Minutes of the Taunton Conservation Commission September 14, 2020 Present: Chair Steven Turner, Vice Chair Debra Botellio, Luis Freitas, Jan Rego, Richard Enos, Joshua Borden, Michele Restino, Courtney White. Absent Matthew Haggerty. Motion to approve the minutes of the August meeting, DB, second JB, so voted. Certificate of Compliance: 1. 588 Crane Avenue South, Barbara, (COC), SE73-2663 Motion to issue COC, DB, second JB, so voted. Continued Certificate of Compliance: 1. 511 Richmond Street, Oliveira, (COC), SE73-2710 Rebecca Baptista present. Motion to issue a COC for this project, DB, second JR, so voted. 2. South Boundary Road, Hawthorne Dev. Inc., (COC), SE73-2791 Request for a continuance. Motion to continue to October 19, 2020, JB, second DB, so voted. Continued Public Meeting: 1. MBTA RR ROW, Coutu/Kelois Commuter Services, (RDA), DSE-1239 Request for a continuance. Motion to continue to October 19, 2020, JB, second DB, so voted. Public Meeting: 1. Lot 10 Leona’s Lane (105-278), Bairos/ALE Realty Trust, (RDA), DSE-1240 Present Karen Patenaude. This is for a single family ranch, 30,004 square foot lot, walkout basement, patio, and deck out back. Currently there is a barrier there and it will be maintained or fixed if needed. DB only this area of wetland? Karen yes just on that side of the road. JB how big is that spot? Karen says it is 1600 square feet. Motion to issue a negative determination with special conditions 1, 2, 3, 4, 5, 7, 8, 14, 18, and 19, LF, second DB, so voted. 2. Lot 11 Leona’s Lane (105-279), Bairos/ALE Realty Trust, (RDA), DSE-1243 Karen Patenaude present. This is next door to the previous project. It is a colonial on lot with ILSF. The same erosion control barrier as the other project. Motion to issue a negative determination with special conditions 1, 2, 3, 4, 5, 8, 14, 18, and 19, DB, second JR, so voted. 3. 15 Diniz Drive, Meister, (RDA), DSE-1241 Present Niles Zager. This is for a septic system repair. The current system is 20-25 years old. Motion to issue a negative determination with special conditions 1, 2, 3, 4, 7, 8, 14, 18, and 19, LF, second DB, so voted. 4. 44 Mello’s Farm Road, Capelo, (RDA), DSE-1242 Jose Capelo present. The applicant wants to put in a pool 16X26, and a deck 20X12. DB how far from the wetland? MR said it is 39 feet. Motion to issue a negative determination with special conditions 1, 2, 4, 18, JR, second LF, so voted. 5. 255 Tremont Street, Holmes Family Trust, (RDA), DSE-1244 Brad Fitzgerald present. This is for a septic system repair. JB asked why there are 2 test pits done so far back? Brad said the reason is there is a lot of pavement and they did not want the septic and tanks under the concrete. Motion to issue a negative determination with special conditions 1, 2, 3, 4, 14, LF, second DB, so voted. Continued Public Hearing: 1. 83 First Street, Cabral, (NOI), SE73-2861 Spencer Lynds present. DB asked how big the garage will be? The garage will be 200-250 square feet. LF says you can see there was a garage there at one time, how long since it was there? Lynds is not aware of how long ago, he cannot speak on this for sure. ST would be ok with the addition but bothered by how wet it is out there and to the left behind the addition. JB asked if there was any chance of shrinking the garage 24X24, maybe use the old footprint? LF asked if they still have to see the ZBA first? JR likes the idea of using the old footprint, 24X24. Motion to approve the modified plan with the 24X24 garage (575 square feet) with special conditions 1, 2, 3, 4, 5, 8, 9, 19, 21, 25, 26, 27, 29, 30, and 31-that the garage be no bigger than 24X24, JB, second JR, roll call vote taken: yes votes RE, JR, JB, LF and no vote DB, motion carries 4-1. Joshua Borden was made aware of a possible conflict of interest with the following hearings. He had worked with the company before on a completely different project. To be certain that there was no conflict, he contacted the Board of Ethics, the highest reporting party. He explained the situation to them and was told there is no conflict of interest. He has done absolutely no work with the Run Brook Circle project and can vote impartially on this project. 2. Lot 19, Run Brook Circle, Run Brook Circle Development, LLC, (NOI), SE73- 2865 Present Chris Moniz and Nick Dufresne. Abutter called in, Mike Costa 517 Tremont Street. He was originally told the plan was to plant green giants along the property line. He used to have privacy and now the new houses will be much taller and overlooking his property. Chris Moniz said he is not a direct abutter but he has worked with him. There was a back and forth but its been 9 months, according to Costa, and nothing has been planted. Moniz says it will take a bit longer because they have not even started construction yet but they will plant. Nick Dufresne will add the steps. Motion to approve with special conditions 1, 2, 3, 4, 5, 6, 7, 8, 9, 17, 19, 21, 24, 25, 26, and 27, DB, second JR, so voted. 3. Lot 21 Run Brook Circle, Run Brook Development, LLC, (NOI), SE73-2866 Present Chris Moniz and Nick Dufresne. Dufresne will add stairs. Motion to approve with special conditions 1, 2, 3, 4, 5, 6, 7, 8, 17, 19, 21, 24, 25, 26, 27, DB, second JB, so voted. 4. Lot 22 Run Brook Circle, Run Brook Development, LLC, (NOI), SE73-2867 Present Chris Moniz and Nick Dufresne. DB has no objections except a condition for further development in the back of the house. Chris is ok with that. JB any thoughts on keeping the septic outside of the drainage easement? Nick said it is not actually in the drainage easement and the Board of Health did approve it. JB if Board of Health is ok with it then he is too. Motion to approve with special conditions 1, 2, 3, 4, 5, 6, 7, 9, 11, 17, 19, 21, 24, 25, 26, 27 and 28- no further development behind the house, JR, second DB, so voted. 5. Lot 1 Oaklawn Avenue, Artesani, (NOI), SE73-2870 Niles Zager present. 6. Lot 2 Oaklawn Avenue, Artesani, (NOI), SE73-2868 Niles Zager present. Motion to approve with special conditions 1, 2, 3, 4, 5, 8, 9, 17, 19, 21, 23- plan shows no infiltration of the roofs to be given to the city engineer, 25, 26, 27, 28- plant hardwood along the rear of the property and plant trees/shrubs on the west working with the conservation agent, 29- along the rear 15 foot no cut and along the west side, 5 foot no cut, JR, second JB, so voted. 7. Lot 3 Oaklawn Avenue, Artesani, (NOI), SE73-2869 Niles Zager present. Motion to approve with special conditions 1, 2, 3, 4, 5, 8, 9, 17, 19, 21, 23, 25, 26, 27, 28, and 29, for conditions 23, 28, 29 same as Lots 1 & 2, JB, second JR, so voted. Violation: 1. Hutt Forest, Staples Street. Motion to continue to October 19, 2020, JB, second JR, so voted. Continued Violations: 1. 50 Partridge Circle. Motion to continue to October 19, 2020, JB, second JR, so voted. 2. E. Whitehill & Brook Street. Motion to continue to October 19, 2020, JB, second JR, so voted. 3. Bunk Pond. Motion to continue to October 19, 2020, contact Brandon Silva prior to the meeting and let him know he needs to be present, and he should have the mess out there cleaned up, JR, second JB, so voted. Motion to adjourn, DB, second JB, so voted. Meeting ended at 9:30pm.
