Kennedy Blvd., 3rd Floor Tampa, FL 33602 TAMPA, FLORIDA 33602 The City Council of the City of Tampa, Florida convened in a workshop session at 9:06 a.m. on this the 30th day of November, 2023 with Guido Maniscalco, Chair, presiding. Members present upon roll call were: Carlson, Hurtak, Clendenin, Henderson, Viera, Miranda, and Maniscalco, constituting a quorum. Moment of Silence Martin Shelby, Council Attorney, was in attendance. File No. CM23-82728 Discussion on hiring a Budget Analyst for the City of Tampa. (Original motion initiated by Clendenin-Carlson on July 13, 2023) Dennis Rogero, Chief Financial Officer; Justin Vaske, Senior Assistant City Attorney; Jean Duncan, Administrator of Infrastructure and Mobility; and Morris Massey, Deputy City Attorney, approached and answered questions from councilmembers. The following individuals appeared before Council to make public comment:  Stephanie Poynor Motion: (Clendenin-Hurtak) Councilman Clendenin be requested to work with City staff to produce a document for action on City Council regarding the Budget Analyst proposed position and to return on December 21, 2023 under Staff Reports and Unfinished Business. Motion carried unanimously. Memorandum from Councilmember Clendenin transmitting the proposed Budget Analyst job description and salary for said agenda item. Motion: (Miranda-Henderson) That said memorandum, be received and filed. Motion carried unanimously. 2. File No. CM23-82322 Brad Baird, Administrator of Infrastructure and Mobility; Jean Duncan, Administrator of Infrastructure and Mobility; and John Bennett, Chief of Staff, to lead a workshop discussion about how the City can improve transparency and accountability in the Contract Administration/CCNA process. (Original motion initiated by Carlson-Hurtak on June 15, 2023) (Continued from August 31, 2023) Richard Mutterback, Director of Contract Administration, appeared and presented a PowerPoint on said agenda item. Gregory Hart, Manager Minority Business Development; Ocea Wynn, Administrator of Neighborhood and Community Affairs; and Brad Baird, Deputy Administrator of Infrastructure, approached and answered questions from councilmembers. (Original motion initiated by Carlson-Miranda on October 20, 2022) (Next bi-annual update to be held on May , 2024) Jean Duncan, Administrator of Infrastructure and Mobility; Brandon Campbell, Smart Mobility Manager; Tony Mulkey, Interim Director of Parks and Recreation; Larry Washington, Solid Waste Director; Brad Baird, Deputy Administrator of Infrastructure; Rory Jones, Water Department Director; and Eric Weiss, Director of Wastewater, appeared and presented PowerPoint on said agenda item. Dennis Rogero, Chief Financial Officer, approached Council and answered questions. The following individuals appeared before Council to make public comment:  Stephen Michelini Email from Phyllis Ho-Zuhars, Senior Executive Aide to Chief of Staff, transmitting PowerPoint for Capital Improvement Update for said agenda item. Motion: (Miranda-Henderson) That said PowerPoint, be received and filed. Motion carried unanimously. 4. File No. CM21-69890 Real Estate Department, Housing Department, Code Enforcement Department, Tampa Police Department, Dr. Brianna Fox of University of South Florida; Re-Entry Service Liaison, and a representative from the Department of Correction, to appear and report on housing solutions, solutions to reduce recidivism, and solutions to reduce density in any one neighborhood, pertaining to sexual predators in the community, specifically in Ybor City. (Original motion initiated by Dingfelder- Maniscalco on August 5, 2021)(Updated motion initiated by Hurtak-Miranda on October 19, 2023) Megan Newcombs, Chief Assistant City Attorney, appeared remotely and stated that a memorandum was provided, and that she was available for questions. John Guzina, Police Detective and Patrick Barrentine, Florida Department of Correction, appeared remotely and answered questions. Motion: (Carlson-Miranda) That Code Enforcement, the Fire Marshall, and Legal be requested to meet with the VM Ybor Neighborhood Association to discuss code violations; further, that a report be presented to Council on February 1, 2024 under Staff Reports and Unfinished Business. Motion carried unanimously. Motion: (Carlson-Miranda) That Council requests the Mayor to meet with the VM Ybor Neighborhood Association to discuss solutions regarding state law. Motion carried unanimously. Page 4 Motion: (Clendenin-Hurtak) That Code Enforcement, Zoning, Fire and Legal Staff be requested to report on December 21, 2023 under Staff Reports and Unfinished Business on the zoning status, fire compliance, occupancy, and building code compliance for 2818 N. Nebraska Ave., 2820 N. Nebraska Ave., and 2821 N. Nebraska Ave. Motion carried unanimously. Motion: (Viera-Clendenin) That the Administration be requested to report on December 21, 2023 under Staff Reports and Unfinished Business on ideas with regards to additional investments in the immediate area, including but not limited to additional lighting, cameras, police presence, law enforcement presence and any other funding measures that will improve safety in the area; further, that the Tampa Police Department be requested to provide information on any possible grants that may be available. Motion carried unanimously. Memorandum from Lee Bercaw, Chief of Police and Nicole Travis, Development and Economic Opportunity Administrator, transmitting a written report for said agenda item. Motion: (Miranda-Henderson) That said Memorandum, be received and filed. Motion carried unanimously. 5. File No. E2022-8 CH 27 Planning and Legal Staff to report on the possibility of creating one or more entertainment districts that is not close to residential areas that could be designated as an entertainment area. (Original motion initiated by Carlson-Maniscalco on January 13, 2022) (Motion to reschedule from May 26, 2022 initiated by Carlson-Viera on April 21, 2022)(Continued from October 27, 2022 and February 23, 2023) (Continued from August 31, 2023) Motion: (Carlson-Henderson) That said agenda item be continued to December 21, 2023 under Staff Reports and Unfinished Business. Motion carried unanimously with Viera and Miranda being absent at vote. 6. File No. CM23-84782 Staff to appear and discuss any emergency changes Council can make to accelerate developments in dense areas within six months. (Original motion initiated by Carlson- Miranda on October 19, 2023) Abbye Feeley, Deputy Administrator for Development and Economic Opportunity appeared and answered questions from councilmembers. (Original motion initiated by Carlson- Hurtak on August 31, 2023) Brian Knox, Senior Forester Examiner, appeared and provided a brief introduction of Dr. Andrew Koeser, Professor of Urban Tree Management at the University of South Florida Research; Dr. Shawn Landry, Director of the USF Water Institute at the University of South Florida; and Dr. Rebecca Zarger, Associate Professor of Anthropology at University of South Florida. The following individuals appeared before Council to make public comment:  Cynthia Malony  Lorraine Perrino  Carroll Ann Bennett  Allison Date  Nancy Stevens  Pamela Jacksahaney  Stephanie Poynor Page 6 Motion: (Hurtak-Carlson) That City Staff including Sustainability, Natural Resources, Parks and Recreation, Legal, and Building Department be requested to come back on April 25, 2024 workshop session to discuss what we can be done to make sure mitigation trees are maintained and not taken out; how we are going to keep track of $1 million of the USDA trees and its maintenance in public spaces; the creation of larger city-wide tree maintenance program for low income residents; how to increase and improve Code Enforcement and Building Department for illegal tree cutting; adding a fine and punishment to tree cutting companies who illegally cut down trees, and incentivizes for planting live oaks. PUBLIC COMMENT FOR REGULAR SESSIONS OF COUNCIL Members of the public shall be given a reasonable opportunity to be heard at a time before City Council takes official action. Speakers shall first state their legal names for the purpose of identification in the record of the meeting. Page 6 City Council may establish time limits for members of the public to address Council. Unless such time limit is otherwise established, each member of the public shall be limited to three minutes. Members of the public addressing Council shall observe all time limitations that may apply. Speakers shall refrain from disruptive behavior, including making vulgar or threatening remarks. Speakers shall refrain from launching personal attacks against any city official, city staff member, or member of the public. Comments shall be directed to the Council as a body and not to individual Council members. No one present during a Council meeting shall engage in disruptive behavior, including intentionally making or causing to be made any disruptive sound or noise, or displaying signs or graphics in a manner disruptive to the proceedings. The Chair shall rule out of order any member of the public who shall speak without being recognized or who shall not address Council from the podium or other established speaker area. No person shall approach the dais of the City Council during meetings except Council members and employees of the City, unless invited by a member of Council. All persons shall at all times conduct themselves in accordance with Council rules. Persons failing to do so shall be ruled out of order and may be directed at the discretion of the Chair to be removed from the Council Chamber. Such person shall not thereafter be readmitted to the Council Chamber or City Hall during the remainder of that day’s meeting. ALL MEETINGS ARE OPEN TO THE GENERAL PUBLIC All persons attending the meeting are subject to search- Weapons are prohibited. Chapter 790.06 (12) Florida Statutes prohibits the possession of firearms or other dangerous weapons in a municipal government meeting by all persons not specifically authorized by Florida Statute. Conviction carries penalties of up to Five (5) years imprisonment and a $5,000 fine. Pursuant to Rule 5 (G) of the Council’s Rules of Procedure, which reads as follows: No weapons or objects that may be used as weapons shall be allowed in the Council Chambers. Persons, bags, packages and parcels entering Council Chambers are subject to search. PUBLIC HEARING SPEAKER'S WAIVER FORM Only during public hearings, individuals in the audience may designate a spokesperson to speak on their behalf, thereby relinquishing their speaking time to the designated spokesperson on the public hearing agenda item for which designation was made. A speaker's waiver form must be filled out and signed by individuals in the audience and presented to Council at the time that s/he appears before Council. Speaking time is one minute per name up to a maximum of 10 minutes. CONSENT AGENDA The COMMITTEE portion of the agenda is known as the CONSENT Agenda. It is an effective procedure used by Council to handle routine items expeditiously. Each Councilmember is assigned a committee and reviews all items prior to the meeting. Committee items are adopted by one motion unless a member of the public or a Councilmember wishes to address a particular item. In such cases, the item will be pulled from the consent agenda and considered separately. Page 7 CANCELLATION OF A NOTICED, SCHEDULED HEARING There are times when a noticed, scheduled hearing will not be heard due to the petition not being perfected. You may call the Office of the City Clerk anytime four days prior to the hearing to confirm that the hearing will be held. COUNCIL/CRA CALENDAR The Council/CRA Calendar is updated by the Office of the City Clerk after the action agenda(s) has been finalized and printed. Items placed on the Council/CRA Calendar are the regular, evening, and workshop sessions scheduled by Council and the regular sessions of the CRA. Also listed on the Council/CRA Calendar are any special sessions of the CRA and any special sessions of Council such as public hearings, workshops, presentations, items scheduled for a time certain, and any cancelled sessions. Also listed on the Council/CRA Calendar are any Standing Committee meetings, Special Discussion meetings or any special meetings that the Council must attend as a group. PARKING FACILITIES IN THE VICINITY OF CITY HALL Fort Brooke has approximately 600 spaces dedicated for hourly parking. This facility is located between Florida/Franklin and Washington/Cumberland. Entrance to the hourly side is off Whiting Street (the north module). The fee for parking is $2.00 per hour with a maximum of $12.00 for the day. Please be advised that all parking meters located on Kennedy Boulevard and south to include Whiting Street are currently enforceable until 8:00 PM and all parking meters south of Whiting Street are currently enforceable until 12:00 AM, seven days per week. Parking meters located north of Kennedy Boulevard are not currently enforceable after 6:00 PM. City Hall can be accessed by transit utilizing the Hillsborough Area Regional Transit Authority (HART).
