Due to a snow emergency, Taunton City Hall were closed on Tuesday, February 13,
2024. The City Council meeting as well as all Committee meetings, were held
remotely at the same times.
Interested parties were able to watch the broadcast online

made to approve. On a roll call vote, seven (7) Councilors were present, seven (7)

Hearing:
On the joint petition of Verizon New England, Inc. and Taunton Municipal Lighting Plant
proposing to place one (1) new joint pole location, 103-1 at 294 Tremont Street in the
City of Taunton. Motion was made to open the hearing. On a roll call vote, seven (7)
Councilors were present, seven (7) Councilors voted in favor. So Voted. Councilors
Quintal and Postell were absent. Motion was made to reschedule this hearing until
February 20, 2024. On a roll call vote, seven (7) Councilors were present, seven (7)
Councilors voted in favor. So Voted. Councilors Postell and Quintal were absent.
Communications {rom the Mavor:
Mayor O'Connell expressed gratitude to the DPW, the Clerks who answered the phones,
the Department of Parks and Recreation, the Building Department, as well as the Police
Department and Fire Department who helped with today's storm.

Mayor O'Connell stated that there are additional announcements listed in the agenda.
Appointments:
Appointment of Ally Rodriguez (City of Taunton VSO), Maaike De Jong (Owner, Raw
Fitness), William Hall (USMC Veteran, Ret. State Trooper) and Denzel Santos (USMC
Veteran, Taunton Police Department) to serve on the Veterans Fund Advisory
Committee. Motion was made to approve. On a roll call vote, seven (7) Councilors
were present, seven (7) Councilors voted in favor. So Voted. Councilors Quintal and
Postell were absent.
Communications from City Officers:
Com. from the Chief Financial Officer stating that the Finance Department would like the
opportunity to review the recent and past success of outcomes related to the City of
Taunton and the Appellate Tax board (ATB). Their Assessing Division has demonstrated
a remarkable ability to optimize fairness to tax payers while successfully retaining
equitable real property values city-wide. Motion was made to refer to the Committee
on Finance and Salaries. On a roll call vote, seven (7) Councilors were present,
seven (7) Councilors voted in favor. So Voted. Councilors Postell and Quintal were
absent.
Com. from the Chief Financial Officer stating that the Finance Department is pleased to
announce their much anticipated internal audit program update to the Council and
residents. He would like to offer a sincere thank you to the City Auditor, Ian Fortes who
has gone above and beyond his required job duties to take the time to conduct internal
audits. Motion was made to refer to the Committee on Finance and Salaries. On a
roll call vote, seven (7) Councilors were present, seven (7) Councilors voted in favor.
So Voted. Councilors Postell and Quintal were absent.
Com. from the Elections Director stating that Chapter 92 of the Acts of 22 requires the
Council to act as the appointing authority for police detail coverage on Election Day. In
advance of the March 5, 2024 Presidential Primary Election, he is formally requesting the
City Council to make a motion to approve police detail coverage for Election Day. Please
be advised additional police details will be necessary this election at our Taunton Public
Schools as school is in session on Election Day. Upon approval, the Police Department
will coordinate coverage with individual officers. He has attached the warrant for the
Presidential Primary. He requests the warrant be approved for signature. Once approved,
his office will coordinate with a constable for posting. Motion was made to approve the
Police detail coverage. On a roll call vote, seven (7) Councilors were present, seven
(7) Councilors voted in favor. So Voted. Councilors Quintal and Postell were absent.
Motion was made to approve the warrant as presented for the Presidential Primary.

Com. from the Chairman, Taunton Planning Board stating that the Taunton Planning
Board is in receipt of a Repetitive Petition for property at 24 Greylock Avenue (parcel
I.D. 64-196, 64-7, 64-198, 64-199). The new proposal is for 2 equal sized lots for a
variance for lot area only and for a singly family only on each lot. Original proposal
needed variances for lot area, dry area and setbacks. The Planning Board will hold a

public hearing on this proposal on Thursday, March 7, 2024 at 5:30PM at 15 Summer St.,
which this petition will be reviewed by the Planning Board. Mayor 0' Connell stated that
no vote is required for this matter.
Com. from the Chief Financial Officer stating that the Finance Department would like the
opportunity to establish the spending parameters of the previously-approved City of
Taunton Mayor's Worthy Cause gift account. Motion was made to refer to the
Committee on Finance and Salaries. On a roll call vote, seven (7) Councilors were
present, seven (7) Councilors voted in favor. So Voted. Councilors Quintal and
Postell were absent.
Com. from the Safety Officer requesting an ordinance for the yield sign on West
Britannia Street near Danforth Street. Motion was made to refer to the Committee on
Ordinances and Enrolled Bills. On discussion, Councilor Pottier also requested that they
refer back to the Safety Officer for the best course of action as they change the yield from
one street to another and suggested possibly having a police presence in that area for a
few days. Motion was made to refer to the Committee on Ordinances and Enrolled

Communications from Citizens:
Com. from Pastor, Fr. Freddie Babiczuk, St. Anthony's Church, 126 School Street,
Taunton, MA 02780 requesting permission to hold their 22nd annual prayer pilgrimage on
March 16, 2024. Motion was made to approve and refer to the Police Chief. On a roll
call vote, seven (7) Councilors were present, seven (7) Councilors voted in favor. So
Voted. Councilors Quintal and Postell were absent.

Petition submitted by Taunton Municipal Lighting Plant proposing to place three new
sole manholes and associated conduits on Myles Standish Boulevard, Taunton. Motion
was made to refer to the City Clerk to schedule the appropriate hearing. On a roll
call vote, seven (7) Councilors were present, seven (7) Councilors voted in favor. So
Voted. Councilors Postell and Quintal were absent.

Petition submitted by Hercilio Costa, 44 Waterford Circle, Dighton, MA 02715 for
Autowise Car Sales, LLC -dba- Auto Wise Car Sales for a NEW Class II License to be
located at 397 Winthrop Street, Taunton. Motion was made to refer to the City Clerk
to schedule the appropriate hearing. On a roll call vote, seven (7) Councilors were
present, seven (7) Councilors voted in favor. So Voted. Councilors Quintal and
Postell were absent.

Councilor Pottier moved to refer a review of the Rules of the Council to the Committee

Councilor Sanders motioned to refer to the Committee on Finance and Salaries
regarding the issue of future collections of community impact fees and the
possibility of rebating already collected community impact fees from cannabis
businesses based on the clarification they have received around the intention of the
law regarding those community impact fees. On a roll call vote, seven (7) Councilors
were present, six (6) Councilors voted in favor, Councilor Dooner was opposed. So
Voted. Councilors Quintal and Postell were absent.

2. Meet to discuss the acceptance of a proposed easement at 10 Henrietta Way.
Attorney Gay explained that this is a small portion ofland where the City's sidewalk
encroaches on the land of the property owner. They are looking for the Committee to accept
an easement for this area.
Motion by Mr. Duarte and second by Ms. Dooner to accept the easement. So voted on a roll
call

The meeting was called to order at 5:38 PM.
1. Approve minutes from January 23, 2024.
Motion by Ms. Dooner and seconded by Mr. Duarte to approve. So voted on a roll call.
2. Meet with Safety Officer to discuss no-parking on the east side of Bradley Avenue.
Officer Chaves explained the need for this request as the parking there makes it difficult for
emergency vehicles to pass.
Motion by Mr. Duarte and seconded by Ms. Dooner to approve the request and refer to the
Law Department to draft the ordinance for a first reading.
Ms. Borges asked if this is still an issue and Officer Chaves stated that in his opinion it is a
safety issue.
So voted on a roll call.
3. Meet with Safety Officer to discuss the request for no parking on both sides of James Street
from Broadway.
Office Chaves explained that they had put temporary signs and he believes this would be a
permanent solution and would keep the area safer.

Motion by Mr. Duarte and seconded by Ms. Dooner to approve the request for no parking
for 125 feet on both sides of James Street from Broadway and refer to the Law Department to
draft the ordinance for a first reading. So voted on a roll call.
4. Meet to discuss eliminating seasonal restrictions on the issuance of permits under City
Ordinance Section 383-20, I.
Mr. Sanders referred to the City Ordinance identified that restricts road openings and
construction from November 1 through April 1.
Mr. Martin, who had referred this matter to the Ordinance Committee, stated that he had
spoken to Attorney Gay who suggested it be sent to the Law Department.
Attorney Gay suggested that perhaps the Ordinance could add discretionary authority with
the DPW so there is some discretion but would no longer require a vote of the Council.
Motion by Mr. Duarte and seconded by Ms. Dooner to approve of the concept and refer to
the Law Department to draft the language in consultation with the DPW Commissioner's
Office and bring it back to the Ordinance Committee for review. So voted on a roll call.
Motion by Ms. Dooner and seconded Mr. Sanders to adjourn the meeting at 5:53 PM So voted
on a roll call.

The meeting was called to order at 5:53 PM.
1. Remarks from the Chair
President Pottier stated that the meeting with the MB TA regarding the South Coast Rail
project has tentatively been scheduled for March 12, 2024.
2. Approve minutes from February 6, 2024.
Motion by Mr. Duarte and seconded by Mr. McCaul to approve. So voted on a roll call.
3. Meet with the Law Department to discuss recommendations related to regulation changes for
cannabis compliance.
Attorney Bond stated that in order for the Law Department to proceed, she needs to know the
Council's position on Host Community Agreements. It was the recommendation of the Law
Department that HCAs be dispensed with.
Motion by Mr. Duarte and seconded by Ms. Borges to eliminate the requirement for Host
Community Agreements going forward

Mr. Sanders questioned how items in the HCAs can then be included in the packets of the
applicants.
Ms. Bond stated that the primary purpose of the Host Community Agreements was the
collection of the community impact fees. However, with the new CCC regulations, charging
the 3% off the top does not work anymore. The City would need to spend money directly
related to the marijuana establishment and then look for reimbursement. Most other items in
the HCAs are unenforceable such as a requirement for local employees or vendors. The
licensing procedure can cover other items. Mr. Sanders asked what will happen with current
HCAs that have been executed and Attorney Bond suggested that current HCAs could serve
as placeholders.
Mr. Duarte recommended that, if HCAs are eliminated, the Law Department reach out to
HCA holders and issue waivers. He suggested that the City might issue provisional licenses
before a Special Permit.
Mr. Sanders suggested that the City should be looking to refund or rebate those 3% fees that
were collected or, at minimum, no further fees should be collected from those on a payment
plan.

4. Meet to review matters in file:
Motion by Mr. Martin and seconded by Mr. McCaul to refer the following marijuana matters
to the Committee on Ordinances and Enrolled Bills: e, h, l, m, q, r, w, x, aa, gg. So voted on
a roll call.
a. Meet to discuss challenges with the auto repair shop located at 274 Winthrop Street.

b. Meet to discuss the Golf Commission's recommendation of the continuation of Ed
Keyes (Keyes Golf) as the operator and manager for the next five years.
Motion by Ms. Borges and seconded by Mr. McCaul to dispense with the matter.
Attorney Gay suggested this should be kept on file. Ms. Borges withdrew her motion.

I was asked by the Mayor's Office to look into the yield sign on West Britannia Street
near Danforth Street. The sign is currently facing West Britannia Street causing
vehicles on West Britannia Street to yield to vehicles entering off of Danforth Street.
After a little research I discovered that the yield sign should be facing Danforth Street. I
spoke with the DPW and the sign will be redirected so that it will face Danforth Street. I
also discovered that there is no ordinance at this time for the yield sign at that location.
I am asking the City Council to allow for an ordinance for this yield sign. I believe that
this yield sign is important at this intersection from a safety perspective.

1. For marijuana companies, meet to discuss the calculation of impact fees particularly on
social equity companies, consider what Boston has done, meet with the Law
Department regarding standard operating procedures, discuss deadlines, and look at
establishing a checklist for people to put in their application. Return within 30 days.
m. Meet to discuss implementing marijuana odor control plans and mitigation.
n. Invite Linda Coelho to come to a meeting of the Committee of the Council as a Whole
for a discussion on things happening at the Taunton Public Library.

fees received for all deliveries both in Taunton and outside of Taunton.
y. Discussion on funding for legal counsel for the city council
z. Request for consideration for a fixed building permit fee from the OPM from the
