Communications from the Mayor: Mayor O'Connell spoke about the importance of Mental Health Awareness Month and how mental health affects every family. She discussed that this week is Safety Week at City Hall for the staff. Mayor O'Connell read a proclamation proclaiming May 2024 as Mental Health Awareness Month. She issued a proclamation to Annemarie Matulis and Tracy Pacheco Medeiros of the Bristol County Regional Coalition for Suicide Prevention. Ms. Matulis stated that she currently serves as the Director for the Bristol County Regional Coalition for Suicide Prevention. She stated that in 2003, they established a Violence Prevention Task Force. She discussed the establishment of the Teen Center. She stated that she will share a link for "Soul Care for the Caregiver". She discussed that mental health and mental illness are not synonymous. She discussed that their message is "mental health is health". Mayor O'Connell introduced Steve Palm from the Kacie Project. She spoke about how Mr. Palm and his wife turned a tragedy in their lives into a way to help people. Mr. Palm stated that in 2014, he lost his 14 year old daughter, Kacie, to suicide. He discussed that he connected with the Bristol County Regional Coalition for Suicide Prevention and started attending kitchen table conversations for suicide loss survivors. He discussed the importance of collaborating with other organizations and the importance of discussions about suicide prevention. He discussed that he has placed some billboards on Route 44 promoting the "988 number'', as well as some lawn signs. Mayor O'Connell presented a proclamation to Mr. Palm.  2 Mayor O'Connell introduced Jenn Hoye and Jessica Van der Stad of the American Foundation for Suicide Prevention. Ms. Hoye stated that she is the Board Chair and Ms. Van der Stad is the Executive Director for the Massachusetts Chapter of the American Foundation for Suicide Prevention. She discussed that seven years ago, she lost her brother Teddy to suicide and that this profound loss changed the trajectory of her life. She discussed that through collaboration with local organizations, she strives to create a world where those living with mental health challenges have access to care. Mayor O'Connell issued Ms. Hoye and Ms. Van der Stad a proclamation. Mayor 0' Connell stated that the community update is listed in the agenda packet. Mayor 0' Connell stated that the operations of Morton Hospital are not affected from the filing of Steward Health for Chapter 11. She stated that the hospital continues to proudly and effectively serve the community. She stated that there is additional information regarding this matter on the City ofTaunton's website. Appointments: Com. from Mayor O'Connell stating that the appointment of Judith Chambers to the Golf Course Commission expired on April 12, 2024. Under Chapter 10, Article IX of the ordinance "nominations may be made by the Council and the Mayor" and the "Municipal Council shall appoint seven Commissioners ... ". The appointment is being referred for their consideration. Councilor Borges stated that she has been a member of the Golf Commission for the last five months and Judith Chambers has been dynamic there. Councilor Borges motioned to continue Judith Chambers on the Golf Commission for a term of two (2) years, expiring in April of2026. Mayor O'Connell stated that she thought this was a one ( 1) year appointment. Councilor Borges stated that she would amend her motion to have her term expire at the appropriate time as per Ordinance. Motion was made to have Judith Chambers continue on the Golf Commission expiring at the appropriate time as per the Ordinance. So Voted. Communications from Citv Officers: Com. from the Chief Financial Officer stating that the Finance Department is requesting a transfer to cover anticipated deficits due to the hiring of a fulltime Sealer of Weights and Measures. They are requesting a transfer in the amount of $23,000. Motion was made to refer to the Committee on Finance and Salaries. So Voted. Com. from the Chief Financial Officer stating that the Finance Department would like the opportunity to bring forward the City of Taunton's Fiscal Year 2025 Consolidated Financial Policies for a vote for ratification. As the Council is aware, they consolidated departmental policies over two years ago into one cohesive and comprehensive document and this is now part of their annual fiscal procedure. Com. from the Chief Financial Officer stating that the Finance Department is requesting a transfer to cover additional cost of emergency demolition at 437 Whittenton St. The requested amount to cover the deficit is $500,000 to be transferred from the Capital Stabilization account. Once the lien is perfected and the City is paid back, they will add the $500,000 back to the stabilization account. Motion was made to refer to the Committee on Finance and Salaries. Ordinance (or a third reading to be ordained on a roll call vote AN ORDINANCE Chapter222 Recreational (Non-Medicinal) Marijuana Establishments  7 Be it ordained by the Municipal Council of the City of Taunton and by authority of the same as follows: SECTION 1: Chapter 222 of the Revised Ordinances of the City of Taunton, as amended, is hereby further amended by deleting said existing Chapter and replacing the same with the following:- §222-1 License Requirements A. Purpose and intent. It is the purpose and intent of this section to expand the local scope over Marijuana Establishments within the City of Taunton under Massachusetts General Laws chapter 94G, and its implementing regulations at 935 CMR 500, and to enable the City to further regulate, improve compliance, deter illegal sales, impose reasonable safeguards to govern the time, place and manner of marijuana establishment operations to ensure public health and safety and well-being and deter illegal sale of marijuana to underage persons and to ensure that the marijuana establishment environment is strictly controlled to meet the requirements of state law. This ordinance is not intended to supersede any existing state laws and should be interpreted to operate in harmony with such laws. The authority for this Ordinance is in the Articles of Amendment to the Massachusetts Constitution, Art. 2, §6, General Laws c. 94G, §3, 935 CMR 500.170, and every other lawful authority. B. Definitions. Any word or phrase that is defined in G.L. c. 94G, §1 or 935 CMR 500.002, as same may be amended from time to time, shall, when used in this ordinance, have the same meaning. 1. The Municipal Council shall serve as the Local Licensing Authority (hereinafter "LLA"), which shall refer all license applications to the Police and License Committee. C. In order to operate a Marijuana Establishment, an Applicant must: 1. Obtain a Host Community Agreement Waiver (hereinafter "Waiver") from theLLA. a. The number of Waivers granted to Marijuana Retailers by the LLA shall not exceed the number of Marijuana Retailer licenses allowed under this chapter. b. If an Applicant does not submit an application to operate a Marijuana Retail Establishment with the Massachusetts Cannabis Control Commission (hereinafter "CCC") within ninety (90) days ofreceipt of the Waiver, there is rebuttable presumption that the Applicant does not intend to move forward with a Marijuana Retail Establishment in Taunton and thereby relinquishes the Waiver and corresponding license.  8 2. Obtain a special permit from the LLA as the special permit granting authority for Marijuana Establishments under the Taunton Zoning Ordinance. a. The hours of operation of the Marijuana Establishment shall be set by the LLA in the special permit. 3. Upon being granted a final license by the CCC an Applicant shall submit a license application to the LLA through the City Clerk. a. All other zoning approvals, including site plan reviews and variances, required under the City of Taunton Zoning Ordinances shall be obtained prior to the LLA considering the license application. D.. The total number of Marijuana Retailer licenses which may be issued pursuant to this chapter shall be nine. 1. Pursuant to 935 CMR 500.181(3)(c)(2), ifthe LLA later decides to allow additional Marijuana Retailers, at least 50% of those licenses, but no less than one license, above the previously established cap shall be reserved for: License Applicants that are Social Equity Businesses; License Applicants that have been designated as Social Equity Program Participants, Economic Empowerment Priority Applicants, or both; or individuals or entities verified or pre-verified pursuant to 935 CMR 500.101(7), including pre-verified individuals or entities that have already been designated as Social Equity Businesses, Economic Empowerment Applicants, or both. E. A new application must be submitted for any changes of ownership or control of the Marijuana Establishment and be subject to approval by the LLA. F. All licenses must be posted under glass or equivalent protective surface and shall be posted on the licensed premises in a clear and conspicuous manner so that the same may be easily observed by a local inspector from a publicly accessible space. G. License applications under this chapter shall be made on a form or forms prescribed by the LLA. The fee for said license applications shall be set by the LLA. 1. License applications shall include a copy of the Applicant's full application with the CCC and a copy of the Applicant's final license. H. Every license issued under this section shall expire annually on June 30, unless sooner revoked. I. Records that are required to be kept by state law or regulation of marijuana purchased and sold must be available when requested by members of the LLA,  9 Police Department, local enforcement officer, or any other authorized person or entity. J. Within thirty (30) days ofreceiving a renewal license from the CCC, a Marijuana Establishment shall submit a copy to the LLA. K. Authority to inspect Marijuana Establishments for compliance and to enforce this Ordinance shall be held by the Building Commissioner, Zoning Enforcement Officers, Taunton Police Department, Taunton Fire Department, the Board of Health, the LLA and its authorized agents, or any other agency designated by the Mayor. Every Marijuana Establishment must permit any such authorized person access for the purpose of lawful inspection as a condition of its license. L. Violations 1. Violation guidelines. In the event that a licensee violates, or permits a violation of a law of the Commonwealth related to recreational marijuana; this chapter or any other City of Taunton ordinance related to recreational marijuana; or any rules and regulations promulgated by the LLA hereunder, the LLA may take the following actions, respectively: a. First violation: warning to seven-day suspension. b. Second violation: warning to thirty-day suspension. c. Third violation: seven-day suspension to revocation. 2. Prior Violations. Violations which occurred more than two years prior to the date of a violation shall not be used in calculating the number of violations for purposes of these guidelines. 3. LLA Discretion. The LLA may use its discretion in determining whether the facts surrounding a violation warrant action different than that suggested by the guidelines. These guidelines shall not be construed so as to limit the LLA's authority to impose additional conditions on a license when warranted. M. There shall be a rebuttable presumption that a recreational marijuana establishment which has received a local license under this chapter and either: (1) has not commenced operations within one year of the LLA's approval of its license; or (2) has not generated revenue at the location of the licensed establishment within one year of the LLA's approval of its license; or (3) is not current on fees owed under applicable law shall be ineligible for renewal of its local license, but the Municipal Council, notwithstanding this, may, in its sole discretion, extend the time period for additional six-month increments in order to achieve compliance with the foregoing. § 222-2 Certain setback requirements. A. Pursuant to MGL c. 94G, § 5(b)(3), the 500-foot buffer zone found within said section is reduced to zero feet with respect to only such parcels of property within  10 the City of Taunton that are: (1) within a Highway Business Zoning District; (2) within 500 feet of the property line of the parcel of land (Assessor ID 67-119) that contains Taunton High School, Parker Middle School and Elizabeth Pole School; and (3) separated from said school buildings by the Taunton River. B. The Municipal Council shall not issue a local license to any marijuana retailer for a premises within 1,000 feet of the premises of another marijuana retailer holding an existing license under this chapter which is also classified by the Cannabis Control Commission as either an Economic Empowerment Priority Applicant or a Social Equity Program Participant pursuant to the Cannabis Control Commission regulations codified at 935 CMR 500.001 et seq. For purposes of this chapter, said 1,000 feet shall be measured in a straight line from the geometric center of the marijuana establishment entrance, unless there is an impassible barrier within those 1,000 feet. In the event there is an impassible barrier within said 1,000 feet, the distance shall be measured along the center of the shortest travel path for pedestrians or automobiles from the geometric center of the marijuana establishment entrance. SECTION 2. All ordinances or parts thereof inconsistent herewith are hereby repealed. This Ordinance shall become effective immediately upon passage. Motion was made to approve. On a roll call vote, nine (9) Councilors were present, nine (9) Councilors voted in favor. So Voted. New Business: Councilor Martin stated that the 32°d Annual Food Drive will take place this Saturday. He stated that they have placed yellow bags into the mail boxes and residents can leave their donations in the yellow bags near their mail boxes around 9 a.m. He stated that the yellow bag was sponsored by Morton Hospital. He stated that all of the donations will go to St. Vincent De Paul and they will distribute them. He stated that St. Vincent De Paul will accept food and toiletries to help the residents in need. He stated that anyone who would like to volunteer can reach out to him and that St. Vincent De Paul can use help breaking down the food as it arrives. He stated that this food drive is about helping neighbors and they usually collect about 20,000 to 25,000 pounds of food every year. Councilor Dooner questioned whether residents can place donations in another bag if they did not receive a yellow bag. Councilor Martin confirmed that this was acceptable. Councilor Pottier requested to refer to the Committee of the Whole to invite Superintendent Cabral, members of his staff, and the School Committee to discuss the Taunton Public School's successes, future plans, and their FY25 budget on June 11. Motion was made to invite Superintendent Cabral, members of his staff, and the School Committee to discuss the Taunton Public School's successes, future plans, and their FY25 budget to the Committee of the Council as a Whole on June 11, 2024. Meet for a pre-review upon the petition of Attorney Daniel F. de Abreau, BRCSM, 174 Dean Street, Unit B, Taunton, MA 02780 on behalf of his client SAN Holdings, LLC, 21 Second Street Taunton, MA 02780 for the issuance of a Special Permit to allow a 1,953 sq. ft. Marijuana Retailer at 235 Hart Street (Parcel 94-215 and 94-152), Taunton, located in an Industrial District.  18 Motion by Mr. Sanders and seconded by Mr. McCaul to invite in the interested parties. So voted. Attorney de Abreu gave a brief overview of the project and explained that there was a previously approved special permit and site plan. However, that lot required a significant amount of fill so they acquired the property next door. The current proposal is to combine the two lots and have a retail only establishment in the existing structure where the previous proposal was for a 7000 sq. ft. retail and cultivation facility. Ms. Dooner expressed interest in learning about neighborhood outreach, plans for fencing and trees, hours of operation, security, number of employees, and their business plan. Mr. Quintal asked how this will fit into the neighborhood and Attorney de Abreu explained that the existing home will be remodeled. Mr. Sanders requested the documentation that was required to change the business type from retail and cultivation to retail only as well as updated information on the situation with the CCC. He asked for information on plans for the lot that was clear cut and noted that since this is close to a school, he'd like to see what the view will be from the road. Mr. Pottier requested renderings and information on traffic patterns and zoning. Motion by Mr. Sanders and seconded by Mr. Postell to excuse the parties with thanks. So Voted. 4. Meet with the Law Department in executive session to discuss a potential litigation matter'. This discussion will be held in executive session pursuant to MGL Chapter 30A §21: "To discuss strategy with respect to collective bargaining or litigation if an open meeting may have a detrimental effect on the bargaining or litigating position of the public body and the chair so declares". 5. Meet with the Law Department in executive session to discuss pending claims and other litigation matters.
