REGULAR MEETING in Council Chambers @ 7:30 p.m. February 23, 17 1. CALL TO ORDER: President of Council Donovan called the Regular Council meeting of Thursday, February 23, 2017 to order at 7:30 p.m. 2. PRAYER: Rev. Josh Deeter, First Church of God, Tallmadge. PLEDGE OF ALLEGIANCE. 3. ROLL CALL: Mrs. Ray, Mr. Rensel, Mr. Sisak, Ms. Tricaso, Mr. Donovan – present. Also present were Mayor Kline, Dir. of Pub. Service Esler, Dir. of Law Raber, Dir. of Finance Gilbride, Economic Developer Weinberg and Clerk of Council Burton. Mr. Stalnaker and Mrs. Kilway were excused. Dir. of Administration was absent. 4. MINUTES: 2-9-17 Regular Council meeting minutes. Mrs. Ray moved to approve the 2-9-17 Regular Council Meeting minutes. Seconded Mr. Sisak. Voice vote 5-0. The 2-9-17 Regular Council meeting minutes were approved by a vote of 5-0. FINANCIAL REPORTS: None. 5. PUBLIC HEARINGS: None. 6. COMMUNITY INPUT: Pres. of Council: Is there anybody here who would like to address City Council this evening? Seeing none. 6.A. ANNOUNCEMENTS: None. 7. REPORTS OF SPECIAL COMMITTEES: None. 8. AGENDA ADDITIONS: None. 9. REPORTS OF ADMINISTRATIVE OFFICERS: MAYOR, DIR. OF PUBLIC SERVICE, DIRECTOR OF FINANCE, DIRECTOR OF LAW, DIRECTOR OF ADMINISTRATION AND ECONOMIC DEVELOPMENT DIRECTOR Mayor: We have been having a lot of meetings from AMATS to the Joint Dispatch Center. I should have something to Council on that hopefully within the next month and a half to two months to give you more of an update on where we are at to date. End of report. Dir. of Pub. Service: No additional report. Thank you. Dir. of Finance: I did forward to everyone on Council information that I had received from R.I.T.A. regarding the analysis and I think it is a pretty comprehensive analysis for you of the changes that the Governor has proposed in the Budget Bill. As I also stated in the e-mail, we have drafted a resolution that is before you tonight for 1st Reading. I’m not asking anybody to adopt it tonight, but just review it and I think you might want to wait until your other Council members are present, but that is up to you. Otherwise, end of report. Dir. of Law: The Assistant Law Director and I were able to conduct our first of two; one of two Police Officer “Illegal Updates” on Wednesday and we will be doing our second one next week. We do this about annually for the Police Department and we are also going to be conducting work sessions with all of the Boards and Commissions to just kind of go over, kind of a quick refresher on ethics and just procedural guides and things like that and just a quick little work session to be able to freshen everybody up. If Council would be interested in doing something similar, we could certainly do something like that at some point too because again, we all go to continuing education things in our professions and I don’t think it ever hurts to brush up on procedural things. If you are interested, let me know. Thanks and end of report. Dir. of Administration: Absent. Economic Developer: I just want to give a brief update on Maplecrest. It has gone through Brimfield Zoning and two public hearings. It went to Regional Planning and there has been a recommendation to go forward with the rezoning for commercial in the front half and then light industrial in the back so that is one hurdle and it will go onto the Trustees next. I’m not exactly sure when they meet. Then hopefully we can go on to consideration of the development that is being proposed for that. End of report. Pres. of Council: Are there any names thrown out there yet? Is there interest in who is going to be in the commercial area? Economic Developer: Well, they do know they have some commitments for Meijer and Menards in the two big box stores. They will be purchasing their parcels. The others will be maintained by the developer and be leased out. I don’t think they have identified anybody at least with 100% certainty who will go into the other stores. 10. Ordinance 28-2017 At 2nd Reading. FINANCE An ordinance providing for the issuance and sale of bonds in the maximum principal amount of $830,000, for the purpose of re- constructing North Avenue from Tallmadge Circle to Heritage Drive, in cooperation with the Ohio Department of Transportation, in- cluding constructing storm water manage- ment facilities, improving intersections, acquiring real estate and interests in real estate and constructing and installing all related improvements, and providing for immediate enactment.  REGULAR MEETING in Council Chambers @ 7:30 p.m. February 23, 17 Pres. of Council: Ord. 28-2017 is at 2nd Reading and will remain before the Finance Committee. 11. Ordinance 32-2017 At 1st Reading. PLANNING & ZONING Extending the moratorium on granting con- P.H. ON 4-13-17 @ 7:33 P.M. ditional zoning certificates for any building structure, use or change of use that would enable the cultivation, processing, or retail sale of medical marijuana and providing for immediate enactment.. Pres. of Council: Ord. 32-2017 is at 1st Reading and is assigned to the Planning & Zoning Committee and I will set a public hearing for 4-13-17 @ 7:33 p.m. 12. Ordinance 33-2017 At 1st Reading. FINANCE Declaring that certain City-owned vehicles obtained through criminal forfeiture to be excess and authorizing the Director of Public Service to dispose of such vehicles in accordance with law and providing for immediate enactment. Pres. of Council: Ord. 33-2017 is at 1st Reading and is assigned to the Finance Committee. 13. Ordinance 34-2017 At 1st Reading. FINANCE Authorizing the Mayor to enter into an agreement with Tallmadge Grow, Inc., a community improvement corporation for the assignment of the lease for 12, 16, and 22 Southwest Avenue and authorizing the leasing and subleasing therefor and pro- viding for immediate enactment. Pres. of Council: Ord. 34-2017 is at 1st Reading and is assigned to the Finance Committee. 14. Resolution 3-2017 At 1st Reading. FINANCE Strongly opposing the State of Ohio Governor’s proposed 2017-2018 Budget, which proposes centralized collection of net profit tax returns and other provisions related to the municipal income tax which will cause substantial loss of revenue needed to support the health, safety, welfare and economic development efforts of Ohio municipalities, and declaring an emergency.
