CITY OF TAUNTON ZONING BOARD OF APPEALS MARCH 10, 2016 – 6:00 pm. (held at Maxham School, 141 Oak St, Taunton, Ma.) Members Present: Dennis Ackerman, Wayne Berube, Steven Vieira, Joseph Amaral, Colby Correira, Michael Staples and George Moniz. Meeting opens at 6:00 PM Wayne made Motion to accept minutes of February 11, 2016 meeting, seconded by Joe. All in favor Chairman Ackerman explained the ZBA process. He stated the petitioner presents their case, then they hear in people favor and people opposed. They allow petitioner to address any of the opposition’s concerns. They do not go back and forth Case #3315 Milani 847 Burt St For: A Variance from Section 6.3 of the Zoning Ordinance to allow a 28’ x 26’ garage having a 7.9’ side setback (instead of 15 feet) For the Petitioner: Joseph & Shannah Milani, 847 Burt St., Taunton, Ma. In favor: None Opposed: None Shannah explains how they wish to expand the kitchen and breezeway. They are currently paying storage fees for vehicle and this will allow them to keep vehicle in their own garage. The garage will be connected to house by breezeway and will allow protection from the weather. Letters from the City Planner, Conservation Commission and Board of Health were read into the record. They met with both neighbors and they have no problem with addition. Wayne asked what side will the addition be on? Shannah answered the right side and those neighbors (Gracia) have no issued with it. It was noted there is at least 20 feet from neighbor’s house. No one in opposition and no one in favor. Motion made and seconded to grant as Presented: Vote: Ackerman, Amaral, Berube, Correira, Vieira ….Yes Petition Granted Case #3316 Jacques 180 School St. Hearing held on March 10, 2016 For: A Special Permit from Section 5.3.4 of the Zoning Ordinance for the expansion of a pre- existing non-conforming structure by allowing the replacement of the existing carport with a larger garage. 1 . For the Petitioner: Atty. Matthew Costa, Gay & Gay, P.C., P. O. Box 988, Taunton, Ma. In favor: None Opposed: None Atty. Costa states they wish to replace the old carport with a new slightly larger garage. The partially collapsed carport was damaged from last year’s snow and will be replaced with larger garage. They reviewed it with the neighbors and they had no issues with it. Atty. Costa stated they need Special Permit because the existing house is non-conforming. They will not be going any closer to property line than the house. Wayne stated they already have garage and now they want another garage? Atty. Costa stated the new garage will be attached to the existing house and garage resulting in a “L” shape. Joe asked if the house is a single family and Mr. Jacques answers it’s actually a 2 family but currently being used as a single family house. Joe asked if they are proposing any living space in garage and he answers no. No one in favor or opposed. Motion made and seconded to grant as Presented: Vote: Ackerman, Amaral, Berube, Correira, Vieira ….Yes OTHER BUSINESS: Letter from Orlans Moran – 30 Pocasset Place - Auction postponed to April 27, 2016 Place on file. Proposed Zoning Changes – dated 1-26-16 and 2-16-16. Chairman Ackerman informed the Board there are some proposed zoning changes which will require a public hearing with the Planning Board & Municipal Council. He encourages all to review them and voice any concerns with the Planning Board at their April 7th meeting or to Municipal Council at their public hearing. Meeting adjourned at 6:10 PM 2 3 4 5
