CITY SOLICITOR June 2, 2022 Council President Phillip Duarte and Members of the Municipal Council City of Taunton/City Hall 15 Summer Street Taunton, Massachusetts 02780 Re: Concern Regarding Trees at Mill River Condominium Raised During Public Input on April 19, 2022 Dear Members of the Municipal Council: This letter is in regards to alleged overgrowth of trees at the Mill River Condominium which was the subject of comments during public input by a neighbor of the Condominium on April 19, 2022. The Council voted to refer this matter to the Law Department. The City only has a role if the trees are impacting a public way or are otherwise impacting public property. Specifically, the City generally has the right to cut any tree growth overhanging onto a public way or public property, but generally does not have the right to enter private property or compel the cutting of trees on private property absent the consent of the property owner or a court order. There is an ordinance relating to hedges and shrubs planted near street intersections but we do not understand this inquiry to relate to that type of scenario . The City should only respond to inquiries such as this where public property or public ways are affected. The City has no jurisdiction if it is a private matter between neighbors. From the information presented at the meeting, we are not aware that public property is involved in this issue at the present time; however, if public property is affected then the City would have the right to take action as set forth above . As part of our peace-building initiatives, we would like to hold a peace charity concert called "PAPA 2022 CHARITY CONCERT," at 1 Porter St. on July 23rd 2022. Purpose PAPA: People's Aspiration for Peace Alliance The event is to promote peace. All peace starts with the family unit and extends to the neighbor, the town, the state, the nation, the world. The charity event will encourage men (papas) to regain their purpose and awareness of their role within the family unit. Our vision is to create a cornerstone unit (family) of peace in the world that has shifted away from such a foundation. The proceedings will go toward supporting fathers who are lost, need education or training to regain this position for themselves. The family unit is stronger with Papa's protective nature and support, enabling mothers to nurture the family and to feel safety, protection and support. During the opening 2 hours spectators have access to participating vendors and event premises. • DJ entertainment 4-Spm Concert Conditions: • A professional music band Wu-tang is going to bring a production company setting up a stage on the Porter 1 premises in the comer of the outdoor space located near the railroad tracks as shown in the sitemap plan. • Concert live performance starts 5pm and ends 8:30pm • The entire 1 Porter St. property is to be fenced and gated with only one access point to the event allowing for more crowd control • The fenced in area as marked on sitemap is planned for a beer/wine vendor, the space capacity is about 200 spectators. Alcohol is going to be served and sold at the stand no delivery service will be made • The rest of the parking lot is going to be used as space for the audience and divided into 3 groups, which denominate a ticket level. • Vendor area to sell food, retail and merchandise at the front of the building near the event entrance. All food and beverage to be in compliance with the health department. • Police detail to be set up with Taunton Police Department. Public safety and order to be in compliance with the police detail. • Five porta potty units are going to be provided and located near the entrance behind the building. • After party for VIP tickets is to be held inside the 1 Porter building.
