I would assume that we do. We used to when we self-collected. We would also have people who would submit their withholding payments through Ohio Business Gateway, but when they do that. . . currently the way it works, that money doesn’t actually go to the State. You set yourself up as an income tax agency and they still directly pay you. So the State . . . it is just kind of a computer system where you can funnel that payment directly. Now that we are with R.I.T.A. and there are other mechanisms to pay online; I don’t know if as many agencies do that. That was back when we didn’t really have a procedure or a mechanism in place for people to pay online directly to us so we had to use the Gateway and that was the point of it so that people would have an online option because it would have been for us too costly to implement that kind of a program. Vice Pres. of Council: Any other questions? 3  REGULAR MEETING in Council Chambers @ 7:30 p.m. February 9, 17 Mr. Sisak: What was the House Bill again? Mayor: 49. Dir. of Finance: 49; that is the Budget Bill. Mr. Sisak: House Bill 49; it is in the budget. Dir. of Finance: They put it into the actual Budget Bill. Mrs. Ray: No one looks at the budget! Dir. of Finance: That’s correct. Mr. Rensel: Mollie, looking at the profit and loss for the Rec Center; at the end of January the salaries and fringes are considerably below what we collected last year, or I mean above; 26%. Can you explain why that is? Dir. of Finance: Yes, part of the issue is the Bureau of Worker’s Comp changed the way we have to pay for Worker’s Comp insurance and the due date for that insurance is now . . . it was January 3rd and so this year we paid that insurance premium in January and last year we paid it in April and so that is about an $11,000 hit that the fringe benefits is taking at the beginning and so that will even out but because that is such a large expense that we didn’t have in January of last year it really bumped those up . . . I know I freaked out when I saw it too, but that is what the issue is that Worker’s Comp premium. Mr. Rensel: Thank you Mollie. Thank you. Vice Pres. of Council: Are there any other questions? I just wanted to report that I am going to be coordinating with the Police Department again for the next Drug Take Back Day which will be April 29th and we are going to approach all of the . . . last fall, I don’t know if you recall, but Acme had been a collection site and so it is my hope that we will get participation from all of the grocery stores and drug stores and I am going to approach all of them to see if they would like to participate. Chief Williams has agreed that we will have an Officer staffed at all those locations to just make it that much more convenient to dispose of their unused prescriptions. Additionally, we have partnered with Community Support Services or Community Health Partners, I apologize; to get a new method of disposal which we are going to distribute to our Primetimers which they don’t even need to leave it . . . it is basically a purple bag and you can deactivate your medication by putting your prescription into this bag and then it is biodegradable. So, again, we are just encouraging, especially the more potent drugs, for people to dispose of those immediately when they don’t need them anymore. So, we will be distributing those as well. Mayor: First of all I would like to thank especially the Law Department; Megan, for such hard work on this. We have been working on this contract for over a year right now and Tallmadge, like I said earlier, was almost a holdout for the master meters to get the best deal that we could get out there and although we have not had a contract with Akron; it has been expired and we have been going year to year for a long period of time; this will solidify the way we operate on the sewer on the Akron side in the next 25 to 30 years and so I think it is a fair contract for us, but we are in destination of our own rates by controlling the flow that goes through that master meter and so whatever we can do to reduce I&I; the sump pumps in these people’s homes and downspouts or footer drains; we want to be very proactive and try to help people reduce the I&I in their system which ultimately lowers their sewer rate. With that, I thank Council for your consideration and again the Law Department for Megan’s help. It is on a quarterly basis, but that rate was done knowing what this contract would look like. Mr. Rensel: I just wanted to confirm so we don’t see a large charge coming through that is retroactive. FINANCE Authorizing the Mayor to enter into a contract for the lease/purchase of a 2.5 ton Freightliner dump truck through the State Purchasing Program and providing for immediate enactment. Mrs. Ray moved for the adoption of Ord. 30-2017 at 1st Reading given that the purchase of this freightliner is in the budget and we are purchasing through the State Purchasing Program. Mrs. Ray: Although I have no idea what it is; given that it was a purchase that was authorized in the budget and we are going through the State Purchasing Program as for the City’s procedures, I would move for adoption at 1st Reading if my committee has no objections after we find out what it is! Service: That is a big four-wheel drive loader that we use to load our trucks with salt or dirt or whatever.
