Minutes of the Taunton Conservation Commission May 1, 2023 Present: Chair Steven Turner, Commissioners Joshua Borden, Matthew Haggerty, & Jan Rego. Commissioners Debra Botellio, Richard Enos & Luis Freitas absent. Conservation Agent, Michele Restino & Recording Secretary, Denise Irving also present. Motion to continue the minutes of April 10, 2023 to May 22, 2023 JB, second JR, so voted. CONTINUED CERTIFICATE OF COMPLIANCE: 1. 38 Winthrop Street, Bastis, COC, SE73-2982-to close out Order of Conditions. Motion to continue Certificate of Compliance to 5/22/23 JB, second JR, so voted. 2. 46 Hamlen Street, Sullivan Construction Services, Inc., COC, SE73-2818-to close out Order of Conditions. Motion to approve Certificate of Compliance JB, second JR, so voted. 3. 1404 Cohannet Street, Ferreira Development Group, LLC, COC, SE 73-2953 -to close out Order of Conditions. PUBLIC MEETING: 1. 388 Harvey Street, Boys & Girls Club of Metro South, RDA, DSE-1319 -after the fact filing for construction of a 20’x 29’ steel storage building & new construction of a 12’x 20’ storage shed. Brad Fitzgerald, SFG Associates present. Motion to issue a Negative Determination with Special Conditions 1-4 JB, second MH, so voted. Motion to go out of regular order of business JB, second JR, so voted. AMENDMENT: 1. 391 Winthrop Street, Strojny, AMEND OOC, SE73-2803 -installation of a pylon sign with concrete foundation. Brad Fitzgerald, SFG Associates present. ST: Any issue with completing the work before the Order expires? BF: Should not be an issue. Motion to approve the Amendment to the Order of Conditions with Special Conditions from the Original Order JB, second JR, so voted. Motion to return to the regular order of business JB, second JR, so voted. PUBLIC MEETING: 2. 1561 Glebe Street, Richard Nielsen, RDA, DSE-1320 -prebuilt 22’x 18’ shed. Richard Nielsen, homeowner present. RN: Shed will be 14’x 24’ not 22’x 18’. Motion to issue a Negative Determination with Special Conditions 1-3, & 18 JR, second JB, so voted. EXTENSION: 1. 55 Hamlen Street, Chan, EXT OOC, SE73-2698 -three year extension request. ST: when did you buy the property? KC: 2020 ST: when do you expect to finish? KC: hoping this year. Motion to approve a three year extension to the Original Order of Conditions that will expire on 5/24/26 JB, second MH, so voted. CONTINUED PULIC HEARING: 1. Winthrop Street (Assessor’s 103-28), D.I. Trust II, NOI, SE73-2921 -for one infiltration basin in association with a proposed 135 SFH lot subdivision on parcels in Dighton. Continuance requested by applicant. Motion to continue until 6/12/23 with an update on the progress of the project JB, second MH, so voted. 2. Off Williams Street (Assessor’s Lot 80-67), Mason/Eastside Development, LLC, NOI, SE 73-3037 -proposed construction of a detention basin to capture stormwater from Maynard & Hunter Streets. No one present. John DeSousa is out of town. Dennis Bartel, 133 Williams Street, abutter present and was allowed to speak. DB: I am not opposed to the project as long as there is no negative impact to my property. His concerns are what type of study they did and where the water will flow. MR: MR & JB visited the site and that’s also our concerns. There is a lot of water. JB: would like a report from the City Engineer, Mike Patneaude or he can attend meeting if he would prefer. ST: If John DeSousa has any questions he can contact MR. Again, Mr. Bartel states he has no opposition if it’s built properly and does not negatively impact his property in any way. Motion to continue until 6/12/23 with an existing conditions plan in addition to all that MR has requested. All information requested is to be submitted to MR no later than 11:00 AM 6/2/23 Friday for review. JB, second JR, so voted. PUBLIC HEARING: 1. 205 Myricks Street, 788 Boston Road, LLC, NOI, SE73-3043 -replacement of existing septic system with a new subsurface sewage system. Jason Youngquist, Outback Engineering & Mickey Higgins, 788 Boston Road present. ST: Is this the Star Drive In? MH: yes ST: When will you be starting work? MH: probably after the summer season. ST: Let MR know when BOH says ok and you are ready to begin. Motion to approve the Order of Conditions with Special Conditions 1-5, 19, 21, & 25-27 JB, second MH, so voted. 2. Willis Pond Road (Assessor’s 37-48), NOI, SE73- 3044 -construction of a single family home with driveway, utilities & associated grading. Tracy Duarte, MBL present. JB: Disclosure – Have done work in the past for Aspen, not involved in this, no monetary value here. Would like to sit in where there are only 4 members present tonight. ST: Will allow JB to vote if that is OK with Tracy. TD: Yes it is ok. Motion to approve the Order of Conditions with the Special Conditions 1-6, 9, 17, 19, 21, 25-27 JB, second JR, so voted. CONTINUED VIOLATION: 1. 155 Field Street – with restoration plan – Linda Mackinaw & Edmund Hathaway present. LM: Devon is in the hospital and couldn’t be here. MR: We have discussed what we are going to be doing to resolve this. ST: Let’s continue this so that Devon can get back to health. Motion to continue to 7/17/23 JB, second JR, so voted. 2. 16 Park Street – No one present. Motion to continue to 5/22/23 and send certified letter stating they must be present JB, second JR, so voted. OTHER BUSINESS: 1. Fremont Street Update from Conservation Agent. Motion to remove from agenda as closed JB, second JR, so voted. Motion to adjourn pending all signatures on paperwork 6:50 pm JB, second JR, so voted.
