CITY OF TAUNTON
ZONING BOARD OF APPEALS
February 14, 2019 at 6:00 pm.
(held at Maxham School, 141 Oak St, Taunton, Ma.)
Members Present: Dennis Ackerman, Steven Vieira, Wayne Berube, Michael Staples,
George Moniz, Sara Arbour and Bill Egan.
Meeting opens a 6:00 pm.
Steve made motion to accept minutes of January 10, 2019 seconded by Sara. All in
favor.
Chairman Ackerman explains the ZBA process. A presentation is made by the
Petitioner then they hear from opposition and people in favor. Then the petitioner is
allowed to answer questions and the Board votes. We do not go back and forth. You
need 4 votes to pass.
Case # 3485 Brennan 26 Jackson St.
A Variance from Section 440 Attachment #3 of the Zoning Ordinance for a 10 foot side
setback for a 40’ x 30’ garage.
For the Petitioner: Daniel Brennan, 26 Jackson St. Taunton, Ma.
Opposition: None
In Favor: None
Mr. Brennan states he wishes to construct an attached garage to the house. The only
other place he could possibly put it is in the backyard of which is small. He doesn’t want
to take up his whole backyard. The way the house is angled he needs a variance but the
direct abutter has no opposition. Chairman Ackerman read letters from the Conservation
Commission, City Planner, Fire, Engineer, Water and B.O.H. into the record. No one in
favor or in opposition.
Motion to Grant as Presented by the Petitioner with the following condition:
1. Grading will be done so that all runoff from the increased impervious area is
directed away from the neighbor’s property. The 2007 Certificate of Final Action
for this property required an emergency turnaround and that needs to be
incorporated into this plan.

Case # 3486 Latham – Pride Inc. 15 Court St.
A Variance from Section 440-706 of the Zoning Ordinance to allow a second free-
standing sign.
For the Petitioner: Doug Latham, representing Pride, Inc., 3 Maple St., Taunton, Ma.
Opposition: None
In Favor: None
Mr. Latham states they are requesting a sing like the one The District has. It will be
placed on the right of the existing stairs and it would be the same size as the District’s
sign. He stated it is a requirement to have a sign because they are funded by
MassHealth. Chairman Ackerman read letters from the Conservation Commission, City
Planner, Fire, Engineer, Water and B.O.H. into the record. No one in favor or in
opposition.
Motion to Grant as Presented by the Petitioner with the following condition:
2. The proposed sign cannot be placed on top of the existing water service, which
can be confirmed during the building permit review process.

Case # 3487 Waters Corporation 177 Robert Treat Paine Drive
A Variance from Section 440 Attachment #3.2 of the Zoning Ordinance to allow an
increase in the allowable maximum height from 50 feet to 60 feet.
For the Petitioner: David Biancavilla, BSC Group, 803 Summer St., Boston, Ma.
Opposition: None
In Favor: None
Mr. Biancavilla stated they are here tonight for a height variance. They are currently
under construction and due to the technology and requirements they need to go higher
than allowed 50 feet. Chairman Ackerman stated the plans and application present is
very thorough and he has no issues with the request. Wayne agrees the application and
plans are very professional and he finds the request logical and knows it will be done
right.
Chairman Ackerman read letters from the Conservation Commission, City Planner, Fire,
Engineer, Water and B.O.H. into the record. No one in favor or in opposition.
Motion to Grant as Presented by the Petitioner:
Vieira, Arbour, Berube, Moniz, Ackerman.......Yes
