Minutes of the Taunton Conservation Commission May 1, 2017 Present: Chair Steven Turner, Commissioners Ernest Enos, Richard Enos, Debra Botellio, Luis Freitas, and Marla Isaac. Vice Chair Neil Kelly was absent. Motion to approve the minutes from April meeting, DB, second MI, so voted. Continued Violation 1. 165R Hart Street Email from property owner was read into the record. Fines as of today $133,500.00, ST would like to continue fining. Motion to continue fines, place a lien on the property pursuant to the direction and instruction of the City of Taunton Law Department, have this done as soon as possible, DB, second MI, so voted. Motion that if anything comes up regarding this property-meaning all boards and commissions across the board, they are to notify the Conservation Commission immediately so that if the property changes ownership, the fines and liens will carry on with the property, DB, second MI, so voted. Motion to ask the DPW to go out and fix the properties on Briarwood, putting them back to where they were, and check into getting them tied into the city, both Greenberg and Rego, DB, second MI, so voted. Public Hearing 1. Winthrop Street (88-120), Hawthorne Development, Inc., NOI, SE73-2694 Field report states that this filing is for razing the existing buildings (on a lot currently known as #545) and construction of a duplex on a newly created lot. The construction will also include decks, driveway, parking, utilities, and associated grading. The wetland line was approved under file #SE73-2473 and an ORAD issued on 6/9/11 which is still valid under the Tolling Period until 2018. A siltation barrier is depicted on the plan running along the 25-foot WPZ and is the limit of work. This duplex is to the west of the proposed duplex under file SE73-2693. A small portion of this building will fall within the 100-foot buffer zone. The concrete washout area and dewatering area are located on this lot as well. Grading on this lot will be 40 feet from the wetland while the easterly corner of the deck will be 84 feet away. Drywells are proposed to capture roof runoff and contours will maintain the current slope toward the wetland area. The work as proposed will not negatively impact the wetland resource area, therefore MR recommends that the TCC approve this project and issue an order of conditions to include the attached special conditions. Present Karen Patnaude for the applicant. Motion to approve with special conditions 1, 2, 3, 4, 5, 7, 8, 16, 17, 19, 21, 25, 26, and 27, DB, second RE, so voted. 2. Winthrop Street (88-121), Hawthorne Development, Inc., NOI, SE73-2693 Field report states that this filing is for razing the existing buildings (on a lot currently known as #545) and construction of a duplex on a newly created lot. Motion to approve with conditions 1, 2, 3, 4, 5, 7, 8, 16, 17, 19, 21, 25, 26, and 27, DB, second EE, so voted. 3. 30 Mozzone Blvd., Brewer/Commonwealth Alternative Care, Inc., NOI, SE73-2696 Field report states that this project is for the redevelopment of a portion of an existing building zoned as industrial use, to include the construction of additional parking and stormwater BMPs. Work will fall within the 100-foot buffer zone of a BVW which was flagged on 1/10/14 by Sabatia, Inc. using flags WF1 to WF17 and originally approved under DEP file # SE73-2569. The wetland edges remain the same and MR recommends that the delineation be approved again. Prior to the issuance of a building permit, the applicant will be required to close out file #2569 with a COC stating that work had not been completed. The site work will be done on the east half of the building, which is currently vacant, and qualifies as a Redevelopment project under 310 CMR 10.05 (6)(k) to (q). the wetland is located along the south and east of the building, along the edge of the existing pavement. A railroad spur, which is significantly higher in elevation, runs along the southern portion of the property. The BVW along the eastern property line runs to a drain which has an outfall into a wetland system at the end of Mozzone Boulevard at County Street. This runoff is untreated before entering the drainage system. The applicant will be reconfiguring the parking lot and in so doing will be removing pavement along the eastern edge and replacing it with a grass swale and stone filter berm, thus increasing pervious surface on site and providing stormwater attenuation. The runoff will be captured in deep sump catch basins and the grassed channel before being conveyed to the sediment forebay of the detention basin to be constructed along Mozzone Boulevard. This system will maximize TSS (total suspended solids) removal and improve water quality to water channeled to the wetland. A siltation barrier is depicted and is considered the limit of work. As the existing pavement is at the edge of the BVW, work will fall within the 25-foot WPZ. An O&M Plan is included in the filing and should remain as part of the documentation. The stormwater structures will be inspected every two years by the applicant and a report sent to the TCC office. Accumulated silt and sediment will be removed four times a year for the sediment forebay or more frequently if the depth exceeds six inches. Accumulated silt and sediment will be removed from the deep sump catch basins at the same rate. Any accumulated trash and litter shall be removed on a monthly basis. The driveway and parking areas will be swept at least once a year. Snow will be stockpiled within and around areas that drain into the stormwater management system as practicable. The slopes, embankments, and bottom of the extended detention basin shall be mowed at least twice a year. The basins will also be inspected for invasive species, and if discovered, shall be removed mechanically (by hand). Use of chemicals will not be used. The work as presented should pose no negative impact to the adjacent wetlands, but rather improve the quality of water leaving the site with the addition of impervious surfaces and stormwater structures. MR recommends that the TCC approve this project and issue an order of conditions to include the attached special conditions. MR also recommends that the wetland delineation be re-approved. Motion to approve with special conditions 1, 2, 3, 4, 5, 7, 8, 9, 11, 16, 17, 18, 19, 20, 21, 25, 26, 27, and 28-an O&M plan should be part of the deed, MI, second LF, so voted. 4. Hamlen Street (77-331), Nadeau, NOI, SE73- Motion to continue to June 22, 2017, DEP # should be in by then, DB, second MI, so voted. Other Business 1. Friends of Boyden. Motion to get 3 bids for a timed gate that will open and shut at set times and lock, DB, second RE, so voted. 2. Bridge at Boyden. Motion to have MR look into general funds and get information on repairing the bridge, DB, second MI, so voted. 3. Cobb Brook. A wall is collapsing at the side of a garage on an abutters property. MR notified them, address is 470 Cohannet Street. They cannot afford to fix it. The garage and driveway will be compromised if the wall collapses. If the wall does fall it will slow the brook as well. Motion to adjourn, DB, second MI, so voted. Meeting ended at 7:30p.m.
