************************************************************ TAUNTON PLANNING BOARD MINUTES CITY HALL, TAUNTON, MA 02780 Meeting held at Maxham School, 141 Oak St, ************************************************************* DATE: April 6, 2017 BOARD MEMBERS: Bob Campbell, Chairman Anthony Abreau Arthur Lopes Jordan H.F. Fiore Manuel Spencer, Clerk Brian Carr Dennis Smith ADVISORS: Mark Slusarz, City Engineer Kevin Scanlon, City Planner __________________________________________________________________________ Roll Call: Carr, Smith, Lopes, Fiore, Spencer, Abreau, and Campbell present. Meeting opens 5:30 PM Public Meeting – Site Plan Review - 295 Constitution Drive - for the construction of a 56,375 square foot office/warehouse building with off street parking, submitted by Robert Turner, TB Partners, LLC. Clerk Spencer read the DIRB comments into the record. Ken Motta was invited into the enclosure. He staed#9 of the DIRB states he needs a hazardous materials permit. He suggests changing language if needed by the Board of Health. Ken suggested changing condition #2 to read 6 foot green slated chain link fence and Chairman Campbell said they can remove condition # 8 & 10 because they submitted updated plans. Ken stated this is the old HP Hood site and they are looking to redevelop and have a 56,375 sq. ft. office and light manufacturing warehouse area. They will be expanding the parking to 74 spaces and provide more landscaping and more green space. They will be maintaining the existing greenery on the Eisenberg property side. Tony made motion to approve the Site Plan Revie with the DIRB comments: seconded by Jody. All in favor. Condition #1) That the plans dated February 28, 2017 and revised on March 29, 2017 shall govern with the following additional conditions; Condition #2) The dumpster shall be located on a concrete pad, be enclosed with a 6 foot green slated chain link fence, be kept closed at all times and be emptied regularly. Condition #3) Lighting shall not illuminate any portion of abutting properties Condition #4) The site shall be kept clean and clear of debris Condition #5) Two set of as-builts shall be submitted upon completion of all work on site prior to occupancy permit and shall include design engineer and land surveyor certification notes stating the development has been built according to the approved plans. Plans will show all construction of buildings, utilities, grades, setbacks etc Condition #6) Two sets of updated plans shall be submitted that conforms to all of the requirements of this decision before any building permits are issued. Two sets are required Condition #7) The patio area shall be handicap accessible from the building 1 Condition #8) A hazardous materials permit must be obtained if required from the Board of Health Condition #9) A sign stating truck entrance 300 feet ahead shall be added at the southerly entrance Special Permit – 67 Summer St. – 4-family in an Urban Residential District- need to forward a recommendation to the Municipal Council Clerk Spencer read dept. comments from the Fire Dept., Conservation Agent, Board of Health, City Planner which were placed on file. Shawn Gilmer, Trustee and Atty. Matt Costa were invited into the enclosure. Atty. Costa stated they need a Special Permit for a 4 family use from the Council. They went to ZBA and was approved for lot size. Atty. Costa stated Mr. Gilmer bought the property in 2009 and the 4th basement apartment was not documented. There was a fire and during the re-construction it was discovered the 4th unit was never documented so they want to make it legal. Jody asked if the insurance is helping pay for the re-construction and Atty. Costa answers he‘s not sure but thinks so. Chairman Campbell asked if the insurance covered 4 units? Atty. Costa stated he has insurance claim for re-construction. He stated according to the Assessor and building dept. it’s a 3 family and the basement used as an accessory to another apartment. There are 2 units on first floor, one on second floor and basement unit is a walkout and has been occupied for years. Chairman Campbell questioned the accessibility of the parking? Atty. Costa stated the engineer drew the parking based on what is there now. There was some discussion on if the parking will work and Atty. Costa mentioned the topography and the drop in the backyard. He states he is unaware of any parking issues. It was suggested looking at the parking and making it more useable. It was noted they needed to upgrade sprinklers and will be doing a NOI with Conservation Commission for dumpster on pad. Manny asked how many bedrooms? Atty Costa answers 1 BR & 3 BR apartment on first floor, 2nd floor has 1 BR and basement apartment has 2 Bedrooms. Brian asked if there are any lines designating the spaces? Atty. Costa stated they could stripe if required. Jody stated the shape of the parking area is dictated by the wetlands in back and the topography. Motion made and seconded to forward a positive recommendation to Council with the condition that improvements be made to the parking plan for 8 vehicles. Mello’s Farm Road – E-5 – Request to release last lot – holding $200,000 plus $24,000 mylar deposit Clerk Spencer read dept. comments from the City Engineer, City Planner and outside consultant into the record. The developer is looking to release last lot and we are holding $200,000. Motion made and seconded to release last lot and also release $30,000 of the surety. All in favor. Dever Drive – Need to forward recommendation to Municipal Council for street acceptance - on 11-3- 16 P.B. voted to release all monies. Tony brought to the Board’s attention the road is crumbling and he suggests having it inspected by the City Engineer and postpone accepting this street. Motion made and seconded to continue until next month and have the City Engineer inspect the roadway and resolve the issue before the Board will forward a recommendation to council for street acceptance. Roadway Improvement Plan – Hoover Street – completion of work – requesting approval for building permits. Letters from the City Planner, Engineer, Conservation Commission were read into the record. Joe Malloch was invited into the enclosure. Bob stated the reverse crown stops short on the cul-de-sac near the hydrant side. He suggest fixing it so it won’t puddle. There was some discussion about working with the City Engineer to come up with the best solution. 2 Motion made and seconded to issue building permits and have the developer work with the City Engineer to find the best solution to correct the existing puddling at the cul-de-sac near the hydrant. All in favor. Cont’d. Public Meeting - Ben Street Roadway Improvement Plan – proposal is to improve 191 feet of the roadway at a width of 18 feet to create 2 residential lots. Letter requesting continuance until June. Motion made and second to grant continuance to June 1st. FYI: Communication from Division of Fisheries & Wildlife – Draft Priority Habitat Map of Rare species – available for public comment – April 3rd – June 3rd. Placed on file. FYI: Communication from MassDOT – South Coast Rail – Notice of Availability for the south Coast Rail’s Notice of Project Change – comment period 3-22-17 thru 4-21-17. There was discussion on the interim project change. Motion made and seconded to have the Board draft letter informing them of the Board’s disappointment in the changes. Chairman Campbell asks all Board members to submit their concerns and he will draft letter. Meeting adjourned at 6:30 PM 3
