Communications from Citv Officers:
Com. from the City Clerk for the appointment of one (1) permanent full-time Fire
Lieutenant from Requisition #08845. On a: roll call vote, eight (8) Councilors were
present, eight (8) Councilors voted to appoint Michael A. Rodriquez. Appointment
effective August 13, 2023. Councilor Sanders was absent. So Voted.
Com. from the City Clerk for the appointment of one (1) permanent full-time Fire
Captain from Requisition #08842. On a roll call vote, eight (8) Councilors were

Com. from the City Clerk for the appointment of one (1) permanent full-time Fire Chief,
which would be effective on August 13, 2023 from Requisition #088377. On a roll call
vote, eight (8) Councilors were present, eight (8) Councilors voted to appoint Steven
Lavigne. Appointment effective August 13, 2023. Councilor Sanders was absent. So
Voted.
Councilor Pottier stated that the Committee on Fires and Wires met on Wednesday to
offer conditional offers of employment to Casey Wellman, Michael Perrotta and Thomas
Richardi. He stated that a conditional offer of employment was also made to Logan
Kenneson, however, she declined the offer. The City Clerk swore in Steven Lavigne as
Fire Chief, Gregory Karsner as Fire Captain and Michael Rodriquez as Fire Lieutenant.
The City Clerk swore in Marc B. Charbonneau, Steven Hutchins and Andrew Michael
Trainor as Full-Time Firefighters. Mayor O'Connell thanked them for their service and
stated that they are excited to have these new servicemen on board. She stated that it is a
bittersweet night as we say farewell to Chief Bradshaw, who has been Chief for thirteen
(13) years. She stated that he has made some great changes at the station and is leaving it
in a better place than when he got there. Mayor O'Connell expressed her appreciation for
Chief Bradshaw and invited him to the podium. Chief Bradshaw spoke about his time as
the Chief and his confidence in Steven Lavigne to be successful in his new role as the
Chief.
Communications from the Mavor:
Mayor O'Connell stated that this evening the Girls Softball and Boys Baseball Division I
Champions from Taunton High School are here. She stated that the Boys Baseball Team
is bringing home their third Division I Championship, this being their second in a row.
She stated that the Girls Softball Team is bringing home their eighth Division I
Championship, this being their third in a row. Mayor O'Connell stated that they have
made us the City of Champions and the community is bursting with pride over their
work. Mayor O'Connell invited the Girls Softball Coach to the podium. Michelle Raposo
expressed gratitude to the coaches, as well as the athletic trainers and directors for their
commitment to their team. She stated that it has been an honor to coach and mentor the
girls during this season. She spoke about the demands of being a part of the team, as well
as the passion of each of the players for the game. Mayor O'Connell invited State
Representative Carol Doherty and Greg DeMelo, Chairman of the School Committee to
the podium. Ms. Doherty expressed gratitude to Chief Bradshaw for his years of service.
Ms. Doherty issued a citation to the softball and baseball teams from the House of
Representatives in recognition of their victories in the 2023 Division I State
Championship. Mayor O'Connell expressed gratitude to the City Council for their
support of the high school students in the community. Mayor O'Connell invited the Boys
Baseball Coach to the podium. Coach Bourque stated that the Baseball Program is
honored to represent the City. He expressed gratitude to the athletic directors, trainers and
the staff at Taunton High School. He also expressed gratitude to his family, the players
and their families for their contribution to the success of the program. Mayor 0' Connell
issued citations to the members of the Softball and Baseball Teams.
Motion was made to recess at 7:41 p.m. So Voted.

Motion was made to revert to the regular order of business at 7:48 p.m. So Voted.
Opportunity for input by the general public.
Lisa Potter, 38 Lakeview Place, Taunton, stated that as a member of the committee that
helped to clean up the weeds at the lake, she was a part of the discussion with the Police
to ensure safety on the lake and on the boat ramp. She stated that as a part of this work it
was agreed that the Police would patrol both the boat ramp and on the water from the end
of June through the end of August. She stated that it was specified that this would be on
the weekends, Saturday and Sunday, after 2:00pm. She stated that over the last month, a
group of irresponsible boaters have wreaked havoc on the lake on at least two (2)
Sundays. She stated that these individuals were parking at both Sabbatia Condominiums
and B.J.'s. She stated that they have transported more than thirty (30) individuals to the
island on a very large boat, brought in four (4) high-powered jet skis, and brought two (2)
twenty-gallon gas tanks filling their water crafts on the water. She stated that they have
been harassing and intimidating fisherman and many other boaters with families. She
stated they are not following the rules of the lake. She stated that they have been partying
so loud that she can hear it from her house by Home Plate. She stated that during the first
incident, the Police and the Mayor's Chief of Staff were notified, however, they stated
that there was not enough staff and the matter would be investigated on Monday. She
stated that the administration needs to recommit to having the Police out on the water
after 2:00pm, tow cars that don't belong and enforce the boating laws. She stated that the
Environmental Police were also brought in to understand their role, to train the Police to
write the tickets and to enforce the boating rules when they could not be present. She
stated that this may be a good time to get a Harbormaster.
William R. Humphrey, Jr., 45 Jenna Circle, Taunton, expressed gratitude to everyone who
has worked so hard to improve Lake Sabbatia. He stated that he recently bought a boat,
but is unable to enjoy the lake because no one is following the rules. He stated that there
has been excessive drinking, no life jackets and overloading of boats. He stated that a
Police presence is needed in order to enforce the rules.
Peg Conte, 57 Lakeview Place, Taunton, stated that they are not expecting any excessive
laws as far as the lake is concerned. She stated that the issue at Lake Sabbatia is that
people are coming from out-of-town and not following the lake rules. She stated that they
are not paying for parking. She stated that last Sunday she witnessed jet skis coming out
of nowhere. She stated that she saw a pontoon boat with a family on it and they were
upset as they were being circled around and tormented. She stated that there are two (2)
specific boats coming in, which are a black boat and a black and red boat. She stated that
they are filling their tanks with gas on the lake.
Judy Wren, 1601 Bay Street, Taunton, stated that on the weekends there has been parking
on both sides of Bay Street. She stated that on Saturday there was a Police presence and
they were not parking there. She stated that on Sunday there was no Police presence and
they proceeded to park on both sides of Bay Street, which does not allow for two-way
traffic. She stated that those who like to use a canoe or kayak are not able to enjoy it
safely with all of the jet-skiing. She stated that she went over to the dock and noted that
many of the vehicles had Rhode Island license plates.

Donna Cady, 120 Scadding Street, Taunton, stated that she and her fiance have witnessed
the same issues that the other members of the community have brought forth. She stated
that if there was more support from Police and towing occurring it would make more a
statement. She stated that the community would like support to improve the issues at the
lake.
Jen Hoye, 16 Eldridge Street, Taunton, stated that as they vote to make parcel 46-212
open space, she would like to express gratitude for working with the residents and
hearing what they had to say about the importance of that parcel to their neighborhood
and what it brings to the City.
Shelley Smith, 8 Shore Drive, Taunton, stated that she has lived on Lake Sabbatia for
most of her life. She stated that it is impossible to use the lake on the weekends and has
become too dangerous. She stated that the noise level of the boaters is obnoxious and
there is trash being left on the island.
Tammi Swensen, 29 Edgewater Lane, Taunton, stated that she is appreciative of Mayor
O'Connell, her administration and the group who has worked to improve Lake Sabbatia.
She stated that she has seen continuous improvement and would like all the residents of
Taunton to be able to enjoy it. She stated that the boaters that have been there for the past
month have been frightening. She stated that it makes her verj nervous for the safety of
children on the lake.
Mayor O'Connell expressed gratitude to everyone for being here this evening for public
input. She stated that the Police have been patrolling, though they cannot be there 24/7.
She stated that the Police have been in the parking lot issuing tickets and on the lake in a
boat. She stated that they are going to look to step up enforcement. She stated that they
are always open to suggestions from residents so they can improve their boating
experience, as well as their serenity in their homes. She stated that they will provide more
information next week.

Communications from the Mavor:
Mayor O'Connell stated that this week the new splash pad was opened at the Weir
Riverfront and it was a very fun and exciting afternoon. It is one of the largest splash
pads in Massachusetts. The hours are 9:00am to 8:00pm daily. She expressed gratitude to
the Parks, Cemeteries and Public Grounds Commissioner, A.J. Marshall, and his entire
team for making that such a successful project.
Mayor 0' Connell stated that there are new crosswalks downtown on Main Street. She
expressed gratitude to Councilor Duarte who advocated for that, as well as the Office of
Economic and Community Development and 'the Department of Public Works for their
efforts.
Mayor O'Connell stated that this Thursday there will be a Whittenton Block Party located
at 370 Bay Street, which will include refreshments and many fun activities for families
and children. She encourages everyone from the community to join them as they continue

to celebrate revitalizing the Whittenton neighborhood. She expressed gratitude to the
Whittenton Community Partners and the Mayor's Office of Economic Development for
hosting this event and for all the Whittenton Community Partners are doing to support the
Whittenton Revitalization Efforts.
Mayor O'Connell stated that there will be a Hopewell Movie Night this Friday, August
11, 2023 at 6:30pm. She stated that this is a free event featuring "The Little Mermaid".
Appointments:
Golf Course Commission Appointments:
Appointment of Seth Turner, 25 Logan Drive, East Taunton to Serve on the Golf Course
Commission for a Term of Three (3) Years Expiring July 2026. Mayor O'Connell stated
that they are asking that no action be taken at this time on this appointment.
Appointment of Nick Tabak, 151 Fremont Street, Taunton to Serve on the Golf Course
Commission for an Unfulfilled Term Expiring July 2024 Due to the Resignation of
Rolland Robillard. Mayor O'Connell stated that they are asking that no action be taken
at this time on this appointment.
Communications from City Officers:
Com. from the Superintendent of Buildings stating that they are requesting to pay prior
year bills, which are for phone services with Verizon, electricity bills with TMLP, and
water service with Ready Refresh. They have received the invoices after the close of the
Fiscal Year. Motion was made to approve. So Voted.
Com. from the Chair, Board of Assessors requesting that the vote taken on August 1,
2023 to surplus Map 92, Lot 279 near 103 East Water Street be amended. The Abutter
Program in the Taunton Ordinance is for the Tax Title Foreclosure properties only. The
parcel will be sold at sealed bid along with the other properties voted surplus that
evening. Motion was made to refer to the Committee on Public Property. So Voted~
Com. from the Chief Financial Officer stating that the Finance Department would like the
opportunity to provide a report on tax title and land court parcels as part of their asset
management program. The team would ask to go before the Committee of the Council as
a Whole to discuss this matter further on August 22, 2023. On discussion, Councilor
Coute stated that he and Councilor Pottier will not be present on August 22, 2023.
Motion was made to refer to Council President Dooner to schedule with the
Committee of the Council as a Whole. So Voted.
Com. from the Chief Financial Officer stating the Finance Department has obtained a
prior year bill from the Police Department. The Police Department is requesting that it be
allowed to expend $799.99 for an FY23 expense, and have it be paid out of account
number 01-210-5200-5386 in the current FY 2024 budget. Motion was made to
approve. So Voted.
Com. from the City Solicitor regarding a memorandum from the Cannabis Control
Commission explaining that under Chapter 180 of the Acts of 2022, which amended
M.G.L. c. 94G, host communities are required to adopt policies and procedures relative to

social equity. The Cannabis Control Commission is required under the law to adopt
regulation in accordance with the new requirements no later than November 9, 2023, at
which time a full regulatory framework will be issued on this subject. However, the
Cannabis Control Commission is recommending initial policies and procedures for
municipalities to consider in order to comply with the new social equity requirements.
Motion was made to refer to the Committee of the Council as a Whole. So Voted.
Communications from Citizens:
Com. from Evan K. Watson, P .E., .W. Engineering, LLC on Behalf of the Owners of 112
Shores Street, Taunton, requesting the commission approve a sewer extension to service a
proposed two family dwelling. He stated that a sewer manhole is in front of the property,
however, extending the sewer by approximately 65' will allow for two separate
connections for the duplex. Motion was made to refer to the Committee on the
Department of Public Works and the Clerk of Committees for a public hearing. So
Voted.
Com. from Zachary & Lindsey Larrimore, 6 Wilson Avenue, Taunton, requesting a
special permit to open the road in front of her house to connect natural gas. She stated
that Eversource's road permit was denied due to the road moratorium. Motion was made
to refer to the Committee on the Department of Public Works. So Voted.
Com. from Jim Erenzo, CFO, Mashpee Tribal Wampanoag Gaming Authority, requesting
the opportunity to discuss a new development project that will impact the timing and
scope of the previously · contemplated gaming complex under the Intergovernmental
Agreement dated May 17, 2012 ("IGA") between the City of Taunton and the Mashpee
Wampanoag Tribe (the "IGA Project"). Motion was made to refer to the Committee of
the Council as a Whole. So Voted.
Petitions:
Personal Kennel License - NEW
Petition submitted by Mary Barchard, 120 Christine Lane, Taunton for a NEW Grade 1
(4-6 Dogs) Personal Kennel License/NOT Business Use to be located at 120 Christine
Lane, Taunton. Motion was made to refer to the City Clerk to schedule a public
hearing. So Voted.
Committee Reports:
Motion was made for Committee Reports to be read by title and approved. So
Voted. Recommendations adopted to reflect the votes as recorded in Committee
Reports by the Committee on Fires and Wires that met on Wednesday, the
Committee on Finance and Salaries and the Committee on Police and License. So
Voted. Councilor Coute motioned to approve item #1 on the Committee on Public
Property, which was to pass the Marketing Property Program properties under
consideration. So Voted. Councilor Coute motioned to approve item #2 on the
Committee on Public Property, which was to declare the land behind Leonard
School, parcel 46-212-0, as open space. So Voted. Councilor Coute stated that there was
a motion during the Committee on Public Property to authorize a right of way to connect
the Leonard School property with the parking lot. On a roll call vote, eight (8)

Councilors were present, six (6) Councilors voted in favor, Councilors Borges and
Mccaul voted in opposition. Councilor Sanders was absent. So Voted.

1. Meet to interview firefighter candidates.
Councilor Pottier explained that the intent was to interview the five candidates in order to make
conditional offers of employment to up to three.
Candidates Casey Wellman, Logan Kenneson, Michael Perotta, Thomas Richardi, and Owen
Brady were interviewed by the members of the Committee. Councilors Pottier, Postell, and
Coute asked questions of each about their experience and their background.
Casey Wellman is an EMT for Brewster in Wareham. He served in the Marine Corps and is
currently in the Anny National Guard.
Logan Kenneson works for Brewster on 911 response. She served in the Army for 3 Yz years.
Michael Perotta was born and raised in Taunton. He currently works for Power Home
Remodeling and served in the Navy.
Thomas Richardi served in the Marines after high school. He has experience as a Wildland
Firefighter.

Owen Brady has served in the Marine Corps and is currently working as a plumber at Emond
Plumbing.

The meeting was called to order at 5:39 PM.
1. Meet to discuss the request for approval from the Downtown Taunton Foundation for
attendees of the 11th Annual Block Party on 9/16/23 to be able to consume alcohol on
Trescott Street.
Motion by Ms. Borges and seconded by Mr. Postell to invite the interested parties in. So voted.
Councilor Postell explained that this had gone to the License Board for the alcohol permit and
had subsequently been referred to this committee as the approving authority.
Colleen Simmons indicated that this is their one major fundraiser and helps to fund other free
activities. She relayed that the License Commission had no issues but that the street is owned by
the City. The Council was deemed the granting authority.
Councilor Borges asked for the time of the event and Ms. Simmons stated that it will be 6pm-
10pm.
Motion by Ms. Borges and seconded by Mr. Postell to grant the approval to the Downtown
Taunton Foundation for this event.

Councilor Pottier asked about former functions that had been held on the Green and Ms.
Simmons indicated that most concerts have been shifted to the Liberty and Union Park which has
a stage and is lit.
So voted.

The meeting was called to order at 5 :49 PM.
Motion by Mr. McCaul and seconded by Ms. Borges to go out of order and discuss the Leonard
School property first. So voted.
2. Meet to discuss declaring the land behind the Leonard School, parcel 46-212-0, as open
space.
Mr. Howland explained that this is the large parcel behind the Leonard School that was
specifically left out of the previous discussion when parcels 46-229 and 46-235 were
declared surplus. He stated that OECD has no issue bringing this to zoning to have it
declared open space. However, an easement would be needed to connect parcels 46-229 and
46-235 in order to allow usage of the parking lot.
Mr. Coute indicated that this could be accomplished by either an easement or by subdividing
the parcel.
Ms. Borges asked for clarification on the easement being suggested. Mr. Howland explained
that it's the piece between parcels 46-229 and 46-235. Otherwise, the access strip could be
subdivided. Lots 46-229 and 46-235 will go out to RFP together.

Mr. Quintal asked for some clarification on the easement that is being proposed and it was
confirmed to be the strip between parcels 46-229 and 46-235.
Motion by Ms. Borges and seconded by Mr. Quintal to open public input. So voted.
Jen Hoye, 169 Eldridge Street indicated she thought the easement makes sense as long as the
rest of the property remains intact.
Mark Knowlton, 17 Long A venue asked for the proposed usage for the piece of property
being connected and Mr. Howland indicated that is not yet known. Developers will respond
to the RFP.
Motion by Ms. Borges and seconded by Mr. Quintal to close public input. So voted.
Mr. Quintal confirmed that ifthe easement is granted, the sliver ofland to Eldridge Street
would be open space as well.
Mr. McCaul asked about the strip ofland leading to 46-212 and Mr. Howland stated that it
will remain as part of 46-212 and be open space ifthat is the decision.
Ms. Borges asked what type of development might go into lots 46-235 and 46-229. Mr.
Howland indicated that the RFP is looking for options. Mr. Coute noted that the parcels are
zoned urban residential so would allow for a 1, 2, or 3 family and anything else would rquire
a special penllit.
Mr. Quintal stated that he believes the residents will be happy with 46-212 being declared as
open space. He doesn't see any issue with granting that easement.
Motion by Ms. Dooner and seconded by Mr. Quintal to task the OECD with moving forward
with declaring the parcel 46-212 as open space subject to a right ofway between 46-229 and
46-235.
Mr. Duarte clarified that at the last meeting, it was voted to approve the concept of 46-235
and 46-229 being developed. They are asking for the easement in order to realize the intent
of that vote.
Ms. Borges noted that she is looking to protect the neighborhood and believes this has been a
healthy discussion.
Mr. Coute emphasized that the school needs to be dealt with and that the only thing that can
go there without a special permit is a 1, 2, or 3 family.
Ms. Borges requested that the motion be divided into two.
Ms. Dooner withdrew her motion and Mr. Quintal withdrew his second.

Mr. Della Russo stated that the Mayor is going to be recommending funding to take
down the water tower that is on this property and they would like this to go for an RFP.
Ms. Borges asked if there is a cost estimate to remove the water tower and Mr. Coute
stated that he had spoken with the DPW and they believe it to be in the $100,000 range.
Ms. Borges asked what the property is worth. Mr. Howland indicated that, combined
with the Range Ave. property it is $1.2 Million.
Motion by Ms. Borges and seconded by Ms. Dooner to invite in the Assessor. So voted.
Ms. LaBelle stated that for the small piece with the water tower the land is valued at
$126,000.
Ms. Borges stated that this parcel had been discussed as potentially part of the abutters
program and Mr. Howland indicated that it doesn't qualify since it was not taken through
tax title.

Mr. Pateakos explained that this is 36 acres that is zoned industrial.
Mr. Dello Russo indicated that the original intent was for a solid waste station to go here.
The City will need to pay back the note that remains on this should it sell. There is
approximately $1.1 Million remaining.
Mr. Coute confirmed that a variance will be required. Mr. Dello Russo stated that a
footage easement from TMLP will also be required.
Motion by Mr. McCaul and seconded by Ms. Borges to authorize the OECD office to
move forward on an RFP and complete any necessary steps related to the sale o/745

Enclosed is a memorandum from the Cannabis Control Commission explaining
that under Chapter 180 of the Acts of 2022, which amended M.G.L. c. 94G, host
communities are required to adopt policies and procedures relative to social equity. The
Cannabis Control Commission is required under the law to adopt regulations in
accordance with the new requirements no later than November 9, 2023, at which time a
full regulatory framework will be issued on this subject. However, the Cannabis Control
Commission is recommending initial policies and procedures for municipalities to
consider in order to comply with the new social equity requirements, which are
referenced in the enclosed memorandum .

Subject: Initial Policies and Procedures for Host Communities to Promote and Encourage
the Full Participation in the Regulated Marijuana Industry by People from
Disproportionately Harmed Communities as Required by Chapter 180 of the Acts
of 2022
Chapter 180 of the Acts of 2022: An Act Relative to Equity in the Cannabis Industry ("Chapter
180") was enacted by the Massachusetts Legislature on August 1, 2022, and signed by Governor
Baker on August 11, 2022. Under Chapter 180, the Cannabis Control Commission
("Commission") has been tasked with ensuring that people from communities disproportionately
harmed by the prohibition and enforcement of marijuana are guaranteed fair, transparent, and
equitable access to the regulated cannabis industry, with the hope of promoting their full and
meaningful participation. Chapter 180 also mandates that the Commission guide Host
Communities to encourage full participation in the cannabis industry by establishing their own
transparent and objective selection processes when negotiating Host Community Agreements
("HCAs'Jwith Social Equity Businesses.
Host Communities are required to adopt initial policies and procedures related to municipal
equity by July 1, 2023. The Commission provides this memorandum to suggest strategies and
resources for Host Communities to consider in order to meet this requirement. Chapter 180
requires the Commission to promulgate regulations in accordance with these requirements no
later than November 9, 2023, at which time, a full regulatory framework will be issued and
enforced in collaboration with the Department of Revenue.
To meet this new mandate, Host Communities should consider focusing on ways to support
people from communities disproportionately harmed by marijuana prohibition and enforcement,
which may include Social Equity Businesses, as defined by Chapter 180, as well as Social Equity
Program ("SEP") Participants or Certified Economic Empowerment Priority Applicants ("EEA")
as defined under Commission regulations. To date, 872 people have participated in the
Commission's SEP. Further, 122 individuals have qualified as EEAs. Past participants or
qualifying applicants would be eligible to fulfill the Host Community's equity mandate.

Host Communities should also be aware that, under M.G.L. c. 64N, §5, they may be eligible to
receive an additional I% of the total sales price of the sale of marijuana or marijuana products
from that portion of the excise imposed on marijuana and marijuana products, distributed
quarterly, if they host a marijuana retailer that is a Social Equity Business.
Below, Host Communities will find a brief description of the criteria that applicants must possess
to qualify for the SEP or as an EEA. Host Communities may adopt initial policies and
procedures to promote and encourage the full participation of applicants that qualify for these
programs in order to meet their obligation under Chapter 180.
Applicants are eligible for the Commission's SEP if they demonstrate they meet at least one
of the criteria below:
• Income that does not exceed 400% of Area Median Income and residency in a
Disproportionately Impacted Area, as defined by the Commission, for at least five of the
past 10 years;
• Residency in Massachusetts for at least the past 12 months and a conviction or
continuance without a finding for an offense under M.G.L. c. 94C or an equivalent
conviction in Other Jurisdictions;
• Residency in Massachusetts for at least the past 12 months and proof that the SEP
a
applicant was either married to or the child of an individual with conviction or
continuance without a finding for a M.G.L. c. 94C offense or an equivalent conviction in
Other Jurisdictions;
• Any individual listed as an owner on the original certification of a Certified Economic
Empowerment Priority Applicant who satisfies one or more the following criteria:
o Lived for five of the preceding 10 years in a Disproportionately Impacted Area, as
determined by the Commission;
o Experience in one or more previous positions where the primary population
served were disproportionately impacted, or where primary responsibilities
included economic education, resource provision or empowerment to
disproportionately impacted individuals or communities;
o Black, African American, Hispanic or Latino descent; or
o Other significant articulable demonstration of past experience in or business
practices that promote economic empowerment in a Disproportionately Impacted
Area.

In accordance with state law, the Commission provided priority licensing review to EEAs
between April 1, 2018, and April 15, 2018. EEA status was granted to applicants who
demonstrated at least three of the following six criteria:
• Majority of ownership belongs to people who have lived in Disproportionately Impacted
Areas for five of the last 10 years.
• Majority of ownership has held one or more previous positions where the primary
population served were disproportionately impacted, or where primary responsibilities
included economic education, resource provision or empowerment to disproportionately
impacted individuals or communities.
• At least 51 % of current employees/subcontractors reside in Disproportionately Impacted
Areas and will increase to 75% by first day of business.
• At least 51 % of employees or subcontractors have drug-related CORI but are otherwise
legally employable in a cannabis-related enterprise.
• Majority of ownership is made up of individuals from Black, African American,
Hispanic, or Latino descent.
• Owners can demonstrate significant past experience in or business practices that promote
economic empowerment in Disproportionately Impacted Areas.

These definitions, the Commission's existing guidance documents, and the suggestions listed
below, are intended to give Host Communities the tools they need to establish initial policies and
procedures to promote and encourage the full participation by people from communities
disproportionately harmed by the prohibition and enforcement of marijuana. This information is
not intended to serve as legal advice. These initial policies and procedures may serve as a base
program for equity in the Host Community' s respective cannabis policies and lay the
groundwork for the upcoming regulations promulgated by the Commission.
If Host Communities have legal questions regarding their rights or obligations under the
Commonwealth's cannabis laws or any other laws, they are encouraged to consult with town or
corporate counsel.
Below are some policies a municipality may consider utilizing to satisfy the requirement to adopt
initial policies and procedures under Chapter 180:
Lower or eliminate fees for equity applications to reduce barriers to entry:
• Consider a waiver or reduction of fees associated with the municipal HCA approval
process and/or zoning review process.
• Reduction or elimination of the Community Impact Fee.

Improve transparency and efficiency in the approval process to reduce barriers to entry
and lower costs:
• Host Communities should adopt options to support equity applicants within their HCA
selection scoring assessment.
• Make improvements to municipal websites to clearly outline the steps needed to gain
approval for an HCA (including zoning and other approvals, not limited to the fire chief,
health department, and police chief).
• Create a written roadmap that can be accessed on a public bulletin board or in a packet
handed out to applicants. This document should provide a clear picture of the steps
needed for approval, including the relevant contacts within municipal government
responsible for approval.
• Create links to all needed application documents or create a package of documents
needed for HCA/Zoning approval, meeting dates, submission deadlines, associated fees,
information and contacts for all parties involved in the cannabis business application
process.
• Communities should expedite their response to the Commission's request for
confirmation that an applicant is compliant with local zoning, ordinances, and bylaws.
Other items to consider either on a website or in a roadmap document:
• Include the most up to date local cannabis ordinances.
• Include a map that clearly designates areas for zoning of Marijuana Establishments and
Medical Marijuana Treatment Centers.
• Publicize all HCA applications as well as any written scoring or evaluation made by the
Host Community when reviewing applicants for approval.
• Create a clearly defined HCA approval process that includes the criteria decision makers
will consider when choosing successful applications.
• Determine how equity will be included in this evaluation process.
• Consider eliminating or reducing the weight of prior participation in the regulated
cannabis market when scoring applications, which can discourage equity applicants or
smaller entrepreneurs.
Two Host Communities that currently provide positive examples are Newton and
Somerville. While all Host Communities may not have the same resources as these larger
communities, their websites provide many examples of policies and procedures that
promote transparency, objectivity, and inclusion of equity that communities might consider
adopting.

Newton includes equity as one criterion when considering HCA applications. They provide
clear details into the special permit process. The zoning map includes an overlay of allowed
areas for applicants to assess; and incorporates special limitations the community has adopted
(e.g., requiring half mile separation between siting of individual licensees). It includes
relevant contact information, and the HCA application is accessible online. Newton
publicizes HCA decisions including how reviewers weighed the applicant against the stated
criteria.

Somerville not only includes equity in its scoring process, but has created a numerical grade
for each criterion, and lists all relevant application fees. These scores and a written
description offer even greater transparency, making it easier for all applicants and the
community to see how decisions are made and further promote confidence that equity
applicants enjoy a fair opportunity to compete.

Mayor O'Connell,
The owners of 112 Shores Street (Map 64, Lot 335) have asked me to request the commission
approve a sewer extension to service a proposed two family dwelling. A sewer manhole is in
front of the property, however, extending the sewer by approximately 65' wi II allow for two
separate connections for the duplex.
Accompanying this letter is a plan by Lighthouse Land Surveying which details the sewer
extension along with the proposed improvements to the site. The proposed 8" sewer line
would start at the existing manhole at the intersection of Anawan and Shores Streets. The
new sewer line would be installed westerly within Shores Street about 65' to a new manhole.
The work will meet all the standards of the City DPW and the Sewer Department.

To Whom It May Concern:
We are writing today to request special permit to open the road in front of my house to connect
to natural gas. Eversource's road permit was denied due to road moratorium.
We were having trouble with our boiler and was unfortunately given terrible news that it would
need to be replaced. We currently have oil as the fuel source. Connecting to clean burning
natural gas will not only allow us to take advantage of the generous rebates through mass save
but, will allow us to have a more efficient heating system that can't be achieved with oil. Saving
a few thousand dollars will greatly help our family.
With fall fast approaching we will need to reconcile this situation. If you are able to expedite this
decision in anyway, we would greatly appreciate it.

Dear Council President Dooner and Members of the Municipal Council,
The Mashpee Wampanoag Tribal Gaming Authority ("Gaming Authority") would like the
opportunity to discuss a new development project that will impact the timing and scope of
the previously contemplated gaming complex under the Intergovernmental Agreement
dated May 17, 2012 ("IGA") between the City of Taunton and the Mashpee Wampanoag
Tribe (the "IGA Project").
Despite a host of delays outside the control of the Gaming Authority, we are ready to
proceed with developing new economic opportunities in the City that we believe will
provide a financially solid pathway to the IGA project. The opportunities prepared by the
Tribe are centered around a new interim project that we believe will create hundreds of
jobs. In addition, it will create hundreds of construction jobs, which will only grow during
the future transition from an initial temporary project to the previously planned IGA
Project. It is our desire for these initial opportunities to serve as a catalyst for economic
growth and development for the Tribe, the City and the greater region.
We respectfully request to attend the committee as a whole on August 29th, 2023 to discuss
the proposal and its impact on the IGA. More specifically, we would like to describe our
need to jointly develop an agreement that satisfies the funding requirements for the new
interim project, and to discuss how these efforts will allow us to progress towards the IGA
Project.
