Opportunity for input by the general public.
Gregory Glynn, 112 Bay Street, Taunton, stated that tomorrow night the Cable
Commission will be having an Ascertainment Hearing for the Comcast Contract. He
stated that they like to hear from the community on what they provide. He requested that
some of the Councilors, as well as members of the community, attend to give a statement
on what they provide.
Motion was made to go out of the regular order of business to Communications
from the Mayor. So Voted.
Communications from the Mavor:
Mayor O'Connell stated that there will be a Safety Presentation from the Safety
Committee this evening. The members of the Committee introduced themselves as Mary
Heim, Employee of the Water Department/Head of Union for Taunton and Attleboro, A.J.
Marshall, Commissioner of Parks, Cemeteries and Public Grounds, Amy Kazlauskas,
Human Resources Director/Safety Chair, Ryan Turner, Safety Manager, Mike Arruda,
Water Superintendent, Tom Pestana, Systems Manager for the Building Department,
Billy Leonard, Chris Carmichael, Superintendent of Buildings, Peter Farinha,
Procurement and Arsenio Chaves, Public Safety Officer for the Taunton Police
Department. Ms. Kazlauskas discussed the history of what brought the safety program to
the City of Taunton. She discussed the tragedy on October 21, 2016 that occurred in
Boston when two municipal workers were killed in a trench collapse. She stated that a
bill was passed in 2017 to reform safety in the public sector. She stated that in 2018,
Governor Baker signed a bill extending the Occupational Safety and Health Act
Protections to all municipal public employees. She stated that Governor Baker also
created an OSHA Advisory Board. She discussed that she was hired in 2020 and

partnered with Mayor O'Connell and the Unions in order to fost,er a safety culture, which
would make the City of Taunton employees work safer. She discussed that in 2020, they
complied with OSHA regulations by posting the injury data at every building in the
required time frames, having monthly safety meetings and maintaining safety minutes for
public record and they partnered with OECD to obtain a safety grant for a needs
assessment. She stated that in 2021, they continued to comply with OSHA regulations.
She stated that they obtained a safety audit and from this audit they created a job hazard
analysis for their labor force, as well as the creation of the first safety and health manual.
She stated that in 2022, the U.S. Department of Labor granted Massachusetts the initial
approval for a state and local government State Plan under OSHA. She stated that in
2022, the City of Taunton hired their first Safety Manager and formed a Safety
Committee consisting of employees across every City Department. Mr. Turner stated that
they had an audit to determine some of the issues they need to improve, which included
the lack of unified, high visibility gear. Mr. Turner used a slide presentation to discuss the
PPE program. He stated that their goal was to ensure the safety of City employees and
citizens, allow employees to work safely and comfortably in the elements and meet the
requirements of the American National Standards Institute. He discussed that they chose
the Tingley brand as they have had good feedback in the past. Mr. Marshall stated that
this is an important tool that will ensure safety. Mr. Marshall stated that the Tingley brand
allows them to be flexible, as well as protected, regardless of the elements. He stated that
they were able to save thousands of dollars by going through the full procurement
process. Mr. Turner stated that the City issued PPE is a Seed program through ARPA
funds and that new hires will receive a starter kit. Ms. Heim discussed that safety is
nonnegotiable. Mr. Turner discussed the new safety training room located in the former
I.T. room at 141 Oak Street. Mr. Turner discussed that Mental Health will be the focus of
this year's safety week. He stated that safety week will take place from May 6th through
the 10th. He discussed the establishment of the Mental Health Subcommittee. Mr. Turner
discussed the schedule for safety week. He stated that there will be QPR training, which
is mandatory for all employees, followed by lunch from the Mayor. Mr. Pestana spoke
about the upcoming lockdown training. Mr. Turner displayed a full list of the Safety
Committee members and expressed gratitude to them. Mayor 0' Connell stated that it is
important for everyone to see how far this program has come in such a short time.
Councilor Dooner expressed gratitude for the high visibility gear. Councilor Pottier
expressed gratitude to Councilor Sanders and Councilor Postell for their involvement. He
questioned whether there are people in each building who will handle safety concerns.
Ms. Kazlauskas stated that they currently have a diverse group and every City
Department is represented in the Committee. She discussed that they have continued to
identify needs in the City and this can be added to the list. She discussed that everyone
needs to have a part in keeping people safe. Councilor Pottier questioned whether they
have a registration for the defibrillators placed throughout the City. Mr. Turner stated that
they have a database and they are checked monthly. Councilor Borges expressed gratitude
for their work and stated that they are doing an outstanding job. She questioned how they
obtain the equipment back after someone leaves City employment. Ms. Kazlauskas
explained that Mr. Turner has a database for what items employees have and they would
retrieve it from the employee. Councilor McCaul expressed gratitude for their hard work
and is pleased that Councilor Sanders is involved with the mental health aspect. He
questioned whether they will be practicing lockdowns every quarter. Ms. Kazlauskas
stated that it will be a yearly training. Mr. Pestana stated that he is happy to discuss any
questions or concerns employees may have. He stated that they are in the process of

implementing training for all of the staff in all of the buildings. Councilor Sanders stated
that what they have discussed is so important. He expressed gratitude for being asked to
be involved and to be able to bring QPR training to the community.
Motion was made to revert to the regular order of business. So Voted.
Hearing:
Continued Hearing: On the petition of the City of Taunton, 15 Summer Street, Taunton,
MA 02780 for the acceptance of Winthrop Lane as a public way in the City of Taunton.
Motion was made to reopen the hearing. So Voted. The City Clerk read a
communication from the City Engineer stating that this letter is an attempt to clarify the
reasons for the request to accept Winthrop Lane as a public way. The standard procedure
for a Definitive Subdivision project is to complete the process with the street acceptance.
The benefits to the City include that the accepted lane miles are used to determine
Chapter 90 funding. This funding mechanism can be used for future roadway
construction projects on accepted streets. As part of the subdivision, two lots were
created with frontage on Winthrop Lane. Without the Planning Board approval, those lots
may not be considered a buildable lot without beginning the process over. Additionally,
per the Planning Board Rules and Regulations, in the event the City is not accepting the
street, a Homeowners Association shall be established for maintenance of the private
road. The fact that the Planning Board did not require a Homeowner Association suggests
that this would be accepted as a public way. In other subdivisions in the City that were
not accepted as public ways, the lack of the maintenance by the abutters eventually led to
the deterioration of the streets and requests to accept them as public ways once they were
in poor condition. Accepting the street now will prevent such problems in the future.
Mayor O'Connell invited Mr. Patneaude into the enclosure. Motion was made to open
public input for this hearing. So Voted. Raquel Pereira, 3 Winthrop Lane, Taunton,
stated that they have continued to ask what the plans are and have never been given a
straight answer. She stated that the piece of property is 22' x 305'. She questioned why
they have never been told about the buildable lots and stated that they want honesty. Mr.
Patneaude stated that he does not have knowledge of plans for that area. He stated that
Special Permits were approved for single family homes for lots #1, #2 and #3 in 2019,
however, they are only valid for two years and have since expired. He stated that
anything that will go there will have to go through the process to obtain a special permit
and at this time, he has not seen anything come through. Donna Silvia, 33 Winthrop
Lane, Taunton, discussed the appearance of the water tower and asked that it be
improved. She stated that there is a lot of land back there and is questioning what is going
on. Mr. Patneaude stated that the land on the left-side of Winthrop Lane is privately
owned. He stated that the land where the water tower is located has been sold as well.
Louis Pereira, 3 Winthrop Lane, Taunton, stated that he was told that the street is not a
private way, however, it was indicated that the left-side of the street is private and that his
property is private as well. Motion was made to close public input and grant the petition.
On discussion, Councilor Pottier questioned whether the land that had the water tower on
it was part of the public dispensation list. Mr. Dello Russo stated that it was a part of the
Marketable Properties Program round one and was passed to be sold and is currently
going through the closing process with Attorney Gay. Mr. Dello Russo stated that the
special permit process must happen and will need to come back to Council if there is
going to be a development that exceeds the square footage of that lot. Mr. Dello Russo

stated that by making this a public way they are gaining Chapter 90 funds, allowing
opportunity for development expansion and it is a public safety component. Councilor
Pottier confirmed with Mr. Patneaude that there is not currently a special permit in
process for the left-hand side of Winthrop Lane. Councilor Pottier questioned Mr. Dello
Russo as to whether the land that was associated with the water tower is also associated
with other acreage. Mr. Dello Russo stated that he does not have that information in front
of him. Councilor Pottier requested that this information is shared with the Pereira's. Mr.
Dello Russo stated that they sold the property for $80,000 and the cost to remove the
tower would be $250,000. Councilor Pottier questioned whether this property was
purchased by someone other than the person who purchased the property on the left-hand
side of the road. Mr. Dello Russo stated that he would need to review the ownership. Mr.
Dello Russo stated that this is creating an opportunity that will need to go through the
public process. Mayor O'Connell questioned whether this is removing liability from the
City in regards to the water tower. Mr. Dello stated that this is removing an insured tower
off the liability and risk-management insurance policy. Councilor Borges stated that
whether or not this is made a public way, there is still another access point which will not
stop whatever is back there. Councilor Sanders stated that he has met many people in the
City who live on unaccepted roads and universally they have asked what they can do to
have the City accept the road. He discussed the role of an HOA and the responsibility of
its members. He stated that this is a unique situation where part of the road is within the
resident's plot line. He stated that the road will either need an HOA or it will need to be
owned by the City. Attorney Gay stated that the Subdivision Control Law is designed to
have streets permitted in such a way that they are satisfactory to the City's standards so
that once they are complete they can be accepted by the City as a public road. He stated
that Mr. Dello Russo alluded to some of the benefits, however, more of it is so that there
will not be constituents complaining about their streets not being maintained or dealing
with an HOA years down the line. He stated that the reason that this is best practice is
because the best time for the City to take control of a road is as soon as it has been
constructed to the standards of the Planning Board and the Subdivision Control Law that
way the road will be in better shape. He stated that at the time this subdivision was
created, if the intent of the abutters and the petitioner was for it to be a private road, it
would have been a condition of the subdivision control decision stating that an HOA had
to be formed and those documents would have had to have been submitted to Kevin
Scanlon, the City Planner, as well as the Planning Board and it would have had to have
been recorded with the Registry of Deeds, therefore, trying to do this after the fact is
procedurally faulted and would not be best practice. He stated that from the Law
Department's point of view, he would agree with Mr. Patneaude that this street falls
within what the City should be accepting as a public way. Councilor Quintal stated that a
lot of work has been done by himself, Mr. Dello Russo, Councilor Borges and Mayor
O'Connell regarding the water tower. He stated that the City did not tum a blind eye and
three people were coming up with the bids and either Paul Braga or Gil Lopes had
provided a number. He stated that they were going through this and it was presented in
the Committee on Public Property and there were not many people at that meeting. He
stated that they should discuss the concerns of the water tower with the new owners and
suspects the metal is worth a lot of money. Councilor Sanders confirmed with the
residents present at public input that they do not wish to have an HOA. Motion was
made to grant the petition. On a roll call vote, nine (9) Councilors were present,
eight (8) Councilors voted in favor. Councilor McCaul was opposed. The motion
passes.

Appointments:
Reappointment of Melissa Langham, 79 Ridgewood Drive, Taunton to serve on the
Elections Commission for a term of four (4) years expiring April 2028. Motion was
made to move approval. So Voted.
Communications from the Mavor:
Mayor O'Connell stated that the community updates are printed in the agenda packet.
She stated that City Hall will be closed this coming Monday in observance of Patriots
Day.
Communications from City Offlcers:
Com. from the Chief Financial Officer stating that the Finance Department is respectfully
requesting a transfer of $1,700,000 from the Capital Stabilization Fund to the School
Department. These funds will be used for a variety of projects in the School District
during the spring and summer FY2024 into FY2025. Motion was made to refer to the
Committee on Finance and Salaries. So Voted.
Com. from the City Solicitor regarding a communication dated March 26, 2024, which
the Law Department has received from Xfinity with information about changes to the
Xfinity channel line-up. Motion was made to receive and place on file pages #2 and
#3. So Voted.
Com. from the Chief Financial Officer stating that the Finance Department is seeking to
expand the allowable uses of the Mayor's Helping Hand Fund. The proposal would
include adding emergency rehabilitation cost to individuals who can clearly present a
hardship and inability to pay. Further, they would propose a cap on the assistance at
$3,000.00 and that those funds are paid directly to the vendor. They also will be
proposing inside the existing order to increase the assistance for taxes and utilities to
increase from $300.00 to $500.00. They respectfully request that this meeting be held on
April 23, 2024 in the Committee on Finance and Salaries. Motion was made to refer to
the Committee on Finance and Salaries. So Voted.
Com. from the Chief Financial Officer stating that the Finance Department is prepared to
present the City's quarterly report for the period ending March 31, 2024. They
respectfully request this meeting be held on April 23, 2024 in the Committee on Finance
and Salaries. Motion was made to refer to the Committee on Finance and Salaries. So
Voted.
Com. from the Human Resources Director submitting a buyout in the amount of
$34,370.39. Mayor O'Connell stated that no approval was needed. Motion was made to
send the appropriate scroll. So Voted.
Com. from the Human Resources Director expressing appreciation for the service
rendered by the Assistant Human Resources Director, Sandy Peavey, who is retiring after
26 years of dedicated service to the City of Taunton. Mayor O'Connell stated that no
action was necessary on this matter.

Com. from the City Solicitor requesting to meet in executive session with the Municipal
Council to discuss a potential litigation matter. Motion was made to refer to the
Committee of the Council as a Whole. So Voted.
Com. from the Chairman, Taunton Planning Board stating that the Taunton Planning
Board is in receipt of the proposed changes to the City of Taunton Zoning Ordinance
dated April 2, 2024 on the following: Section 440 Attachment 3- Intensity of Use Table;
Section 440-201; Definitions; Section 440-602- Bulk and Dimensional Requirements;
Section 440-702- Landscaping; Section 440-703- Comer Lots; Section 440-702- Off
Street Parking- under A (4) Residential Units; Section 440-711- Accessory Structures;
Article XV Site Plan Review- Section 440-1501 thru 1506- Purpose and Authority;
Section 440-1707- Other Design Requirements. The Planning Board will hold a public
hearing on the proposed zoning changes on Thursday, May 2, 2024 at 5:30 PM at City
Hall, 15 Summer Street, 2nct Floor, in the Chester R. Martin Municipal Council
Chambers. Motion was made to receive and place on file. So Voted.

Joint petition submitted by Taunton Municipal Lighting Plant and Verizon New England,
Inc. proposing to relocate one (1) joint pole location, EL 71 to be relocated 21' on Hart
Street, Taunton. Motion was made to refer to the City Clerk to schedule a public
hearing. So Voted.
Pole Location
Joint Petition submitted by Verizon New England, Inc. and Taunton Municipal Lighting
Plant proposing to place new facilities, Pole 51 S to be located on Fremont Street,
Taunton. Motion was made to refer to the City Clerk to schedule a public hearing.

Councilor Pottier stated that they met today in executive session and the Committee of
the Council as a Whole voted to approve the MOA of the Collective Buying Agreement
with the Taunton Supervisor Police Association for 2024 through 2027 and covering the
period of 2023 and 2024. He stated that this was a unanimous vote of eight (8) to zero
(0). (Councilor Sanders was absent during Committee).

That Section 405-53 of the Revised Ordinances of the City of Taunton, as amended,
be and hereby are further amended by adding thereto the following:
Bradley Ave., east side of the Street for the entire length of the Street.
James Street, both sides, from the intersection with Broadway for 125'.
All ordinances or parts thereof inconsistent herewith are hereby repealed. This
Ordinance shall become effective immediately upon passage.

AN ORDINANCE
Chapter 222
Recreational (Non-Medicinal) Marijuana Establishments
Be it ordained by the Municipal Council of the City of Taunton and by authority of
the same as follows:
SECTION 1: Chapter 222 of the Revised Ordinances of the City of Taunton, as
amended, is hereby further amended by deleting said existing Chapter and
replacing the same with the following:-
§222-1 License Requirements
A. Purpose and intent. It is the purpose and intent of this section to expand the local
scope over Marijuana Establishments within the City of Taunton under
Massachusetts General Laws chapter 940, and its implementing regulations at
935 CMR 500, and to enable the City to further regulate, improve compliance,
deter illegal sales, impose reasonable safeguards to govern the time, place and
manner of marijuana establishment operations to ensure public health and safety
and well-being and deter illegal sale of marijuana to underage persons and to
ensure that the marijuana establishment environment is strictly controlled to meet
the requirements of state law. This ordinance is not intended to supersede any
existing state laws and should be interpreted to operate in harmony with such

laws. The authority for this Ordinance is in the Articles of Amendment to the
Massachusetts Constitution, Art. 2, §6, General Laws c. 94G, §3, 935 CMR
500.170, and every other lawful authority.
B. Definitions. Any word or phrase that is defined in G.L. c. 94G, § 1 or 935 CMR
500.002, as same may be amended from time to time, shall, when used in this
ordinance, have the same meaning.
1. The Municipal Council shall serve as the Local Licensing Authority
(hereinafter "LLA"), which shall refer all license applications to the Police
and License Committee.
C. In order to operate a Marijuana Establishment, an Applicant must:
1. Obtain a Host Community Agreement Waiver (hereinafter "Waiver") from
the LLA.
a. The number of Waivers granted to Marijuana Retailers by the LLA
shall not exceed the number of Marijuana Retailer licenses allowed
under this chapter.
b. If an Applicant does not submit an application to operate a
Marijuana Retail Establishment with the Cannabis Control
Commission (hereinafter "CCC") within ninety (90) days of
receipt of the Waiver, there is rebuttable presumption that the
Applicant does not intend to move forward with a Marijuana Retail
Establishment in Taunton and thereby relinquishes the Waiver and
corresponding license.
2. Obtain a special permit from the LLA as the special permit granting
authority for Marijuana Establishments under the Taunton Zoning
Ordinance.
a. The hours of operation of the Marijuana Establishment shall be set
by the LLA in the special permit.
3. Upon being granted a final license by CCC an Applicant shall submit a
license application to the LLA through the City Clerk.
a. All other zoning approvals, including site plan reviews and
variances, required under the City of Taunton Zoning Ordinance
shall be obtained prior to the LLA considering the license
application.
D. The total number of Marijuana Retailer licenses which may be issued pursuant to
this chapter shall be nine.
1. Pursuant to 935 CMR 500.181(3)(c)(2), ifthe LLA later decides to allow
additional Marijuana Retailers, at least 50% of those licenses, but no less than

one license, above the previously established cap shall be reserved for:
License Applicants that are Social Equity Businesses; License Applicants that
have been designated as Social Equity Program Participants, Economic
Empowerment Priority Applicants, or both; or individuals or entities verified
or pre-verified pursuant to 935 CMR 500.101(7), including pre-verified
individuals or entities that have already been designated as Social Equity
Businesses, Economic Empowerment Applicants, or both.
E. A new application must be submitted for any changes of ownership or control of
the Marijuana Establishment and be subject to approval by the LLA.
F. All licenses must be posted under glass or equivalent protective surface and shall
be posted on the licensed premises in a clear and conspicuous manner so that the
same may be easily observed by a local inspector from a publicly accessible
space.
G. License applications under this chapter shall be made on a form or forms
prescribed by the LLA. The fee for said license applications shall be set by the
LLA.
1. License applications shall include a copy of the Applicant's full
application with the CCC and a copy of the Applicant's final license.
H. Every license issued under this section shall expire annually on June 30, unless
sooner revoked.
I. Records that are required to be kept by state law or regulation of marijuana
purchased and sold must be available when requested by members of the LLA,
Police Department, local enforcement officer, or any other authorized person or
entity.
J. Within thirty (30) days ofreceiving a renewal license from the Massachusetts
Cannabis Control Commission, a Marijuana Establishment shall submit a copy to
the LLA.
K. Authority to inspect Marijuana Establishments for compliance and to enforce this
Ordinance shall be held by the Building Commissioner, Zoning Enforcement
Officers, Taunton Police Department, Taunton Fire Department, the Board of
Health, the LLA and its authorized agents, or any other agency designated by the
Mayor. Every Marijuana Establishment must permit any such authorized person
access for the purpose of lawful inspection as a condition of its license.
L. Violations
1. Violation guidelines. In the event that a licensee violates, or
permits a violation of a law of the Commonwealth related to
recreational marijuana; this chapter or any other City of Taunton
ordinance related to recreational marijuana; or any rules and
regulations promulgated by the LLA hereunder, the LLA may take
the following actions, respectively:

a. First violation: warning to seven-day suspension.
b. Second violation: warning to thirty-day suspension.
c. Third violation: seven-day suspension to revocation.
2. Prior Violations. Violations which occurred more than two years
prior to the date of a violation shall not be used in calculating the
number of violations for purposes of these guidelines.
3. LLA Discretion. The LLA may use its discretion in determining
whether the facts surrounding a violation warrant action different
than that suggested by the guidelines. These guidelines shall not
be construed so as to limit the LLA' s authority to impose
additional conditions on a license when warranted.
M. There shall be a rebuttable presumption that a recreational marijuana
establishment which has received a local license under this chapter and
either: (1) has not commenced operations within one year of the LLA's approval
of its license; or (2) has not generated revenue at the location of the licensed
establishment within one year of the LLA's approval of its license; or (3) is not
current on fees owed under applicable law shall be ineligible for renewal of its
local license, but the Municipal Council, notwithstanding this, may, in its sole
discretion, extend the time period for additional six-month increments in order to
achieve compliance with the foregoing.
SECTION 2. All ordinances or parts thereof inconsistent herewith are hereby
repealed. This Ordinance shall become effective immediately upon passage.
The City Clerk stated that the Law Department would like to postpone the first reading of
this ordinance to next week so it can add section 222-2 which does not have any changes
but needs to be added as the ordinance on the agenda is intended to replace Chapter 222
in its entirety. The ordinance will be placed on the agenda and read in its entirety next
week. Motion was made to move approval. So Voted.
New Business:
Councilor Pottier requested to meet with the Law Department in executive session to
discuss ongoing City lawsuits. Councilor Pottier requested to refer this matter to the
Committee of the Council as a Whole and noted that this will be both a lengthy and
important meeting, therefore, he would like to do this in the coming weeks when all nine
(9) Councilors are present, if possible. Motion was made to refer to the Committee of
the Council as a Whole. So Voted.

The meeting was called to order at 5:41 PM.
1. Remarks from the Chair
President Pottier noted that there are some important issues coming up in the Committee of
the Council as a Whole in the next few weeks and requested that the Councilors notify of any
ab senses.
2. Approve minutes from March 19, 2024.
Motion by Mr. McCaul and seconded by Mr. Postell to approve. So voted.
3. Meet in executive session to discuss the Memorandums of Agreement with the Taunton
Police Supervisory Personnel Association for successor collective bargaining agreements.
This discussion will be held in executive session pursuant to MGL Chapter 30A §21: "To
discuss strategy with respect to collective bargaining or litigation if an open meeting may
have a detrimental effect on the bargaining or litigating position of the public body and the
chair so declares".
Motion by Mr. Postell and seconded by Mr. Duarte to enter into executive session. So voted
on a roll call.

Mr. Pottier reported that there was a motion made that was unanimously voted by the 8
councilors present to approve the Memorandum of Agreement for the 2024-2027 Collective
Bargaining Agreement between the City of Taunton and the Taunton Police Supervisor
Union as well as the same agreement for 2023-2024.
Motion by Mr. Duarte and seconded by Mr. Postell to adjourn at 6:22 PM. So voted.

Chapter 222
Recreational (Non-Medicinal) Marijuana Establishments
Be it ordained by the Municipal Council of the City of Taunton and by authority of
the same as follows:
SECTION 1: Chapter 222 of the Revised Ordinances of the City of Taunton, as
amended, is hereby further amended by deleting said existing Chapter and
replacing the same with the following:-
§222-1 License Requirements
A. Purpose and intent. It is the purpose and intent of this section to expand the local
scope over Marijuana Establishments within the City of Taunton under
Massachusetts General Laws chapter 94G, and its implementing regulations at
935 CMR 500, and to enable the City to further regulate, improve compliance,
deter illegal sales, impose reasonable safeguards to govern the time, place and
manner of marijuana establishment operations to ensure public health and safety
and well-being and deter illegal sale of marijuana to underage persons and to
ensure that the marijuana establishment environment is strictly controlled to meet
the requirements of state law. This ordinance is not intended to supersede any
existing state laws and should be interpreted to operate in harmony with such
laws. The authority for this Ordinance is in the Articles of Amendment to the
Massachusetts Constitution, Art. 2, §6, General Laws c. 94G, §3, 935 CMR
500.170, and every other lawful authority.
B. Definitions. Any word or phrase that is defined in G.L. c. 94G, § 1 or 935 CMR
500.002, as same may be amended from time to time, shall, when used in this
ordinance, have the same meaning.
1. The Municipal Council shall serve as the Local Licensing Authority
(hereinafter "LLA"), which shall refer all license applications to the Police
and License Committee.
C. In order to operate a Marijuana Establishment, an Applicant must:
1. Obtain a Host Community Agreement Waiver (hereinafter "Waiver") from
the LLA.
a. The number of Waivers granted to Marijuana Retailers by the LLA
shall not exceed the number of Marijuana Retailer licenses allowed
under this chapter.
b. If an Applicant does not submit an application to operate a
Marijuana Retail Establishment with the Cannabis Control
Commission (hereinafter "CCC") within ninety (90) days of
receipt of the Waiver, there is rebuttable presumption that the
Applicant does not intend to move forward with a Marijuana Retail
Establishment in Taunton and thereby relinquishes the Waiver and
corresponding license.
2. Obtain a special permit from the LLA as the special permit granting
authority for Marijuana Establishments under the Taunton Zoning
Ordinance.
a. The hours of operation of the Marijuana Establishment shall be set
by the LLA in the special permit.
3. Upon being granted a final license by CCC an Applicant shall submit a
license application to the LLA through the City Clerk.
a. All other zoning approvals, including site plan reviews and
variances, required under the City of Taunton Zoning Ordinance
shall be obtained prior to the LLA considering the license
application.
D. The total number of Marijuana Retailer licenses which may be issued pursuant to
this chapter shall be nine.
1. Pursuant to 935 CMR 500.181(3)(c)(2), ifthe LLA later decides to allow
additional Marijuana Retailers, at least 50% of those licenses, but no less than
one license, above the previously established cap shall be reserved for:
License Applicants that are Social Equity Businesses; License Applicants that
have been designated as Social Equity Program Participants, Economic
Empowerment Priority Applicants, or both; or individuals or entities verified
or pre-verified pursuant to 935 CMR 500.101(7), including pre-verified
individuals or entities that have already been designated as Social Equity
Businesses, Economic Empowerment Applicants, or both.
E. A new application must be submitted for any changes of ownership or control of
the Marijuana Establishment and be subject to approval by the LLA.
F. All licenses must be posted under glass or equivalent protective surface and shall
be posted on the licensed premises in a clear and conspicuous manner so that the
same may be easily observed by a local inspector from a publicly accessible
space.
G. License applications under this chapter shall be made on a form or forms
prescribed by the LLA. The fee for said license applications shall be set by the
LLA.
1. License applications shall include a copy of the Applicant's full
application with the CCC and a copy of the Applicant's final license.
H. Every license issued under this section shall expire annually on June 30, unless
sooner revoked.
I. Records that are required to be kept by state law or regulation of marijuana
purchased and sold must be available when requested by members of the LLA,
Police Department, local enforcement officer, or any other authorized person or
entity.
J. Within thirty (30) days ofreceiving a renewal license from the Massachusetts
Cannabis Control Commission, a Marijuana Establishment shall submit a copy to
the LLA.
K. Authority to inspect Marijuana Establishments for compliance and to enforce this
Ordinance shall be held by the Building Commissioner, Zoning Enforcement
Officers, Taunton Police Department, Taunton Fire Department, the Board of
Health, the LLA and its authorized agents, or any other agency designated by the
Mayor. Every Marijuana Establishment must permit any such authorized person
access for the purpose of lawful inspection as a condition of its license.
L. Violations
1. Violation guidelines. In the event that a licensee violates, or
permits a violation of a law of the Commonwealth related to
recreational marijuana; this chapter or any other City of Taunton
ordinance related to recreational marijuana; or any rules and
regulations promulgated by the LLA hereunder, the LLA may take
the following actions, respectively:
a. First violation: warning to seven-day suspension.
b. Second violation: warning to thirty-day suspension.
c. Third violation: seven-day suspension to revocation.
2. Prior Violations. Violations which occurred more than two years
prior to the date of a violation shall not be used in calculating the
number of violations for purposes of these guidelines.
3. LLA Discretion. The LLA may use its discretion in determining
whether the facts surrounding a violation warrant action different
than that suggested by the guidelines. These guidelines shall not
be construed so as to limit the LLA's authority to impose
additional conditions on a license when warranted.
M. There shall be a rebuttable presumption that a recreational marijuana
establishment which has received a local license under this chapter and
either: (1) has not commenced operations within one year of the LLA's approval
of its license; or (2) has not generated revenue at the location of the licensed
establishment within one year of the LLA's approval of its license; or (3) is not
current on fees owed under applicable law shall be ineligible for renewal of its
local license, but the Municipal Council, notwithstanding this, may, in its sole
discretion, extend the time period for additional six-month increments in order to
achieve compliance with the foregoing.
SECTION 2. All ordinances or parts thereof inconsistent herewith are hereby
repealed. This Ordinance shall become effective immediately upon passage.

This letter is an attemptto clarify the reasons for the request to accept Winthrop Lane as a public way.
The. standard procedu:re for a Definitive Subdivision project is to complete the process with the street
acceptance. The benefits to the. city includes that the accepted lane miles are used to detennine Chapter
90 funding; This funding mechanism can be used for future roadway construction projects on accepted
streets. As part ofthesubdivision, two lots were created with frontage on Winthrop Lane. Withoutthe
Planning Board approval, those lots may not be considered a buildable lot witho.ut beginning the process
over. Addi'.tionally, per the Planning Board Rules and Regulations, in the event the City is not accepting
the street, ·•a Homeowners Association shall be established for maintenance of the private road. The fact
thatthe Planning Board did not require a homeowner asso.ciation suggests that this would be accepted as a
Plilblic way, In other subdivisions in the city that were not accepted as public ways, the lack the
maintenance by the abutters eventually led to the deterioration ofthestreets and requests to acceptthem
as public ways once they were in poor condition. Accepting the street now will prevent such problems in
the future.

The Finance Department is seeking to expand the allowable uses of the Mayor's Helping Hand
Fund. The proposal would include adding emergency rehabilitation cost to individuals who can
clearly present a hardship and inability to pay. Further we would propose a cap on the assistance
at $3 ,000.00 and that those funds are paid directly to the vendor.
We also will be proposing inside the existing order to increase the assistance for taxes and utilities
to increase from $300.00 to $500.00.

Dear Mayor Shaunna O'Connell, Council President Potter and Members of the Municipal Council,
I am writing to express my heartfelt appreciation for the outstanding service rendered by Assistant
Human Resources Director, Sandy Peavey who is retiring after 26 years of dedicated service to the
City of Taunton. Under the O'Connell Administration and my leadership, Sandy was promoted
from Office Manager to Assistant Director in 2021 for recognition of her exceptional leadership
skills, strong work ethic and increase in responsibilities throughout the years.
Throughout Sandy' s tenure, she has had unwavering commitment, integrity, tireless effort and
contributions, and strong leadership which was paramount to the success of the Human Resources
Department. She was one of the first employees to be hired in the personnel department and is a
trailblazer of the City's Human Resources Department as it is known today. For the past 26 years
Sandy has manually maintained a data base to capture historical employee data such as;
employment information and compensation, she was the administrator of Labor and Official
Service and she created and maintained a library for all City job descriptions which is used today.
Sandy's roles and responsibilities and "firsts" go on and on.
As Sandy embarks on her next chapter and a well-deserved retirement filled with relaxation. I want
to take this opportunity to express my deepest gratitude for her exceptional service and invaluable
contribution to our employees at the City.
Sandy Peavey has made an indelible mark on our City and will be tremendously missed by ALL.

Police Supervisory Personnel Association for successor collective bargaining agreements.
This discussion will be held in executive session pursuant to MGL Chapter 30A §21: "To
discuss strategy with respect to collective bargaining or litigation if an open meeting may
have a detrimental effect on the bargaining or litigating position of the public body and the
chair so declares".
