(Ordinance being presented for first reading consideration) - An ordinance rezoning property in the general vicinity of 2402 West Cypress Street, in the City of Tampa, Florida, and more particularly described in Section 1, from Zoning District Classification(S) RM-16 (Residential, Multi-Family) to PD (Planned Development, Residential, Single-Family, Semi- Detached); providing an effective date. Motion: (Clendenin-Carlson) That Council moves to deny said petition due to the failure of the applicant to meet its burden of proof to provide competent and substantial evidence that the development, as conditioned and shown on the site plan, is consistent with the Comprehensive Plan and City Code and the applicant’s failure to meet its burden of proof with respect to the requested waivers; Further, that the requested waivers as the staff has found, the applicant is not able to build two units on that site under the existing Euclidean Zone of RM-16; Staff has determined that the applicant cannot build two units on the site under the current zoning regulations. The applicant is seeking a Planned Development (PD) approval instead. However, the design of the proposed project is not unique and does not warrant a waiver. The applicant failed to provide sufficient evidence to support their request for a waiver. The requested waivers are not in alignment with the intent and purpose of Chapter 27-139 of the PD Code criteria and other relevant land development regulations, as well as the Tampa Comprehensive Plan criteria. Lastly, the Tampa Comprehensive Plan listing specific code sections section 27.136.1 and 27.136. 3, support reasoning. Motion carried by voice roll call vote of 6-1 with Hurtak voting no.
