Hearings: On the petition of the City of Taunton, 15 Summer Street, Taunton, MA 02780 for the acceptance of Saints Way and Bridget Drive as public ways in the City of Taunton. Motion was made to open the public hearing and invite the parties into the enclosure. So voted. The City Clerk read the communication received from the Chairman, Taunton Planning Board submitting a positive recommendation. A map of the streets was provided. Motion was made to make the communication and the map a part of the record. So voted. City Engineer, Michael Patneaude said both these streets are part of a sub-division that was approved by the Planning Board. It was constructed on the Planning Board's rules and regulations. It was completed and the as-built drawings were submitted and approved. The benefits to the City is that it adds to our Chapter 90 roadway links and they both are constructed according to these City standards which are good conditions. Mayor O'Connell asked if these are roads we already take care of. Mr. Patneaude said not yet, we will now take care of them this winter. Motion was made to open public input. So voted. There was nobody present to speak for public input. Motion was made to close public input and approve the acceptance of Saints Way and Bridget Drive. So voted. On the petition of the City of Taunton, 15 Summer Street, Taunton, MA 02780 for the acceptance of Johnson Court as a public way in the City of Taunton. Motion was made to open the public hearing. So voted. The City Clerk read the communication received from the Chairman, Taunton Planning Board submitting a no recommendation comment. A map of the street was provided. Motion was made to make the communication and the map a part of the record. So voted. City Engineer, Michael Patneaude said the Planning Board has a no recommendation comment because this was not completed as 2 part of a Planning Board approved sub-division. This is an older street that has been in existence for a longtime and was never formally accepted. He said he should have included Johnson's Court when they did Allan's Avenue because it's basically the same plan. It was an oversite on his part. Merchant's Lane has already been accepted, which is kind of the bridge between the two streets. This is just a clarification of an existing street. This is one they actually do own and maintain. This would be to just formalize it. Councilor Coute asked exactly where the street is. Mr. Patneaude said Johnson's Court comes out on to Weir Street, next to Bobby's Place. It's a 200 ft. road, if that. It ends where Merchant's Lane is, behind the union block project that is being developed. Councilor Coute asked if we already plow this street. Mr. Patneaude said yes we do. Motion was made to open public input. So voted. There was nobody present to speak for public input. Motion was made to close public input and approve the acceptance of Johnson's Court. So voted. Communications from the Mayor: Mayor 0' Connell said as reminders, City Hall will be closed for Christmas this Thursday, December 22nd at 12:00 p.m., closed on Friday, December 23rd all day and also closed Monday, December 26th all day. This weekend is your last chance to get a picture with Santa on the Taunton Green which will be on Friday, December 23rd from 5:00 p.m. to 8:00 p.m. Also, our gingerbread house decorating contest was a real success. They had about 50 people enter from the City. There were some amazingly creative gingerbread houses. She hopes everyone had a chance to go on the Facebook page and take a look at them. 1st place in the adult division, goes to the Lucy family for their "UP" inspired gingerbread house (from the movie UP). Congratulations to Jimmy Walczak (9-years old) for 1st place in the youth division. You can check both these gingerbread houses out on the Facebook page. They will be receiving some fun prizes for entering. It was nice to see how many people participated and it shows the spirit that this community has. She thanked everyone who entered. Appointments: NONE Communications from City Officers: Com. from the Chief Financial Officer requesting a $25,000.00 transfer of reserve funds to cover the cost related to advertising in the Procurement Office. Motion was made to refer to the Committee on Finance and Salaries. So voted. Com. from the Chief Procurement Officer requesting to present an update on procurement activities and enhancements to the City's Procurement Procedures. Motion was made to refer to the Committee on Finance and Salaries. So voted. Com. from the Police Chief requesting a list for two full-time Police Officers from the Human Resources Division, to fill two expected vacancies in the Police Department. Motion was made to refer to the City Clerk to call for a list. So voted. Com. from the Chairman of the Taunton Planning Board notifying of a meeting and public hearing for a Special Permit/Site Plan Review for property at 225 Cape Road to allow the addition of 4,023 sq. ft. of retail space to the existing 1,800 sq. ft. retail space, an 1,820 sq. ft. greenhouse, a 1,220 sq. ft. outdoor display area and 4,465 sq. ft. of 3 storage space, an outdoor food trailer with 3-picnic tables with 12-seats and 432 sq. ft. office space, submitted by Fariborz Motamedi. The next scheduled meeting for this petition will be on Tuesday, December 27, 2022 at 8:45 a.m. in the Taunton Planning Board Office, 141 Oak Street, at which time the application shall be reviewed by the DIRB and the Planning Board will hold a public hearing on Thursday, January 5, 2023 at 5:30 p.m. at City Hall, 15 Summer Street. Motion was made to receive and place on file. So voted. Com. from the Chairman, Taunton Planning Board notifying of a Public Hearing for a Special Permit from Section 440 Attachment #2 of the Zoning Ordinance for a drive-thru for a new 30-seat restaurant in conjunction with an existing commercial shopping plaza, on premises situated at 2089 & 2101 Bay Street, Taunton (Prop. I.D. 14-14, 14-108 and 14-109). Submitted by G&J Realty LLC & Blue Sky Donuts, Inc. The Taunton Planning Board will hold a public hearing on this proposal on Thursday, January 5, 2023 at 5:30 p.m. at City Hall, 15 Summer Street. Motion was made to receive and place on file. So voted. Com. from the Chairman, Taunton Planning Board notifying of a site plan review for a property on Myrick's Street (Prop. I.D. 138-11) for the construction of a 9-self storage buildings facility (total 83,775 sq. ft.) and 900 sq. ft. office space with 106-parking spaces, submitted by 788 Boston Road LLC. The next scheduled meeting will be on Tuesday, December 27, 2022 at 8:30 a.m. in the Taunton Planning Board Office, 141 Oak Street, at which time the application shall be reviewed by the DIRB and then the Planning Board will review it on Thursday, January 5, 2023 at 5:30 p.m. at City Hall, 15 Summer Street. Motion was made to receive and place on file. So voted. Com. from the Assistant Executive Director of Retirement notifying of the retirement for Jeffrey Riccitelli, an employee of the Veteran's Office. He is scheduled to retire on March 9, 2023 with 24-years of service. Motion was made to receive and place on file and send the appropriate scroll with the Council's thanks for his years of service. So voted. Com. from the Safety Officer submitting a response on the speeding on Granite Street between Hodges Avenue and Tremont Street. Granite Street is a short thickly settled street with an unposted 30-mph speed limit. He placed the Black Cat II radar unit on the phone pole in front of 10 Granite Street on December 6, 2022. The unit recorded 4,347 vehicles. The average speed recorded was 15-mph, with the highest speed recorded being 41-mph. During this time period, 2-vehicles were recorded traveling between 35-mph and 40-mph. One vehicle was recorded traveling between 40-mph and 45-mph. The unit recorded one enforceable violation. A separate packet was provided. With this information provided by the radar unit, he doesn't believe that there is a speeding issue on Granite Street at this time. Motion was made to receive and place on file with the Council's thanks. So voted. Com. from the Chief Procurement Officer requesting to present an update to the Committee on Public Property regarding recommendations for 0 Bay Street. Councilor Coute said he spoke to Attorney Winters, and Attorney Winters reminded him that he was present for the Public Property Committee meeting last week on this and the vote at Public Property Committee was to authorize the Procurement Officer to dispose of the 4 property. Attorney Winters didn't think an update was needed. This property probably shouldn't be on the agenda. Motion was made to receive and place on file. So voted. Com. from Mayor O'Connell providing an update on Army Reserve Center on Eldridge Street. In order for a property owned by the Federal Government to be sold or transferred, a formal process is undertaken to verify that the property is no longer of use to the Government. This process is referred to as "disposal". The Army Reserve Center is undergoing the disposal process. The estimated date for conclusion of environmental due diligence, barring and adverse findings, is late 2024. More details were provided. Motion was made to refer to the Committee on Public Property with thanks to the Mayor's Office for the update. So voted. Motion was made refer to the City Clerk to schedule a Public Hearing. So voted. Marijuana Application RENEWAL Application submitted by Tree Market Taunton LLC for the RENEWAL of their Marijuana Retailer License located at 9 Cape Road, Taunton. Motion was made refer to the Committee on Police and License and the Police Chief to be scheduled for January 3, 2023. So voted. Auto Sales meets the criteria for their business certificates but that they are not in line with details of the Planning Board decision. He read a letter from Bob Pirozzi dated 9/2/22 which outlined the details of the zoning violation. MOTION: Make the letter part of the record. So Voted. Councilor Sanders indicated that the business is not in compliance and, as such, a motion to deny seems appropriate. Councilor Borges suggested that they notify the applicant and request that they come in to explain the situation. She suggested that they grant the business 90 days to come into compliance. Councilor Sanders indicated that he would agree to a month but they make it clear the applicant should be at the next meeting. Councilor Borges expressed her opinion that a month is unrealistic especially during the holidays. Councilor Coute suggested that the Council invite them back to explain their issues and then vote on the length of the extension. Councilor Pottier indicated that it is not fair to the other businesses that are in compliance. Councilor Borges expressed her support for Councilor Coute's suggestion of bringing them back next week and made a motion. MOTION: Table this discussion for one week, and invite the petitioners to come and discuss the letter from Mr. Pirozzi in September and to explain the reasons for not meeting the conditions set by the Planning Board. Meet for a pre-review for the issuance of a special permit upon the petition of Brianna Correira, Esq., Correira Law Office, PLLC., 123 Broadway, Taunton, MA on behalf of her client Huendel Da silva Furlan of Astor Transportation, LLC., 170 Gore Road, Revere, MA to allow a 4,032 sq. ft. truck terminal use in conjunction with the existing 66-vehicle auto sales use located at 397 Winthrop Street in the Highway Business District. Attorney Correira gave some background on the project. She indicated that the site has been used as an auto sales dealership and that her clients have a transportation business which helps to relocate vehicles. As such, the car carriers are usually offsite. They are looking for a special permit to park the car carriers in the rear when they are not in use. Councilor Pottier expressed his interest in seeing a schematic of the property and learning more about any outreach to the neighborhood. He also would like to know the anticipated hours of operation and potential mitigation during heavy traffic times. Further, he would like to be assured that the trucks are registered and pay excise taxes in Taunton. Councilor Borges is interested in hours of operation, number of employees, number of vehicles, and any other services at that site. Councilor Sanders indicated that traffic is a huge concern in that area and at certain times of the day there are long lines of traffic. He believes that people who live in the area will be concerned with the traffic impacts. He would like to know the estimated number of vehicles in and out of the facility as well as details on the types of vehicles. Information on the impact to traffic is also of interest to him. Councilor Coute suggested that the site has already been used in this capacity so suggested the petitioner talk about any issues that have arisen. 18 Page Two December 20, 2022 The Committee of the Council as a Whole - Continued Councilor Duarte expressed his interest in learning more about the number of trucks and the size.
