City Engineer May 13, 2022 Honorable Mayor O'Connell Members of the Municipal Council City Hall, 15 Summer Street Taunton, MA 02780 Re: Street Acceptances Dear Mayor O'Connell and Councilors, At this time a formal acceptance request is being forwarded to the Municipal Council for following listed streets (see attachment). The Engineering Department in conjunction with the Planning and Conservation Department and the Law Department created a list from the inventory of private and/or unaccepted City streets. Of the 66 streets listed, 65 have layout plans already recorded at the Northern Bristol County Registry of Deeds (the other street has a certified plan created that is available to be recorded). Research indicates that these streets were intended for acceptance but the process was never completed. Additionally, all of the streets are being maintained by the City and the abutters are benefiting from City services. A positive recommendation has been sent out by the Planning Board. The Airport Commission suspended operations on Friday July 29, 2022 and after review, inspection, and cleaning reopened the subject dispenser on August 3, 2022. Operation of the dispenser was suspended out of an abundance of caution due to the discovery of particulates suspended in the fuel. These particulates were discovered as part of-routine testing and sampling of the fuel at the Airport. The fuel was immediately run through filters to clean the fuel in the tank. In addition, an aviation fuel consultant was engaged, as well as a tank cleaning contractor. An interior inspection and cleaning was performed, followed by additional testing. As a result, the dispenser was reopened after the fuel tested negative for particulates.  During the course of the suspension, the Federal Aviation Administration (FAA) and MassDOT were notified and a FAA notice of the suspension was promptly issued. At all times, proper FAA procedures were followed. In addition, the Airport staff responded to all inquiries from the aviation public. Throughout the suspension, the Airport responded to numerous inquiries and provided updates when information was available. The Airport continues to test and monitor fuel from that dispenser daily. The revision adds bodywork practitioners and bodywork permit applicants to the list of licensees who must submit to a CORI background check in order to receive a City license. The practice of bodyworks shall commence licensing by a regulation of the Board of Health in October. The regulations were a result of a collaboration between the Mayor, Chief of Police and the Board of Health to provide additional oversight of bodywork establishments . The addition of this category to the list will allow for a full police CORI review instead of the City's more limited review. This will allow for a more thorough examination of the applicant's criminal history and will improve public safety for the citizens of Taunton. The revision to the Ordinance is supported by the Police and Health Departments. Enos DEPUTY CHIEF OF STAFF BUDGET DIRECTOR August 19, 2022 Council President Phillip Duarte Members of the Taunton Municipal Council 15 Summer Street Taunton , MA 02780 Dear Council President Duarte and Members of the Municipal Council, I am writing to provide an update on the successes and achievements of our first Chief Financial Officer and the accomplishments he has helped bring forward for the City of Taunton. These efforts have improved internal processes, standardized procedures, and created clear lines of authority and oversight over the finances of the City. We now have a clear path forward , and I respectfully request that Council invite Mr. Delio Russo and members of the Finance Department to provide a presentation on the City's first Five-Year Financial Forecast. Upon Mr. Delio Russo's appointment, he provided a plan for phase one of the newly created position. These goals were presented to my Administration within 30 days of his appointment and accomplished in six months. This plan included nine tasks: 1) Establish bi-weekly finance meetings; 2) Improve the budget process; 3) Implement a Capital Budget; 4) Close out ledgers in line with MGL; 5) Create a competitive investment banking system; 6) Develop a spending plan for ARPA funds; 7) Provide oversight for the MUNIS project; 8) Create and publish an RFQ for a public safety facility , and 9) Develop a "cost for contract" template to understand what percentage increases to union groups equal in dollar values. Formulating the Finance Department: Mr. Delio Russo was tasked upon his appointment with a transition of four key components of the Finance Department. 1) The hiring of a new Treasurer Collector; 2) Oversight of a recently appointed City Auditor; 3) The hiring of a Chief Procurement Officer; and 4) The hiring of a Purchasing Agent for the new Procurement Department. Mr. Delle Russo instituted bi-weekly meetings with action item agendas and created an atmosphere that allows for a free flow of ideas which encouraged "buy in" from the team. The Finance Department has expanded these meetings to include the School Dept., OECD, DPW and IT. This provides everyone an opportunity to share their input and has been a tremendous success with ongoing positive results. Budget Process Improvements: Changes to the budget process have streamlined and standardized budget hearings. The Finance team met regularly with Department managers and spent over 100 hours preparing the operational budget to present to Council. For the first time, we were able to pass a budget in one night without having Department managers appear before the Council night after night. Mr. Delle Russo provided the budget and all relevant information two weeks prior to the hearing to allow the Council ample time to review information, research figures, and ask questions. We shared the budget information on the homepage of our City website to increase transparency and provide an easy and convenient way for City residents to access this information. We received exceedingly positive feedback from multiple stakeholders who expressed sincere appreciation for the changes implemented. First City of Taunton Capital Budget: One of the most impressive tasks our CFO completed was the creation and establishment of a Capital Budget. We focused on analyzing our City's needs and identifying the best sources to fund those needs. The implementation of the Capital Budget allows us to practice "project accounting," which is in line with DOR best practices. A Five- Year Capital Improvement Plan will be presented in November 2022. Close of General Ledger and Reduction of Carry-Over Request: The City previously had a history of not closing their "books" in a timely fashion. For the first time in recent history, the City's books are closed in line with M.G.L. This is largely attributed to the procedural changes in the end-of-year processes put in place in January 2022 by our CFO. ARPA Grant Planning and Functionality: The City was granted nearly $30 million through the American Rescue Plan Act (ARPA). Mr. Delle Russo immediately formulated a three-tier system we are currently using to identify which projects should move ahead to the County, City Restricted, or City Unrestricted funding. This careful consideration will allow us to strategically use these funds for the current and future needs of our City. Banking Competitiveness amongst Investment Firms: A noticeable deficiency identified by our CFO was the lack of investment activity with our stabilization and investment accounts. We are requiring that banks work more competitively for our business under the Monitor, Manage, Care (MMC) approach we have implemented while still adhering to the Safety, Liquidity, Yield (SLY) principles required under MGL. This new approach to cash management has allowed the City to receive $411,000 in newly recognized funds. MUNIS Project Oversight: As part of our plan to bring the City more fully into 21st century finance governance, we have purchased MUNIS software. Mr. Delle Russo has expansive knowledge of software conversions and is leading this project with IT Director Paul Arikian. This long-awaited software change will be completed in April 2023.  1 Public Safety Facility RFQ: As promised, we are moving forward with plans for a new public safety facility. We are now in the process of interviewing three reputable firms who submitted bids to become the City's Owners Project Manager (OPM) for this enormous undertaking. Mr. Delio Russo provided the format and layout for the RFQ of the OPM, saving time and money. We look forward to the next steps in this process. Costing of City-Wide Contracts: To ensure union contracts are negotiated with a full understanding of the broader financial impact, Mr. Delio Russo has developed a standard contract form that can cost out the actual price within a margin of error for the duration of a contract. With this forecast model , we are able to determine what we can realistically afford and employ this information to negotiate contracts more knowledgeably . Mr. Delio Russo has brought a level of energy and excitement to City Hall that has truly motivated the Finance team . Our first CFO has exceeded our highest expectations and we are looking forward to the vital contributions he will continue to bring to our City. I am thankful to Mr. Delio Russo and the entire Finance Team for the extraordinary accomplishments they have made in the past eight months to put our City in a strong financial position for the future. With regards to Bacon Felt, 395 West Water Street (Parcel 92-340) and West Water Street (Parcel 92-339): the City has had ownership/title to the properties since August 3, 2022. The foreclosure judgment transferring ownership/title was recorded at the Registry of Deeds on August 16, 2022. Attached please find a copy of the recorded foreclosure judgment. With regards to Whittenton Mills: the City has moved its portion of the tax lien into a foreclosure case. The Court will assign a title examiner who has 60 days to file a report. After the report has been filed, the Court will send notice to the owner, the assignee LHPNJ, LLC, and the mortgagees. I am sure all of the parties will file an answer in the case. The time frame for this to happen is optimistically six to nine months. We will try to move the case along as quickly as possible. The City is in a position to pursue a judgement to have the owners sell, in which the City would receive all funds owed, or negotiate terms acceptable to the City.
