Opportunity for input by the general public.
Mary Reilly, P.O. Box 182, Taunton, spoke about the latest Senior Trash Curbside Bag
Program. It was on the back of the bulletin sent by the Council on Aging this month. She
feels the way it is worded, is very confusing. Her explanation continued. Mayor
O'Connell said her office will work with the DPW and the Assessor's office to provide
her with a response.

Communications from the Mayor:
Mayor O'Connell wanted to let everyone know City Hall will be closed on Monday,
January 16th in observance of Martin Luther King, Jr. Day. There will be a Martin Luther
King, Jr. ceremony by the Greater Taunton Clergy Association, as they do every year.
This will be their 31st Observance Day. The Mayor's Worthy Cause is pleased to support
this ceremony. It will be on Monday, January 16th at 6:00 p.m. at the Memorial United
Methodist Church, located at 176 Somerset Avenue in Taunton. The public is invited and
encouraged to attend. They hope to see everyone there.
Appointments:
Reappointment of Robert Dickerman, 30 Ashland St., Taunton to serve on the Historic
District Commission for a term of two (2) years expiring January 2025. Motion was
made to approve. So voted.
Reappointment of Charles Thayer, 30 Dean St., Taunton to serve on the Historic District
Commission for a term of two (2) years expiring January 2025. Motion was made to
approve. So voted.

Reappointment of Peter Higgins, 645 Burt St., Taunton to serve on the Cable Television
Advisory Commission for a term of five (5) years expiring January 2028. Motion was
made to approve. So voted.
Appointment of Jason Cross, 10 Rockland St., Taunton to serve on the Library Board of
Trustees for a term of three (3) years expiring January 2026. Motion was made to
approve. So voted. On discussion, Councilor Borges said Mr. Cross is new to the City of
Taunton. She had the opportunity to meet with him and she thinks it's a great
appointment.
Communications from City Officers:
Com. from the Safety Officer submitting a response on Liberty Street speeding as there is
only one speed limit sign at this time. On December 28, 2022, the DPW placed three
additional 30-mph speed limit signs on liberty Street. One of the signs was placed at the
beginning near Middleboro Avenue, another placed at the beginning near Caswell Street
and one placed in the middle of Liberty Street across from the existing speed limit sign.
Sargent Balmain has agreed to place a radar speed sign on Liberty Street as soon as one
becomes available. Patrol has been asked to monitor and enforce the speed on Liberty
Street in the a.m. and p.m. Motion was made to receive and place on file. So voted. On
discussion, Councilor McCaul thanked Officer Arsenio Chaves for responding quickly.
He talked to a few residents in that area and they are saying they have seen a difference in
the speeding that has been taken place on Liberty Street.
Com. from the Safety Officer and the City Engineer submitting responses on the four-
way stop intersection at Kingman and Seekell Streets. At this time, the intersection at
Kingman Street and Seekell Street has a stop sign on both approaches of Kingman with
advanced warning road markings. The area is a rural residential 30-mph. Traffic volume
on Kingman Street is higher than Seekell Street. The intersection is offset with a slight
hill on Seekell Street. The intersection has a difficult sight line on Seekell Street near
Kingman Street. There has been several motor vehicle crashes at this intersection in the
past. He believes a four-way stop at this intersection will make this intersection safer and
reduce motor vehicle crashes. Along with the four-way stop signs, advanced warning
road markings and signs should be placed on both Seekell Street and Kingman Street. He
asks that this request be approved by the Municipal Council and be forwarded to the
Ordinance Committee. Also attached was a recommendation from Michael Patneaude,
the City Engineer. Motion was made to refer both communications to the Committee
on Ordinances and Enrolled Bills. So voted.
Com. from the Building Department Office Manager submitting an accrued time buyout
for Richard Ames in the amount of thirteen thousand, seven-hundred and forty-three
dollars and five-cents ($13,743.05). Motion was made to receive and place on file. So
voted.
Com. from the City Auditor requesting a transfer of funds from the reserve account to
cover two employee buyouts. Kristin Gagnon has taken a position with the School
Department effective January 1, 2023 with the buyout amount of $3,213.59.Sandra
Kingsbury will be retiring on February 11, 2023 with the buyout of $21,971.08. The total
amount requested is twenty-five thousand, one-hundred and eighty fours dollars and

sixty-seven cents ($25,184.67). Motion was made to refer to the Committee on
Finance and Salaries. So voted.
Com. from Larry Silvia, President/Treasurer of the Neighborhood Corporation (formerly
the WEIR Corporation) submitting a Notice of Dissolution effective December 30, 2022.
Motion was made to receive and place on file and send a letter to thank Mr. Silvia
and the board members. So voted. Mayor O'Connell said they thank Larry Silvia and
the many people involved over the many years with the Neighborhood Corporation. They
have made a tremendous difference in the Weir area of our City. Improving blighted
properties, creating affordable housing and really bringing that part of the community
together. They are sad to see them go but, very grateful for the work that they have done
here in our community for decades. Councilor McCaul said as a member himself for
years, with the Weir Corp. and also living in the Weir section, they did a lot of great work
in the area. Councilor McCaul requested that since they have dedicated their time and
effort to trying to straighten out the Weir section on many issues and bringing business in
the area for forty years, the mayor issue a proclamation to the members and invite them
to the Council meeting to present this to them. Mayor 0' Connell said they can talk to
Larry Silvia.
Com. from the City Solicitor regarding an Open Meeting Law complaint filed on
November 8, 2021 by Barry Sanders with the Office of the Attorney General against the
Taunton City Council. A letter dated December 19, 2022 from the Assistant Attorney
General Kerry Anne Kilcoyne regarding the filed complaint. They are pleased to report
that the Attorney General agreed with the Law Department's position in concluding that
the Municipal Council did not violate the Open Meeting Law. Given said determination,
the matter is now considered resolved. Motion was made to receive and place on file.

Communications from Citizens:
Com. from Attorney William Rounds, 115 Broadway, Taunton requesting to renew a
Host Community Agreement. The City Clerk stated this letter should have been put on
the agenda for a different Host Community Agreement. She inadvertently put the wrong
letter on the agenda. The correct letter for LMCC, LLC will be put on next week's
agenda. No motion was taken.
Com. from Attorney Richard Burke, Jr., Beauregard, Burke & Franco, 32 William Street,
New Bedford, MA requesting approval of Hours of Operation for Bask, Inc. from 9:00
a.m. to 10:00 p.m., seven days a week. Motion was made to refer to the Committee on
Police and License. So voted.

refer to the Committee on Police and License and the Police Chief. So voted.

Pole Location
Petition submitted by TMLP for one (1) new sole electric light location including one (1)
hand hole and associated conduits to be located on Washington Street, Taunton. Motion
was made to refer to the City Clerk to schedule a public hearing. So voted.

Motion was made for Committee reports to be read by title and approved. So
Voted. Recommendations adopted to reflect the votes as recorded in committee

New Business:
Councilor Postell requested a motion to refer to the Safety Officer for a review of
the lighting conditions in the area of Weir Street at the crosswalk near the Pearl
Restaurant. So voted.
Councilor Borges made a motion to refer 75 Oak Street (the former Fire Prevention
office) and 45 School Street to the Committee on Public Properties for discussion. So
voted.
Councilor Borges said now that we are approaching our budget time and meetings,
she made a motion to refer to the CFO and the Mayor's office to include two (2)
additional Building Inspectors in the budget, which she believes is completely
appropriate with all the current growth and new projects they have coming within
the City. So voted.
Councilor Pottier made a motion to call for a lieutenant list as requested to him by
the Fire Chief. So voted.
Information only, Councilor Pottier believes there are couple of items on the agenda for
tomorrow that may not be coming forth due to scheduling issues.
Councilor Sanders said he takes comments from Public Input to heart. He knows when
they originally created the new Senior Trash Bag program, they were piloting that
program and wanted to keep it sort of trim. As Ms. Reilly noted some income
requirements. Motion was made to refer a review of the Senior Trash Bag program
to the Committee of the Department of Public Works. So voted.

The meeting was called to order at 5 :34 PM.
1. Meet to review the weekly vouchers and payrolls for City departments.
MOTION: Approve the payroll warrant in the amount of $3,987, 024.39. So voted.
MOTION: Approve the accounts payable warrant in the amount o/$4,315,355.30. So voted.
2. Meet to discuss the proposed cost of living adjustment for City retirees/survivors.
Paul Slivinski of the Retirement Board gave a synopsis of the two issues at hand. Recently
legislation was passed that allowed the COLA increase to go as high as 5%. Secondly, the Board
voted to increase the base to $16,000. He indicated thatthere would be minimal impact on the
budget since the retirement system has had excess earnings. This is an opportunity to benefit
members of the .retirement system and share some of the gains.
Councilor Pottier asked about the basis going from $15,000 to $16,000 and Mr. Slivinski
indicated that this would take effect in FY2024. The increase of3 to 5% would be as of July 1,
2022. Councilor Pottier asked for the total impact of this increase and Mr. Dello Russo answered
that this would be covered by earnings. Mr. Pottier further questioned the impact of the last few
challenging years and Mr. Slivinski explained that they use a technique called actuarial
smoothing that mitigates impacts.
Councilor McCaul questioned the impact of last year as it was a tough year and Mr. Slivinski
answered that they haven't measured that yet but that they aim to earn 7.6%.
MOTION: Adopt Ch. 269 ofthe Acts of2022. So voted.

MOTION: Approve the COLA base increase to $16,000pursuantto G.L. c.32,§103(j). So
voted.
3. Meet with CFO, Treasurer-Collector, and Budget Director for an update on Investment
and Revenue Performance.
Patrick Dello Russo, Christine Clymens, and Gill Enos gave a brief presentation on the revenue
strategies and investment activity of the City. Mr. Dello Russo indicated that the City has
changed the way it does banking. Ms. Clymens reported that 78.5% of funds are operational or
liquid and are housed in 8 banks. 4 institutions hold 87% of the liquid assets. 17.5% of funds
are in an investment portfolio and 4% of funds are in savings accounts. She reported that the
City's investment income is over $1 Million for the first six months of the year where in FY22
investment income totaled $353,000 for the entire year. Mr. Delio Russo pointed out that
municipal dollars are more favorable to financial institutions than borrowing from the Federal
Reserve and that they have been able to move funds into higher yielding accounts. Ms. Clymens
stressed that the objectives of safety, liquidity, and yield are always kept in mind. She takes a
conservative approach and the majority of funds are no longer held in one bank. Ms. Clymens
reported that the team has negotiated higher rates and they are shooting for $4 Million in 2024.
She also indicated that they have greatly improved the collection rate of police detail payments
and have cross trained the treasurer staff on collection functions.
Councilor Pottier asked why funds are spread out over four institutions and Mr. Delio Russo
stated it was for competition. Mr. Pottier further asked how readily the funds can be transferred
and Ms. Clymens informed him that it was instantaneous.
Councilor Postell asked for more information on the collection for police details and Mr. Dello
Russo indicated that he will provide more. Mr. Postell further indicated that he would like to see
a list of those who are delinquent.

The meeting was called to order at 6:05 PM.
1. Meet with Detective Rutherford on the following applications for renewal of Class II
Used Car Dealer Licenses:
a. Leo's Auto Sales and Service at 350 l/2R Winthrop Street
Detective Rutherford gave a positive recommendation.
MOTION: Approve. So voted.
b. Amaro's Family Auto Sales at 503 Middleboro Ave
Detective Rutherford reported that the applicant has not met the requirements of the site plan
review and has started another business on the property.
Councilor Postell referred to the August 10, 2022 correspondence from Mr. Pirozzi that detailed
where the applicant was not in compliance since those conditions had not been met. Mr. Scanlon
explained that Mr. Amaro had started doing auto repair for outside clientele which requires a
special permit. He further indicated that auto repair would require some storage spaces so that
would likely reduce the available spaces for the Class II business. However, he expressed his
belief that Mr. Amaro is working towards compliance but that is going to take some time.
Councilor Postell pressed Mr. Amaro on when the outside repair work began and Detective
Rutherford indicated that when this went before the Planning Board it was just for an auto sales
business. Mr. Scanlon clarified that with a Class II license he can do accessory repair such as
getting cars ready to sell. Mr. Scanlon indicated that the site plan needs to be adjusted and,
therefore, recommended a several month temporary extension. Councilor Postell asked Mr.
Amaro how long he had been doing outside repair work and Mr. Amaro suggested 3-4 months.
Detective Rutherford emphasized that he is allowed to do repair work on vehicles for sale.

Councilor Postell asked Mr. Amaro ifhe had advertised the vehicle repair and Mr. Amaro
confirmed that he had and that he thought that he could do it without a permit. Since he's
learned that he cannot, he has ceased and desisted outside repair operations. Detective
Rutherford confirmed that the signs are down and reiterated that he needs to apply with the
planning board for a special permit. Mr. Postell asked Mr. Amaro ifhe understands that he will
need to apply with the Planning Board and Mr. Amaro indicated his understanding. Mr. Postell
also asked how long the process will take and Mr. Amaro said that he didn't know.
Councilor Borges indicated that Mr. Amaro owned up to his mistake, took down the sign, and
now knows what he needs to do. She indicated that an oil/water separator, which is required by
the site plan, is very expensive. She expressed her support for a 6 month extension with the
condition that he files with the Planning Board for a Special Permit to revise his site plan. She
also emphasized that he will need to get a license with the City Clerk at the end of the process.
Councilor Sanders stressed that it is important for business owners to find out what is expected
but also indicated that he would be comfortable with a 6 month extension.
MOTION: Grant the petitioner a 6 month license extension with the following conditions: (1)
Cease and desist on outside repair operations. (2) Apply with the Planning Board/or a Special
Permit by the end ofFebruary and (3) Return in 5 months to report on progress.
Councilor Sanders requested that the applicant should communicate with the Committee Chair if
he is unable to meet those dates and Mr. Amaro agreed.
Councilor Coute suggested that the oil/water separator and the sewer tie in could be worked on
immediately since those are not going to change.
So Voted.
2. Meet with Detective Rutherford to discuss the application for the renewal of a
marijuana retail license for LMCC, LLC at 83 County Street.
Detective Rutherford indicated this is a renewal and that the Council had previously given the
petitioner a 6 month extension. He reported that they meet all the criteria. Mr. Pirozzi reported
that the original building permit had expired due to 6 months of no work being done but they
were issued a new building permit on 7/8/22. The rough plumbing and gas inspections were
done and electrical work is ongoing with the electrical rough inspection expected soon. Attorney
Rounds stated that they are moving as quickly as possible, that significant work has been
completed, and that work continues every day. They hope to be virtually complete in 6 months.
Councilor Borges affirmed that there has been significant progress since last time. She indicated
that she had visited the site and had taken photos which she would share. She expressed her
support for a 6 month extension.

Councilor Sanders asked for the status of the state license and Ms. Hungaro indicated that they
are in good standing with the State. He also supported a 6 month extension.
Detective Rutherford indicated that it won't be 6 months exactly since the license expires on
June 30.
Councilor Coute agreed that significant progress has been made and asked when they expected to
be complete and Ms. Hungaro stated that she hopes to be done with construction in 6 months.
MOTION: Extend the license until June 30. So voted.

Redevelopment Authority, and Dennis Ackerman were also present.
The meeting was called to order at 7:05 PM.
1. Meet to discuss the proposal to turn over parcels (22-29, 22-30, 23-9, 23-10, 23-12, and
23-13) on Harvey Street to the Taunton Redevelopment Authority.
Attorney Ed Brennan gave an overview of the proposal. 6 parcels, owned by the City, for a total
of about 20 acres would be transferred from the City to the Taunton Redevelopment Authority
(TRA). They would make two parcels shovel ready and sell those two parcels. This would
provide the seed money for the TRA. The proposal is to use approximately 3 acres for 2 house
lots and approximately 17 acres would be preserved as open space in perpetuity. On the two
parcels, houses would be built on Harvey Street and returned to the tax rolls and be added to the
housing stock. Bill Roth stated that the TRA would need to contract with an engineer who
would do all the preparation such as a survey, a wetlands survey and an ANRAD. Attorney
Brennan suggested that this plan is both fiscally responsible and preserves open space.
Councilor Borges asked if members of the TRA can purchase the land and Mr. Brennan
confirmed that members of the TRA are prohibited from purchasing. Mr. Roth stressed that the
17 acres of land to be open space is approximate at this time.
MOTION: Approve of this land being transferred to the Taunton Redevelopment Authority with
the clauses that it be limited to the minimum area for 2 single family lots with the remainder to
have a deed restriction for conservation.
Councilor Dooner asked how this works and Attorney Brennan indicated that he would work
with the City Solicitor's office to draw up binding documents for the transfer.
Councilor Pottier asked how much in taxes were owed Attorney Brennan did not know. Mr.
Pottier wondered why the previous owners didn't sell and Mr. Ackerman indicated that there
several owners so they really couldn't do anything.

Councilor Sanders indicated that he originally was opposed to this proposal but recognized that
this is a good opportunity to preserve 16-17 acres of open space in perpetuity. He also expressed
his support for the TRA.
Mr. Roth suggested that the biggest issue will be perc testing and finding the areas for the septic
systems.
So voted.

1. Meet with the Police Chief to discuss proposed ordinance to exclude out of town
constables.
Chief Walsh stated that the Council had voted on 9/24/2013 to modify the ordinance by adopting
the general law where the appointment of constables was put under the Mayor. He suggested
referring this to the Law Department since this vote was never codified.
MOTION: Request the Law Department codify the vote taken on 912412013. So voted.
MOTION· Make that vote part of the record So voted.
2. Meet with the Police Chief to discuss request to remove parking meters on Grovener
Street.
Councilor Sanders stated that this is not Grovener Street but, rather, should be Governor Street.
Since this was not properly posted it will be reposted for another day.

The meeting was held at Taunton City Hall, 15 Summer Street, Taunton, MA 02780 in the
Chester R. Martin Municipal Council Chambers.
Present were Council President Kelly Dooner and Councilors Duarte, Borges, McCaul, Pottier,
Coute, Sanders, and Postell. Councilor Quintal was absent.
The meeting was called to order at 7:43 PM.
1. Meet in executive session with the City's legal representation to discuss the pending
litigation of Greater Goods, LLC vs. City of Taunton Municipal Council.
President Dooner reported that Attorney Costa was unable to attend due to an unforeseen
circumstance and, due to a Councilor's absence next week, requested this be postponed for 2
weeks.
MOTION· Postpone for 2 weeks. So voted.

At the November 15th meeting of the Municipal Council, Councilor McCaul made a
motion to have the Safety Officer look at placing more speed limit signs on Liberty Street
as there is only one speed limit sign at this time, having the radar trailer placed on Liberty
Street, and having a police cruiser on Liberty Street from 6:00 AM to 8:00 AM and 3:00
PM to 6:00 PM.
On 12/28/2022 the DPW placed three additional 3 0 MPH speed limit signs on Liberty
Street. One of the signs was placed at the beginning near Middleboro Ave, another placed
at the beginning near Caswell Street, and one placed in the middle of Liberty Street
across from the existing speed limit sign. Sargent Balmain has agreed to place a radar
speed sign on Liberty Street as soon as one becomes available. Patrol has been asked to
monitor and enforce the speed on Liberty Street in the AM and PM.

At the December 22, 2022 meeting of the Municipal Council, a motion was made to refer
to the Safety Officer and the City Engineer to review the intersection of Kingman Street
and Seekell Street for a four way stop intersection.
At this time the intersection at Kingman Street and Seekell Street there is a stop sign on
both approaches of Kingman Street with advanced warning road markings. The area is a
rural residential 30 MPH. Traffic volume on Kingman Street is higher than Seekell
Street. The intersection is off set with a slight hill on Seekell Street. The intersection has
a difficult sight line on Seekell Street near Kingman Street. There have been several
motor vehicle crashes at this intersection in the past.
I believe that a four way stop at this intersection will make this intersection safer and
reduce motor vehicle crashes. Along with the four way stop signs, advanced warning
road markings and signs should be placed on both Seekell Street and Kingman Street. I
ask that this request be approved by the Municipal Council and be forwarded to the
Ordinance Committee. Attached is a recommendation from Michael Patneaude, the City
Engineer.

Dear Members of the Municipal Council;
During the City Council meeting on November 22, 2022 under new business, Councilor Postell requested
a review of the intersection of Kingman St. and Seekell St. Safety Officer Chaves conducted an analysis
at the four approaches to the intersection from 12/14/2022 to 12/28/2022. The current traffic controls at
this intersection include stop signs for both approaches on Kingman St. The data indicates that Seekell St.
has a lower traffic volume than Kingman St., which would be the better choice for the stop controls.
Due to the existing stop control installations and the roadway horizontal and vertical geometry, it is
recommended that multi-way stop controls would improve traffic operational characteristics of the
intersection. To achieve the desired effect, stop signs should be added to the Seekell St. approaches. All
four stop signs should be supplemented with "All Way" or "4-Way" signs. Additionally, advanced
warning signs and pavement markings should be added.
Since changes to the intersection are being introduced, it is recommended that variable message boards be
implemented in advance of the proposed signage installations. The proposed stop signs on Seekell St. and
the existing stop signs on Kingman St. will require Council approval to be added to City Ordinance §405-
94: Designation of stop intersections.

Please accept this letter as notification that The Neighborhood Corporation's (formerly the WEIR
Corporation) has dissolved effective December 30th, 2022.
We would like to take this opportunity to thank the current and past Boards of Directors for their
dedication to the mission of the organization and the extraordinary work that has been completed not
only in Taunton but also in the surrounding area.
Together with the support of City of Taunton and local elected officials as well as the countless
vofunteers we have accomplish much over the past 40 years with the major focus on the revitalization
of the Weir section ofTaunton including the development of Robinson on the River apartment and
commercial building, the Big Wong Restaurant and Laundromat complex, the redevelopment of Baron's
Furniture in partnership with the BID, the development of the Riverfront Park. With our focus on
developing affordable housing, we have created housing at 9 First Street, 120 and 117 lngell Street,
Staple Avenue, as well as Shoe Shop Place in Middleboro. Additionally, we created the Taunton River
Festival and many events that promoted the values of community and revitalization.
Our final act in 2022 with the assistance of the City of Taunton, the Massachusetts DEP and the EPA
is the completion of the final clean up and reuse of the Nu Brite Brownfield site.
On a personal note, it has been a pleasure to be one of the many caretakers of this organization
which was started by a small group of dedicated individuals some 40 plus years ago to fulfill their dream
of improving their community for future generations

RE: Open Meeting Law Complaint
Dear Attorney Gay:
This office received a complaint from Barry Sanders on November 8, 2021, alleging that
the Taunton City Council (the "Council") violated the Open Meeting Law, G.L. c. 30A, §§ 18-
25. The complaint was originally filed with the Council on or about August 31, 2021, and you
responded, on behalf of the Council, by letter dated September 15, 2021. The complaint alleges
that the Council met in executive session for an improper purpose on August 10, 2021.
We appreciate the patience of the parties while we reviewed 1'.his matter. Following our
review, we find that the Council did not violate the Open Meeting Law in the way alleged. In
reaching this determination, we reviewed the original complaint, the Council's response to the
complaint, and the complaint filed with our office requesting further review. We also reviewed
the notice and open session minutes of the Council meeting held on July 20, 2021, as well as the
notice and open and executive session minutes of the Council meeting held on August 10, 2021.
FACTS
We find the facts as follows. During a meeting held on July 20, 2021, the Council
reviewed a communication from the City Solicitor informing the Council that a memorandum of
agreement had been reached between the Mayor of Taunton and the Taunton firefighters' union
for successor collective bargaining agreements. The memorandum covered a one year contract
for the period of July 1, 2020, through June 20, 2021, and then for a three year contract covering
the period of July 1, 2021, through June 20, 2023. Because the Council must approve any
financial terms reached in the preliminary memorandum, the Council voted to refer this matter to
the Committee of the Council as a Whole to discuss in executive session on August 10, 2021.
During a meeting held on August 10, 2021, the Council convened in executive session
undeI;' Purpose 3 "to discuss memorandum of agreement with Taunton Fire Fighters, Local 138,
IAFF for successor collective bargaining agreements." The terms of the proposed memorandum
of agreement were presented to the Council during the executive session, and the Council voted
unanimously to approve the contract. The collective bargaining agreement was signed by the
Mayor, City Solicitor and firefighters' union on October 26, 2021.
DISCUSSION
The Open Meeting Law was enacted "to eliminate much of the secrecy surrounding
deliberations and decisions on.which public policy is based." Ghiglione v. School Committee of
Southbridge, 3 76 Mass. 70, 72 (1978). The Open Meeting Law requires that meetings of a
public body be noticed and open to the public, unless an executive session is convened. G.L. c.
30A, §§ 20(a)-(b), 21. A public body may enter an executive, or closed, session for any of the
ten purposes enumerated in the Open Meeting Law provided that it has first convened in an open
session, that a majority of members of the body have voted to go into executive session, that the
vote of each member is recorded by roll call and entered into the minutes, and the chair has
publicly announced whether the open session will reconvene at the conclusion of the executive
session. G.L. c. 30A, §§ 21(a), (b); see also OML 2014-94. 1
One permissible reason to convene in executive session is "to discuss strategy with
respect to collective bargaining or litigation if an open meeting may have a detrimental effect on
the bargaining or litigating position of the public body and the chair so declares." G.L. c. 30A, §
21(a)(3) ("Purpose 3"). When convening in executive session pursuant to Purpose 3, a public
body must identify the collective bargaining unit with whom it will be negotiating, if doing so
will not compromise the lawful purpose for secrecy. See OML 2018-139; OML 2016-43; OML
2015-87.
The complaint alleges that the Council convened in executive session for an improper
purpose on August 10, 2021, to discuss the memorandum of agreement which had previously
been reached between the Mayor and firefighters' union. We find that it was appropriate for the
Council to meet in executive session under Purpose 3 where the Council discussed its strategy ·
with respect to the collective bargaining agreement with the firefighters' union. Although certain
terms might have been agreed to by the Mayor and union at the time of the August 10, 2021,
executive session, we find that the Council was still reasonably engaged in strategy discussions
regarding the memorandum of understanding and collective bargaining agreement. See OML
2013-84 .

CONCLUSION
For the reasons stated above, we find that the Council did not violate the Open Meeting
Law by meeting in executive session. We now consider the complaint addressed by this
determination to be resolved. This determination does not address any other complaints that may
