Chairman Campbell read statement: “Tonight’s Planning Board meeting is being conducted remotely
consistent with Gov. Bakers Exec. Orders due to the current State of Emergency in the CW.
In order to mitigate the transmission of the COVID-19 virus, we have been advised and directed by the CW
to suspend public gatherings, and as such, the meetings in a publicly accessible physical location.
Accommodations for public access have been made via livestreaming, and this meeting is also being
recorded.
Public Hearing – Special Permit/Site Plan Review - 403 Winthrop Street for a change of use from
Restaurant to Bank with a drive-up window, submitted by Peter Ambrose, Taunton Federal Credit
Union.

Chairman Campbell read dept. comments from the DIRB, Historic District Commission and TMLP which
were placed on file. Brad Fitzgerald, P.E. SFG Associates, Inc., 28 Main St., Lakeville, Ma. representing
Taunton Federal Credit Union. Brad stated the former Dunkin Donuts has a drive up window and the
Taunton Federal Credit Union purchased the property and now wishes to have a bank with drive up and
lobby service. He stated there is 15 parking spaces and per zoning they only need 5 spaces. They will be
pulling out concrete pad and put a little bigger one to accommodate 2 lanes for drive –thru. There will be no
change in the drainage and the bumper strip will remain. They have gone to Conservation Commission and
received Order of Condition. Brad anticipates it will be less traffic than the former dunkin donuts. Manny
stated he’s satisfied with the plan and presentation. Open public input: No one in favor or opposed. Close
public input.
John made motion to approve the SP/SPR with all Dept. comments. Seconded by Arthur. All in favor.
Condition #1) That the plans dated June 5, 2020 and revised through June 15, 2020 shall govern with the
following additional conditions:
Condition #2) Lighting shall not illuminate any portion of abutting properties.
Condition #3) The site shall be kept clean and clear of debris.

Condition #4) Two sets of as-builts shall be submitted upon occupancy for all work on site and shall include
design engineer and land surveyor certification notes stating the development has been built according to the
approved plans. Plans will show all construction of buildings, utilities, grades, setbacks etc
Condition #5) Two sets of updated plans shall be provided that conforms to this decision prior to Building
permit.
Condition #6) Dumpsters shall be located on a concrete pad, enclosed with a 6 foot stockade fence, be kept
closed at all times and emptied regularly.
Condition #7) Any changes to the water service would require DPW permits, city licensed contractor, road
opening and trench permits and must conform to DPW Water specifications including materials, installation,
inspection and testing.
Condition #8) Compliance with the Conservation Commission Order of Conditions Number 2856.

Public Hearing – Modification of Massasoit Estates –Special Permit Inclusionary Cluster Subdivision
– to amend Condition #2 which required all lots to have individual leaching fields on each individual
lot. The modification is to construct a common leaching field for the entire subdivision and also the
installation of a sewer system in the roadway to convey sewerage from the septic tanks located on each
lot within the development to the common leaching field on premises situated at 945 Middleboro
Avenue, E. Taunton, Ma. known as Assessor’s Map 111, Lot 112.
Hearing opens at 5:48 PM. Roll call: Ackerman, Lopes, Spencer, Reardon, Campbell and Tony. Chairman
Campbell read public hearing notice, dept. comments from the City Engineer, Conservation Commission
Water Dept. which were placed of file. Jeff Tallman, Sitec Eng. And developer Steve Figueiredo invited into
the meeting. Jeff stated after they received P.B. approval for Definitive Inclusionary Cluster development
they did soil testing and it wasn’t consistently 4 feet deep per B.O.H Title 5 rules. Then they thought of
putting a common septic in the rear with the deepest soils is. They would install a sewer main in the ROW
and have a common leaching field. Jeff stated they have revised the plans and designed a sewer main and
leaching field and will submit to the B.O.H. and he doesn’t see any concerns. Jeff stated they were waiting
for this approval then they will proceed to the B.O.H. Manny asked if there would be a septic tank on each
property and all go to one leaching field? Jeff stated the whole site has sand issue and had poor Title 5 with
it not having 4 feet deep , with some places having 3 ½ feet deep. He said he spent a day and half out there
trying to get each lot to see what they have. Lots 11, 12, 13, and 14 have the deepest amount of sand which
will require quite a bit of grading. He stated the houses will most likely have walkout basements. Per rates
were less than 2 minutes and the homeowner’s association will be responsible for drainage and a portion of
the septic system and leaching field. Manny asked about lot 13 that has a lot for water. Jeff explained each
lot will have an individual tank and one common leaching field. Jeff said to minimize the grading they will
place the leaching field in the front of the lot close to the road. If we had to put it in back it would not be
good. Manny asked what happens if there is a problem? All disposal will be from lot 13 and the sewer will
not go into the sewer system. The homeowner’s will be responsible and will most likely hire a company to
monitor it and will probably have an alarm system. If any issues they will come right out and fix it. Jeff
stated there will be no sewer fees to the City. Dennis stated he’s in favor of the project but has concerns.
He feels uncomfortable with the 4-5 lots in the rear and suggest those lots have own service and then then the
lots in front have common one. He has been contacted by several neighbors. He stated the B.O.H should
have approved this before it coming here. Jeff stated this is no different than each lot having to perc. Dennis
feels uncomfortable approving this at this time because he hasn’t had a chance to view plans due to computer

issues. Jeff stated what Dennis suggested having some lots on own system and some on common system
becomes a legal nightmare. Dennis stated they would get more for the lots if they had their own system.
Steve Figueiredo said there is a good possibility sewer will be going in near the Airport and he could use to
connect to his property. Steve said the amendment tonight is for the sewer line to go in the ROW for
possible connection in the future. It would be in his best interest to bring sewer to his project which will be
about 1,600 feet with stubs along the way. Chairman Campbell stated the sewer designed for this is not
designed for city sewer. Tony stated the common sewer is in “Matthews Drive” and they have had issues
with that. Tony said if the timeline is right and sewer goes in near airport through that is good but if not he
can put sewer in on his own he would have to leave stubs. There was discussion about the low pressure main
heading down 4 feet from subdivision and then it drops off 10 inches near Richmond Pond. Chairman
Campbell suggests putting in gravity system and have a low pressure installed. Currently there is a 2 inch
system to a septic area going down the road. They could start the leaching field and put sewer on top of it.
Jeff stated they can’t put a low pressure in. The Board asked the developer what he wants? Tony stated the
shared systems work and best base case they tie into city sewer which would be costly. Jeff stated they are
asking to amend #2 of the approval stating each lot have their own septic system and allow a change to use a
common leaching field. It was suggested going to the B.O.H for approval and then come back here. Jeff
stated he feels confidence that the B.O.H will approve but they send it out to outside consultant (Presbrey
Company) to review and that takes a couple of weeks. Chairman Campbell pointed out the P.B.R&R require
the BOH approval prior to subdivision approval and it was overlook and now they need to get BOH approval.
He stated there are outstanding issues. Public Input: Maria Dimakis, 915 Middleboro Ave. had questions
about lots 11, 12, and 13 and how the common leaching field will work? Will there be a reserve leaching
field in case they need it? Jeff sated they have room for a replacement and the homeowners associations will
take care of it. There will be monies in the associations to make sure there is funding in case they need it.
She stated he might lose a lot when the B.O.H reviews it. She asked if the houses would have a garbage
disposal and Jeff answers no. Dennis suggests leaving public input open and continue to August and have
them go to B.O.H. for approval. Jeff stated they will submit the info to the B.O.H but he’s not sure they
will have it all approved.
Dennis made motion to continue to next month, seconded by John. All in favor

Public Hearing – Special Permit- Winthrop Street Assessor’s Map 101 Lot 27 – A Special Permit from
Section 440 Attachment # 1 of the Zoning Ordinance for a 3 family use on the proposed 7 lots ( total 21
units) in a Highway Business District, submitted by Jeffrey Terra, Trustee
Hearing opens at 6:53 PM – Roll call: Spencer, Lopes, Reardon, Abreau, Ackerman, Campbell present.
Chairman Campbell reads the dept. comments from Conservation Commission, Water Dept., City Planner,
B.O.H, T.M.L.P which were placed on file. Jeff Tallman, Sitec Engineering representing petitioner. Jeff
stated the will need to file a Definitive Subdivision plan if approved to create the lots. He stated lot 7 will be
an ANR plan because it has frontage on Winthrop Street but will access off new road. The site consists of
5.29 acres about 800 feet east of Dighton line. The property is in the Highway Business District and has
some resource areas and is bordering vegetated wetlands and will need Conservation Commission approval.
They are proposing a residential subdivision with water and sewer. They need the Special Permit for the uses
before they file a Definitive Subdivision. Dennis stated the proposal is cut and dry. Open Public Input:

resident (Toby) from 1285 Burt St. called in to say there are a lot of issues with the water table in the area.
He stated they put the solar panels across the street they said they weren’t going to be a problem and now
there are water issues. His neighbor runs their sump pump 24/7. He’s concerns with flooding and doesn’t
want the neighborhood to flood. Jeff stated the concept is to allow us to more forward and they will analyze
the drainage out there but the first step if the Special permit for use then file a Definitive Subdivision. Jeff
stated they will show they are not going to affect the drainage and they will design it using the existing
contours and the low point is pitching away from his property. Toby said they are now paying the price due
to the solar panels going in. He purchased house in 1986 for the country setting and now there is all houses
around. It was asked what the cost of the houses will be? Chris Moniz, representing petitioner answers
between $325,000 and 335,000. Opposed: Gerald Dallaire, 1265 Burt St. stated there are water issues there
now. He stated when the solar panels went in it cost him money and now they want to put all these houses
in. Dennis stated the developer would be putting in upscale homes and will do a good job. Mr. Dallaire
stated it sounds like Dennis is marketing for the developer. Jeff stated they haven’t really gotten into the
design of the drainage but it’s out duty to make sure it works. Dennis suggests to Jeff to look at the 2
abutters across the street to see they can straighten out their problem. Jeff said they will be willing to look
and see if it’s something we can do to help. Dennis suggests looking at it to be a good neighbor. Mr.
Dellaire heard this before and stuff promised was never done with the solar panels, the guys is in Georgia.
Chairman Campbell suggests looking at putting an intercepting subdrain between the buildings and the
easterly and southerly property lines to ensure that groundwater flow is directed toward the river. Mr.
Dellaire asked if he wanted to see 2 floor he would have move downtown. Public Input closed.
Dennis made motion to approve the Special Permit with the following conditions, seconed by Tony. All in
favor.
Condition #1) The property will be serviced by Municipal Water and Sewer. All dwellings must
comply with the Minimum Standards of Fitness for Human Habitation, State Sanitary Code, Chapter
II.
Condition #2) A flow test shall be performed before the design approval is considered to confirm the
size and length of the main extension that would be allowed.
Condition #3) A MassDOT Road Opening Permit would be required to tie-in to the existing City
Water in Winthrop Street/Route 44. The permit application and the permit granted shall be
forwarded to the Planning Board.
Condition #4) A City Licensed Contractor will be required to perform all work on City Water.
Condition #5) A DPW Trench Permit will be required to perform all work on City Water.
Condition #6) DPW Water Specifications will apply including: design, materials, installation, and
inspection/testing.
Condition #7) Each unit will require an individual City Water service, with three (3) services with
individual meters per triplex.
Condition #8) The property is within the 200-foot Riverfront Area of the Segreganset River, an
associated Bordering Vegetated Wetland, and 100-year Flood Zone, which will require a Notice of
Intent for three of the proposed triplexes and for the proposed subdivision road.
Condition #9) The continguous dry area shall be shown for each lot.
Condition #10) The plus/minus notation on the acreage shall be removed.
Condition #11) The access easement for Lot 7 shall be on either lot 6 or lot 7 to eliminate the need for
a common driveway special permit.
Condition #12) A homeowner’s association will be required to maintain the drainage basins since they
straddle multiple lots.
Condition#13) An intercepting subdrain between the buildings and the easterly and southerly
property lines will be required to ensure that groundwater flow is directed toward the river.

Condition #14) This Special Permit is subject to the creation of the lots through the approval of a
Definitive Subdivision Plan.

Public Hearing - 52 Sakonet Ave - Special Permit from Section 440 -710 of the Zoning Ordinance for
an 846 sq. ft. accessory dwelling unit in a Rural Residential District, submitted by Peter Avery.
Roll call: Spencer, Lopes, Reardon, Ackerman, Abreau, Campbell present. Hearing opens at 7:31 PM
Chairman Campbell reads dept. comments from Water, Conservation Commission, B.O.H., Historic District
Commission, and City Planner which were placed on file. Atty. Dan deAbreu, and Tom Pozerski, P.E.
Merrill Engineering representing petitioner. This property is located in Powhattan Estates which was
approved under a 40B project. They are proposing an 846 square foot addition for Mr. Avery to reside.
They have 6 parking spaces and only need 4. One of the means of egress will be through the breezeway.
They will be using the existing utilities but may have to re-locate some electrical. Tom said if anything needs
upgrading per the water dept. letter they will do it. Dennis asked if they were aware this needs to be renewed
every 5 years and Atty. deAbreu answered yes they are aware of that. Open public input. No one in favor or
in opposition. Public input closed.
Manny made motion to grant the Special Permit with the dept. comments, seconded by Dennis. All in favor.
Condition #1) If municipal sewer is not available. The lot would need to construct or upgrade an on-
site septic system with appropriate setback requirements and buffers in accordance with Title 5
regulations, to accommodate the addition of a bedroom. The dwellings must comply with the
Minimum Standards of Fitness for Human Habitation, State Sanitary Code, Chapter II.
Condition #2) Maintain sidewalk grades through proposed driveway
Condition #3) A new curb cut will be required from the DPW.
Condition #4) The additional bedroom will require an I & I fee from the DPW.
Condition #5) No new work can occur above the existing City Water lines.
Condition #6) DPW Water Specifications would apply if the existing water lines need to be changed,
including,: design, materials, installation, and section/testing.
Condition #7) If the existing City Water Lines need to be changed, a City Licensed Contractor will be
required to do the work and DPW Road Opening and or Trench Permits.

Public Meeting – 396 Winthrop St. - A Site Plan Review for property at 396 Winthrop Street for
change of use of an existing 693 sq. ft. building from Office Use to Hair Salon, submitted by Aafaque
Akhter, owned by 16 Legion, LLC.
Chairman Campbell reads the dept. comments from the DIRB and water department which were placed on
file. Jack Tabares, Farland Corp. representing petitioner. They wish to change the previously approved use
as office to a hair salon. They are proposing 4 hair stylists all by appointment only. Each appointment
usually lasts between 45 – 60 minutes. Hours of operation Monday – Saturday 9-6. Chairman Campbell
asked where the free-standing sign will go? It was stated they would comply with the sign ordinance and not
obstruct any view. Tony stated he’s ok with the project as long as they show water and sewer on plans.
John asked where would be put snow? It was stated they can put it near the guard rail. Open public Input:
No one in favor or opposed. Public Input closed.

Public Meeting - 350 Revolutionary Drive – A Site Plan Review for the construction of parking areas
with associated and drainage improvements to support the operations of a potential tenant for the
existing building, submitted by JCC 350 Revolutionary Drive.
Chairman Campbell dept. comments from the DIRB, Water Dept., Engineer and Historic District
Commission which were placed on file. Bob Field, P.E., Field Engineer representing applicant. They are
adding 44 van spaces to the south of the building and some drainage improvements. Bob stated the basin
was designed for full buildout and they will modify the outlet and go to Conservation Commission for RDA.
Bob states he has no issue with DIRB comments. They will provide updated plans. Tony, Manny and
Dennis stated they are all set. Open public input: No one in favor or in opposition. Public input closed.
John made motion to approve the SPR for 350 Revolutionary Drive with the dept. comments, seconded by
Manny, all in favor.
Condition #1) That the plans dated June 5, 2020 shall govern with the following additional conditions:

match the proposed grade will have to be completed by a City Licensed Contractor with a valid trench Permit
from DPW.
Condition #8) Proposed improvements over existing water lines must follow DPW Water specifications to
prevent utility conflicts.
Condition #9) Compliance with the Conservation Commission decision number DES-1233.

Condition #10) Show all egress points and doors on final plan.
Condition #11) Show free-standing sign on the plan.
Condition #12) Strict adherence to the Post Construction Operation and Maintenance Plan is required.
Public Meeting – Site Plan Review – 44 Dean St. Prop. I.D. 55-756 and 55-757 – for a 3 story 36 unit
residential apartment building with 80 space parking lot, with utilities, stormwater management,
landscaping and associated grading. Submitted by Mohiuddin Ahmed, owned by Konako Dev. LLC
& Kenneth Effron.
Chairman Campbell read dept. comments from DIRB, Historic District Commission, TMLP, and City
Engineer which were placed on file. Nick Dufrense, P.E., Farland Corp. representing petitioner. He stated
the project consists of 2 parcels and the site is currently abandoned with a house located in the front and an
abandoned garage. They are proposing a 36 unit residential building and have received Council in approved
but the approval will expired in Dec. 2020. The plans show 80 parking spaces (72 required) and will be
service by municipal sewer and water and all stormwater will be contained on site. They will erect a 6 foot
privacy fence and landscaping. They are seeking a 50% landscaping waiver as shown on the plans. Manny
stated this property was subject to a zoning change making it in the transient development zone. He
remembers the Planning Board recommending less numbers that what was approved. The Council approved
36 units and there is nothing we can do about it now. Dennis asked if the site was contaminated? He stated
there is a big traffic issues in this area and asked if a traffic study was done? Nick stated there was traffic
study done and that was provided to the Council. Nick stated it was initially for 60 units and then they
reduced it so it would show a reduction. Manny asked about the water in the rear. Nick said they would be
containing on the water on site per the City Engineer. Manny asked who the owner is? Nick stated he is
representing the potential buyer. The property was approved and put on the market and now has a buyer.
Manny asked about the landscaping waiver they are asking for? Nick pointed out the plans shows 7 ½ feet
on most of the property and 11 ½ - 15 feet in rear. Nick stated the hazardous waste has been clean up and
DEP is monitoring the site. Chairman Campbell pointed out on the elevation plans needs correcting. You
should show contours on adjacent property. Nick stated any additional runoff is going to be contained and
there will be no more than what is there now, it’s going in the same place. The elevation is close to the 100
years storm (flood election 13 feet and bottom of basin is 12 feet) It was asked if the develop will be
removing the buildings and it was answered yes they are pretty dilapidated. It was mentioned they would
need Historic District commission approval to remove the building. Chairman Campbell asked if there was
any accessible walkway and it was answered no. There is an active railroad there and it was suggested
putting fencing around to protect as well as privacy. Nick stated a fence would not be sound proof and he
think the building itself will be insulation. It was asked about the driveway and it being so wide and Nick
said that is what DOT wanted. They are going to the Historic District Commission at the end of month.
Manny asked about the fire department’s comments relative to one entrance and one exit. Nick pointed out
they only have frontage on Dean Street, not Arlington Street. The 24 foot wide driveway is per Mass DOT
standards. Manny says he remembers this going to the Council in 2016 and asked why hasn’t it been
developed? Dennis stated he remember is going to ZBA for landscaping buffer and was denied and they
wanted 28 units not 36 units. Then the Planning Board sent their recommendation in for 32 units and the
Council approved 36 units. Nick stated they are not asking for any parking waivers. Dennis suggests the
Board not approve the landscaping waiver (as presented on the plans. the DIRB can waiver50% reduction).

Chairman Campbell stated if the Board wishes to not grant the landscaping waiver they need a reason
relating the landscaping, not because the Board doesn’t agree with the Councils approval for 36 units.

Condition#4) Two sets of As-Builts shall be submitted upon occupancy for all work on site and shall
include design engineer and land surveyor certification notes stating the development has been built in
according to the approved plans. Plans will show all construction of buildings, utilities, grades,
setbacks, etc.
Condition #5) Two sets of updates plans shall be provided that conforms to this decision prior to
issuance of a building permit.
Condition #6) Dumpsters shall be shown on the plan, located on a concrete pad, enclosed with a 6 foot

Condition #7) DPW Permits will be required for all utilities including city licensed contractor, road

Condition #8) A filing with the Conservation is required.
Condition #9) A new curb cut filing is required from Mass DOT and a copy shall be provided prior to
issuance of a building permit.
Condition # 10) Existing City Water service shall be cut and shut off at the corporation stop.
Condition #11) A fire flow test will be to be performed on the nearest hydrant to confirm sizing.
Condition #12) Proper backflow protection shall be required on the fire protection.
Condition #13) Sanitary Sewer service plans shall show an inside drop into the existing sewer
manhole and outside cleanout off the building to meet current sanitary sewer standards.
Condition #14) The parcels shall be combined via a recorded plan and updated deed prior to building
permit.
Condition #15) The geometry of the driveway access at Dean Street shall be detailed on the plan and
shall show right-turn-only with a “delta island” for exiting traffic, subject to approval by Mass DOT.
The MassDOT permit application and permit conditions shall be forwarded to the Planning Board.
Condition #16) Show the edge treatment at the edge or pavement along bio-retention area 1.
Condition #17) Maintain 100 percent of increased site drainage on the site and show the grading of
adjacent sites sufficiently to determine existing runoff flow paths.
Condition #18) The sewer connection to the City’s Sewer will require payment of the

Condition #19) The soil logs from the soil investigations performed shall be included in the drainage
package and shown on the drainage sheet. Add wetland flags to the plan.
Condition #20) The structure is located in the Historic District and will require an open public
hearing with the Historic District Commission.
Condition #22) Submit an updated traffic study based upon the reduced number of units to the

Modification of Special Permit – 144 W. Britannia St. 800 sq. ft. marijuana manufacturing to add
delivery – submitted by Freshly Baked Company. Need to forward a recommendation to the
Municipal Council
Phil Smith, 144 W. Britannia St. stating they are requesting a Special Permit from Council to add delivery
their 800 sq. ft. manufacturing marijuana business, Freshly Baked Company. They might be looking to add
cultivation later but now they wish to add delivery to their business. The only change will be adding 2
security cameras. They have a guard shack where the vehicles will load up and there will be 1- 4 max
delivery vehicles. They will work 7 days a week and have no deliveries before 8 AM and will have 7
employees. Tony asked if they would be deliveries their products, and it was answers yes (gummys) John
asked if the Police Chief is aware of this and it was stated he’s on the referral form so he gets a copy. It was
stated the delivery people do not carry cash. It’s all done by e-commerce delivery with either a debit card or
credit card. There an app that they will pay through. The customer places an order and they are sent a text
to register, answer questions and then the ID. Is verified. There is a limit on 1 ounce per day that one person
can get. The system flags someone if they try to buy more and residential addressed are limited. They
cannot delivery to hotels, schools or public housing. The delivery person will have 2 body cameras on
while they are working.
Dennis made motion to forward a positive recommendation to the Municipal Council to add delivery
to the existing 800 sq. ft. manufacturing establishment, seconded by Manny. All in favor.
Old Business:
Run Brook Circle –modification of the Homeowner’s Assoc.
Letter from City Solicitor David Gay stating the proposed amendment which allows the homeowner’s
association the opportunity to actually mortgage which would be necessary in order to obtain authority for the
Association to borrow the monies necessary at times to maintain the common areas.
Manny made motion to approve the amendment, based on the review by the City Solicitor, seconded by
Arthur. Al in favor.
Fuller Estates – Lot release – requesting release of lot #8 - holding $72,000 & 4 lots
Request to release lot #3, Letter from City Planner, City Engineer and outside consultant Greenman Pedersen
was read into the record.
John made motion to release lot #8 upon receipt of $9,000 of surety, seconded by Manny. All in favor.
