Minutes of the Taunton Conservation Commission March 4, 2024 Present: Chair Steven Turner, Vice-Chair Debra Botellio, Commissioners Joshua Borden, Richard Enos, Matthew Haggerty, & Jan Rego. Commissioner Luis Freitas absent. Conservation Agent, Michele Restino & Recording Secretary, Denise Irving also present. Motion to approve the minutes of February 5, 2024 DB, second JB, so voted. CERTIFICATE OF COMPLIANCE: 1. 118 Summer Street, Dorsey, COC, SE73-2792-to close out Order of Conditions. Motion to approve the Certificate of Compliance DB, second RE, so voted. Documents: Plan, Field Report 2. 48 Herbert Street, Mota, COC, SE73-2947-to close out Order of Conditions. Motion to approve the Certificate of Compliance DB, second JB, so voted. Documents: Plan, Field Report 3. Burt Street (Assessor’s Lot 61-11), Binda/Binda Realty, LLC, COC, SE73-3053 -to close out Order of Conditions – NO WORK DONE. Motion to approve the Certificate of Compliance – No Work Done DB, second MH, so voted. Documents: Field Report JB steps down AMENDMENT: 1. Norton Avenue Lot 2 (Assessor’s Lot 45-1 & 16), Moniz/ MRH Development, LLC, AMEND, SE73-3032 -to allow the construction of an onsite septic system, well, relocation of proposed dwelling, retaining walls, and fill. Chris Moniz, MRH Development, LLC present. DB: Is this moved farther away from the wetland? CM: yes. Motion to approve the Amendment to the Order of Conditions, all previous Special Conditions remain in effect JR, second DB, so voted. Documents: Plan, Field Report, Legal Ad JB steps back in JB disclosure: has done work for Chris Moniz but has no financial interest in this project. EXTENSION: 1. Millview Street (Roadway formerly Assessor’s Lots 38-108 & 125), Mill River Development, LLC, EXT OOC, SE73-2828 -requesting a three year extension. Chris Moniz, MRH Development, LLC present. Motion to approve a three year extension to the Order of Conditions to expire 2/25/27 All Special Conditions to remain in effect. DB, second JB, so voted. Documents: Field Report 2. 0 & 2318 Bay Street, TK Taunton, LLC, EXT OOC, SE73-2819 -requesting a three year extension. Jamie Bissonette, Zenith Consulting Engineers present. Motion to approve a three year extension to the Order of Conditions to expire 5/11/27 All Special Conditions to remain in effect. JB, second RE, DB votes no, motion carries. Documents: Field Report PUBLIC HEARING: 1. 43R Chandler Ave. (Assessor’s Lot 54-459), Pernock/Live & Learn Ventures, LLC, NOI, SE73-3071-construct a 2 family duplex style dwelling. Richard Riccio, Field Engineering present. RR: Building and pavement have been reduced. Motion to approve the Order of Conditions with Special Conditions 1-7, 16, 17, 19, 21, 23, 25-27, 39, 45, & 47 DB, second JB, so voted. Documents: Plan, Field Report, Legal Ad 2. 555 Burt Street, Lombardi, NOI, SE73-3074 -septic system repair, associated grading, and driveway reconstruction. Brad Fitzgerald, SFG Associates present. Motion to approve the Order of Conditions with Special Conditions 1-5, 19, 21, & 25-27 DB, second MH, so voted. Documents: Plan, Field Report, Legal Ad 3. Burt Street (Assessor’s Lot 61-11), Binda/Binda Realty, LLC, NOI, SE73-3073 -construction of a SFH with garage, driveway, associated grading, and utilities. Mike Binda, Owner and Scott Faria, JK Holmgren Engineering present. DB: what is the closest point to the wetlands? ST: I will read MR’s report and that should answer your question. DB: yes. That answers my question. Motion to approve the Order of Conditions with Special Conditions 1-6, 8, 9, 17, 19, 21, & 25-27 JR, second DB so voted. Documents: Plan, Field Report, Legal Ad VIOLATIONS: 1. 250 Lakeview Avenue Peter Waterman, owner & Debra Lettner present. PW: not denying that the violation occurred. I did start grading before replacing the barrier. The barrier has now been replaced. MR: visited site, grading & flood vents are needed to satisfy to get occupancy. ST: are you living there? PW: no ST: you have owned the house for 4 years? PW: owned the old house since 2008 ST: we want to make sure everything is done properly MR: how will you bring this back? MH: the house was built at the wrong elevation? MR: yes it has to meet building requirements PW: only needed 6’ but I went 20’ will need to fill. RE: where did you put the soil? PW: the front yard and side yard. RE: is the soil covered? MR are you worried about run off? MR: yes that is a concern. RE: you might want to cover it. ST: where do you live now? PW: Sometimes in my truck or stay with my ex-wife. JR: so we want to bring that to 6’? MR: he needs to fill it back but also needs to meet the requirements for the flood control. ST: What’s your timeline? DL: Need at least a month ST: til our next meeting on 4/22/24 JR: grass and no patio? PW: no patio RE: Whenever you are going to do something you need to call MR and stay in touch with her on the progress JB: erosion controls is place? MR: yes MH: Are you clear where you need to be with the soil? PW: yes ST: You are clear on this and don’t need any assistance Motion to continue the Violation until 4/22/24 and must stay in contact with MR during the process JB, second DB, so voted. OTHER BUSINESS: 1. Discussion – Marla Isaac Education Center/ Dedication DB: What would the Commission like on the plaque? ST: Would like you to take the lead on this. Please do what you think is appropriate. DB: Dedication in May? But will need to talk to Marla’s son Jason and see what the Mayor’s schedule is. 2. Dumping of materials along the River (by Berkley Beer Company) ST: Received a call from Berkley Beer Company that a contractor doing driveway paving had dumped along the bank of the river. JB: Was that the Binda property? MR: yes but he had no knowledge of the dumping, it was the contractor that did the dumping and needs to be cleaned up. ST: Put on the agenda for 4/1/24 for follow up discussion. 3. Boyden Wildlife Refuge MR: There are now security cameras for the Arthur Bent Cabin at the Boyden Refuge.
