The City Council of the City of Tampa, Florida convened in an evening session at 5:05 p.m. on the 9th
day of May 2024 with Guido Maniscalco, Chair, presiding. Members present upon roll call were:
Hurtak, Clendenin, Henderson, Miranda, and Maniscalco constituting a quorum. Viera arrived at
5:06 p.m., and Carlson being absent.
Martin Shelby, Council Attorney was in attendance.
The minutes were recorded and prepared by Jazmean Afanador, City Clerk Support Technician/
Office of the Cit y Clerk, recording secretary for these proceedings.
Motion: (Clendenin-Miranda) That Council moves to open all public hearings. Motion carried
unanimously with Carlson being absent.

5:01 P.M. – PUBLIC HEARINGS - (ITEMS 1 THROUGH 5) – (Quasi-judicial proceedings require
witness to be sworn in prior to testifying pursuant to Resolution No. 2004-667)
1. File No. SU2-23-09 (Ord. approved on 1st reading- UNAN)
Public Hearing on application of Natalie Stuntz request for special use Restaurant w/Drive In
Window for property generally located at 16001 Tampa Palms Boulevard.
LaChone Dock, Zoning Supervisor, appeared and presented on behalf of the City; David Hey,
Planning Commission, appeared and presented the staff report; and Erin Maehr, Forester
Examiner, appeared and answered questions.
Thamee Thet, applicant’s representative, approached and presented on said public hearing.
Motion: (Clendenin-Miranda) That said public hearing be closed. Motion carried
unanimously with Carlson being absent.
(Ordinance being presented for first reading consideration) - An ordinance approving a
Special Use Permit (SU-2); approving a restaurant with drive-in window in a CU (Community
Unit) zoning district in the general vicinity of 16001 Tampa Palms Boulevard, in the City of
Tampa, Florida, and as more particularly described in Section 1 hereof; providing an effective
date.
Motion: (Miranda-Viera) That said ordinance be approved on first reading by title only and
published. The proposed request will be integrated into an existing shopping center and is
consistent with the development pattern pursuant to Land Use Policies 1.2.3, 1.2.8 and
15.2.1; Further, the use is located in a CU zoning district, it does not request any waivers
and meets the general standards in Section 27-129 of the Land Development Code. The Use
is compatible with the mix of the neighborhood, serving commercial uses located adjacent
to the site and will not establish a precedent or encourage incompatible uses in the
surrounding area. The title of said ordinance was read in full. Motion carried unanimously
with Carlson being absent. (Second reading and adoption to be held on June 6, 2024, at
9:30 a.m.)

Public Hearing on application of Michael M. Shenoda request to rezone property generally
located at 5006 E 97th Ave., Folio # 142834.0025, 142830.5075, 142830.5050, 142830.5025
& 142830.5000 from RS-60 to RM-24.
LaChone Dock, Zoning Supervisor, approached and presented on behalf of the City; David
Hey, Planning Commission, approached and presented the staff report.
Todd Pressman, applicant’s representative, approached and presented on said public
hearing.
The following individuals appeared before Council to make comments:

Motion: (Clendenin-Hurtak) That said public hearing be closed. Motion carried unanimously
with Carlson being absent.
(Ordinance being presented for first reading consideration) - An ordinance rezoning
property in the general vicinity of 5006 East 97th Avenue and Folio Numbers 142834-0025,
142830-5075, 142830-5050, 142830-5025 and 142830-5000, in the City of Tampa, Florida,
and more particularly described in Section 1, from zoning District Classification(s) RS-60
(Residential, Single-Family) to RM-24 (Residential, Multi-Family); providing an effective date.
Motion: (Viera-Miranda) That Council moves to adopt said ordinance. The applicant has met
its burden of proof to provide competent and substantial evidence that the rezoning is
consistent with the Planning commission staff report and the findings and reasoning of the
said report. Motion failed by voice roll call vote of 3-3 with Hurtak, Clendenin and Henderson
voting no and with Carlson being absent.
Motion: (Hurtak-Henderson) That Council moves to deny said petition due to the failure of
the applicant to meet its burden of proof to provide competent and substantial evidence in
the record that the rezoning is consistent with the Comprehensive Plan and the City Code.
Further, adopting the findings and reasoning of the City staff report. The proposed rezoning
does not meet the definition of ‘compatibility’ as adopted in the Comprehensive Plan.
Although the requested zoning district may be considered in the RES-25 designation, the
maximum development potential is of a height, scale, mass and bulk that is not compatible
with the single-family detached uses located near or adjacent to the subject property. And,
although compatibility does not mean “the same as”, it requires a sensitivity of development
in order to maintain the character of existing development; Further, the proposed rezoning,
which allows consideration of up to 34 dwelling units at a maximum height of 60 ft, is
inconsistent with the surrounding single-family detached uses. This allowable height is out of
character with the surrounding built environment and allows for a scale that is not
compatible with the existing development pattern nor appropriate in the center of an
established residential single or multi-family block. Motion failed by voice roll call vote of 3-3
with Viera, Miranda, and Maniscalco voting no and with Carlson being absent.
Motion: (Viera-Clendenin) That said public hearing be reopened. Motion carried

Cate Wells, Deputy City Attorney, approached and answered questions; LaChone Dock,
Zoning Supervisor, approached and made additional comments.

Motion: (Viera-Clendenin) That said public hearing be continued to June 20, 2024, at 1:30
p.m. Motion carried unanimously with Carlson being absent.

Public Hearing on application of Anthony Scaglione request to rezone property generally
located at 1102 W. Ohio Avenue from RS-60 to RS-50.

Hey, Planning Commission, approached and presented the staff report.

(Ordinance being presented for first reading consideration) - An ordinance rezoning
property in the general vicinity of 1102 West Ohio Avenue, in the City of Tampa, Florida, and
more particularly described in Section 1, from Zoning District Classification(s) RS-60
(Residential, Single-Family) to RS-50 (Residential, Single-Family); providing an effective date.
Motion: (Henderson-Miranda) That said ordinance be approved on first reading by title
only and published. The findings and reasoning of the Planning Commission staff report,
applicant’s report and testimony, establishes that the rezoning will allow for enhanced
utilization of the land consistent with the density anticipated under the Residential-10
designation; and will provide additional infill housing on an underutilized parcel in
accordance with Land Use Policies 2.1.2, 9.2.1 and Housing Policy 1.3.4. and compliance
with Land Development Code, although the predominant pattern of development includes
lots that are 60 feet or wider, the overall lot area of the resulting lots is approximately
6,825 which is greater than the minimum lot area for the RS-60 zoning district; Further,
within a 2-block range to the North, there are existing PD zonings; REZ-06-67 which allowed
a lot split which created a 37’ wide lot and REZ-06-36 which allowed for 2 homes in the rear
of the existing lots. The title of said ordinance was read in full. Motion carried unanimously
with Carlson being absent. (Second reading and adoption to be held on June 6, 2024, at
9:30 a.m.)

Public Hearing on application of Michael Gianeskis request to rezone property generally
located at 1408 E. 21st Avenue from RS-50 to RM-18.
LaChone Dock, Zoning Supervisor, approached and presented on behalf of the City; David
Hey, Planning Commission, approached and presented the staff report.
Michael Gianeskis, applicant, appeared and presented on said public hearing.
Motion: (Clendenin-Henderson) That said public hearing be closed. Motion carried
unanimously with Carlson being absent.
(Ordinance being presented for first reading consideration) - An ordinance rezoning
property in the general vicinity of 1408 East 21st Avenue, in the City of Tampa, Florida, and
more particularly described in Section 1, from Zoning District Classification(s) RS-50
(Residential, Single-Family) to RM-18 (Residential, Multi-Family); providing an effective date.
Motion: (Clendenin-Miranda) That said ordinance be approved on first reading by title only
and published. Establishing compliance with the applicable goals, objectives and policies in
the Comprehensive plan as noted in the Planning Commission staff report, that the
rezoning will not alter the character or development pattern of this portion of VM Ybor
neighborhood, and will encourage residential development on an underutilized lot; and will
provide additional housing choices in the East Tampa Urban Village in accordance with
Land Use Policies 5.1.4, 8.15.2, 9.3.8, 9.7.1, 2.1.2, 5.1.1, 9.6.1, 9.6.2, 9.6.4 and Housing
Policy 1.3.4. The title of said ordinance was read in full. Motion carried unanimously with
Carlson being absent. (Second reading and adoption to be held on June 6, 2024, at 9:30
a.m.)
5. File No. REZ-24-21 (Will not be heard; Mis-noticed)
Public Hearing on application of Global Engineering request to rezone property generally
located at 2109, 2111 & 2113 W North A Street from RM-16 to PD (Residential Single Family
Attached).
LaChone Dock, Zoning Supervisor, approached and requested that said public hearing be
removed from the agenda.
Motion: (Clendenin-Miranda) That said public hearing be removed from the agenda.
Motion carried unanimously with Carlson being absent.

INFORMATION REPORTS AND NEW BUSINESS BY COUNCIL MEMBERS:
6. File No. E2024-48
Motion: (Viera-Miranda) That Council be requested to present a commendation to retired
Judge Perry Little, honoring his 55 years of admittance to the Florida Bar and 40+ years of
service as a Judge for the 13th Judicial Court to be delivered off-site. Motion carried
unanimously with Carlson being absent.
7. File No. CM24-5328
Motion: (Viera-Henderson) That Staff be requested to report on September 19, 2024, under
Staff Reports and Unfinished Business, on the feasibility of conducting a GPR Scan and/or
consulting with an archaeologist and/or dive team to conduct a search for the College Hill
Cemetery on the city owned property in and around the retention pond located at the
corner of 25th avenue and 26th street, adjacent to the Italian Club. Further, that city staff
continue to work with the Italian Club ahead of the upcoming presentation in August.
Motion carried unanimously with Carlson being absent.
8. File No. CM24-5292
Motion: (Hurtak-Henderson) That Legal staff be requested to present an in-person report
on June 6, 2024, under Staff Reports and Unfinished Business, on the residency
requirements in Charter Sec. 6.01 – specifically, analyzing whether and how the number of
individuals to whom the requirements apply can be reduced. Motion carried unanimously
with Carlson being absent.
9. File No. CM24-5327
Motion: (Hurtak-Miranda) That the Public Works Administration be requested to provide a
report on the Solid Waste rate adjustment on May 23, 2024, workshop session. Further, a
resolution pertaining to said matter will be placed on the June 6, 2024, agenda for
adoption. Motion carried unanimously with Carlson being absent.
10. File No. E2024-48
Motion: (Viera- Hurtak) That Council be requested to send a letter in support of the Hive
Inclusive Community’s efforts on accessible and affordable housing in Tampa. Motion
carried unanimously with Carlson being absent.
MOTION TO RECEIVE AND FILE ALL DOCUMENTS:
11. Motion: (Henderson-Miranda) That the memorandum from Councilmember Carlson, be
received and filed. Motion carried unanimously with Carlson being absent.
12. Motion: (Henderson-Miranda) That the speaker sign-in sheet presented by Chair
Maniscalco, be received and filed. Motion carried unanimously with Carlson being absent.
ADJOURNMENT:
There being no further business to come before the Council at this time, Chair Maniscalco
adjourned said meeting at 6:47 p.m. on the 9th day of May 2024.

Pursuant to Rule 7(I) of Council’s Rules of Procedure, persons requesting to use electronic media
for presentation to City Council are required to notify the Chair, the City Clerk’s office and the City
of Tampa Cable Communication Department (CTTV) at least forty-eight (48) hours in advance. The

PUBLIC COMMENT FOR REGULAR SESSIONS OF COUNCIL
Members of the public shall be given a reasonable opportunity to be heard at a time before City
Council takes official action. Speakers shall first state their legal names for the purpose of identification
in the record of the meeting.
City Council may establish time limits for members of the public to address Council. Unless such time
limit is otherwise established, each member of the public shall be limited to three minutes. Members of
the public addressing Council shall observe all time limitations that may apply.
Speakers shall refrain from disruptive behavior, including making vulgar or threatening remarks.
Speakers shall refrain from launching personal attacks against any city official, city staff member, or
member of the public. Comments shall be directed to the Council as a body and not to individual
Council members.
No one present during a Council meeting shall engage in disruptive behavior, including intentionally
making or causing to be made any disruptive sound or noise, or displaying signs or graphics in a manner
disruptive to the proceedings.
The Chair shall rule out of order any member of the public who shall speak without being recognized or
who shall not address Council from the podium or other established speaker area. No person shall
approach the dais of the City Council during meetings except Council members and employees of the
City, unless invited by a member of Council.
All persons shall at all times conduct themselves in accordance with Council rules. Persons failing to do
so shall be ruled out of order and may be directed at the discretion of the Chair to be removed from
the Council Chamber. Such person shall not thereafter be readmitted to the Council Chamber or City
Hall during the remainder of that day’s meeting.
ALL MEETINGS ARE OPEN TO THE GENERAL PUBLIC
All persons attending the meeting are subject to search- Weapons are prohibited. Chapter 790.06
(12) Florida Statutes prohibits the possession of firearms or other dangerous weapons in a
municipal government meeting by all persons not specifically authorized by Florida Statute.
Conviction carries penalties of up to Five (5) years imprisonment and a $5,000 fine.
Pursuant to Rule 5 (G) of the Council’s Rules of Procedure, which reads as follows: No weapons or
objects that may be used as weapons shall be allowed in the Council Chambers. Persons, bags,
packages and parcels entering Council Chambers are subject to search.
PUBLIC HEARING SPEAKER'S WAIVER FORM
Only during public hearings, individuals in the audience may designate a spokesperson to speak on
their behalf, thereby relinquishing their speaking time to the designated spokesperson on the public
hearing agenda item for which designation was made. A speaker's waiver form must be filled out and

signed by individuals in the audience and presented to Council at the time that s/he appears before
Council. Speaking time is one minute per name up to a maximum of 10 minutes.
CONSENT AGENDA
The COMMITTEE portion of the agenda is known as the CONSENT Agenda. It is an effective procedure
used by Council to handle routine items expeditiously. Each Councilmember is assigned a committee
and reviews all items prior to the meeting. Committee items are adopted by one motion unless a
member of the public or a Councilmember wishes to address a particular item. In such cases, the item
will be pulled from the consent agenda and considered separately.
CANCELLATION OF A NOTICED, SCHEDULED HEARING
There are times when a noticed, scheduled hearing will not be heard due to the petition not being
perfected. You may call the Office of the City Clerk anytime four days prior to the hearing to confirm
that the hearing will be held.

The Council/CRA Calendar is updated by the Office of the City Clerk after the action agenda(s) has been
finalized and printed.
Items placed on the Council/CRA Calendar are the regular, evening, and workshop sessions scheduled
by Council and the regular sessions of the CRA. Also listed on the Council/CRA Calendar are any special
sessions of the CRA and any special sessions of Council such as public hearings, workshops,
presentations, items scheduled for a time certain, and any cancelled sessions. Also listed on the
Council/CRA Calendar are any Standing Committee meetings, Special Discussion meetings or any
special meetings that the Council must attend as a group.
The updated Council/CRA Calendars are posted on the bulletin board in the main lobby of Old City
Hall and are also available on the Hyland Agenda On-Line Repository on the City of Tampa’s website
via the following link:

PARKING FACILITIES IN THE VICINITY OF CITY HALL
Fort Brooke has approximately 600 spaces dedicated for hourly parking. This facility is located
between Florida/Franklin and Washington/Cumberland. Entrance to the hourly side is off Whiting
Street (the north module). The fee for parking is $2.00 for first hour/$3.00 every hour after with a
maximum of $15.00 for the day.
Please be advised that all parking meters located on Kennedy Boulevard and south to include
Whiting Street are currently enforceable until 8:00 PM and all parking meters south of Whiting
Street are currently enforceable until 12:00 AM, seven days per week. Parking meters located
north of Kennedy Boulevard are not currently enforceable after 6:00 PM.
